ADJOURNMENT The Regular Monthly Meeting of the Town Board of the Town of Wappinger was held on February 18, 1975 at 8:00 P.M. in the Town Hall, Mill Street, Wappingers Falls, New York. Supervisor Diehl called the meeting to order at 8:14 P.M. Present: Louis Diehl, Supervisor Louis Clausen, Councilman Leif Jensen, Councilman Stephen Saland, Councilman Frank Versace, Councilman Elaine Snowden, Town Clerk Others Present: William Horton, Superintendent of Highways Allan Rappleyea, Attorney to the Town Rudolph Lapar, Engineer to the Town Reports for the month of January were received from the Supervisor, Town Justices and Building Inspector and also the Annual Reports from the Grinnell Library and Town JusticesVincent Francese, and semi-annual report from Virginia Ferris, Town Historian, were received. MR. CLAUSEN moved that the monthly report for January from the Supervisor, Town Justices and Building Inspector and the Annual Reports from Grinnel Library and Town Justice Vincent Francese and SOmi-Annual Report from the Town Historian, be accepted and placed on file. WD 324.67 Capt Imp. & Proj. 137,666.40 RFSD 4,193.64 Misc. W&S Dist 8,859.94 MR. CLAUSEN moved the bills be paid, subject to audit. Seconded by Mr. Saland. Motion Unanimously Carried 41. Mr. Diehl, indicating that there was a long agenda directed that the topic of Benefit Assessments on the Water and Sewer Improve- ments be brought to the top of the agenda due to the number of interested people in the audience. Before opening the floor to questions, Mr. Diehl commented that the Board has discussed the area of the problems that are here, and, beginning next Monday, there will be informational forms with the Town Clerk and the Board is asking that anyone with complaints or problems if they would pick up an informational form and return it to the Town Clerk. The Board will then sit with the Engineer and Attorney to the Town and review the problems to see if there are any methods whereby adjustments, or whatever, can be made for the future. Mr. Diehl then opened the meeting to the floor advising that each person speaking would be limited to five minutes to state their problems or their objections. Dr. John MacDonald was recognized, and read from a prepared statement (a copy of which was given the Town Clerk and filed with "Grievance Complaints" on Assessments for the Sewer and Water Improvement Areas). The text of Dr. MacDonald's statement was basically his beliefs regarding what he considers poor advise given the Town Board by its hired"professionals, and several grievous mistakes they have made. His grievance also centered around the absolute inability at this point in time to even forsee utilizing the public sewer and he Wwants off" the sewer tax roll, he states he doesn't need it, he doesn't want it, and he wants the sewer improvement drawn around his property, excluding it as was done with Councilmen Jensen and Clausen properties. Frank Presti, Fenmore Drive, commenting first that, unfortuneately we are people, on our street, that are in dire need of water and sewer, and they had a list of questions they would like answers to. The first question was what is the schedule for installation for Fenmore and Cady. Mr. Lapar answered that the contract had been let for both Fenmore and Cady. It is projected that they kw should be able to tie in both sewer and water by October or November this year. The second question was is everyone in the water and sewer district #1 paying the same amount this time for the water and sewer system, if not, why not. It was answered all are paying the same, per unit. The last questions were which way will the lines be laid, and, if we're paying taxes, paying the rate, and we don't get hooked up this fall, and some- body has domestic troubles, the well y gives out or septic gives out, who is responsible? Mr. Lapar said the only answer he could give right now was is that there is a penalty clause in the con- tract, and the only thing the Town Board can possibly invoke is that penalty clause. Mr. Presti also presented a petition with the Board signed by 50 residents of Fenmore and Cady objecting to the assessment for Central Water and Sewer District #1 before services are available (petition filed along with the Grievance Complaints). Patrick Cunningham, Fenmore Drive, stated he had heard rumors that Fenmore Drive was being skipped over to go to Lake Oniad because they were in trouble. Mr. Lapar stated this was not true. Mary Townsend asked if some people are already hooked in to the Sewer and Water in other areas, and if they paid for it like we are before they got the use of it? Mr. Rappleyea answered that this was the first year for everyone to pay a Benefit Assessment, however, if they are hooked in they pay additional O&M charges for the use, which those who are not hooked in do not pay. Kenneth Prince, Dose Road, asked first if it was correct that this Sewer Improvement was not funded by any Federal or State funds. Mr. Diehl answered that was correct. Mr. Prince then asked if there were Federal or State Aid, would he still be paying the $46.24. Mr. Rappleyea replied that there was no Federal aid for the water. Another question was what would his charges be if he chose not to Benefit Charge. hook up to the water. The reply was, only the He also asked what impact does the suit that the Board of Education have on him as a taxpayer, in this District. It was noted that the suit was still in court, and Mr. Jensen com- mented that the School Board had requested the Town Board that when the SewerDistrict was created they would like to get in it because they were having problems getting rid of their sewage. Ed Sailes, Fox Hill Road, asked why is the formula used for the Benefit Assessments equitable. Mr. Rappleyea answered. Mr. Sailer submitted a written statement listing his complaints (filed with grievance complaints), further pursued them. He ended his remarks by saying that there would be some land owners that would be bearing an undue burden of taxes next year some of whom might possibly have to sell their property due to the in- abaility to pay. He suggested the whole problem could be solved by putting the whole district on an ad valorum basis. It is now a totally inequitable situation, and should be corrected this year. Mr. Saland attempted to expose the fallacies in Mr. Sailer's remarks, that ad valorum taxation would, in actuality, subsidize his venture. Mr. Versace also vehemently attacked Mr. Sailer's attitude toward the Board, and what they had attempted to do, to schieve an equitable basis for the Benefit Assessments. Mr. and Mrs. Baumler, Yorktown Heights,(owners of 32 acres on Kent and Myers Corners Road), spoke in defense of Mr. Sailer's state- ments. He didn't particularly want the lines to go through his property, and he doesn't particularly care to pay the taxes that are being charged for it. He feels that the people who have a house and are getting the benefit of the sewers should pay, a barren piece of land, no. Mrs. Baumler added she doesn't want sewers and doesn't want to pay for them, but now they have to sell the land. It would have to be sold to developers, and then the Town will be in a worse mess. 1 45. Carl Kaufman, Fenmore Drive, asked questions on the contracts, for installation and pipe line size, and how priorities were established as to what sections go in first. Supervisor Diehl called a recess at 9:32 P.M. Supervisor Diehl called the meeting back to order at 10:29 P.M. All Board members were again present. The Board then proceeded with the normal order of business on the Agenda. Bids had been sought for girls, boys and mens baseball equipment by the Recreation Commission for the 1975 program. One bid had been received and opened on January 6, 1975. The one bid re- ceived was from Letterii Sporting Goods, in the amount of $4,107.40. The Recreation Commission recommended acceptance of this bid. MR. SALAND moved to accept the recommendation of the Recreation Commission, and award the bid for baseball equipment to Letterii Sporting Goods for a total bid of $4,107.40. Seconded by Mr. Jensen. Roll Call Vote: Councilman Clausen Aye Councilman Jensen Aye Councilman Saland Aye Councilman Versace Nay Supervisor Diehl Aye Mary Schmalz, being recognized by the Chair, critized the sole bid, and commented that last year she had gone around to various sporting goods stores at the time the Town was seeking these bids and they had told her they considered it a waste of time to bid for baseball equipment because Letterii was the Little League representative in this area, arid all the Towns were going to buy from him, they also believed there was a direct conflict here. They were not going to take time to put in bids. Mr. Diehl com- mented that past performances of this Board has always been to 4 accept the lowest responsible bid, those statements are not true statements of the Board. The Board can do no more than attempt to get bids, they can't physically force anyone to put in a bid. The Town had sought and received two bids for #2 fuel oil, Vince's Oil Service at .343 per gallon and Bottini at .339 per gallon. The Highway Superintendent recommended the contract be awarded to Vinces Oil Service due to the fact that although Bottini was the apparent low bidder, Bottini's fuel Oil Corp. bid contained the statement that "this price is based upon a .03 discount off the posted listed price and will be adjusted in accordance with any change in the posted listed price. The current posted listed price is .369 per gallon", which in the Superintendent's estimation wpzxdx +amackaxktmExmax*xictstxmxuxale ixexixwataxxammexadxxacxm*exkxx would indicate that each time a delivery was received, a check would have to be made with the posted listed price, whereas the bid from Vinces contained the statement that "quoted price of oil is subject to increase or decrease, according to economic stabilization program", and it was further noted that service to the Town buildings over several year period had established an allocation of #2 oil which would guarantee fuel oil as required for the period of the bid. (This latter statement had been verbal at the time of submission of bids. It was requested this be placed in writing and filed with the bid). It was also noted that there was a difference in service contracts. MR. CLAUSEN moved to accept the Highway Superintendent's recom- mendation and award the bid to Vinces Oil Service for #2 fuel oil, conditioned upon a written statement guaranteeing that a percentage of his allotment will be for fuel consumption used by the Town of Wappinger buildings. Seconded by Mr. Jensen. Motion Unanimously Carried There were no bids received for gasoline for the Highway Department but the following letter was received from Agway. Mr. Jensen commented that the Town Board has also requested this information from Mr. Lapar, and he believes most of it, if not all of it, has already been compiled. MR. JENSEN moved that Rudolph Lapar be directed to furnish the requested time tables to the Planning Board with copy to the Town Board. Seconded by Mr. Saland. Motion Unanimously Carried The following letter was received: January 16, 1975 Town Board Mill Street Wappingers Falls, N.Y. Gentlemen: The Recreation Commission would like to know what your intent is for the usage of the Valley View Farms buffer area. The Commission feels that the area would be excellent for nature study trails. Sincerely yours, s/ Hugh J. Maurer, Chairman MR. JENSEN moved to inform the Recreation Commission that the reason for the buffer area was to reserve it as a buffer, and to have no other use. Recreation land has been set aside in Valley View Farms, the buffer zones were meant to be used as buffers. Seconded by Mr. Saland. Motion Unanimously Carried A letter was received from Jon Gromyko, 13 Vorndran Drive, indicating that he was interested in purchasing some land between the end of his property and the gas line. This land is owned by the Town for recreation. He would like to fill it in and 55. plant grass seed which he believes would remove an eyesore, and give his family more room to play sports. He goes on further to request a low purchasepriceor permanent permission to use it. Supervisor -Diehl commented that the request had been discussed with the Attorney, and it was indicated that it would be unwise to entertain any such proposition. Mr. Jensen added that it has been deeded as recreation land and it would take an act of Legislature to change the use. MR. Motion Unanimously Carried A speed limit request had been submitted to the New York State Department of Transportation involving the Wildwood Development, and upon review of the request, the Department of Transportation recommended including the Quiet Acres Area. A 30 MPH speed limit in the Wildwood-Quiet Acres Area, described as: beginning at the intersection of the westerly right-of-way line of St. Nicholas Road with the southerly right-of-way line of New Hacken- sack Road, C.R. 104, thence southerly along the westerly right- of-way line of St. Nicholas Road to its intersection with the southerly right-of-way line of Widmer Road; thence north easterly along the southeasterly R.O.W. line of Widmer Road to its inter- section with the westerly R.O.W. line of All Angels Road, C.R. 94; thence southerly along the westerly R.O.W. line of All Angels Road to its intersection with the northerwesterly R.O.W. line of Myers Corners Road, C.R. 93; thence south westerly along the northwesterly R.O.W. line of Myers Corners Road to its intersec- tion with the Wappingers Falls Village line; thence northerly and westerly along the Village line to the center of the Wappinger Creek; thence north easterly along the center line of Wappinger Creek to the southwesterly R.O.W. line of White Bridge Road; thence along the westerly R.O.W. line of White Bridge Road to its intersection with the southerly R.O.W. line of New Hackensack Road; thence northeasterly along the southerly R.O.W. line of New Hackensack Road to the point of beginning. Mr. Saland pointed out the error in the designated roads ex- cluded from the restricted speed limit area - that being Widmer Road. Widmer is a Town Road, not a County Road. He recommended this be brought to the attention of the Department of Transporta- tion. MR. SALAND moved to concur in the recommendation of the New York State Department of Transportation in that the Quiet Acres Area be included in the request submitted for Wildwood Area, to said Department of Transportation, therefore, pursuant to Section 1622.2 of the Vehicle and Traffic Law, the Town Board of the Town of Wappinger requests an area speed restriction be estab- lished within the Wildwood-Quiet Acres area; and further, that Widmer Road be correctly identified as a Town Road. Gentlemen: On behalf of the Rockingham Farms Homeowners' Association, 5 • I would like to formally request permission to erect a sign (approximately 3' x 5') to an existing, free-standing, structure on the corner of All Angels Road and Carroll Drive in the Town of Wappinger. Presently, the corner property is owned by Schoonmaker Homes, Inc. Mr. Steinberg, President of Schoonmaker Homes, Inc. has agreed to permit us to erect such a sign. However, he indicated that the property will be deeded to the Town in the near future and suggested that we receive your approval. The design has not been formulated, to date, but will be pro- fessionally made by a local sign company indicating simply, the name of the development and possibly illuminated by Central Hudson. The applicants have requested to be allowed partial payment in the form of $200.00 per lot as build- ing permits are requested. Att: Mr. Joseph Paggi, Engineer 90 East Main Street Wappingers Falls, N.Y. 12590 Re: Your letter dated January 31, 1975 (Wappinger Sewer Improvement Contract #1) Dear Mr. Paggi, This letter is in response to the complaint of Mrs. Edith Barbara of 93 Ardmore Drive. On July 13, 1974, my forman was notified by my office at mid -night to investigate a report by a resident on Orchard Drive that a water main was broken and surging water on their property. Upon arriving at the loc ation, the town water and sewer representative was also there. The main, however, was not broken. It was actually a spur line for future development which had been capped when this area was being constructed. The valve for this line had evidently been left open and the force of the water blew the end cap on this line. This in turn caused a surge of silt, mud & sediment in the main which caused clogging of water systems in some homes. The representative from the Town water and sewer was in agreement with my forman that this was no fault of ours. I am quite sure that he will verify this fact. Considering the above, we believe that we are under no obligation to the aforementioned party. Mr. Diehl, commenting on the Barbara complaint and subsequent correspondence, recommended that the Engineer to the Town, make a determination, and forward a recommendation to the Town Board. Under Committee Reports, Mr. Clausen indicated a letter had been received from Morton Siegel in reference to the office space for the Town Justices. Mr. Rappleyea commented that Mr. Lapar and Mr. Siegel will have to get together to draw Specifi- cations for the renovation. Mr. Saland suggested any action that may be taken with these prospective landlords be provided in writing including any specs, that may be part of the agreement, such specs as would be satisfactory to the Justices, since they will be the ones using those particular quarters. He would like to see Mr. Lapar contact both Judge Bulger and Judge Francese to see what they want incorporated with that structure. MR. SALAND moved that Mr. Lapar be authorized to confer with the respective Justices for the purposes of tentative prospective specifications - those specifications being mutually satisfactory be incorporated into any lease agreement we may enter with the landlords. Seconded by Mr. Jensen. Motion Unanimously Carried Mr. Rappleyea reported that the Town has had closings on the Wildwood Sewer System and Tall Trees Water System. The Town is now operating those two systems. Mr. Clausen mentioned that David Harvatin, 16 Cider Mill Loop, had spoken to him about a drainage problem where water is coming from the neighbors property crossing the road and on to his driveway causing icing conditons. It seems there is a catch basin in the vicinity but it appears to be at the wrong angle to carry away the water. He asked Mr. Horton if he would check out the situation. to Mr. Jensen reported/the Lighting Committee that it had come to his attention that there used to be a street light at the inter- section of Old State and Old River Roads, and it is no longer there. He was wondering if someone could check out whether that was in the Lighting District, if not, perhaps a light should be put there. Mr. Clausen indicated he would check it out. Supervisor Diehl called for a recess at 11:15 P.M. Supervisor Diehl called the meeting back to order at 12:25 P.M. All Board members again present. Mr. Clausen explained to the audience that the recess was taken to discuss a proposition before the Town Board to see if the Board couldn't resolve it this evening. The following resolution was offered by SUPERVISOR DIEHL who moved its adoption: WHEREAS, two years have passed since the Paris Peace Treaty of January 27, 1973. WHEREAS, the accounting, as outlined in this legal docu- ment, of American servicemen in Southeast Asia has not been accomplished, WHEREAS, our Government hasinformation that servicemen who were alive and captured were not returned, BE IT RESOLVED that the Town of Wappinger strongly urges that the U.S. Government vigourously and immediately extend their efforts to account for these servicemen:and to return home all still being held in captivity. DIEHL moved that a letter of intent be sent to Mrs. Lou Glass of the County Agency that the Town of Wappinger will participate in the "Dial -a -Ride" program not to exceed an expenditure of $7,000.00 per year. Seconded by Mr. Clausen. Motion Unanimously Carried Mr. Jensen enlarged briefly that this would be for the Senior Citizens in the Town of Wappinger which will provide a bus service on a once or twice a week basis on call. It will be headed up through the Department of the Aging, Mrs. Lou Glass's department. Mr. Diehl indicated there was a second request in from Lou Glass also, requesting an amount of $2,000, which is 50% refundable to the Town by the State, to continue with the Drop in center program for Senior Citizens held at the KofC building in the Village of Wappingers Falls. Diehl, Supervisor Town of Wappinger Mill Street Wappingers Falls New York - 12590 Dear Mr. Diehl, Our Agency hopes that the Town of Wappinger will want to join with the Village of Wappingers Falls, the Wappingers School District, and the United Way in supporting our Wappingers Falls Senior Citizens Drop-in Center. As you know the Wappingers Falls Senior Citizens Drop-in Center opened on April 1, 1974 at the Knights of Columbus Hall. This was made possible by a generous gift from the Wappingers Falls Kiwanis Club, and committments from the United Way, the School District, and the Knights of Columbus members who provide the meeting place at no cost. Since that date the Village has also agreed to help support the center. The receiption that the center has received from Senior Citizens is amazing to us ---comparing that with our experience in other communities. After only 10 months of operation, the center has 145 members. Of course not all members come every week ---they get sick, the weather is sometimes bad etc. Never - the less our average attendance for the center's first 40 weeks of operation is 59 members. Why do we need more money? Well it's costing at the rate of $6,000ra year to maintain the center. Of that, the school district is picking up $1,750, annually, and the village is paying $500. In 1974 we also received a one-time contri- bution of $1,500 from the Kiwanis Club and $300 from the County Office for Aging for the Wappinger center. Clearly this leaves a considerable deficit ---which has traditionally been picked up by the United Way. However, this year we are getting only 2/3 of the amount we feel we need from the United Way. Our choice is either to cut programs and services, or to find other sources of funds. So we come to you. The enclosed brochure outlines the State Office for Aging's matching fund program for Recreation for the Elderly. CLAUSEN moved that the Town Board advise the Town of Wappinger Recreation Commission that a sum of $2,000 will be appropriated for the Commission to work in conjunction with the County Office for the Aging in developing a program for the Senior Citizens in Wappinger. Rae, Sr., an accountant has been inter- viewed and found to be acceptable for said position, NOW, THEREFORE, BE IT RESOLVED, that this Town Board does hereby establish the Office of Town Comptroller for the Town of Wappinger and it is further RESOLVED, that the Town Board appoint Charles R. Rae, Sr., for a period dating from the 3rd day of March 1975, until the first day of January 1976. Thereafter the Town Board shall appoint a comptroller who shall hold the office for a term of two years pursuant to Section 20, Subdivision 3 (b) of Town Law, and it is further RESOLVED, that the salary for Charles R. Motion Unanimously Carried Mr. Jensen commented that this was similar to a proposition he and Mr. Saland made about a year or so ago, and he feels it's about time the Board invoke the quarterly payment. Seconded by: Councilman Clausen Roll Call Vote: 5 Ayes 0 Nays A letter was received from William Paulus, Vice President of the Hudson Valley Federal Savings and Loan Association, Kingston, New York, requesting permission to open a temporary savings and loan facility, permitting them to conduct business prior to the establishment of a permanent facility. Mr. Diehl directed this matter be tabled due to the fact that it is anticipated the moratoriunwill be over in a short period of time and no apparent emergency does exist as presented to the Beard by this Savings and Loan Association. A proposal was received from Robert G. Ruit for cleaning services in the various Town Offices. He submitted a price of $300.00 per month which included the Town Hall Building, Justice Court and office, and the Assessors Office, and also including snow removal Erom the sidewalk in front of the Town Hall when necessary. The price of $125 per month will remain the same for the cleaning and waxd.ng of the floors and window cleaning. MR. CLAUSEN moved to accept the proposal submitted by Robert G. Ruit, at $300.00 per month for Janitorial Services for all the Town Offices, and continuing the $125.00 per month for floors and windows. Seconded by Mr. Versace. Motion Unanimously Carried An answer was received from John Steinberg, President Schoon- maker Homes Inc. in regard to the Recreation Area in the Schoon- maker (Rockingham Farms) Developemnt. He indicated, among other things, that they will honor their verbal commitment to perform such additional regrading as is necessary to eliminate the major ponding, but it is his opinion that the Town's request for $5,000 is really quite unreasonable, so, that their only alternative is to perform the work themselves as soon as weather permits in early spring. Mr. Jensen indicated that he had spoken to Mr. Steinberg about this recreation land. In response to the letter from the Town, Mr. Steinberg said he has an alternate number he is willing to offer the Town to relieve them of the responsibility of finishing said recreation site. In this way the Town could take it over and finish the job. No doubt by next Town Board meeting some- thing will have been received in writing firming up a price which the Recreation can use to fix up the recreation area, and upon which the Town can take action on. MR. JENSEN moved to direct the Attorney to the Town to prepare a Resolution for Acceptance of Cash $2,500, in lieu of Schoonmaker doing the complete job on the recreation site. Seconded by Mr. Clausen. Motion Unanimously Carried A Deed for recreation land in the Thornacres Development (off Chelsea Road) was received, along with letters of recommendation for acceptance from the Planning Board, the Engineer to the Town and the Recreation Commission. (Acceptances by the Town Board, of Recreation Deed, one of the conditions of Planning Board approval) MR. CLAUSEN moved to accept the deed for Recreation Land in the Thornacres Development for Tann Recreation conditioned on the review and approval of said Deed by the Attorney and Engineer to 7' 7 . the Town. Seconded by Mr.% Jensen. Motion Unanimously Carried Mr. Versace commented that the Board had received a request from Nancy Moreau, member of the Town of Wappinger Conservation Advisory Council, for the use of some space on the third floor of the Town Hall Building for water testing facilities. Mr. Jensen inquired as to whether chemicals would be used in connection with this testing and Mr. Versace replied yes, but not of a dangerous nature. Mr. Lapar suggested the use of the third floor be investigated to check the exposure to the Town. Mr. Diehl suggested a check be made with the underwriters and the insurance company first. MR. VERSACE moved to grant permission to the Town of Wappinger Conservation Advisory Council to utilize a portion of the third floor of the Town Hall Building for a laboratory, contingent upon approval by the underwriters and insurance company. Seconded by Mr. Clausen. Motion Unanimously Carried Reverting back to unfinished business, Mr. Clausen commented that the Board had asked Mr. Lapar to come in with an updated report on what it would cost Wappinger Park to do a portion of 6 their drainage. Mr. Lapar indicated that he had not gotten this report completed. Mr. Clausen asked if this report could be submitted for the next Town Board meeting. The following Resolution was introduced by COUNCILMAN CLAUSEN who moved its adoption: WHEREAS, the Town Planning Board has previously made a request to the Town Board asking that the development known as Cranberry Hills be developed in accord with Section 281 of the Town Law to provide for more open space, now therefore be it RESOLVED: 1. That the Town Planning Board is hereby granted the authority pursuant to Section 281 of the Town Law to review and grant sub- division approval to the development known as'Cranberry Hills in accordance with the provisions of Section 281 of the Town Law subject to the following conditions in addition to the conditions imposed by Section 281. A. That a parcel of land of at least 20 acres be dedicated to the Wappinger Central School District. B. That a parcel of land of at least 5 acres be dedicated to the Town for its general purposes. C. That the Town Planning Board make appropriate provisions for recreation lands in accord with Town subdivision regulations but that said recreation lands include; (1) At least 8 tennis courts constructed in the same general manner as those in Martz Field. (2) In the event Town Houses are constructed: separate recreation areas maintained by the Town House owners organized in the form of a not for profit corporation of which each owner shall be a member. D. That the development shall be in single family dwelling units with each unit being in single separate ownership. E. That any lands shown on the map as open space shall: (1) Be left in its natural state and not disturbed during or after construction and the Planning Board shall make appropriate conditions to insure this provision. (2) Be dedicated to a not for profit corporation of which each property owner shall be a member and the deed to which shall contain a provision that said lands be forever wild. That said articles of incorporation shall further provide that the lands be kept open and forever wild and main- tained free and clean of debris junk or other obnoxious material. F. That a road be constructed from Widmer Road to Myers Corners Road with a 60 foot right of way. G. That the Planning Board make appropriate conditions for staging so that a proper mix is created in proportion to the particular types of units which may be approved. H. That no main roads shall have driveways exiting there- upon. I. That only the lands dedicated to roads be excluded for any density computation under Section 281 of the Town Law. J. That the restrictions set forth on a map known as Cranberry Hills Scheme A. and having been amended in red and initialed by the Town Clerk this date shall be binding upon the Planning Board.
