Engineer to the Town Subject: 1324 Route 9 Gas station FOIL Request Date: April 6, 2010 We received a copy of a FOIL Request for the site of a former gas station located at 1324 Route 9 (southeast comer of Route 9 and Old Hopewell Road). This request was made by Mr. Robert McCarthy of 54 Tuttle Place, Middletown, Connecticut. Mr. McCarthy's request was: 'We are completing an environmental assessment for the property: 1324 Route 9 (Southeast comer of Old Hopewell Road) and request any historic records related to Site use, ownership, occupancy, hazardous-material storage or handling, and sewer and water system connection details." After reviewing the files in Town Hall the following summary of the records is offered: · The owner of record is: Real Holding Corp. 239 Agar Lane Mahopac, NY 10541 · The tax parcel number: 135689-6157-02-610544 · Present zoning designation: HB (Highway Business) · The site is served by an on-site individual drilled well located on the east side of the building. · The site is served by an on-site individual subsurface sewage disposal system located in the northwest corner of the site. · The site has been inactive since 1989. -.....m---'-------.h-.-h--.h---The:original-b(Jjldirt~rpermifwas-issue-a-in--1-966-a-s-Perrnifnumber-ga:;9;--h_n_--______ which was voided and replaced by permit number 67-23. . · The original Certificate of Occupancy was issued on 2/29/68. · In 1990, there was an oil burner fire. · In a February 29, 1996 letter form Charles Lujack Title Agency, Inc. they found that violations have existing since the site was posted by the Fire Inspector (1/14/90). The building was posted as unsafe due to oil burner fire and numerous electrical violations. Owner, at that time, was instructed to obtain building permit to correct violations, which was never done and building has been vacate since that date. · In 9/92, the Fire Inspector posted that the building shall not be occupied until violations of the posted order are corrected, these were still as a result of the fire and electrical violations. Unsafe structure due to fire 9NYCRR 1153.1 (a). · In 1971 a building permit was issued (71-79) for the gasoline tanks however no C.O. was ever issued. In 10/98 a Certificate of Compliance was issued for the removal of 4 underground gasoline storage tanks. Application #A92250 and permit #P92250. · There was a report of a petroleum spill #8909945 and that debris was stockpiled on site with a need to dispose of properly in accordance with Division of Solid and Hazardous Waste. · In 1992 a building permit was applied for to install 2 new garage doors, the permit was denied per prior letters by the Fire Inspector. · In 2/99 a Certificate of Compliance was issued for the Demolition of canopy and gut interior. Application #A96861 and Permit #P96861. · In 7/07, the Fire Inspector issued two appearance tickets for (1) failure to secure vacant building #01048 and (2) failure to remove combustibles from vacant building #01049. There was no further information in the files as to the resolution of these tickets. The above information was obtained from the files of record in the town of Wappinger Building Department.
