ADJOURNMENT T The Reorganizational Meeting of the Town Board of the Town of Wappinger was held on January 3, 1977 at 5:00 P.M. at the Town Hall, Mill Street, Wappingers Falls, New York. Present: Louis Diehl, Supervisor (absent at roll call -was seated immediately after meeting was opened) Louis Clausen, Councilman Leif Jensen, Councilman Nicholas Johnson, Councilman Frank Versace, Councilman Elaine Snowden, Town Clerk Others Present: William Horton, Highway Superintendent William Egan, Confidential Secr. to Supervisor Matthew Ryan, Comptroller Deputy Supervisor Clausen called the meeting to order at 5:06 P.M. Mr. Horton, Highway Superintendent stated that his Deputy would remain Mr. Kenneth Croshier. Mrs. Snowden, Town Clerll,stated her two Deputies would remain Gladys Ruit and Ethel Relyea. (Supervisor Diehl took his seat with the Board). The following resolution was offered by COUNCILMAN CLAUSEN who moved its adoption: TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK AUTHORIZING ISSUANCE AND PAYMENT FOR PAYDAYS OF 1977 RESOLVED that, the salaries of all persons holding either full time or part time positions as otherwise fixed for these designated positions shall be paid to the holders of such offices and positions payable every other Friday throughout the year 1977, with 26 pay periods during such year, with the first pay day to be January 14, 1977, and be it further RESOLVED, that the Comptroller of the Town of Wappinger be authorized to issue and pay the holders of these designated positions in accordance with the above designated paydays of ttie year 1977. 2 Seconded by: Mr. Jensen Roll Call Vote: Councilman Clausen Aye Councilman Jensen Aye Councilman Johnson Aye Councilman Versace Aye Supervisor Diehl Aye Resolution Duly Adopted The following resolution was offered by SUPERVISOR DIEHL who moved its adoption: TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK APPOINTING PERSONNEL TO VARIOUS TOWN OFFICES AND POSITIONS OF EMPLOYMENT RESOLVED, that the following persons be and they hereby are appointed to the following offices and positions of employment with the Town of Wappinger to serve in such capacity throughout the year 1977, unless their services shall be sooner terminated, at the pleasure of the Supervisor: NAME OFFICE Frank Cuccia William Egan Supervisor's Bookkeeper Supervisor's Confidential Secretary AND IT IS FURTHER RESOLVED, that the salaries otherwise fixed for the above designated offices and positions shall be paid to the holders of such offices and positions, payable every other Friday throughout the year 1977, with 26 pay periods during such year with the first payday to be January 14, 1977. Lapar be and they hereby are employed and retained for the purpose of furnishing to the Town Board, its officers and agencies, such engineering advice and services as may be required and they shall receive compensation therefor in accordance with a proposal submitted to this Board. Seconded by: Councilman Jensen Roll Call Vote: Councilman Clausen Aye Councilman Jensen Aye Councilman Johnson Aye Councilman Versace Aye Supervisor Diehl Aye Resolution Duly Adopted The following resolution was offered by SUPERVISOR DIEHL who moved its adoption: TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK APPOINTING A CLERK TO THE SUPERVISOR OF THE TOWN OF WAPPINGER RESOLVED, that Debra Brown be and she hereby is appointed to serve as Clerk to the Supervisor of the Town of Wappinger, Dutchess County, New York, and it is further RESOLVED, that the salary for the Clerk to the Supervisor of the Town of Wappinger be and the same hereby is fixed and established at an annual rate of $6,475.00, to be paid every other Friday throughout the year 1977, with the first payday to be January 14, 1977. Seconded by: Councilman Clausen Roll Call Vote: Councilman Clausen Aye Councilman Jensen Aye Councilman Johnson Aye Councilman Versace Aye Supervisor Diehl Aye Resolution Duly Adopted The following resolution was offered by COUNCILMAN CLAUSEN who moved its adoption: TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK ESTABLISHING THE SALARIES OF CERTAIN CLASSIFIED CIVIL SERVICE POSITIONS IN THE TOWN RESOLVED, that the annual salaries for the following classified civil service positions in the Town be and the same hereby are fixed and established at the following annual rate: Glaqys Timbo, Clerk to the Assessor Sylvia Anderson, Zoning Administrator $8,945.00 11, 010.00 AND IT IS FURTHER RESOLVED, that the salaries of the persons holding such positions shall be paid every other Friday throughout the year 1977, with 26 pay periods during such year, with the first payday to be January 14, 1977. Seconded by: Councilman Versace Roll Call Vote: Councilman Clausen Aye Councilman Jensen Aye Councilman Johnson Aye Councilman Versace Aye Supervisor Diehl Aye Resolution Duly Adopted Mr. Jensen, prior to the vote on the above resolution, stated that he would vote Aye for the salaries but would like to reiterate that he doesn't believe the Zoning Administrator should be a Civil Service job at this time, based on the fact stated previously . Mr. Johnson concurred with Mr. Jensen in that he too didn't believe the Zoning Administrator position should be Civil Service. At the conclusion of the vote on the above resolution, Mr. Jensen stated he did speak to Mrs. Anderson about her duties, as there seems to be some confusion in this area. He felt it might be wise to address a letter to her, either through the Supervisor or Director of Personnel office indicating that her services are required at all Planning Board and Zoning Board meetings as it is quite important that she attend them. It might be incumbent upon the Board to put it in writing that she attend all of them. Mr. Diehl pointed out that this was the reorganizational meeting and the subject was inappropriate, but would keep Mr. Jensen's remarks in mind. Mr. Clausen, in conclusion, pointed out that Mrs. Anderson hersOlf had requested a meeting with the Town Board on the subject for clarification. Mr. Jensen agreed this was true, but by the same token some members made this a Civil Service appointment without knowing what the qualifications and duties were, which he believes is somewhat irregular. The following resolution was offered by COUNCILMAN CLAUSEN who moved its adoption: TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK SETTING SALARY FOR SECRETARY TO THE HIGHWAY SUPERINTENDENT RESOLVED, that the annual salary for Frances Frisina, Secretary to the Highway Superintendent of the Town of Wappinger, be and the same hereby is fixed and established at the rate of $8,570.00, to be paid every other Friday throughout the year 1977, with 26 pay periods during such year, with the •1• first payday to be January 14, 1977. Seconded by: Councilman Johnson Roll Call Vote: Councilman Clausen Aye Councilman Jensen Aye Councilman Johnson Aye Councilman Versace Aye Supervisor Diehl Aye Resolution Duly Adopted The following resolution was offered by COUNCILMAN VERSACE who moved its adoption: TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK ESTABLISHING THE PAY SCALE FOR CERTAIN EMPLOYEES OF THE TOWN OF WAPPINGER HIGHWAY DEPARTMENT RESOLVED, that the pay scale for the following categories of employees hired by the Town of Wappinger Highway Department be and the same hereby is fixed and established at the following minimum to maximum hourly rates: Heavy Operator $5.31 to 5.51 Light Operator 5.26 to 5.35 Laborer 3.96 to 5.23 Foreman 5.86 Time and one-half for overtime over 40 hours. AND BE IT FURTHER RESOLVED, that all of such Highway Department employees engaged on an hourly basis shall be paid every other Friday throughout the year 1977, with the first payday to be January 14, 1977. RESOLVED, that the pay scale for all extra part time clerical employees engaged to perform services for the Town Board of this Town and/or its officers, officials, and agencies be and same hereby is fixed and established at a maximum hourly rate of $3.30 per hour, and it is further RESOLVED, that all of such extra part time clerical employees engaged on an hourly basis shall be paid every other Friday throughout the year 1977, with the first payday to be on Friday, January 14, 1977. Seconded by: Councilman Jensen Roll Call Vote: Councilman Clausen Aye Councilman Jensen Aye Councilman Johnson Aye Councilman Versace Aye Supervisor Diehl Aye Resolution Duly Adopted The following resolution was offered by COUNCILMAN CLAUSEN who moved its adoption: TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK AUTHORIZING THE SUBMISSION OF THE SUPERVISOR'S ANNUAL FINANCIAL REPORT TO THE STATE COMPTROLLER WHEREAS, Subdivision 10 of Section 29 of the Town Law requires that the Supervisor of each Town prepare and file with the Town Clerk within 30 days after the expiration of each fiscal year, an annual financial report accounting for all monies received and disbursed by him, together with the certificates or certificate of the bank or trust company where Town monies are deposited, showing the amount of such monies on deposit with said bank or trust company, and cause a certified copy of such report to be published in the official newspaper. WHEREAS, in lieu oft -preparing the report required by Subdivision 10 of Section 29 of the Town Law, the Town Board may determine, by resolution, that the Supervisor shall submit to the Town Clerk within 60 days after the close of 15 the fiscal year, a copy of the report to the State Comptroller required by Section 30 of the General Municipal Law and the Town Clerk shall cause a summary of such report to be published within 10 days after receipt there of in a form approved by the State Comptroller in the official newspaper. NOW, THEREFORE IT IS HEREBY RESOLVED, that in lieu of preparing the report required by Subdivision 10 of Section 29 of the Town Law, the Supervisor shall submit to the Town Clerk within 60 days after the close of the fiscal year, a copy of the report to the State Comptroller required by Section 30 of the General Municipal Law and that the Town Clerk shall cause a summary of such report to be published within 10 days after receipt thereof in a form approved by the State Comptroller in the official newspaper. Seconded by: Councilman Jensen Roll Call Vote: Councilman Claueen Councilman Jensen Councilman Johnson Councilman Versace Supervisor Diehl Resolution Duly Adopted Aye Aye Aye Aye Aye The following resolution was offered by COUNCILMAN CLAUSEN who moved its adoption: TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK RELATIVE TO TEMPORARY DEPOSIT AND INVESTMENT OF TOWN FUNDS WHEREAS, it has come to the attettion of this Town Board of the Town of Wappinger that there are now or may be in the future funds and monies, except proceeds of loans and monies the investment of which is otherwise provided by law, belonging to the Town which are or which may be in excess of the amount required for immediate expenditure to pay current expenses and obligations, and WHEREAS, it is or it may be to the advantage of the Town to deposit and/or invest all or part of such funds in special time deposit accounts, in, or certificates of deposit issued by, banks or trust companies located and authorized to do business in this State, short term obligations of the United States of America and/or the State of New York, and WHEREAS, it appears that investment of such excess and and profitable to the Town of the temporary deposit and/or surplus funds may be beneficial Wappinger, NOW, THEREFORE, IT IS HEREBY RESOLVED, that the duly elected, qualified and acting Supervisor of the Town of Wappinger be and he hereby is 17 authorized, empowered and directed to deposit and/or invest such surplus and excess funds of this Town in the aforesaid manner pursuant to Section II of the General Municipal Law of the State of New York, and it is further RESOLVED, that such temporary deposits and/or -investments shall be secured, registered or held, as the case may be.in the manner prescribed by Section II of the General Municipal of the State of New York, and it is further RESOLVED, that the aforesaid Supervisor of this Town be and he hereby is authorized, empowered and directed to take all steps necessary from time to time to carry out and implement this resolution. DIEHL moved that compensation for mileage for Town officers, officials and employees shall be established at $.i5 a mile. Seconded by Mr. Clausen Motion Unanimously Carried The resignation of Donald Grossman as Civil Defense Director for the Town of Wappinger, having been received several months ago, Supervisor Diehl at this time brought the matter of the vacancy to the Board's attention. MR. DIEHL moved that Edward Hawksley be appointed Civil Defense Director for the Town of Wappinger. Seconded by Mr. Clausen. Motion Unanimously Carried The term of office of Robert Steinhaus as a member of the Planning Board expires January 4, 1977. The following resolution was offered by SUPERVISOR DIEHL who moved its adoption: 113 RESOLVED, that Victor Fanuele, be and he hereby is appointed to fill the vacancy on the Planning Board of the Town of Wappinger which has occured by reason of the expiration of the term of Robert Steinhaus, and it is FURTHER RESOLVED, that the said Victor Fanuele is hereby appointed to the said Town Planning Board for a term which shall expire on the 4th day of January 1984. Seconded by Mr. Clausen Roll Call Vote: Councilman Claueen Aye Councilman Jensen Nay Councilman Johnson Nay Councilman Versace Aye Supervisor Diehl Aye Resolution Adopted Mr. Johnson commented that it seems like whenever we have quali- fied people - shades of 1974 - summarily we dismiss them without an opportunity to discuss the reasons why, just to dismiss someone after 14 years of service seems a shame. Supervisor Diehl directed that the Planning Board be asked to caucus and recommend to the Town Board a Chairman to represent their Board. The Chairmanship appointment to the Planning Board was thereby tabled. MR. VERSACE moved that Mr. Joseph Landolfi be appointed Chairman of the Zoning Board of Appeals for the year 1977. Seconded by Mr. Clausen. Motion Unanimously Carried MR. DIEHL moved that Hugh J. Maurer be appointed Chairman of the Recreation Commission for the year 1977. Seconded by Mr. Clausen. Motion Unanimously Carried Mr. Ryan, Comptroller having submitted a late request for some transfers, the matter was discussed, and Mr. Diehl commented this meeting was established solely for the purpose of Reorganization, and if there was a dire need to authorize these transfers, this meeting would be adjourned and a Special Meeting called if the entire Board was in agreement.
