RE: Handi Rental, aka, Lois Realty Corp.
Dear Mr. Ruggerio,
I am writing to put on record the events that have transpired in January 2006 regarding the activity on the
commercial property of Handi Rental aka Lois Realty Corp. which borders my residential land. I understand the
actions ofland grading, tree removal, etc. have happened without proper approval from any Town ofWappingers
Board or Department. Please see the enclosed document.
I am very concerned about the damage done to the land bordering my property as well as the devaluation of
my residential homestead. The only way to rectify this matter is to restore the land back to it's original
form prior to January 1, 2006 as well as instruct Handi Rental aka Lois Realty Corp. to build a privacy
fence between our properties. With these two actions enforced by the Town ofWappingers Board there is
a chance no loss of value will be sustained on my residence now and in the future if ever Handi Rental aka
Lois Realty Corp. receives approval of proposed site plans.
I understand a stop work order has been issued to Mr. Lois. I appreciate your assistance to date on this
matter. In addition, please know I am experiencing difficulty in obtaining copies of all the pertinent
records on this matter from the Zoning Department but will diligently continue to pursue the matter. I will
be attending the next scheduled Town Board or Planning Board meetings to elaborate on my request to
deny approval of any proposed site plans from Handi Rental aka Lois Realty Corp. and insist on the
restoration of the property area as well as installation of a privacy fence immediately.

RE: Handi Rental aka Lois Realty Corp.
1 st week of January 2006
1. I noticed work traffic cones, the use of heavy equipment and landscaping activity on the closed
side road near County Route 28 by Handi Rental aka Lois Realty Corp. This side road has been
closed for over 25 years.
2. I called the Zoning Department and spoke with Susan Dao. She stated that Handi Rental aka Lois
Realty Corp. have an approved site plan. She also stated that she had pictures of the site plan and
the buffer zone. I told her what I saw and that there didn't seem to be a buffer zone between the
commercial property and my residential property. In addition, I was unaware of any public
meetings held to discuss a site plan. She insisted that there was an approved site plan and an
approved permit from DPW for opening an un-useable access road.
3. I called the Department of Public Works. I spoke with Bob Balkind. I explained what Ms. Dao
had told me and he remarked he only had an application for a permit, no approved permit. He
would investigate the situation and get back to me.
4. I called the Zoning Department back and spoke with Ms. Lukianoff. I told her what the DPW
representative told me. Again I was told that a permit had been issued and the DPW person was
wrong. Based on this conversation I went to the Zoning Department and requested the first of
several FOILS to obtain copies of the records regarding this site plan and Handi Rental aka Lois
Realty Corp.
2nd week of January 2006
1. I did not hear back from anyone so I called Mr. Ruggiero. I advised him of the conversations to
date. He informed me that there were laws against strip mining and would investigate the matter
and get back to me.
2. Mr. Ruggiero called me back and stated there would be a meeting held between Mr. Lois, Mr.
Robers, Mr. Paggi, Ms. Lukianoff, and himself regarding this matter. In addition, a stop work
order has been issued to Handi Rental aka Lois Realty Corp.
3. I called Mr. Balkind at the DPW back to advise him of this meeting and that I had filed a FOIL
request for copies.
3rd week of January 2006
1. The five day waiting period for the completion of FOIL #54 had passed so I went to the Zoning
Department to pick up my copies. The copies were not available and I was told I had to purchase
a code book for $25 dollars in order to frod and read for myself if the buffer zone existed. Not
being fluent in code book law, I was told I have to request all the documents at my own cost. I did
so. This created FOIL # 61.
2. Mr. Balkind of the DPW called me to let me know that a letter was being mailed out advising
Handi Rental aka Lois Realty Corp. that no approved site plan existed and repair to the land must
be made. It was further explained that only a grading permit was issued and that it was expired.

Mr. Balkind also mentioned that he received a fax from Ms. Lukianoff which stated that no site
plan existed.
4th week of January 2006
1. The five day waiting period for the completion of FOIL #61 had passed so I went to the Zoning
Department to pick up my copies. I was told that the Xerox machine was broken and the copies
were not ready. I had the FOIL #61 updated to show that I was there and now include copies of
the minutes from the meeting Mr. Ruggiero was to hold.
2. As of right now, I have not heard back from Mr. Ruggiero regarding the details of the meeting
held on this matter with Mr. Lois.
3. I called Mr. Paggi and was advised that he did attend a meeting. In addition, he stated that Mr.
Lois has been advised to file a site plan and that I will need to attend the next Planning Board to
obtain further details. It was mentioned that the Town Board would be seeking a privacy wall for
Route 9. At this time, I told Mr. Paggi since my residential property is adjacent to this area, Handi
Rental aka Lois Realty Corp. should be made to place a privacy wall for me as well to protect the
buffer zone. Also, if there is a 50 foot buffer zone in place for the Alpine Corp. and my property,
why then is there only 25 feet between my property and Handi Rental property? This information
was obtained by calling Charlie Delbene's office.
