A Public Hearing was held by the Town Board of the Town of
Wappinger on October 30, 1978 at 7:00 P.M. at Town Hall, Mill
Street, Wappingers Falls, Dutchess County, New York on an Ordin-
ance to Amend the Zoning Ordinance of the Town of Wappinger
(Mozayenty-R-40 &R-20 to OR).
Supervisor Diehl opened the Hearing at 7:05 P.M.

Leif Jensen, Councilman
The Town Clerk offered for the record the Affidavit of Posting
and Publication duly signed and notarized (attached hereto).
Newspapers and radio stations had been notified and a notice was
posted on the Town Clerk's Bulletin Board.
Mr. Stephen Saland, Attorney representing the applicant spoke on
the rezoning and presented a map of the area prepared by Hayward
and Pakan Associates. Originally the application was for 7 acres
for LB rezoning; since that time they went before the Planning
Board and the request was now modified in writing for OR rezoning.
The reason for the change is that there were certain sideyard
requirements that required more acreage; the map presented was for
8.2 acres, which conformed with OR requirements. They proposed to
construct office research facilities for professional people and
possibly, a bank. He asked the Board if they had any questions.
Mr. Johnson asked if they had three identical buildings. He also
asked if they had met with the requirements of the Planning Board,
the parking, etc.
Mike Hirkala commented that although he had no objections to this
change to OR, and it was probably good for the area but he went
back to the Zoning Ordinance that had been proposed and banted about,
but they are still working with the old one, and the builders
and developers in this Town would be a lot better off if they
had something to work with. They have said that is one of the
reasons they don't like to work in this Town, because they never
know what is going to happen next. He has no objection to the
change, but feels we should have a new Zoning Ordinance.
Donald McMillen --in favor of this; you're taking a low tax base
of property and turning it into a much better tax paying base.
Rezoning it to OR is basically along the lines of the new Zoning
Ordinance; the water draw would be less than if it was residential;
there's no burden to the Town whatsoever. He disagreed with what
Mr. Hirkala was saying; even if we adopted a new Ordinance we
would still be here tonight holding a public hearing. No matter
what you adopt, there's always going to be rezoning requests.
Mr. Jensen arrived at 7:17 P.M.
He asked if this was now OR and had met all requirements.
No one else spoke.
MR. JOHNSON moved to close the Public Hearing, seconded by Mrs.
Mills and carried.
The Hearing closed at 7:22 P.M.
