Dear Mr. Cantor,
I am responding to your letter dated March 17, 2004, requesting a determination by this
office. The issue, although at present concerns the above mentioned property, is a more
general one and would affect any single-family residential parcel which would aspire to the
use of ' 'private camp for seasonal residents".
You have posed several questions:
. Profit vs. non-profit status - In reviewing the definitions of "camp" provided by the
Code of the Town of Wappinger as well as New York Zoning Law and Practice, I
see no differentiation if the use be non-profit or for-profit.
. Clarification of the word "residents"- The word "residents" designates the users of
the facility and should not be applied to limit participants to only residents of the
immediate municipality nor to imply permission for year-round habitation.
. Question of "overnight stays"- In Section 240 the definition of "camp" includes the
term "temporary or seasonal living purposes" which, while prohibiting year-round
habitation, in my view would not preclude "overnight" stays.
Therefore it is the determination of this office that the use "private caIIl}l.[~~~EC'
