We are writing to you as attorneys for the Hughsonville Fire District with regard to this matter. It has come to my attention that the nomination to that Bureau by the Hughsonville Fire District of Peter Muro, has been acted on by the Fire Prevention Bureau. Such action by the Bureau is a nullity and of no real force and effect since the BUfeau itself is not a self-sustaining organization. I enclose herewith first page of a copy of the Town of Wappinger legislation establishing the said Bureau and as can be seen therefrom the appointment of all members is to be acted on by the Town Board. To my knowledge the Town Board has taken no action concerning Mr. Muro I s nomination, al though the same was made to it in January of this year. This local law shall provide the basic, administration and enforcement of the APPLICABILITY , Prevention Code in the Town of Wappinger and shall establish powers, duties and responsibilities in connection therewith. ARTICLE 2 ADMINISTRATION There is hereby designated a Bureau of Fire Prevention, hereinafter referred to as "the Bureau", to administer and enforce the State Fire Prevention Code within the Town of Wappinger. The Bureau shall consist of seven (7) members. Two (2) members, active firefighters, representing each fire district in the Town of Wappinger, shall be designated by their respective District Board of Fire Commissioners and approved by the Town Board of the Town of Wappinger. The Town Board shall also designate the Town Building Inspector as a ni~mber of the ~ureau., The term. of' office 2.." We are in receipt of copies of correspon- dence from the Chairman of the Fire Prevention Bureau to you dated January 22, 1992 apparently suggesting that you not appoint Mr. Muro to the vacancy. We are also in re- ceipt of a copy of the minutes of the Fire Prevention Bureau meeting dated January 21,1992. It is of great concern that no mention of Mr. Muro'squalifications or appointment is ~e61~cted in those minutes. Wa, therefore, fail to under- stand how the letter of January 22 could be written. For your review, we enclose minutes of the Fire Prevention Bureau and the letter from that Bureau. We, therefore, recommend the appointment of Mr. Muro as set forth in our letter of December 2.4, 1991. We would be more than happy to cooperate with you with regard to any questions you may have on this appointment. We would expect to hear from you on the Town Board'S decision. Members present were: Mark J. Liebermann. Tim Classey. Robert Colden. George Budd. Ron Andrews. and Herb Muller. ABSENT: None Minutes of previous meeting were accepted as corrected. Opened meeting with comments of meeting at Greystone's Special on Saturday. January 18. 1992 at 9:30A.M. It went well. double access. agreed upon. New specs will be submitted. Approved. (Members just loved the paper towel prints of Greystone.) FIRE INSPECTOR AND BUILDING INSPECTOR REPORTS: Tim Classey returned from sick leave. and all is well. Mark Liebermann is telling us there has been three arsons since Christmas. New Hackensack Fire House should watch out for Mikie! Comja. on All Angels Rd. has been burning in his front yard. will get summons if it doesn't stop. Al Marsit is also burning in front of his property on Rt.9. claiming to have his dog chase Mark. I would like to appologize to you Supervisor Smith and members of the Wappinger Town Board if my name was used to cause any problems to you in any way. What W8S happening to me had nothing to do with any of you. The misuse of ~y name in various statements c8used me to be looked upon in disfavor an~injured my character in the eyes of many. This is'in no reflection to you Supervisor Smith & Town Board members. What my intentions were and still are to serve the town and my fire distict with my 27 years of fire service to the community. I cannot control the varlOUS statements th8t were made by others. So, again I appologize for the inconvience it caused all of you, and again request my name be WITHDRAWN.
