The Regular Bi -Monthly Meeting of the Town Board of the Town
of Wappinger was held November 22, 1976 at 7:00 P.M. at the
Town Hall, Mill Street, Wappingers Falls, New York.
Supervisor Diehl Called the meeting to order at 7:08,P.M.

The Minutes of the September 13, 1976 Regular Monthly Meeting,
and the September 14, 1976; September 20, 1976, and November
4, 1976 Special Meetings, having been previously sent to the
Town Board Members, were now placed before them for their
approval.
Mr. CLAUSEN moved the Minutes of the September 13, 1976 Regular
monthly meeting, and the Special Meetings of September 14, 1976,
September 20, 1976, and November 4, 1976, as submitted by the
Town Clerk be and they are hereby approved.

Mr. Diehl stated he would recommend interest be paid on all loans
from Gen. Fund to the Special Districts as of Nov. 22, 1976.
Mr. CLAUSEN moved to authorized the Comptroller and Supervisor
to transfer $3,000.00 from General Fund, Contingency, to Wappinger
Sewer Improvement #1, with intorest at the current rate.

Dear Mr. Ryan:
On August 26, 1976, Longhitano & Sons, Inc. picked up and
paid for a Water and Sewer Hook-up Permit for lot 59 on All
Angels Hill Rd.
Apparently Mr. Longhitano never noticEied Wilson Excavators
of this, and when Mr. LaPar's office notified them they needed
a hook-up permit, came in on October 28, 1976 and took out one.
Later it was discovered there were two fees paid for the same
lot, now, Mr. Longhitano requests a refund of $50.00.

A Memo was received from Mr. Ryan, Comptroller to the Town Board
stating: "Please authorized this refund all appears in order."
Mr. CLAUSEN moved that Mr. Longhitano be repaid the sum of
$50.00 as a result of double fees paid for a hook-up permit for
lot #59 on All Angels Hill Road.

The following Resolution was offered by Councilman CLAUSEN who
moved its adoption:
WHEREAS, the Town Superintendent of Highways has been requested
to remove snow from County roads, and to sand or otherwise treat
them for the purpose of removing the danger of ice and snow, by
the Commissioner of Public Works of Dutchess County, in
accordance with Article 6, Section 135-a of the Highway Law,

NOW, THEREFORE, BE IT RESOLVED, that the Town Superintendent
be and is herein authorized to perform such work as is found
necessary, at the hourly rate as fixed by the State Commissioner
of Transportation for the renting and hiring of such equipment,
for the Winter season 1976-77.

At its regular meeting on 11 October 1976, the Conservation
Advisory Council unanimously endorsed Mrs. Robert Menger for
appointment to fill the unexpired term of Mr. Charles Cortellind
(June 1977)
I can personally speak for Mrs. Mengers' qualifications, her
integrity and her willingness to be of service to the community.
I believe she would be an asset to this council and therefore
request that Mrs. Menger be considered for this appointment.

Mr. Hawksley, being recognized by the Chair, stated he knew Mrs.
Menger personally, had worked with her in other Organizations, and
felt whe had a sincere desire to do something for the community,
and would be an asset to the Council.
Mr. Clausen said he would move the appointment of Mrs. Menger to
the Council upon Mr. Hawksleys recommendation, and Mr. Versace
indicated a second, but the motion was withdrawn after both Mr.
Johnson and Mr. Jensen stated they had not received Mr. Hawksleys
letter of recommendation, and it was generally agreed to reconsider
the Conservation Advisor Councils recommendation at the December
meeting.

Grossman as Deputy Director of the Town of Wappinger for Civil
Defense had been received.

The Town Clerk informed the Board that she had been served with
a Summons by Lombardi & Son, Inc., on November 18, 1976

Mr. DIEHL moved to accept the recommendation of the Attorney, which
was that a list of titles first be compiled, and that forwarded to the
County Courthouse Librarian to ascertain if they could be utilized by
said Library.

Discussion was held on setting Public Hearings for Operation and
Maintenance Rate Changes in several of the Sewer and Water Districts.
This matter was temporarily tabled to a later point in this meeting.
Supervisor Diehl stated that the Board had received three proposals
for Contracts for the Operation and Maintenance of the Municipal
water and sewer Districts and Improvements, and had gone over each
of them.
Mr. DIEHL moved that the proposal for a Contract for the Operation
and Maintenance of all the Municipal Sewer and Water Districts and
Improvement Areas for the Town of Wappinger, submitted by Camo
Pollution Control, Inc., as presented to the Town Board November 17,
1976, be accepted.

Supervisor Diehl called a recess at 7:32 P.4I.
Supervisor Diehl Called the Meeting back to order at 9:45 P.M.
All Board Members present with the exception of Mr. Clausen.
Two Local Laws were placed before the Board. The first was to Amend
Local Law #4 of the year 1975; the second was to Amend Local Law #8
of the year 1975.
The following Resolution was offered by Councilman JOHNSON, who moved
its adoption:
WHEREAS, there has been duly presented and introduced at a meeting of
this Town Board held November 22, 1976, a proposed Local Law entitled
"A Local Law Amending Local Law #8 of the year 1975,.Establishing the
Rates for the Fleetwood Sewer District", and
WHEREAS, the provisions of the Municipal Home Rule Law require that
no local law shall be passed by the legislative body of the Town
until a Public Hearing thereon has been held before such body, 403
NOW, THEREFORE, BE IT RESOLVED as follows:
1. That a Public Hearing shall be held on the said proposed
Local Law by the Town Board of the Town of Wappinger on the
9th day of December 1976, at 7:00 P.M. on such day, at the
Town Hall, Mill Street, in the Village of Wappingers Falls, Town
of Wappinger, Dutchess County, New York.
2. That at least five (5) days notice of such hearing shall be
.given by the Town Clerk of the Town of Wappinger by the due
posting thereof upon the bulletin board maintained by said
Town.Clerk in the Town Hall and by publishing such notice at
least once in the official newspaper of the Town of Wappinger.

meeting of this Town Board held on November 22, 1976, a proposed
Local Law, entitled "A Local Law amending Local Law ##4 of the
year 1975, Establishing the Rates for the Wappinger Sewer
Improvement Area #1", and
WHEREAS, the provisions of the Municipal Home Rule Law require

Mr. Versace briefly reported on the November llth Tri -Municipal
Committee meeting. He notied that the Tri -Municipal Committee
had moved to revise and re -submit Step I and Step II Grants. The
reason was that EPA has requested an additional Facilities Study.
Included would be an Environmental Impact Study and the feasibility
of sizing down the Plant and intercepter line as were presented
initially.
Mr. Johnson questioned Mr. Versace as to where the Board stands
on the Sewer Improvement #3 Engineering proposals. Mr. Versace
stated he was in touch with the Engineering firms, and enlightened
them as to what the Town Board expected as far as the lateral Dists.
were concerned, as it appeared that initially all the Engineering
firms weren't on the same ground. These firms will each submit
a new proposal to Mr. Versace, who will forward them on to the
Town Board sometime after December 1st. Hopefully, when he receives
the information he will pass this on to the other Board members
and set up a workshop session to go over the proposals.
Mr. Jensen made a few more comments on Tri -Municipal, indicating
that EPA had indicated to the Committee that the contractual work
will be reviewed by EPA, and before any contracts are awarded,
they will select those contracts for awarding. Contracts could
be broken up into individual contracts, or all under one, as the
EPA sees fit. He hoped by the December meeting there will be a
final answer.
Mr. Diehl commented that within the past week there have been
approximately $300.00 worth of damages done to the Fleetwood Sewer
Plant again. Watchmen have been posted there this week to try to
apprehend the vandals - to no avail. He appealed to the
residents to forward recommendations to curb or stop this
continued vandalism.
There being no other business to come before the Board, the
Chair entertained a motion to adjourn.
Mr. DIEHL moved to adjourn the meeting, seconded by Mr. Jensen
and unanimously carried.

Wappingers Falls, Dutchess County, New York on Oakwood Assessment.
Supervisor Diehl opened the Hearing at 7:40 P.M.

The Town Clerk offered for the record the Affidavits of Posting and Pub-
lication duly signed and notarized by Albert Osten of the W&SD News, this
notice was published in both W&SD News and the Poughkeepsie Journal.
(Affidavits are attached hereto and made a part thereof of the minutes of
this Hearing).
Mr. Logan explained the method of assessing for B Units.
Mr. Versace asked Mr. Ryan if the Benefit Assessment charges_included the General
Fund charge of $4,800. He answered that a portion of it would be paid back
& the amount of $53.56 Benefit Assessment should be less next year.
Jack Peace asked is this a larger amount than we have paid? Mr. Diehl
answered actually it was a decease. He was surprised that there were people
who were delinquent in paying their bills.
Mr. Versace asked if there was a possibiltiy of a reduction in all districts
next year if most of the districts were paying back General Fund.
Mr. Ryan answered yes, there probably would be.

Journal. (Affidavits are attached hereto and made a part thereof of
the minutes of this Hearing).
Mr. Logan, Assessor, explained the method of assessing for Benefit
Unit -- each house and lot, 1 unit, apartments 3/4 unit. Wildwood
had 75 units, Green Tree 18, total in District 3181/2 units.
Mr. Cortellino thought that in another district apartments were
assessed differently - 3/4 unit for 1 bedroom, 1 unit fond2 bedrooms
and 1 unit and a fraction for 3 bedrooms.
Mr. Logan said no, this was incorrect - all apartments in the Town
are assessed at 3/4 unit.
Mr. Cortellino then asked what the public hearing was for - just
number of units in the district.
Mr. Diehl said it was actually to tell them the amount they would
be assessed - the bills were there and had to be paid. The Assess-
ment Rolls have been on file in the Town Clerk's office for anyone
to inspect and they are here tonight.
No one else spoke.
The Public Hearing closed at 8:05 P.M.

A Public Hearing was held by the Town Board of the Town of Wappinger on November
22, 1976 at 8:30 P.M. at Town Hall, Mill Street, Village of Wappingers Falls,
Dutchess County, New York on the Assessment Roll of the Fleetwood Water District.
Present:
Louis Diehl, Supervisor
Leif Jensen, Councilman
Nicholas Johnson, Councilman
Frank Versace, Councilman
Absent:
Louis Clausen, Councilman

41110 The Town Clerk offered for the record the Affidavits of Posting and Publication
duly signed and notarized by Albert Osten of the W&SD News, this notice was
published in both W&SD News and the Poughkeepsie Journal. (Affidavits are
attached hereto and made a part thereof the minutes of this Hearing).
Mr. Diehl said they would listen to comments on both water & sewer at this
time. Fleetwood Sewer Public Hearing was scheduled at 9:00 P.M.
Mr. Logan explained method of assessing for benefit units. Apartments at 3/4
unit - house & lot 1 unit - total of 172 units.

Mr. Diehl stated that Assessment Rolls have been available in the Town Clerk's

Office for anyone to inspect, also available at the Hearing.
Joseph Incornato spoke and said banks have been asking for increases in their
escrow accounts, it is not for taxes as there's no increase to speak of and the
assessment in the district shows no marked increase, so what are they basing
it on. He stated they were co -mingling accounts, that of 0 & M and capital in-
debtedness. He continued on comparing figures from last year & this year.
Mr. Solomon a resident of Fleetwood with one of the more serious problems with
water, complimented the Board on their selection of Camo Pollution as this
Company has extended themselves beyond their contract to satisfy his needs.
Previously Mr. Incornato had asked Mr. Ryan for figures from last year, he
now answered that the gross amount appropriated including debt service was
$13,084. $7,254 was the actual expense of operation & maintenance of plant.
He explained the monies, where they wereapplied, there was no surplus &
no unexpended balance.
Mr. Incornato, looking at the budget on these districts said they were woe-
fully inadequate. He complained about the form. He discussed a Town Water
& Sewer Department. Mr. Diehl said they would be very receptive to a quali-
fied operator if anyone had capable men to recommend.
Mr. Jensen had done someresearching on this subject & said at this time, it
was not lucrative to have our own water & sewer department.
Mr. Versace had asked the Comptroller previously about the loan from General
Fund for the districts. These amounts this year included payment of this loan,
so therefore, next year, the sum should be reduced.
Mr. Ryan said this could be but not necessarily should be. Fleetwood Sewer
would still owe a considerable sum. The monies would be applied toward
repayment in 1977 but it would not eliminate the whole amount by 1978.
There was a lengthy discussion throughout the hearing on work that had to be
done at the plant, and communications from the Supervisor's Office asking the
residents to decide which direction they would take to pay for this work.
There were choices of payments given to them and when this was completed, the
Board would go by the choice of the majority. This subject, however, did not
pertain to the subject of the hearing & Mr. Diehl discouraged discussion on it.
This could be taken up at another time.
Mr. Almena, asked if the water in their district has been provent to be un-
healthy.
Mr. Solomon seemed to have the worst problem in the district with the water.
Mr. Alemena, however, did not think the district should be charged to change
Mr. Solomon's water, he should pay for a filter or whatever he needed himself.
They all had water from the same system & Mr. Alemena said he could live with
the sulphur odor.
Mr. Jensen explained that Mr. Solomon's supply was apparently much more dis-
tasteful & odorous probably because of his location or the pipes & it would
not be fair for him to pay extra when he was paying the same now as everyone
else.
Mr. Solomon then brought in a sample of water in a jar which he said was seven
days accumulation.
Mr. Diehl again tried to discourage the subject they were on as it was not the
subject of ;the Hearing which was Benefit Unit Assessment.
No one else spoke.
The Public Hearing closed at 9:24 P.M.

two separate districts and were advertised as separate hearings, it must be
done this way.
Mr. Almena asked about the bids for operating the plants.
