RE: Linda Yankowski
File No. 12951.0863
Dear Mr. Roberts:
In accordance with our meeting of this date, which included Recreation Director and the
Bookkeeper, accept this summary of our discussion and research.
Linda Yankowski was employed for approximately seven (7) months during 2005, with a first
paycheck issued 6/3/2005, as a (clerical) Recreation Assistant.
As understood, Ms Yankowski, through her attorney, is seeking the replacement of her
6/30/2005 paycheck for $741.60, as she failed to cash such to this date. Ms. Yankowski has
provided this office with a copy of her stale check.
Further, she is claiming the Town of Wappinger owes her for five (5) vacation days, for which
she would have accrued in accordance with the Town of Wappinger Personnel Policy/Manual.
Our records do not reflect payment specifically for this accrual.
This former employee's records exhibit a high level of overtime, including hours beyond those
that reflect Town Hall related activities and events. It was common for her to more than double
her weekly earnings due to overtime, which is unusual for this role.
It is interesting to note that during her employment period that more than one payroll check was
issued in given periods. For example, on 12/23/2005, she received one check for $501.22, which
reflects her weekly pay rate and is shown on her handwritten time card, as executed by the
;..,
claimant and Ralph Holt. Yet, a second check was issued, also on 12/23/2005, for $1028.37, for
which we cannot locate documentation.
In discussion with Ralph, the employee was terminated for performance related issues as
coordinated by Supervisor Ruggiero. He only remembers Supervisor Ruggiero advising him that
'everything was taken care of'. Unfortunately, the latter check does not reflect the five (5) day
accrual of vacation, which would amount to approximately $477.
While I have no objection to the replacement of the un-cashed payroll check, I am hesitant to
honor the request of further payment in the presence of such a discrepancy.
I ask that you relay this to the claimant's attorney.
