Resolution Employing Legal Services for the Town of Wappinger
BE IT RESOLVED, that Albert Roberts be and he hereby is employed and retained for
the purpose of furnishing to the Town Board, its officers and Agencies, such legal advice and
services as may be required and he shall receive compensation therefore in accordance with a
proposal to this board, and
BE IT FURTHER RESOLVED, that Emanuel Saris be and he hereby is employed and
retained for the purpose of furnishing to the Town Board, its officers and agencies, such legal
advice and services as may be required for representing and defending the Town of Wappinger
for all Article 78 Tax Certioraris as may be filed against the Town in the year 2007, and he shall
receive compensation therefore in accordance with a proposal to this board, and
BE IT FURTHER RESOLVED, that Marco Caviglia be and he hereby is appointed

the Supervisor, Town Clerk, and Town Justices for the Town of Wappinger
BE IT RESOLVED, that James Sedore, Jr., and Company Certified Public Accountants,
be and they are hereby retained to audit the accounts and reports of the Town Supervisor, Town
Clerk, and Town Justices for the year 2007, and
BE IT FURTHER RESOLVED, that the said Accountants are hereby further retained
for the purpose of furnishing to the Supervisor, Comptroller and Bookkeeper to the Supervisor,
such additional accounting assistance as may be requested from time to time, and
BE IT FURTHER RESOLVED, that the said accountants receive said compensation
for all inclusive productive services which they shall render to the Town in this connection.

BE IT FURTHER RESOLVED, that all such personnel engaged on a weekly basis

Resolution Establishing the Pay Scale for Certain Employees of the Town of Wappinger
Highway Department
BE IT RESOLVED, that the pay scale for the employees hired by the Town of
Wappinger Highway Department will be in accordance with the C.S.E.A. contract, and
BE IT FURTHER RESOLVED, that all such Highway Department employees engaged
on an hourly basis shall be paid every Friday throughout the year 2007 with 52 pay periods
during such year consistent with the gay schedule in accordance with a signed C.S.E.A. contract,
with the first payday to be January 5t , 2007.

Patrol Personnel engaged to perform certain services for the protection of Town Parks, various
other Town properties and performance of other such duties as may be assigned by the Town
Board of the Town, be and the same hereby is fixed and established as per contract with the

Resolution Establishing Petty Cash Funds for Various Offices
WHEREAS, the Justice Court has had an increase in its work load and has the need of
having to make change on a daily basis, and
WHEREAS, the Town Clerk of the Town of Wappinger has numerous requests for
expenditures of small amounts of cash for postage, supplies, making change on a daily basis, and
various miscellaneous items, for various departments of the Town of Wappinger, and
WHEREAS, a Petty Cash fund has been established for the Receiver of Taxes, pursuant
to the provision of Section 64, paragraph 1-a of Town Law, which shall be reimbursed to the
Supervisor for advances at the close of each fiscal year, and
WHEREAS, the Recreation Committee has numerous request for expenditures of small
amounts of cash for supplies and miscellaneous items and reimbursement of small expenditures
to various areas of the Recreation program and Maintenance work for the Town of Wappinger,

Resolution Authorizing the Submission of the Supervisor's Annual Report to the State
Comptroller
WHEREAS, subdivision 10 of Section 29 of the Town Law requires that the Supervisor
of each Town prepare and file with the Town Clerk within 30 days after the expiration of each
fiscal year an annual financial report accounting for all monies received and disbursed by him,
together with the certificates or certificate of the bank or trust company, and cause a certified
copy of such report to be published in the official newspaper, and
WHEREAS, in lieu of preparing the report required by Subdivision 10 of Section 29 of
Town Law, the Town Board may determine, by resolution, that the Supervisor shall submit to the
Town Clerk within 60 days after the close of the fiscal year, a copy of the report to the State
Comptroller required by Section 30 of the General Municipal Law and the Town Clerk shall
cause a summary of such report to be published within 10 days after receipt thereof in a form
approved by the State Comptroller in the official newspaper.
NOW, THEREFORE IT IS HEREBY RESOLVED, that in lieu of preparing the
report required by Subdivision 10 of Section 29 of Town Law, the Supervisor shall submit to the

Resolution Introducing Local Law Establishing the Salary of the Superintendent of
Highways for Calendar Year 2007
WHEREAS, the Notice of Hearing of the Preliminary Budget of the Town of Wappinger
for Calendar Year 2007 fixed the salary of the Superintendent of Highways for the year 2007 at
$72,167.00; and
WHEREAS, the Superintendent of Highways, Graham Foster, has been fulfilling his
duties in a diligent and professional manner; and
WHEREAS, it has come to the attention of the Town Board of the Town of Wappinger
that the present salary of the Superintendent of Highways is lower and non-competitive with
salaries paid by neighboring municipalities to their Superintendent of Highways who have
similar duties and responsibilities; and
WHEREAS, the Town Board believes that in light of the foregoing, it is appropriate that

the salary for the Superintendent of Highways be increased by $2,165.00 to $74,332.00, for
Calendar Year 2007 to make his salary consistent with the salaries paid by neighboring
communities to Highway Superintendents with similar duties and responsibilities; and
WHEREAS, Section 27 of the Town Law of the State of New York provides that the
Town Board may increase the annual salary of an elected official for not more then one (1) fiscal
year in excess of the amount specified in the Notice of Hearing on the Preliminary Budget by a
Local Law adopted pursuant to the Municipal Home Rule Law; and
WHEREAS, Section 24 of the Municipal Home Rule Law of the State of New York
provides that a Local Law adopted by a Town to increase the salary of an elected officer during
his/her term of office is subject to referendum on petition; and
WHEREAS, this is a Type II action pursuant to 6 NYCRR 617.5 (c) (20) and is
otherwise exempt from environmental review pursuant to the New York State Environmental
Review Act (SEQRA).
NOW, THEREFORE, BE IT RESOLVED:
1. The Town Board hereby introduces for adoption Local Law No. of 2007 in
the form annexed hereto.
2. The Town Board hereby determines that the enactment of the aforementioned
Local Law is a Type II action as defined in 6 NYCRR 617.5 (c) (20) and, accordingly, the Town
Board hereby expressly determines that this action is not an action that requires review pursuant
to the provisions of New York State Environmental Review Act (SEQRA) or pursuant to Local
Law No. 6 of 1992 or pursuant to 6 NYCRR Parts (617).
BE IT HEREBY FURTHER RESOLVED that the Town Board hereby schedules a
Public Hearing on the Proposed Adoption of Local Law No. of 2007 to be held at Town
Hall, 20 Middlebush Road, Wappingers Falls, New York on the 22nd day of January, 2007, at

RESOLUTION AUTHORIZING AMENDMENT NO. 1 TO AMBULANCE SERVICE
AGREEMENT WITH TC HUDSON VALLEY, INC. D/B/A TRANSCARE and
CORRECTING PRIOR RESOLUTION
WHEREAS, at a meeting of the Town Board on December 26th, 2006 the proposed
Amendment No. 1 to the Ambulance Services Agreement, that is attached hereto as Exhibit A
was reviewed and discussed and the Town Board determined that it was in the best interests of
the Town to modify the agreement; and
WHEREAS, on December 26th, 2006, a motion was made and seconded to introduce a
Resolution Authorizing Amendment No. 1 to Ambulance Service Agreement with TC Hudson
Valley, Inc. d/b/a TransCare, however the printed resolution that was before the Town Board
was not the proper resolution authorizing Amendment No. 1; and
WHEREAS, the Town Board, by adoption of this resolution, intends to correct the error
and introduce the proper corresponding resolution authorizing Amendment No. 1 to Ambulance
Service Agreement with TC Hudson Valley, Inc. d/b/a TransCare; and
WHEREAS, the Town of Wappinger previously established the Wappinger Ambulance
District; and .
WHEREAS, the Town of Wappinger, on behalf of the Wappinger Ambulance District,
has previously entered into a written Agreement with TC Hudson Valley, Inc. d/b/a TransCare
(hereinafter "TransCare" � to supply ambulance services within the Wappinger Ambulance
District dated January 25' , 2005; and
WHEREAS, the Town Board finds that it is in the best interest of the Town to have

TransCare continue to supply general ambulance services as defined in Section 3001 of the
Public Health Law for the purpose of transporting all sick or injured persons found within the
boundaries of the Wappinger Ambulance District as more particularly set forth in the Ambulance
Services Agreement; and
WHEREAS, at the time the Town of Wappinger and TransCare entered into the
Ambulance Services Agreement, TransCare did not believe that a third ambulance was necessary
to provide adequate service to the Ambulance District, however it agreed to make available one
Basic Life Support (BLS) Ambulance with crew for 12 hours per day in order to provide excess
service for the Ambulance District to assuage the concerns of the Town with the understanding
that it could renegotiate the Ambulance Service Agreement with the Town if actual experience
determined that there was no need for the third ambulance; and
WHEREAS, the Town Board finds that the ambulance services provided by TransCare
to the Ambulance District pursuant to Ambulance Services Agreement have been satisfactory;
and
WHEREAS, the Town Board finds that it is in the best interest of the Town to have
TransCare continue to supply general ambulance services, as defined in Section 3001 of the
Public Health Law, for the purpose of transporting all sick or injured persons found within the
boundaries of the Wappinger Ambulance District as more particularly set forth in the Ambulance
Services Agreement; and
WHEREAS, TransCare has shown the Town Board that actual experience has
demonstrated that the removal from service of one Basic Life Support (BLS) 12 hours per day
will not adversely impact the health, safety and welfare of the residents of the Ambulance
District; and
WHEREAS, the contract specifically provides for Backup in the event that all of the
Town ambulances are in use; and
WHEREAS, this Amendment No. 1 to the Contract provides that TransCare agrees to
remedy any adverse impacts caused by the reduction in service; and
WHEREAS, the Town Board finds that it is in the best interest of the Town to amend the
Ambulance Service Agreement in accordance with the terms of Amendment No. 1 as more
particularly set forth in the proposed Agreement attached as Exhibit "A"; and
WHEREAS, a contract for supplying ambulance services is exempt from competitive
bidding pursuant to General Municipal Law Section 103 as the Ambulance Service Agreement
with TC Hudson Valley, Inc. d/b/a TransCare is a contract for professional services that require
technical skill, training and medical expertise.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby agrees to the terms in Amendment No. 1 to the
Ambulance Service Agreement between the Town of Wappinger and TC Hudson Valley, Inc.
d/b/a TransCare dated January 25th, 2005, in substantially the same form as attached hereto
marked and designated as Exhibit "A".
3. Supervisor Joseph Ruggiero is hereby authorized and directed to execute said
Amendment No. 1 to the Ambulance Service Agreement between the Town of Wappinger and
TC Hudson Valley, Inc. d/b/a TransCare dated January 25th, 2005 on behalf of the Town in
substantially the same form as attached hereto as Exhibit "A".

VI. Discussion
A. Association of Towns
Supervisor Ruggiero opened the discussion at 8:21 PM. Councilman Bettina made a
motion that the members of the Town Board, Planning Board, and Zoning Board be allowed to
attend the annual Association of Towns conference in New York City for educational purposes.
The motion was seconded by Councilman Beale and passed unanimously. The discussion was
closed at 8:22 PM.

VII. New Business/Comments
1. Beale New Business
Councilman Beale thanked the Supervisor and Town Board members for the inauguration
ceremony.
2. Bettina New Business
Councilman Bettina congratulated Mark Liebermann for being honored by the New York
State Building Officials Conference and for being elected to Vice Chairman.
3. Councilman Paoloni
Councilman Paoloni asked where the Town stood on the topic of the Chelsea Yacht Club.
Supervisor Ruggiero replied that Jay Paggi, Engineer to the Town, had submitted a report to Al 11 A
Roberts, Attorney to the Town. Mr. Roberts is to look over the report and comment back to the
Board. The Supervisor is waiting to hear Mr. Roberts' report before talking to anyone from the
Yacht Club. Councilman Paoloni stated that the current Commodore of the Yacht Club
contacted him and he seems to be agreeable to the idea.
Councilman Bettina asked that a workshop be set up to discuss this topic. Supervisor
Ruggiero commented that the workshop should be set up after the Town Board has heard the
opinion of the Town Attorney.
4. Councilman Beale
Councilman Beale asked to clarify that Councilman Bettina's motion for the Association
of Towns Conference also included the Town Justices. He then made a motion that the Town
Justices have the opportunity to attend the Association of Towns Conference for recertification
and educational purposes. The motion was seconded by Councilman Bettina and passed
unanimously.
