A Public Hearing was held by the Town Board of the Town of
Wappinger on April 23, 1979, at Town Hall, Mill Street, Village
of Wappingers Falls, Dutchess County, New York, on a proposed
Local Law Limiting Parking of Vehicles on Certain Streets in
the Town of Wappinger.
Supervisor Diehl opened the Hearing at 6:52 P.M.
Present:
Louis Diehl, Supervisor
Leif Jensen, Councilman
Bernice Mills, Councilwoman
Janet Reilly, Councilwoman
Elaine Snowden, Town Clerk
Absent:
Nicholas Johnson, Councilman
The Town Clerk offered for the record the Affidavit of Posting
and Publication duly signed and notarized, (attached hereto and
made part thereof of the minutes of this Hearing).
Mal Haight asked if this law included the establishment on Route
9D.
Mr. Diehl replied that this was another matter and they were
working with New York State on that since it was a state road.
Robert Conklin, speaking for the residents of Marlorville Road,
commented that everyone wanted the 200' extended to cover the
rest of the road, which would acttally amount to no parking
along both sides of the entire road. It is a narrow road, he
said, rises that you cannot see over and children playing in the
street.
Discussion followed on the speed limit of the road and the
nuisance that the business on the corner was causing.
No one else spoke on the subject of this local law.
Mrs. Mills moved to close the Public Hearing, seconded by Mrs.
Reilly and carried.
The Public Hearing closed at 7:03 P.M.

Limiting Hours of Operation of Junkyards.
Supervisor Diehl opened the Hearing at 7:06 P.M.

Tom Witchey had no objection to these hours but asked how this
came about.
Mr. Diehl answered that the Town had had complaints regarding
another junkyard and it was open well into the night, even at
midnight. The hours they were setting were 7A.M. to 7P.M. for
the operation of the junkyards, however, this had nothing to do
with being called upon to bring in a wreck or an inoperable car;
that would be termed as an emergency. The hours applied to dis-
mantling or selling; it would not apply if the owner was there
to check over the property or work on his own.
No one else spoke.
Mr. Jensen moved to close the Public Hearing, seconded by Mrs.
Mills and carried.
The Hearing closed at 7:12 P.M.

ORDINANCE LIMITING HOURS OF
OPERATION OF JUNKYARDS
BE IT ORDAINED by the Town Board
of the Town of Wappinger es follows:
Section 1. Definitions. For the purpose
of this section, a•junkyard" shall have
the same definition end meaning es that
set forth in the General Municipal Law
Section 136, Subdivision- 2.,
Section 2. The hours, of operation of
any junkyard within the Town of
Wappinger shall be limited to those
. hOul? eome, nclhg at 7 a.m. in the
morning -and ending et 7 p.m. In the
evening.
Section 3. Penalties and Violations.
Violators of any portion of this ordinance
shall be guilty of an offense punishable
by a fine for the first offense not ex-
ceeding S50.00, for the second offense,
not exceeding 6100.00 and for the third
offense, not exceeding 6250.00. In ad.
dition thereto, the Town Board, In its
discretion, after due notice and ap
portunity for a hearing,may terminate
any license previouslIssued to any
Junkyard found guilty of three offenses
within eighteen months.
Section 4. Effective Data. Thls ordinance
shall become effective upon filing,
posting and publication es prescribed by
Article 9 of the Town Lew.
