Deputy Supervisor Nicholas Johnson opened the Hearing at 7:08 P. M. Present: Nicholas Johnson, Deputy Supervisor Bernice Mills, Councilwoman Janet Reilly, Councilwoman Frank Versace, Councilman Elaine H. Snowden, Town Clerk Absent: Louis Diehl, Supervisor Others Present: Henry Cuatt, Comptroller and Jon Holden Adams, Attorney to the Town.. The Town Clerk offered for the record the Affidavits of Posting and Publication duly signed and notarized. (These Affidavits are attached hereto and made part thereof of the Minutes of this Hearing). All stool and said the Pledge of Allegiance to the American Flagg The Minutes of the Regular Meeting of October 15, 1980 and the Special Meeting of November 3, 1980, having previously been sent to the Town Board, were now placed before them for their consid- eration. MR. JOHNSON moved that the Minutes of the Regular Meeting of October 15, 1980 and the Special Meeting of November 3, 1980, be and they are hereby approved, as submitted by the Town Clerk. Seconded by Mrs.Mills Motion Unanimously Carried Reports for the month of October were received from the Town Justices, Building Inspector/Zoning Administrator, Mr. Horton's Hydrant Report and The Supervisor/Comptroller Report through September 30, 1980. MRS. MILLS moved to accept the above mentioned reports and place them on file. Seconded by Mrs. Reilly Motion Unanimously Carried 92 A formal petition for a street lighting district was received from residents in the Top O'Hill area of the Town. Mr. Adams explained that the Board must have knowledge of the Benefit Assessment to be levied on the tax bill and also the yearly amount for the maintenance of such district before they could go to public hearing on this matter. MR. VERSACE moved to accept this petition and forward to Central Hudson for their survey to determine the Benefit Assessment charge and the yearly maintenance charge, prior to setting a public hearing. Seconded by Mrs. Reilly Motion Unanimously Carried A report was received from the New York State Department of Environmental Conservation on the status of the work at the Fleetwood Sewer Treatment Plant which had been mandated and for which the Town was eligible for reimbursement. Mr. Johnson reported that some of the work was completed and the remaining items hinged on the receipt of parts ordered. The work must be completed by December 31, 1980, in order to meet the grant require- ments. MRS. MILLS moved to receive the report and place it on file. Seconded by Mr. Johnson Motion Unanimously Carried Mr. Napoli of the Dutchess County Department of Health wrote to the Board concerning work being=done at the Rockingham Farms Sewage Treatment Plant. When asked by Mr. Versace what work was being done, Mr. Lapar answered that they Were revising the by-pass and adding chains to the clarifier; it was part of a program mandated by the state, and a minor portion was being done by Camo Pollution, but the major portion was being held in abeyance until they could determine the status of the Tri -Municipal project. Mr. Versace then reminded the Board that if the costs go beyond $5,000, the work must go out to bid, and Mr. Johnson asked that a letter be directed to Camo Pollution Control for this information. 94. MRS. MILLS moved to receive this communication and place it on file. Seconded by Mrs. Reilly Motion Unanimously Carried A response was received from the New York State Department of Transportation to Mr. Diehl's request forgreen arrows on the traffic signal at County Road #93 into Route 9. They did not feel this was needed since the owners of the shopping center had been issued a permit to install a traffic signal at the main entrance to the shopping center which would be interconnected and coordinated with the existing signal at Myers Corners Road and Route 9. Mr. Diehl sent another request to the Department of Transportation to reconsider this matter, as he did not feel they had addressed this problem, since this would help the flow of traffic exiting from Myers Corners Road and had nothing to do with a new signal on Route 9. MRS. MILLS moved to receive this letter and place it on file. Seconded by Mrs. Reilly Motion Unanimously Carried A Notice of Public Hearing was received from the Zoning Board of Appeals on a variance for an addition to the home of Wallace Post which abutted Town property on Robinson Lane. MRS. REILLY moved to receive the notice and place it on file. Seconded by Mrs. Mills Motion Unanimously Carried Several months ago, Mr. Lapar was authorized to purchase an Aqua -Scope (water leak detection device) and make arrangements for the training of personnel in its use. A report was received from him stating he had received this equipment and a field instructional session would be held on Tuesday, November 18, 1980 at 9 A.M. He requested that the participants meet at his office at 90 East Main Street in Wappingers Falls. Mr. Diehl had pre- viously requested that this training be done in the Watch Hill Water district and test for leaks in that area. MRS. MILLS moved to receive the letter and place it on file and at Mr. Versace's request that they honor Mr. Diehl's recommendation to do this testing in the Watch Hill Water District. Seconded by Mrs. Reilly Motion Unanimously Carried A second report from Mr. Lapar recommended that the Board request extensive use as needed of Well #5, so that Wells #1 and 2 could be rehabilitated. The cost to do this work was included in the 1981 budget. MRS. MILLS moved to contact the Dutchess County Department of Health and request that the Town use Well #5 in the Central Wappinger Water Improvement Area while Well #1 and #2 are being refurbished. Seconded by Mrs. Reilly Motion Unanimously Carried A letter was received from Mr. Amodeo, Dutchess County Commissioner of Finance regarding Schoonmaker Brothers time of the a parcel of land which was conveyed by to the Town of Wappinger, however, at the conveyance the taxes were due and unpaid. The amount now required for the quitclaim deed would be $1,027.37 plus $8.65 for filing the deed in the County Clerk's office. MRS. MILLS moved that this matter be referred to the Attorney and to the Assessor, Mr. Logan for their review and comments. Seconded by Mr. Johnson Motion Unanimously Carried The Town Clerk of the Town of Dover wrotetothe Town Clerk re supportive action regarding an Environmental Impact Statement prior to the establishment of a Division for Youth at the Harlem Valley Psychiatric Center in Wingdale. The Board had previously adopted such a resolution, but they were evidently looking for re -confirmation of this resolution. - MR. VERSACE moved that the Town Board of the Town of Wappinger support the Town of Dover in their resolution requesting the appropriate agencies of New York State to prepare an Environmental Impact Statement, prior to the establishment of a Division for Youth at the Harlem Valley Psychiatric Center, in Wingdale, Town 96 of Dover, New York, and so notify the Town Clerk of Dover. Seconded by Mr. Johnson Motion Unanimously Carried A memo was received from Mr. Fanuele, Chairman of the Planning Board regarding a policy regulating conservation subdivisions. Two applications had been received by them and he anticipated more to come; he listed three possibilities to designate and control the land and asked for comments from the Town Board. MR. VERSACE moved to accept this correspondence, place it on file, and invite Mr. Fanuele and members of the Planning Board, also the Recreation Commission to attend the next work session of the Town Board on December 15, 1980, to discuss the policy they should set on conservation subdivisions. Seconded by Mrs. Reilly Motion Unanimously Carried Under Committee Reports, Mrs. Reilly requested that the Attorney prepare a rider to Mr. Battaglia's proposed contract for'a Town Hall listing the recommendations he felt should be added to the contract submitted. She asked that this be ready for the work shop session on November 24, 1980, later changed to December 15, 1980. Mr. Johnson reported that he had met with the Fire Chiefs, and the first meeting of the Fire Prevention Board would be on the 18th of November, 1980 at Town Hall. His next report referenced the Tri -Municipal Project, and at a meeting held last week, they reached the end of Step I, and were presented with the first draft of the Environmental Impact State- ment, and expected to see the next draft within a few days. He had been appointed to a committee to review this draft before its presentation at a public hearing. At last month's meeting the Town Board requested the Tri -Municipal Commission to hold a public hearing for the Town of Wappinger residents, and it was decided by the Commission to first hold a meeting with the Town Board so they would be knowledgable of the available information, 97 and then schedule a public informational meeting for the residents of the Town of Wappinger, similar to the one planned by the Village of Wappingers Falls. Mr. Versace added to this by inviting anyone interested to attend the meeting with the Town Board and the Tri -Municipal Commission, so they too, would be knowledgable of the pertinent facts; they could obtain information on the date and place of this meeting by contacting any Town Board member. As a point of information, Mr. Johnson informed the public that the Town Vandalism Patrol detected the fire that occurred at the Evans School; they spotted the fire on their routine check- up and radioed for the fire companies, although it was not reported this way in the papers. The following Local Law was introduced by MR. JOHNSON BE IT ENACTED by the Town Board of the Town of Wappinger as follows: ARTICLE 1 The Town Board of the Town of Wappinger recognizes that the consumption of alcoholic beverages within public places and areas in the Town of Wappinger must be adequately controlled and regulated so as to prevent public disorder, littering and other acts that affect the health and welfare of the residents of the Town of Wappinger. ARTICLE 2 2-1 Alcoholic Beverages. Shall include beer, wine, liquor and all alcoholic beverages as more specifically defined by section three New York State Alcoholic Beverage Control Law or mixtures which include in part alcoholic beverages. 2-2. Container. A container shall be any bottle, glass, cup or other container containing any alcoholic beverage or mixtures which include alcoholic beverages. For the purpose of this local law, a container shall be deemed open if the bottle or distiller's original seal has been broken. 2-3 Public Places. A place to which the public or a substantial number of persons have access and includes but is not limited to public highways, streets, sidewalks, public ways, alleys, parking lots, parking areas, and other places open or bused by the general public. ARTTCLE 3 3-1 No person shall carry, transport or have in his poeeession in a public place any open, resealed or partly empty bottle, can, container or similar article containing an alcoholic beberage of any kind or description. 3-2 No person shall break, leave, discard or deposit in any manner glass, bottle, glassware, crockery, can or container of any kind, make or description in any public street, sidewalk, park, parking area or public place of any nature within the Town of Wappinger. 3-3 No person shall consume any alcoholic beverage in a public place unless consent has been obtained from the Town Board of the Town of Wappinger for an exemption from this local law. ARTICLE 4 Violations of this local law shall constitute a violation as defined by the Penal Law of the State of New York. ARTICLE 5 The penalties for violation of this local law shall be those prescribed by the Penal Law of the State of New York for violations (Penal Law Section 80.05, subdivision 4). ARTICLE 6 If any provision of this local shall be declared to be invalid, all other provisions thereof shall remain valid and enforceable. ARTICLE 7 This local law shall not extend to activities conducted by civic or not-for-profit organizations who have been authorized by the State of New York to dispense alcoholic beverages if such activities take place in public places and prior permission has been obtained from the Town Board to conduct such activities in public places. ARTICLE 8 Nothing contained therein shall be construed to prohibit residents from consuming alcoholic beverages within and on private property. Private property shall not include vehicles located in public places as defined by this local law. ARTICLE 9 This local law shall take effect upon its being duly filed with the New York Secretary of State. The following resolution was introduced by MR. JOHNSON who moved its adoption: WHEREAS, there has been duly presented and introduced at a meeting of this Town Board on the 10th day of November, 1980, a proposed Local Law ##5 of 1980, Prohibiting the Discarding of, or Open, Alcoholic Bottles, Cans, or Containers of Consumption of Any Alcoholic Beverage in Public Places in the Town of Wappinger, and WHEREAS, the provisions of the Municipal Home Rule Law requires that no local law shall be passed by the Legislative Body of the Town until a Public Hearing thereon has been held before such body, NOW, THEREFORE BE IT RESOLVED, 1. That a Public Hearing shall be held on the said proposed Local Law by the Town Board of the Town of Wappinger on the 8th day of December, 1980 at 7:45 P.M. EST, on such day at Town Hall, Mill Street, in the Village of Wappingers Falls, Dutchess County, New York. 8 2 2. That at least five (5) days notice of such hearing shall be given by the Town Clerk of the Town of Wappinger, by the due posting thereof upon the bulletin board maintained by said Town Clerk in the Town Hall and by publishing such notice at least once in the official newspaper of the Town of Wappinger. Parsons, Inc. versus the Town of Wappinger Tax Certiorari was received by the Board for their consideration. The settlement would reduce the assessment levied on the property from $92,000 to $75,000 and therefore would involve no reimbursement this year. The following resolution was offered by DEPUTY SUPERVISOR NICHOLAS JOHNSON, who moved its adoption, seconded by Councilwoman Janet Reilly, to wit: BE IT RESOLVED, that Rosen Crane and Wolfson is hereby directed toexecute a consent judgment settling the A. & J. Parsons, Inc. against Wappingers Central School District and the Town of Wappinger tax certiorari, a copy of which is attached hereto and made a part hereof, and that Rosen Crane and Wolfson is authorized and directed to settle the above captioned proceeding pursuant to the terms of said judgment. Roll Call Vote: 4 Ayes 0 Nays A proposed Local Law which would increase the amount of allowable income of senior citizens eligible for tax exemption, was presented to the Board for their consideration. The following Local Law was introduced by COUNCILWOMAN REILLY: A Local Law amending Local Law No. 1 of 1967, Local Law No. 5 of 1977 and Local Law No. 2 of 1980. BE IT ENACTED by the Town Board of the Town of Wappinger Dutchess County, New York as follows: Section 1. Section 2 (b) of Local Law No. 1 of 1967, Section 2 of Local Law No. 5 of 1977 and Local Law No. 2 of 1980 are hereby amended to read as follows: (b) The income of the owner or the combined income of the owners of the property shall not and may not exceed the sum of Nine Thousand Two Hundred ($9,200.00) Dollars for the income tax year immediately preceding the date of making the application for exemption. The income tax year shall mean the twelve month period for which the owner or owners filed a federal personal income tax return, or if no such return is :bo filed, the preceding calendar year. Where title is vested in either the husband or the wife, their combined income may not exceed such income. Such income shall include social security and retirmment benefits, interest, dividends, net rental income, salary or earnings, and net income from self-employment, but shall not include a return of capital gifts or inheritances. Rental income and self-employment shall not be reduced by an allowance for depreciation. Section 2. This Local Law shall take effect immediately upon adoption and filing. Seconded by: Councilwoman Mills Roll Call Vote: 4 Ayes 0 Nays A request from James Klein, developer of Spookhill Estates to release the Road Bond and accept the remaining portion of Reggie Drive, had been tabled from the last meeting. When questioned on the status of this matter, Mr. Adams replied that he had received verbal confirmation that the language he recommended would be included. He suggested that the Board either defer this matter to the next meeting, or accept the Maintenance Bond, subject to the tender of the bond to the Attorney on the form specified by him. 106, MR. VERSACE moved that this matter be tabled until the next meeting pending receipt of the proper form of Maintenance Bond on Reggie Drive, from Mr, Klein, by the Attorney. Seconded by Mr. Johnson Motion Unanimously Carried Mr. Adams advised the Board that the same circumstances existed on the next two items on the Agenda---Klassen Builders and Primrose Subdivision; Mr. Johnson then directed that these items be tabled until the next meeting. A vacancy still existed on the Recreation Commission, however no recommendation had been received for this appointment. Mr. Johnson requested that a letter be sent to the Recreation Commission asking for a recommendation for this vacancy by the next Board meeting. Under Unfinished Business, Mr. Versace brought up a matter of several months ago on complaints received from Mr. Llewellyn on Kent Road concerning the removal of tree limbs, drainage work, etc. The matter was referred to both the Attorney and the Highway Superintendent and responses were received from them. He requested that copies of this correspondence be sent to Mr. Llewellyn. Since there was litigation pending on an accident in this area, it was suggested that the Board go into executive session to discuss the matter with the Attorney. Before recessing, Mr. Johnson wished to direct the Town Clerk to send a letter to Mr. Horton regarding a drainage problem at 104 Brothers Road; Mr. Horton had previously indicated that he would clean out the drainage ditches at that residence which would probably alleviate the drainage problem. He asked that Mr. Horton be reminded of this matter. Mrs. Mills then informed the Board that she had asked the Attorney to draw up a local law concerning the regulating of fees on garbage removal. This request was prompted by complaints received by her from residents complaining about the constant increase of the cost for this service. Mr. Adams had supplied her with a sample local 107 law regulating garbage removal in the Town of Wappinger and copies were distributed to the Town Board for their review. MR. JOHNSON moved that the Town Board recess for five minutes to discuss a matter pertaining to possible litigation. Seconded by Mr. Versace Motion Unanimously Carried The Town Board recessed at 8:48 P.M. to go into executive session with the Attorney. The meeting resumed at 9:03 P.M. and all Board members that had been present before the recess, were again present. Mr. Johnson then reported that the Board had discussed an item of possible litigation, and had agreed that the Attorney should review the correspondence discussed by Mr. Versace to determine if it would affect the litigation; if not, it would be forwarded to Mr. Llewellyn, as requested by Mr. Versace, otherwise, it would be'held in abeyance pending the outcome of the litigation. Mr. Versace then reported that the work shop session originally scheduled for November 24th, the foutth Monday of the month, was changed to December 15th, which would combine work sessions for November and December, due to the holidays. He asked that Mr. Fanuele and the Recreation Commission be notified of this date to meet with the Town Board on discussion of conservation sub- divisions. The session would start at 7:00 P.M. so it would not interfere with the Planning Board meeting scheduled for 8:00 P.M. MRS. MILLS moved to adjourn the meeting, seconded by Mrs. Reilly and carried.
