A Special Meeting of the Town Board of the Town of Wappinger
was held on March 7, 1977 at the Town Hall, Mill Street,
Wappingers Falls, New York.
Said meeting was requested by Councilman Jensen and,Johnson on
March 4, 1977, for the purpose of considering the introduction
of a Local Law regarding the importation and control of dumping
in the Town of Wappinger and setting a Public Hearing thereon.
Notice of said meeting was mailed to all Board members on March
4, 1977, calling the Special Meeting for March 7, 1977 at
7:30 P.M. at the Town Hall, Mill Street, Wappingers Falls, New
York and also a notice of said meeting was posted on the Town
Clerk's Bulletin Board on March 4, 1977, further, notice was
given on March 4, 1977 to the three area newspapers, Pough-
keepsie Journal, W&SD News and Beacon Evening News and four
area radio stations,. WEOK, WBNR, WHPN and WKIP on the same
date in compliance with the Open Meetings Law.
Supervisor Diehl called the meeting to order at 7:41 P.M.

A Local Law Regulating the use of Lands Within the Town of
Wappinger as a Dump or Dumping Grounds, was read in its entirety.
MR.JENSEN moved to introduce a Local Law Regulating the Use of
Lands Within the Town of Wappinger as a Dump or Dumping Grounds.
Seconded by Mr. Johnson

Mr. Versace asked Mr. Rappleyea if in this local law, balefill
also means the balefill site in Wappingers? Mr. Rappleyea stated
that if literally interpreted it would prohibit the importation
of any garbage from outside the Town, and would include the
balefill.
Mr. Versace questioned Section 3.7, does it allow homewners to
bury their own garbage on his own property? Mr. Rappleyea
answered that it doesn't✓ prohibit as opposed to permitting it.
The following Resolution was introduced by COUNCILMAN JOHNSON
who moved its adoption:
WHEREAS, there has been duly presented and introduced at a
meeting of this Town Board held on March 7, 1977, a proposed
Local Law entitled, "A Local Law Regulating the Use of Lands
Within the Town of Wappinger as a Dump or Dumping Ground, and,
WHEREAS, the provisions of the Municipal Home Rule Law
require that no local law shall be passed by the Legislative
Body of the Town until a Public Hearing thereon has been held
before such body,
NOW, UltREFORE, BE IT RESOLVED as follows:
1. That a Public Hearing shall be held on the said
proposed Local Law by the Town Board of the Town of Wappinger
on the 15th day of March 1977 at 7:00 P.M. on such day at the
Town Hall, Mill Street, in the Village of Wappingers Falls,
Town of Wappinger, Dutchess County, New York.
2. That at least five (5) days notice of such hearing
shall be given by the Town Clerk of the Town of Wappinger by
due posting thereof upon the bulletin board maintained by said
Town Clerk in the Town Hall and by publishing such notice at
least once in the official newspaper of the Town of Wappinger.

MR. JOHNSON moved that the Town Clerk be authorized and directed
to publish the notice of said Public Hearing not only in the
W&SD News, the official Town of Wappinger newspaper, but also
in the Poughkeepsie Journal and the Beacon Evening News.

Mr. Johnson asked that any residents interested in the landfill
sites proposed by the County write their County Legislators,
since they are the ones that would be voting for landfill sites.
MR. DIEHL moved the meeting be adjourned, seconded by Mr. Jensen
and carried.
The Meeting adjourned at 7:56 P.M.
