1981-09-28 SPMA Special Meeting of the Town Board of the Town of Wappinger was held on September 28, 1981, at Town Hall, Mill Street, Village of Wappingers Falls, Dutchess County, New York. Supervisor Diehl opened the meeting at 6:47 P.M. Present: Louis Diehl, Supervisor Nicholas Johnson, Councilman Bernice Mills, Councilwoman Janet Reilly, Councilman Frank Versace, Councilman Elaine H. Snowden, Town Clerk Notice of this meeting was sent to all Board Members on September 18, 1981, calling said meeting for September 28th, 1981 at 6:45 P.M. Notice was sent to the three newspapers, the four radio stations and posted on the Town Clerk's Bulletin Board. At the last Town Board meeting a resolution submitting a proposi- tion on Tri -Municipal to the Board of Elections to be presented to the voters on Election Day, was introduced, seconded and voted upon by the Town Board; the resolution, itself was defeated. MR. DIEHL moved to reconsider action by the Town Board on this resolut ion. Seconded by Mr. Versace Roll Call Vote: Supervisor Diehl Aye Councilman Johnson Nay Councilwoman Mills ___Ye Councilwoman Reilly Nay Councilman Versace Aye Motion Carried The following resolution was introduced by COUNCILMAN VERSACE who moved its adoption: WHEREAS, the Town of Wappinger has adopted, on July 13, 1981.Local Law No. 6 of 1981 which provides for the prohibition of members of the Town Board from casting votes which would permit continuation of the Town of Wappinger as.a member of. Tri -Municipal Commission, pursuant to Article 3, Section 23-2f of the Municipal Home Rule Law, and WHEREAS, the adoption of such local law is subject to the vote of the electors of the Town of Wappinger at a mandatory referendum, and WHEREAS, the Town Clerk has transmitted to the Town Board the form of a proposition to be considered by the electors, ,NOW, THEREFORE, BE IT RESOLVED, that the following proposition shall be submitted to the voters of the Town of Wappinger at a Special Election to be held at the time of the annual election on November 3rd, 1981: PROPOSITION SHALL A LOCAL LAW OF 1981 ADOPTED BY THE TOWN BOARD OF THE TOWN OF WAPPINGER WHICH PROHIBITS INDIVIDUAL TOWN BOARD MEMBERS FROM GRANTING APPROVAL TO FURTHER PARTICIPATION OF THE TOWN IN TRI -MUNICIPAL BE APPROVED? BE IT FURTHER RESOLVED, that the Town Clerk of the Town of Wappinger is hereby authorized and directed to submit the above proposition to the Board of Elections of the County of Dutchess so that said proposition may be acted upon at the annual election to be held on November 3rd, 1981. Said election shall be conducted upon machine ballots, and the polling places shall be those provided for at the annual town election to be held on November 3rd, 1981, as follows: POLLING PLACE LOCATION Wappinger Jr. High Ketcham High School New Hackensack Church Christian Education Ctr. Remsen Ave. DISTRICT 4 (exclusive of Village Wappingers Falls 5, 7 and 8 6 and 21 9 and 20 10, 17 and 18 11, 12 and 16 14 and 15 19 13 The polls shall be open between the hours of 6:00 A.M. and 9:00 P.M. The Election Inspectors and ballot clerks shall be those designated by the Board of Elections pursuant to the provision of the Election Law to serve for the general election for 1981. Seconded by: Councilwoman Mills Roll Call Vote: Supervisor Diehl Aye Councilman Johnson Nay Councilwoman Mills Aye Councilwoman Reilly Nay Councilman Versace Aye Resolution Duly Adopted The following resolution was offered by COUNCILWOMAN MILLS, who moved its adoption: A RESOLUTION AUTHORIZING THE PURCHASE OF A DUMP TRUCK BY THE TOWN OF WAPPINGER, DUTCHESS COUNTY, NEW YORK, AT A MAXIMUM ESTIMATED COST OF $12,265, AND AUTHORIZING THE ISSUANCE OF NOT EXCEEDING $12,265 SERIAL BONDS OF SAID TOWN TO PAY THE COST THEREOF. BE IT RESOLVED, by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: Section 1. The purchase of a 1981 Chevrolet one -ton dual wheel dump truck for use by the Highway Department of the Town of Wappinger, Dutchess County, New York, is hereby authorized at a maximum estimated cost of $12,265. Section 2. The plan for the financing of such maximum estimated cost is by the issuance of $12,265 serial bonds of said Town, hereby authorized to be issued therefor pursuant to the Local Finance Law. Section 3. It is hereby determined that the period of probable usefulness of the aforesaid specific object or purpose is five years, pursuant to subdivision 29 of paragraph a of Section 11.00 of the Local Finance Law. It is hereby further determined that the maximum maturity of the serial bonds herein authorized to be issued will not exceed five years. Section 4. The faith and credit of said Town of Wappinger, Dutchess County, New York, are hereby irrevocably pledged for the payment of the principal of and interest on such bonds as the same respectively become due and payable. An annual appro- priation shall be made in each year sufficient to pay the principal of and interest on such bonds becoming due and payable in such year. There shall annually be levied on all the taxable real property of said Town, a tax sufficient to pay the principal of and interest on such bonds as the same become due and payable. Section 5. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Supervisor, the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Supervisor, consistent with the provisions of the Local Finance Law. Section 6. The validity of such bonds and bond anticipation notes may be contested only if: 1) Such obligations are authorized for an object or purpose for which said Town is not authorized to expend money, or 2) The provisions of law which should be complied with at the date of publication of this resolution are not substan- tially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or 3) Such obligations are authorized in violation of the provisions of the Constitution. Section 7. This resolution which takes effect immediately, shall be published in full in the W&SD News, the official news- paper, together with a notice of the Town Clerk in substantially the form provided in Section 81.00 of the Local Finance Law.
