Width of access for a Flag Lot.

Dear Mr. Cantor,
I am responding to your letter dated October 25,2002, regarding the above referenced
issue. You are correct in that there is no specific notation in the Code of the Town of
Wappinger which mandates that the width of the lot frontage (set at a minimum of 50 feet
for a residential lot) be the same width for the depth of a lot. We are not, of course,
discussing pre-existing lots. At issue are proposed new flag lots.
It has been the consistent practice of this office to require the "pole" portion of flag lots to
meet the minimum required frontage for the entire length of access. The main, or more
readily buildable portion of the lot (the flag), is usually some distance from its frontage on
an existing road. I feel that it is both the logical and reasonable intent of the Code to
project the frontage from the access road to the entrance of the "flag" lot itself. Therefore
this access needs to meet the minimum 50 ft. requirement throughout its length.
