Revised Proposed Amendments to Town Buildin~ Code
As requested, we have revised the proposed amendments to the Town of Wappinger
Ordinance for Administering and Enforcing the State Building Construction Code,
otherwise known as the Town Building Code. These amendments pertain to:
. Requiring a foundation survey prior to any further construction, in order to
demonstrate conformance with the approved location and elevation of the
foundation. The proposed amendments now also specify where the foundation
elevation is measured.
. Requiring that the building permit application materials provide enough information
for the Town Building Inspector to determine that the number of bedrooms in
residential structures does not exceed the number imposed by the regulations of the
Dutchess County Department of Health, and that residential structures do not
contain any space which is readily and obviously convertible to one or more
additional bedrooms.
" Requiring a benchmark elevation to be located on each plot of land for the
Building Inspector's use in field checking the elevation of the preparation for the
foundation, prior to the foundation being constructed.
Once these proposed amendments have been finalized, they should be recommended to
the Town Board for formal adoption.

1. Section 10, subparagraph (c) of the Town Building Code would be amended to

2. Section 8, subparagraph (c) of the Town Building Code would be amended to read
as follows:
( c) Each application for a building permit shall be accompanied by duplicate
copies of plans and specifications, including a plot plan, drawn to scale,
showing the location and size of all proposed new construction and all
existing structures on the site, the nature and character of the work to be
performed and the materials to be incorporated, distance from lot lines, the
relationship of structures on adjoining property, widths and grades of
adjoining streets, walks and alleys, and, where required by the Chief
.Building Inspector, details of structural, mechanical and electrical work,
including computations, stress diagrams and other essential technical data.
