Dear Dave:
In connection with Ms. Flint's comments regarding Local Law No.7 of2005, it is my
recommendation that no amendments be made to Section 137-5. With respect to Section
137 -7, it is my recommendation that a period should follow Subsection B( 5)(b).
With respect to Local Law No. 2-2005, it appears that we will have to re-adopt the Local
Law with the diagram attached. This is one of the difficulties that is created by using e-
mail to transmit legislative documents. When your office prepares a Local Law it should
ensure that all attachments are included in the proposed Local Law. In those
circumstances where attachments are required, I would recommend that the Local Law
with attachments be sent by overnight mail rather than bye-mail. In the alternative, clear
instructions have to be provided to the Town staff to make sure that the attachments are
added to your e-mail.

Thank you for taking the time to speak with me regarding the supplement we are preparing for
the Town of Wappinger Code.
As we discussed, this supplement includes Local Law Nos. 1-2004 through 10-2004. Since this
supplement affects 38 chapters in the Code, we will also begin the process of converting your
Code to our new software publishing system, which is designed to lower costs and improve
turnaround time. You will notice a difference in the pagination system for each chapter that is
affected by the legislation noted above. Under the new system, page numbers contain the chapter
number and page number separated by a colon (e.g., 144:1, 144:2, etc.). The conversion process
requires that the first time each chapter is amended, it must be entirely reprinted in order to
change all ofthe page numbers. Therefore, you will receive complete copies of chapters with this
supplement. With future changes to those chapters, you will receive only the supplemental pages
on which there have been changes.
As a result of the conversion to our new publication system, the Town's PC/CodeBook and E-
Code will be upgraded to our latest versions, giving you easier search and print functions. Your
new E-Code will now allow you to view and print entire chapters without scrolling page by page.
Because of size ofthis supplement, we would like to offer you two options for updating the Code
at this time.
OPTION I:
Update the Code to include Local Law Nos. 1-2004 through 10-2004 and reprint only the
chapters affected by this supplement: $3,200 to $3,500

use.

Codification of Local Laws and Ordinances
As requested, we have reviewed certain comments and recommendations made by General
Code Publishers for the purpose of rendering our recommendations thereon.
Environmental Quality Review
Section 23, Environmental Quality Review, of the codified Town Code currently provides
local regulations which are different from Part 617 of Title 6 of the New York Code of
Rules and Regulations (the Statewide regulations implementing the State Environmental
Quality Review Act) promulgated by the New York Department of Environmental
Conservation. Part 617.14(b) states:
"Individual agency procedures to implement SEQR must be no less protective of
environmental values, public participation and agency and judicial review than the
procedures contained in this Part. This Part supersedes any SEQR provisions
promulgated or enacted by an agency that are less protective of the environment."
The only reason for a municipality having its own SEQR regulations would be for the
purpose of having its regulations be more restrictive than the Statewide regulations
pertaining to SEQR. In that we do not believe that it is the objective of the Town of
Wappinger to be more protective of the environment than is provided by the Statewide
regulations, nor do we believe that the Town needs to be more protective of the
environment, we recommend that it would be appropriate for the Town to no longer have
its own local environmental quality review regulations, other than to reference the
Statewide regulations in Part 617.

Professional Consulting Fees
Article I, Professional Consulting Fees, of ~ 24, Fees, of the codified Town Code
provides for the payment by Applicants of professional review costs incurred by the
Town. These provisions pertain to the review of "zoning permits, zoning amendment
requests, subdivision applications, [and] permits required by the Building Code, the Fire
Prevention Ordinance or other statutes or Local Laws." These provisions therefore
provide an "umbrella" over the Zoning Law, the Subdivision Regulations, etc. Further,
the subject provisions do not contradict the provisions of the Zoning Law. We therefore
recommend that the subject provisions remain in the Town Code as Article I of ~ 24.
Attorneys' Prosecution Fees
Article II, Attorneys' Fees, of ~ 24, Fees, of the codified Town Code provides for the
Town's recovering of "reasonable attorneys' fees for the prosecution of' "civil proceedings
to enforce a local law, ordinance, subdivision regulation, rules and regulations, highway
specifications, or other rules of conduct or standards" "as well as the costs and
disbursements of said proceedings."
The subject fees are not application review costs and we are not in a position to render
an opinion as to whether the Town should seek to recover the subject fees.
Recreation Fees
On page 24 of General Code Publishers' Comments and Recommendations dated
September 1997, Code Publishers states: "This local law establishes a subdivision
recreation fee required to be paid per lot subdivided. Should it be included?"
The Town's Subdivision Regulations contain provisions regarding the payment of a
recreation fee in lieu of the reservation of parkland. We believe that it would be
satisfactory to include the subject provisions being questioned (Article III, Recreation
Fees, of ~ 24, Fees, of the codified Town Code) so long as the subject provisions are
consistent with the associated provisions in the Town's Subdivision Regulations.
Subdivision of Land
1. On page 37 of General Code Publishers' Comments and Recommendations, General
Code Publishers asks whether the sections in the Subdivision Regulations regarding

preliminary and final subdivision plat approval (questions A and B on page 37,
respectively) should be revised by merely referencing the appropriate sections of
New York State Town Law, or whether the subject sections should be amended by
means of reciting the appropriate provisions from the Town Law.
We believe that the Subdivision Regulations should be a "stand alone document,"
and should not expect readers of the Subdivision Regulations to have a copy of
New York State Town Law on hand. For this reason, we recommend that the
subject sections regarding preliminary and final subdivision plat approval be revised
by means of including a recitation of the appropriate provisions of New York State
Town Law.
2. With respect to the filing of the final subdivision plat in the Office of the Dutchess
County Clerk (question C on page 37), the specified time period in ~ A123-9 of
the Subdivision Regulations should be changed from 90 to 62 days.
Sunday Activities
With respect to Article I, Public Sports and Exercise, and Article II, Public Entertainment,
of ~ 43, Sunday Activities, of the codified Town Code we believe that the subject
provisions are obsolete and should be deleted from the Town Code.
Swimming Pools
General Code Publishers states that the enclosure of swimming pools is "also covered in
Part 720 of the New York State Uniform Fire Prevention and Building Code, which the
Town has adopted. It seems that this ordinance could be deleted from the new Code
because the provisions of the Uniform Code apply."
Rather than deleting the provisions regarding the enclosure of swimming pools, we believe
that, in the interest of safety, it would be appropriate to either leave the subject provisions
where they are or to relocate them to the Zoning Law. Even though the subject
provisions may be redundant in that the subject is covered in the New York State Uniform
Fire Prevention and Building Code, in the interest of safety we do not believe it would
be inappropriate to have the regulation mentioned twice.

1. In response to General Code Publishers' suggestion that the Town may want to
amend the definition of "family" in its Zoning Law in response to recent court

2. General Code Publishers mentions that 9 274-a.8 of the New York State Town Law
provides that the Planning Board shall mail notice of the public hearing on a site
plan application to the Applicant at least 10 days before the hearing. General Code
Publishers asks whether a sentence should be added to 9 450.5 of the Town's
Zoning Law to this effect. We recommend that such a sentence be added to 9
450.5 regarding notice to the Applicant.

As an outgrowth of our October 31, 1997 meeting, I have reviewed the
sections you requested in your October 20, 1997 letter to our office and
advise the following:
1 . Section 36 - Service Pioe, Sewer and Water:
I believe this section should be redefined and clarified
especially as to whose responsibility it is to construct
and maintain the water service and sewer lateral.
2. Section 37 - Sewers:
This section appears to be acceptable and in current
use. However, in Article 3 through Article 7, the rates
will need to be modified on yearly basis.
3. Section 40 - Solid Waste, Dumoin9 Ground Re9ulation:
This section is very confusing as Local Law No.1 of
1969 says that only the Town can dump (bury)
garbage. Local Law No.1 of 1977 says that nobody
can except private property owners. Therefore, these
statements appear to be contradictory. This should be
reviewed and straightened out by the Town Board.
Local Law No.6 of 1989 appears to be acceptable.
4. Section 41 - Streets and Sidewalks, Drivewavs ant:/..
Excavations, Maintenance of Unacceoted Streets and
Street SDecs:
I have checked these and recommend that the curiem
Town Highway Specifications be included, not the old
ones.

Graham Foster should be asked if there is any
modification that he would want in the current Town
Highway Specifications. I believe there might be some
small changes.
The driveway section should be re-drafted to meet
current standards.
The excavation section appears acceptable, however,
the insurance coverage limit appears to be rather low.
The maintenance section of the unaccepted streets, I
be live is in the Highway Specifications (this section
should be reviewed and added to, if necessary) and
could be deleted. This should be verified.
5. Section 48 - Water System Construction Regulations:
In Article 2 through 8, the water rates should be
checked.
In Article 9, the Local Law regarding the installation of
water services should be checked and re-drafted with
comments from Camo Pollution Control, Inc. and
Graham Foster.
I think a meeting should be arranged with the appropriate people so that
the recommendations can be made to the Town Board for what we feel
should be re-drafted and altered.

This will confirm our commencement of the research of the records of the Town of Wappinger.
We will be in Wappinger on Monday, July 14, 1997, at 9:00 a.m. to initiate this research and the
preparation of the Code of the Town of Wappinger. Please be assured that this will result in a
minimal disruption of your daily routine.
To facilitate our work and to minimize the interruption of your normal activities, we will need
the following:
I. An adequately lighted area with table or desktop space adequate for reviewing minute
books.
2. Access to all of the minute and ordinance books and local law files, as well as any
available printed copies of ordinances, local laws and electronic versions, if available.
Our goal will be to obtain existing duplicate copies or to make copies of all such
effective legislation. Any assistance that you can provide in this regard will be greatly
accepted.
3. A list of the names of town officials for our records.
4. Any historical information regarding the town that the Town Board may wish to have
included in the Preface.
5. A reproducible-quality copy of the Official Emblem or Town Seal. (An imprint or a
letterhead may be sufficient.)
6. A clear copy of the Official Zoning and/or Street Map.
7. Vouchers for billing purposes.
It may also prove time conserving to both of us if one of your assistants, or someone in your
office, could be assigned to help in locating records, showing us through the town offices and
answering questions.
The codification and editing of your Code will begin as soon as we return to our offices with the
research material. An editor will be assigned to organize and evaluate your existing legislation
and prepare recommendations as to this legislation and new subject matter. Following the

2. Local Law No. 13-2013, adopted 9-9-2013, amends Chapter 240, Zoning, by removing all
references to the HO Highway Office District in § 240-6 and in the Schedule of Use Regulations
and the Schedule of Dimensional Regulations. However, the HO Highway Office District is also
referenced in § 240-8B(5), HD -Highway Design District. Please let us know if any changes to §
240-8B(5) should be made with this supplement.
