A Special Meeting of the Town Board of the Town of Wappinger was
held November 23, 1976, at the Town Hall, Mill Street, Wappingers
Falls, N.Y.
Notice of said meeting was mailed to each Board Member on November
18, 1976, calling the meeting for 8:30 P.M., November 23, 1976, for
the purpose of adoption of the Benefit Assessment Rolls for the
year 1977.
Supervisor Diehl called the meeting to order at 8:35 P.M..

The following Resolution was introduced by Councilman CLAUSEN, who
moved its adoption:
WHEREAS, the Town Assessor did prepare at the direction of the Town
Board, the assessment rolls for the Oakwood Water District for the
assessment to be levied in 1977, and
WHEREAS, said assessment roll was filed with the Town Clerk of Town
of Wappinger, and
WHEREAS, she thereafter gave notice by posting upon the bulletin
Board of the Town and in the newspaperpublished within the Town
of the time and place when the Town Board would conduct a hearing
and hear objections upon or to said roll, and
WHEREAS, the Town Board of the Town of Wappinger did meet on the
22nd day of November, 1976, to consider and., hear objections to
said roll,
NOW, THEREFORE, BE IT RESOLVED that the assessment roll of 1976 of
the Oakwood Water District for taxes to be collected in 1977 be
approved, ratified and confirmed and adopted, and the Supervisor
and Town Clerk are hereby authorized and directed to execute the
warrant for collection of said taxes in the manner prescribed by
Law.

collected in 1977 be approved, ratified and confirmed and adopted
and the same is hereby approved, ratified and confirmed and
adopted, and the Supervisor and Town Clerk are hereby authorized
and directed to execute the warrent for collection of said taxes
in the manner prescribed by Law.

The following Resolution was introduced by Councilman Clausen, 4 1 0
who moved its adoption:
WHEREAS the Town Board of the Town of Wappinger has adopted
benefit assessments for the following Improvemeht districts
on November 23, 1976, and
WHEREAS said assessments are to be included upon real property
tax bills prepared by the County of Dutchess, and
WHEREAS, the Town Board desires that said assessments be
included in full upon the first payment period of the three
payment periods,
NOW, THEREFORE BE IT RESOLVED that the benefit assessments for
the year 1977 for the Oakwood water District, Fleetwood Water
District, Central Wappinger Improvement Area, Fleetwood Sewer
District, Wildwood Sewer District and Wappinger Sewer Improvement
#1 be transmitted to the County of Dutchess for inclusion on the
land tax bills prepared by said County, and
BE IT FURTHER RESOLVED that the County Legislature of Dutchess
County accept this resolution as a request that it direct the
appropriate County officials to include on its tax bills the
benefit assessments in accordance with the foregoing.
BE IT FURTHER RESOLVED that this resolution be accepted by the
County Legislature as a request that the benefit assessments
for the aforesaid districts be included in their entirety in
the first payment period.

A Public Hearing was held by the Town Board of the Town of Wappinger on
November 23, 1976, at 7:45 P.M. at Town Hall, Mill Street, Village of
Wappingers Falls, Dutchess County, New York on Central Wappinger Water
Improvement Area.

The Town Clerk offered for the record the Affidavtis of Posting and Publi-
cation duly signed and notarized by Albert Osten of the W & S D News, this
notice was published in both the W & S D News and the Poughkeepsie Journal.
(Affidavits are attached hereto and made a part thereof of the minutes of
this Hearing).
Mr. Diehl asked Mr. Logan, Town Assessor, to explain the method of
assessment.
Mr. Logan explained Benefit Units -- each house and lot -- 2 acres -- 1 unit,
apartments 3/4 unit of Benefit Assessment. The assessment rolls are present
tonight and have been available in the Town Clerk's Office for the public to
inspect. Each unit would pay $96.67, increased from last year $25.00.
Mary Townsend asked about the increase, why was there one.
Mr. Ryan explained the banking and varied interest rates which determine
the yearly rate.
Walt Cherry asked if it included Rockingham.
Jack Peace askfed if the Primrose Hill, Myers Corners Road, was part of the
District.
The Public Hearing closed at 7:58 P.M.

Mr. Logan explained the Benefit Unit Assessment and the method of assessing
one unit and additional acreage.
Walt Cherry asked if there are more units in water than in sewer -- why?
Mary Townsend asked why aren't the people that do not have their own sewer
districts included in the Wappingers Sewer Area?
Dagney Morley-- is this meeting on $83,000 to be raised for Sewer #1. Is it
Operating and Maintenance. What is the figure for? I saw in the newspapers
the figures. She thought lastyears rate was $111.00. It was explained this
last year was $209.00 per unit, this year $181.00 - it went down $28.00.
Mrs. Townsend asked why it was going down? Is everytihng completed?
Mr. Ryan explained the bonding interest rate & number of units in the district
determine the rate.
Mrs. Owen - Are the units that Mr. Logan explained the same as they have bee n
the last few years.
Jack Peace - What is Benefit Assessment? What about a house on the sewer
line, but not hooked up. When it was explained they pay the same assessment
but not Operating & Maintenance charges Mr. Peace wanted know why they
shouldn't pay the same.
Mr. Diehl said this has been referred to the Attorney for an opinion & since
it was Operating & Maintenance he did not want to discuss it tonight.
Mrs. Morley wanted to know when they would receive sewer service ---they
were now paying a reduced Benefit Assessment.

Wayne Moreau asked if a health hazard existed? What about the people that are
hooked up -- did they hook up on their own -- did they think they were causing
pollution problems. There are a large number not hooked up who are potential
polluters.
Mr. Diehl moved to close the Hearing seconded by Mr. Clausen and carried.
After the vote Mr. Diehl remembered a letter he wanted read into the minutes
and reopened the Public Hearing. All members were present.
The Town Clerk read a letter from Ken Stenger regarding assessment of White
Gate Apts.. It was referred to Allan Rappleyea for an opinion.
The Public Hearing closed at 8:34 P.M.
