1975-01-02 ReorgThe Reorganizational Meeting of the Town Board of the Town of Wappinger was held on January 2, 1975 at 4:00 P.M. at the Town Hall, Mill Street, Wappingers Falls, New York. Present: Louis Clausen, Deputy Supervisor Leif Jensen, Councilman Stephen Saland, Councilman Frank Versace, Councilman Elaine H. Snowden, Town Clerk Absent: Louis Diehl, Supervisor Others Present: William Horton, Superintendent of Highways Allan Rappleyea, Attorney to the Town Deputy Supervisor Clausen called the meeting.to order at 4:22 P.M. Upon calling the meeting to order Deputy Supervisor Clausen noted the fact that Supervisor Diehl was absent due to the fact that one of his daughters was severely ill and he was at the hospital with her. TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK APPOINTING PERSONNEL TO VARIOUS TOWN OFFICES AND POSITIONS OF EMPLOYMENT. The following resolution was offered by Councilman Saland who moved its adoption: RESOLVED, that the following persons be and they hereby are appointed to the following offices and positions of employ with the Town of Wappinger to serve in such capacity throughout the year 1975, unless their services shall be sooner terminated at the pleasure of the Supervisor: Name Office John Doyle William Egan Supervisor's Bookkeeper Supervisor's Confidential Secretary AND IT IS FURTHER RESOLVED, that the salaries otherwide fixed for the above designated offices and positions shall be paid to the holders of such offices and positions, payable every other Friday throughout the year 1975, with 26 pay periods during such year, with the first payday to be January 3, 1975. Seconded by: Councilman Saland Roll Call Vote: Councilman Clausen Aye Councilman Jensen Aye Councilman Saland Aye Councilman Versace Aye Supervisor Diehl Absent TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK ESTABLISHING THE PAY SCALE FOR CERTAIN EMPLOYEES OF THE TOWN OF WAPPINGER HIGHWAY DEPARTMENT The following resolution was offered by Councilman Versace who moved its adoption: RESOLVED, that the pay scale for the following categories of employees hired by the Town of Wappinger Highway Department be and the same hereby is fixed and established at the following minimum to maximum hourly rates: Heavy Operator Light Operator Laborer Foreman AND BE IT FURTHER $4.76 to $4.95 per hour 4.71to $4.80 per hour 3.49 to 4.68 per hour 5.28 per hour RESOLVED, that all of such Highway Department employees engaged on an hourly basis shall be paid every other Friday throughout the year 1975, with the first payday to be on Friday, January 3, 1975. AND BE IT FURTHER RESOLVED, that such Highway Department Employees shall be compensated for any hours worked over and above 40 hours per week at the rate of time and one half for overtime. Seconded by: Councilman Saland Roll Call Vote: Councilman Clausen Aye Councilman Jensen Aye Councilman Saland Aye Councilman Versace Aye Supervisor Diehl Absent TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK DESIGNATING OFFICIAL NEWSPAPER OF THE TOWN OF WAPPINGER The following resolution was offered by Councilman Saland who moved its adoption: RESOLVED, that the W&SD News, a newspaper regularly published in the Town of Wappinger, Dutchess County, New York, and having a general circulation in this Town, and being a newspaper entered as second class mail matter, be and the same hereby is designated as the official paper of this Town, and it is further RESOLVED, that the Poughkeepsie Journal and the Evening News, newspapers published in the County of Dutchess and having general circulation therein, be and they hereby are designated as additional newspapers for the publication of Town notices, subject to the limitations of Section 64, Subdivision II of the Town Law of the State of New York, and it is further RESOLVED, that the Town Clerk be and she hereby is authorized and directed to give notice of such designation to the publishers of such newspapers. Wappingers Branch, a general insurance agency doing business in the Town of Wappinger, Dutchess County, New York, be and it hereby is designated as the insurance agent for this town. Seconded by: Councilman Saland Roll Call Vote: Councilman Clausen Aye Councilman Jensen Aye Councilman Saland Aye Councilman Versace Aye Supervisor Diehl Absent TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK AUTHORIZING THE SUBMISSION OF THE SUPERVISOR'S ANNUAL FINANCIAL REPORT TO THE STATE COMPTROLLER The following resolution was offered by Councilman Saland who moved its adoption: • WHEREAS, Subdivision 10 of Section 29 of the Town Law requires that the Supervisor of each Town prepare and file with the Town Clerk within 30 days after the expiration of each fiscal year, an annual financial report accounting for all monies received and disbursed by him, together with the certificates or certificate of the bank or trust company where Town monies are deposited, showing the amount of such monies on deposit with said bank or trust company, and cause a certified copy of such report to be published in the official newspaper. WHEREAS, in lieu of preparing the report required by Sub- division 10 of Section 29 of the Town Law, the Town Board may determine, by resolution, that the Supervisor shall submit to the Town Clerk within 60 days after the close of the fiscal year, a copy of the report to the State Comptroller required by Section 30 of the General Municipal Law and the Town Clerk shall cause a summary of such report to be published within 10 days after receipt thereof in a form approved by the State Comptroller in the official newspaper. NOW, THEREFORE IT IS HEREBY RESOLVED, that in lieu of preparing the report required by Subdivision 10 of Section 29 of the Town Law, the Supervisor shall submit to the Town Clerk within 60 days after the close of the fiscal year, a copy of the report to the State Comptroller required by Section 30 of the General Municipal Law and that the Town Clerk shall cause a summary of such report to be published within 10 days after receipt thereof in a form approved by the State Comptroller in the official newspaper. Seconded by: Councilman Versace Roll Call Vote: Councilman Clausen Aye Councilman Jensen Aye Councilman Saland Aye Councilman Versace Aye Supervisor Diehl Absent TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK ESTABLISHING THE AMOUNT OF UNDERTAKINGS TO BE FURNISHED BY OFFICERS AND EMPLOYEES OF THE TOWN OF WAPPINGER The following resolution was offered by Councilman Saland who moved its adoption: RESOLVED, that all of the official bonds and undertakings by the officers, clerks or employees of the Town of Wappinger may be in the form of a blanket undertaking from any duly authorized corporate surety and said undertaking shall indem- nify the Town of Wappinger against the loss of the type more particularly set forth in SECTION II of Public Officers Law. SALAND moved to table Items #4 and #5 and the appointment of the Chairman of the Planning Board in Item #6. Seconded by Councilman Versace kie Roll Call Vote: 4 Ayes 0 Nays Upon the presentation of the matter of the vacancy on the Board of Assessment Review, Mr. Saland made the statement that in light of the fact that we are missing Mr. Diehl, whose attendace invoked would probably be of great interest and perhaps critical on several of these appointments, the Board has agreed to table #4, #5 and the question of the appointment of the Chairman of the Planning Board. MR. SALAND moved to table the appointment of a member to the Board of Assessment Review (Item #4), the vacancy on the Planning Board (Item #5) and Chairman of the Planning Board for the year 1975 (Part of Item #6). Seconded by Mr. Versace Roll Call Vote: 4 Ayes 0 Nays MR. SALAND moved that Nicholas Johnson be appointed as the Chairman of the Zoning Board of Appeals for the year 1975. Seconded by Mr. Jensen. Roll Call Vote: 4Ayes 0 Nays MR. JENSEN moved that Hugh J. Maurer be appointed as the Chairman of the Recreation Commission for the year 1975. Seconded by Mr. Saland. Roll Call Vote: 4 Ayes 0 Nays MR. VERSACE moved that the mileage compensation for all legitimate mileage expanditures be maintained at 12 per mile. Seconded by Mr. Saland. Roll Call Vote: 4 Ayes 0 Nays A request was received from Thomas Logan, Assessor for per- mission to attend the New York State Assessors Convention in Rochester, New York from January 12, 1975 to January 15, 1975 - as provided by Section 210 of the Real Property Law. MR. SALAND moved that Mr. Logan be granted permission to attend the New York State Assessor's Convention in Rochester, New York, January 12 through January 15th, 1975, and that his legitimate expenses be a Town charge. Seconded by Mr. Jensen Roll Call Vote: 4 Ayes 0 Nays Deputy Supervisor Clausen called a recess at 4:46 P.M. Deputy Supervisor Clausen called the meeting back to order at 5:14 P.M. All Board members again present with the exception of Supervisor Diehl. The following resolution was introduced by COUNCILMAN VERSACE; who moved its adoption: WHEREAS, the Town Board did adopt an Ordinance on September 19th, 1974, regarding the withholding of site plan approvals and subdivision plats by the Town Planning Board and WHEREAS, the Town Board, the Town Planning Board and Zoning Advisory Commission are in the process of reviewing and studying the new Zoning Ordinance, NOW, THEREFORE BE IT ORDAINED as follows: 1. That the Ordinance adopted by the Town Board on September 19th, 1974, be affirmed and continued for an additional 60 days beyond its effective date so as to provide the Town Board and the Town Planning Board additional time to prepare a new comprehensive Zoning Ordinance. Said Ordinance providing for said moratorium is more fully set forth at pages 313 and 314 of the minute book of the Town Clerk for the period commencing June 10th, 1974 reference to which is hereby made. 2. This Ordinance shall take effect immediately upon posting and publication as provided by Town Law. Seconded by: Councilman Jensen MR. VERSACE moved that a Public Hearing be held on January 15, 1975, at 7:30 P.M. at the Town Hall, Mill Street, Wappingers Falls, New York on the matter of an extension of the Building Moratorium in the Town of Wappinger, at which time all interested persons will be heard.
