A Public Hearing was held by the Town Board of the Town of
Wappinger on June 23, 1980, at Town Hall•, Mill Street, Village
of Wappingers Falls, Dutchess County, New York, on a proposed
Local Law to Indemnify and Hold Harmless Employees in Certain
Civil Actions.
Deputy Supervisor Johnson opened the hearing at 7:08 P.M.
Present:
Nicholas Johnson, Deputy Supervisor
Bernice Mills, Councilwoman
Janet Reilly, Councilwoman
Frank Versace, Councilman
Elaine H. Snowden, Town Clerk
Absent:
Louis Diehl, Supervisor
The Town Clerk offered for the record the Affidavits of Posting-
and Publication duly signed and notarized. (These Affidavits
are attached hereto and are part of the minutes of this hearing).
Mr. Johnson asked if any member of the Board had comments.
Mr. Versace asked that the wording be changed in Paragraph 5--
(a) delivery to the town attorney and town Supervisor,
he wished "town supervisor" changed to "town board".
Henrietta MacDonald asked the Board to give an example of how
the law would work --explain it.
Mr. Johnson then explained it briefly ---if in the course of
discharging their normal duties and acting within the scope of
their duties, a Town official or employee becomes the recipient
of a suit against him or her, the town will act to defend this
person and the expense of this defense will be paid by the town.
Mrs. MacDonald then asked what brought this on ---who suggested
this law.
Mr. Johnson responed that the attorney found that this law had
been on the books of other Town's and recommended that it also
be adopted in the Town of Wappinger.
Mr. Johnson asked if there were any other comments.
No one else spoke.
The Hearing closed at 7:17 P.M.
