1978-05-15 SPM7.16 A Special Meeting of the Town Board of The Town of Wappinger was held on May 15, 1978, the Town Hall, Village of Wappingers F:.als, Mill Street, Wappingers Falls, New York. Notice of said meeting was mailed to each Board member on May 11, 1978, calling the meeting for 6:30 P.M. May 15, 1978 for the purpose of setting a Public Hearing on an amendment to the Zoning Ordinance relating to shopping centers and a change in the Zoning Map to rezane certain areas as shopping centers. Notices were also given of said meeting to the Poughkeepsie Journal, Southern Dutchess News (W&SD News) and the Beacon Evening News, also Radio Stations WBNR, WHPN, WEOK & WKIP & a notice was posted on the Town Clerk's Bulletin Board on May 11, 1978. Supervisor Diehl called the meeting to order at 6:40 P.M. Present: Louis Diehl, Supervisor Nicholas Johnson, Councilman Leif Jensen, Councilman Bernice Mills, Councilwoman Janet Reilly, Councilwoman Gladys Ruit, Deputy Town Clerk Others Present: Allan Rappleyea The following Ordinance was introducedby SUPERVISOR DIEHL: Be It Ordained by The Town Board of the Town of Wappinger as follows: Section 424 of the Zoning Ordinance of the Town of Wappinger duly adopted on January 29, 1963 is amended as follows: Section One: The minimum 30 -acre lot area requirement under category SC Business is deleted and substituted in its place shallibe the minimum lot area requirement of 10 acres. Section Two: This ordinance shall take effect upon adoption, posting and publication. Seconded by: Councilman Jensen Roll Call Vote: Supervisor Diehl Aye Councilman Johnson Aye Councilman Jensen Ave Councilwoman Mills Ave Councilwoman Reilly Aye Mr. DIEHL moved to set a Public Hearing on an Ordinance amending the Zoning Ordinance of the Town of Wappinger on June 15, 1978, at 7 P.M. at the Town Hall, Mill Street, Wappingers Falls, N. Y. at which time all interested persons will be heard and further to refer the Ordinance to the Dutchess County Planning Board for their review & recommendation and a notice sent to all adjoining municipalities. 717 Seconded by Mr. Jensen. Motion Unanimously Carried The following Ordinance was introduced by COUNCILMAN JOHNSON: BE .IT ORDAINED by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: The Zoning Map of the Town of Wappinger duly adopted on January 29, 1963 is amended as follows: Section One: The zoning classification of "HB2" for that area bounded on the west by Route 9, on the south by Meyers Corners Road and containing all the lands of Astarita, Babcock, Central Valley Concrete and N.iessen contiguous to either said Route 9 or Meyers Corners Road is deleted and substituted in its place is the zoning classificatidn "SC". Section Two: Thisordinance shall take effect upon adoption, posting and publication. Diehl Town Hall Mill Street Wappingers Falls, New York 12590 Re: Town of Wappinger V. County of Dutchess Dear Mr. Diehl: As you know, the Town of Wappinger protested the County equalization rate in 1975. Mr. Logan has indicated that this matter can not be pursued with any hope of success. There is a preliminary meeting scheduled on May 22nd, and P.:() 18 if the matter is going to be withdrawn, I would like to notify the State of our action before that date. I enclose herewith a resolution for your considration. Very truly yours, s/Corbally,Gartland & Rappleyea The following Resolution was introduced by Councilperson JOHNSON: who moved its adoption: WHEREAS, the Town of Wappinger protested the equalization rate, as established by the County of Dutchess by appeal to the New York State Board of Equalization and Assessment, which appeal was made on November 25, 1975. ihr+ NOW, THEREFORE, BE IT RESOLVED, that the Town of Wappinger hereby withdraws said appeal. Seconded by Councilwoman Reilly Roll Call Vote: Supervisor Diehl AYE Councilman Johnson AYE Councilman Jensen AYE Councilwoman Mills AYE Councilwoman Reilly AYE Mr. Rappleyea asked for authorization from the Town Board to hire a surveyor in the matter of surveying the fence line at Mid -Hudson Auto Wreckers to establish if it is properly located. A Public Hearing is scheduled on the appeal of the denial of their Salvage Yard License and since this seems to be the only violation, he would like to have this matter attended to before the Hearing. There was discussion on the history of the fence being erected, possibly by direction of the former Zoning Administrator. MR. DIEHL moved that if the attorney finds it necessary in order to make a decision he should be authorized to hire a surveyor so that a proper decision can be made as to the legal location of the fence erected at Mid -Hudson Auto Wreckers Salvage Yard on Route 9D, in the Town of Wappinger. Seconded by Councilwoman Reilly Motion Unanimously Carried Mr. Incoronato being recognized by the chair, thought they should wait until they make a decision on the issuance of the:.license before they spend money to hire a surveyor. The Board felt that since this was the only existing violation, the decision should be properly made. SUPERVISOR DIEHL moved to adjourn the meeting. Seconded by Mr. Johnson.
