1981-07-28 PHA Public Hearing was held by the Town Board of the Town of Wappinger on July 28, 1981, at Town Hall, Mill Street, Village of Wappingers Falls, Dutchess County, New York, on an Ordinance Amending the Zoning Map of the Town of Wappinger (Montfort). Supervisor Diehl opened the Hearing at 7:00 P.M. Present: Louis Diehl, Supervisor Nicholas Johnson, Councilman Bernice Mills, Councilwoman Janet Reilly, Councilwoman Frank Versace, Councilman Elaine H. Snowden, Town Clerk The Town Clerk offered for the record the Affidavits of Posting and Publication duly signed and notarized. (These Affidavits are attached hereto and made part thereof of the minutes of this hearing). Mr. Versace asked the applicant what he intended to do on the property and the response was fresh fruits and vegetables, a greenhouse, nursery stock, and Mr. Lawrence said he would also run his landscaping business from these premises. He felt it would be a real asset to the area. When asked by Mr. Versace what other retail business he intended to have in that area, he replied that for the first year, he intended to have what he had mentioned previously and keep it mostly cultural. Later on he hoped to run a business where the housewife could buy all the fresh produce, eggs, wine and cheese, just about plus that you would find locally.' Mr. Incoronato in the Grand Union, but everything and you could buy it asked if they were following the requirements of the State DEC since it was wetlands and governed by them ; he asked about an egress road, was the Board requiring this in order not to clutter up Route 9. Mr. Hawksley asked if there were comments from the Dutchess County Planning Board and was told they disapproved of the rezoning for the following reason "In view of the above findings, the Dutchess County Department of Planning recommends that this rezoning application be disapproved. A rezoning to a highway business zone would adversely impact a wetland and extend commercial zoning further along the Route 9 corridor - a fact which will adversely impact existing centers of commercial activity". The Town of Wappinger Planning Board recommended that the proposed rezoning be adopted. Mr. Hawksley felt that the County Planning Board made some very good recommendations; if this is adopted and it is every challenged by the state, he claimed, unless a community need and benefit is shown, it could be overruled. No one else had any comments either for or against the rezoning. The Hearing closed at 7:40 P.M. Elaine H. Supervisor Diehl opened the Hearing at 7:48 P.M. Snowden, Town Clerk The Town Clerk offered for the record the Affidavits of Posting and Publication duly signed and notarized. Recommendations were received from the Dutchess County Department of Planning and the Town of Wappinger Planning Board. The Town Planning Board recommended against the adoption of the proposed rezoning since they felt that each property should be addressed on an individual basis. The Dutchess County Planning Department recommended that the decision be based upon local study of the facts in the case. Consideration, they stated, should be given to the problems which could ensue due to the non -conforming lots which would result from a rezoning. Mr. Johnson, at Mr. Diehl's request, reviewed the situation saying that.the original application was received from Mr. Rega due to a denial on an appeal to the Zoning Board of Appeals, then other requests followed in the same area Mr. Rega explained to the Board why he wanted this rezoning ---- the one parcel, as it was now, was not usable, if it was rezoned, he could use this parcel. Mr. Holt said if it changed to R-40, it would allow more properties to be built up, he preferred that it remain country like and wide open, perhaps it would help Mr. Rega as an individual and could be considered as such. There were other residents from that area and all voiced the same opinion ----they didn,lt want their zoning changed, but felt that Mr. Rega should have the opportunity to request an individual 84 zoning change since it would benefit him.
