377 A Special Meeting aE the Town Board of the Town of Wappinger was held on Monday, November 18, 1974 at the Town Hall, Mill Street, Wappingers Falls, New York. Notice of said meeting was mailed to each Board member on November 14, 1974, calling the meeting for 7:30 P.M. November 18, 1974, for the purpose of considering the problem of Schoon- maker Development on Spook Hill Road, and any other business that may properly come before the Board. Supervisor Diehl called the meeting to order at 9:39 P.M. Present: Louis Diehl, Supervisor Louis Clausen, Councilman Leif Jensen, Councilman Stephen Saland, Councilman Frank Versace, Councilman Elaine Snowden, Town Clerk Others Present: Jon H. Adams, Attorney with Corbally, Gartland & Rappleyea Rudolph Lapar, Engineer to the Town The following Resolution was introduced by COUNCILMAN SALAND, who moved its adoption: WHEREAS, the Town of Wappinger is the present owner of the Oakwood Knolls Sewer Treatment Plant, and WHEREAS, because of operating difficulties, the Town has instituted a program to correct the deficiencies of the said treatment plant, and WHEREAS, pending the completion of said corrective work, said plant is able to absorb new sewage only at a limited rate, and WHEREAS, said sewage plant serves the area known as Wappinger Sewer Improvement District No. 1 and is the only facility for treatment of sewage discharged in said area, and WHEREAS, the developers of commonly known Spook Hill Estates and Pond View subdivisions are desirous of constructing additional homes in said subdivisions, and said homes must discharge their sewage and waste waters into the sewage system served by the said Oakwood plant to obtain certificates of occupancy, and WHEREAS, at a meeting between representatives of the Town and the Dutchess County Board of Health on October 17th, 1974, procedures were agreed upon to pemmit the issuance of 23 certifi- cates of occupancy and 5.3 sewer connections, including those for 87 U the aforesaid 23 certificates of occupancy while the deficiencies of the Oakwood Knolls sewage plant are being corrected, and WHEREAS, the Dutchess County Board of Health has requested that a Resolution be duly adoptdd by the Town implementing and binding its officials to said understanding. NOW, THEREFORE, on the motion of Councilman Saland, seconded by Councilman Versace BE IT RESOLVED that Until further agtion-Of this Board, all building permits issued for signle family residences in the area known as Wappingers Sewer Improvement District No. 1, be issued in the manner prescribed herein, and BE IT FURTHER RESOLVED that building permits for the areas described in the preceding paragraph be issued only subsequent to the approval of the issuance of the same by the Dutchess County Board of Health and the Building Inspector of the Town of Wappinger, and BE IT FURTHER RESOLVED that no more than 53 sewer connec- tions shall be approved in the area affected by this Resolution, the same to be allocated as follows: Schoonmaker Homes, Inc. 22 for homes for which building permits have been issued to date, one (1) for Exquisite Homes for the residence occupied by McKay, the balance of thirty to be allocated from time to time as deter- mined by the Town Board, and BE IT FURTHER RESOLVED that no further building permits for homes requiring sewer connection shall be issued for the affected area subsequent to this Resolution unless sewer connections have been allocated by the Town Board, and BE IT FURTHER RESOLVED that all requests for building per- mits subsequent to date of this Resolution in the subdivisions known as "Spook Hill" and "Pond View" be forwarded to the Dutchess County Board of Health after approval by the Town of Wappinger Building Inspector in groups of ten (10) permits only, and that no subsequent groups of permits shall be forwarded until the prior approval of the preceding permits, and BE IT FURTHER RESOLVED that all other building permits in the affected area be forwarded individually to the Dutchess County Board of Health after prior approval of the permits by the Building Inspector of the Town of Wappinger, and BE IT FURTHER RESOLVED that the issuance of certificates of occupancy shall be accomplished in the same manner as des- cribed heretofore for building permits, unless waived by the Board of Health of Dutchess County to the extent their approval be required, and BE IT FURTHER RESOLVED that no building permit or certificate of occupancy shall be valid in the affected area subsequent to this Resolution unless bearing signatures both of the Town Building Inspector and an authorized representative of the Board of Health, and 379 BE IT FURTHER RESOLVED that upon approval of this Resolution, and the acceptance of the same by the Dutchess County Board of Health, approval for certificates of occupancy shall be granted immediately to all those homes in the affected area for which building permits were issued prior to September 17th, 1974, if said homes shall have otherwise complied with all statutes, regulations and ordinances, and otherwise, qualify for issuance of the same, and L BE IT FURTHER RESOLVED that the Building Inspector of the Town of Wappinger, or the Town Engineer, shall immediately pro- vide the Dutchess County Board of Health with a list of each home in the affected area having a sewer connection to the sewer system serviced by the said Oakwood Knolls Sewer Treatment Plant, and shall additionally inform said agency of any subsequent time connections as they are made, and BE IT FURTHER RESOLVED that the regulations set forth by this Resolution shall be construed with and shall be subject to the provisions of a simultaneous Resolution relative to water supply in the same affected area, and BE IT FURTHER RESOLVED that the provisions of this Resolution shall be effective immediately. Seconded by Mr. Versace Roll Call Vote: Louis Clausen Aye Leif Jensen Aye Stephen Saland Aye Frank Versace Aye Louis Diehl Aye Resolution Duly Adopted The following Resolution was introduced by COUNCILMAN SALAND, who moved its adoption: WHEREAS, Orchard Homes Water System is unable to accomodate additional customers, and WHEREAS, new homes in the Spook Hill Estates Subdivision to obtain certificates of occupancy can only obtain water from the aforedescribed water supply system, and WHEREAS, the developer, Schoonmaker Homes, Inc. will at its own expense provide those improvements necessary to increase the capacity of said water system to serve the aforedescribed homes, and WHEREAS, at meetings between representatives of the Town, Schoonmaker Homes, Inc. andthe Dutchess County Board of Health on October 16th, 1974 and November 6, 1974, procedures were agreed upon to permit the issuance of certificates of occupancy in the area aforedescribed, and 380 WHEREAS, the Dutchess County Board of Health has requested that a Resolution be duly adopted by the Town implementing and binding its officials to said understanding, NOW, THEREFORE, on the motion of Councilman Saland, seconded by Councilman Clausen, BE IT RESOLVED that until further action of this Board, all certificates of occupancy issued for signle familty resi- dences in the area known as Spook Hill Estates be issued in the manner prescribed herein, and BE IT FURTHER RESOLVED that certificates of occupancy for the area described in the preceding paragraph be issued only subsequent to the approval of the issuance of the same by the Dutchess County Board of Health and the Building Inspector of the Town of Wappinger, and BE IT FURTHER RESOLVED that Schoonmaker Homes, Inc. shall provide and install those improvements deemed necessary by the Town Board as set forth in memorandums of Schoonmaker Homes, Inc., dated October 28, (original), October 28, (revision) and November 11 (Memorandum of Record), copies of which are annexed hereto, and BE IT FURTHER RESOLVED that the installation of said improve- ments shall be subject to approval of the Town Board by the Town Engineer and the Board of Health, and certificates of occupancy shall take place only after Schoonmaker Homes has completed the necessary improvements to the said water system as hereinafter provided, and the same have been approved, as provided herein, and BE IT FURTHER RESOLVED that upon approval of the completion of the aforesaid improvements, the following number of certifi- cates of occupancy shall be issued for the following subdivision: Schoonmaker: 22 for Spook Hill Estates Exquisite: 1 for residence of McKay Provided, however, that said certificates of occupancy shall be also approved and endorsed by the Dutchess County Board of Health and the Town Building Inspector, and BE IT FURTHER RESOLVED that no further building permits or certificates of occupancy be issued for homes requiring connec- tion to the Orchard Homes water system until further order of this Board, and BE IT FURTHER RESOLVED that the regulations set forth by this Resolution shall be construed with and shall be subject to the provisions of a simultaneous Resolution relative to sewer supply in the same affected area, and BE IT FURTHER RESOLVED that the provisions of this Resolu- tion shall be effective immediately. Mr. Jensen approached the subject of the Recreation Area in Rockingham I, and indicated to Mr. John Steinberg and Mr. Robert Fields that he was not satisfied with this area, there appeared to be wet areas and puddling. He suggested first, that the Engineer to the Town shoot a line to see if, in fact, the area was up to grade as per the Planning Board approval, and he then could recommend to the Board whether or not it was in presentable condition before the Board acts on acceptance, along with any recommendations as to the puddling. In the discussion of this, Mr. Clausen expressed his thought that this shouldn't be a Town expense. Mr. _Fields- indicated that their Engineer could, if acceptable, take the elevations. MR. JENSEN moved that Schoonmakers' Engineer certify to the ele- vations as they exist in the Recreation Area in Section I of Rockingham Development and submit them to the Town Board and the Engineer to the Town. Seconded by Mr. Clausen. Motion Unanimously Carried Due to the fact that the Poughkeepsie Journal inadvertently failed to publish the notice on the Order of the Establishment of the Town of Wappinger Sewer Improvement Area #II, setting the date for the Public Hearing, the matter was placed before the Board. MR. SALAND moved to reconsider the Order of the Establishment of the Town of Wappinger Sewer Improvement Area #II, designating the date for a Public Hearing. Seconded by Mr. Clausen. Motion Unanimously Carried 3 82 MR. SALAND moved to rescind the Order in the Matter of the Establishment of the Town of Wappinger Sewer Improvement Area #II, in the Town of Wappinger, Dutchess County, New York, pur- suant to Article 12c of the Town Law (adopted November 13, 1974) which called for a public hearing November 27, 1974. Seconded by Mr. Clausen. Motion Unanimously Carried COUNCILMAN SALAND moved the adoption of the following Order in the Matter of the Establishment of the Town of Wappinger on Sewer Improvement Area #II, in the Town of Wappinger, Dutchess County, New York, pursuant to Article 12c of the Town Law, seconded by Councilman Clausen, and upon roll call vote, unani- mously adopted. IN THE MATTER OF THE ESTABLISHMENT OF THE TOWN OF WAPPINGER SEWER IMPROVEMENT AREA NO. II IN THE TOWN OF WAPPINGER, DUTCHESS COUNTY, NEW YORK, PURSUANT TO ARTICLE 12c OF THE TOWN LAW. WHEREAS, a map, plan, and report have been prepared in such manner and in such detail as has heretofore been determined by the Town Board of the Town of Wappinger, relating to the establishment of a proposed Sewer Improvement Area to be known as the Town of Wappinger Sewer Improvement Area No. II, in the Town of Wappinger, Dutchess County, New York, pursuant to Article 12c of the Town Law, and WHEREAS, said map, plan, and report have been duly filed in the Clerk's Office of the Town of Wappinger for public inspection, and WHEREAS, said map, plan, and report were prepared by Hayward and Pakan and Rudolph E. Background Information A) Orchard Homes, Inc. constructed a water company prior to 1970. B) The assets of Orchard Homes, Inc. (hereafter called Orchard Homes water system) were sold to the Town of Wappinger in April or May of 1974 and at that time the Orchard Homes . water system was servicing about 63 homes. In March of 1974 Schoonmaker Homes, Inc. purchased Spook Hill Estates, a subdivision of 80 lots which was approved by the Planning Board on Feburary 25th, 1974. June 1974 the Town issued several building permits to Schoonmaker Homes and by October llth had issued a total of 22 permits. During the summer and in September 1974 the -Town of Wappinger began testing a water main on Spook Hill Road with water from the Orchard Homes water system. C) D) E) F) G) In During September, Schoonmaker Homes completed seven houses on Spook Hill Road, but these homes could not be occupied until the water main was accepted by the Department of Health. During the week ending October 4th, the Board of Health of Dutchess County and the Town of Wappinger received many complaints from the homeowners on the Orchard Homes water system as the result of several random and ,unrelated occurrences which interrupted water service. ,Fage . Meeting about reinforcement of the Orchard Homes Water System H) After these complaints, the Board of Health reviewed the Orchard Homes water system and directed the Town of Wappinger to stop issuing permits and not to issue Certificates of Occupancy for the homes on the new water main on Spook Hill Road which would tie into the Orchard Homes water system. I) This information was communicated, by phone, to Schoonmaker Homes on Thursday, October 10th, 1974 by Rudy LaPar. J) Between October 10th and October 18th, 1974, there were several meetings between Board of Health, Town of Wappinger, and Schoonmaker Officials -- separately and jointly. II. The following items were discussed and, subject to approval by the Town Board of Wappinger, were resolved at the meeting and documented by this memo: A) In the opinion of Town Engineer,Rudloph LaPar, connection of the Hilltop water system to the Orchard Homes water system will be complete no later than November 15, 1975. 8) There are presently 63 homes connected to the Orchard Homes system and Schoonmaker with approval from the Board of Health and the Town of Wappinger would like to connect an additional 50 homes by November 15, 1975, for a total of 113 homes. C) Based on the above information and with the concurrence of the Town of Wappinger Engineer, Rudolph LaPar, the Board of Health, Jack Hill, will permit the connection of the 22 homes for which permits have been issued after the Orchard Homes water system has been reinforced as follows: 1) Install one 20,000 gallon storage tank, 2) Install two transfer pumps which will deliver 250 gallons per minute against a head resistance of 130' of water. 3) Install such pipes, fittings, and valves as are re- quired to connect the storage tank and transfer pumps to the system and to provide for by passing the trans- fer pumps with the well pumps on a manual basis. 0) Schoonmaker Homes would pay for the direct cost of the reinforcement with or without financial assistance from the Town of Wappinger. E) Schoonmaker Homes will request financial assistance from the Town of Wappinger for this reinforcement. F) Schoonmaker Homes would retain the right to salvage the reinforce- ment components once the Hilltop system is connected to the Orchard Homes system. G) The Town of Wappinger would give permission for Schoonmaker Homes to enter onto the property of the Orchard Homes system and perform the modification and related activities described in paragraph II, c above. 0:4; , Page 3 tleeirhg about reinforcement of the Orchard Homes Water System H) The Town of Wappinger will issue Certificates of Occupancy for the houses on which 22 permits have been issued when the Orchard Homes water system has been reinforced and inspected and approved by the Town of Wappinger Engineer, Rudolph War, and the Dutchess County Board of Health,and when the sewer main on Spook Hill Road has been sealed. It is the Town of Wappinger's responsibility to assure that the sewer line is satisfactorily sealed by November 15, 1974. I) No additional permits will be issued until: 1) The plans for the expansion of the Oak Knolls sewer plant are approved by the Department of Health of the State of New York. 2) And, that the Dutchess County Board of Health Administrator, Jack Hill, is satisfied with the quality and quantity of the effluent from the existing Oak Knolls plant and the pace of construction of the Oak Knolls plant expansion. J) A decision by Jack Hill, Dutchess County Department of Health Regional Administrator, as to when and if additional permits will be issued can reasonably be expected by December 1, 1974. K) Based on the proposed reinforcement of the Orchard Homes water system, an additional 26 permits and Certificates of Occupancy will be issued to Schoonmaker Homes and one additional permit and Certificate of Occupancy to one other builder when satisfactory progress on the sewer plant expansion has been achieved. G) The Town of Wappinger will issue Certificates of Occupancy for the houses on which 22 permits have been issued when the Orchard Homes water system has been reinforced and inspected and approved by the Town of Wappinger Engineer, Rudolph LaPar, and the Dutchess County Board of Health, and when the sewer main on Spook Hill Road has been sealed. H) No additional permits will be issued until: 1) The plans for the expansion of the Oak Knolls sewer plant are approved by the Department of Health of the State of New York, 2) The Dutchess County Board of Health Administrator, Jack Hill, is satisfied with the quality and quantity of the effluent from the existing Oak Knolls plant and the pace of construction of the Oak Knolls plant expansion, 3) And the approval of the Town Board of Wappinger has been received. J) Jack Hill will seekapproval to add an additional 53 homes into the Oak Knolls plant. 383 WHEREAS, the maximum amount proposed to be expended for said improvement is $27,613.063.00 and the proposed method of financing to be employed consists of the issuance of serial bonds of said Town pursuant to the Local Finance Law, to mature in annual installments over a period not exceeding forty years, payable in the first instance by assessments levied upon the several lots or parcels of land within the benefited area herein- before described in just proportion to the amount of benefit which the improvements shall confer upon such lots or parcels; and WHEREAS, it is now desired to call a public hearing pursu- 011, ant to Section 209Q, Subdivision 3, of the Town Law; %.0 K t NOW, THEREFORE, IT IS HEREBY ORDERED, by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: Section 1. A meeting of the Town Boardof the Town of Wappinger, Dutchess County, New York, shall be held in the Town Hall, Mill Street, Wappingers Falls, New York, on the 2nd day of December, 1974, at 8:00 P.M., Eastern Standard Tiem, to hold a public hearing on the aforesaid proposed improvements and the plan, report, and map prepared and filed in connection therewith, at which all pegsons interested in the subject thereof may be heard concerning the same, and to take such action thereof as is required or authorized by law. Section 2. The Town Clerk is hereby authorized and directed to give notice of such public hearing by publishing a copy of this Order once in the official newspaper, and by posting a copy hereof upon the bulletinrboard of her office, such publica- tion and posting to be made not less than ten (10) nor more than twenty (20) days before the date set herein for said public hearing. Section 3. ORDERED that the within Order shall supercede the prior Order of this Board dated November 13, 1974, and the Public Hearing of November 27, 1974, shall be held instead on December 2, 1974 at 8:00 P.M. as set forth herein. Section 4. This Order shall take effect immediately. APPENDIX "A." The following Resolution was introduced by COUNCILMAN CLAUSEN, who moved its adoption: .WHEREAS, the Town Board is desirous of implementing a payment schedule for inspection fees due to the Town from George Kazazis, developer of the Pond View subdivision, and WHEREAS, the Town Board is willing to permit said inspec- tion fees to be paid on an installment basis, as hereinafter provided, NOW, THEREFORE, upon the motion of Councilman Clausen, seconded by Councilman Saland, BE IT RESOLVED, that payment of inspection fees to the Town for inspection of sanitary sewer, storm sewer and water lines of the Pond View subdivision shall be made in accordance with the following terms and conditions: One: The developer shall pay to the Town commencing January 1, 1975, the monthly sum of Two Thousand ($2,000.00) dollars, said payments to continue monthly until the sum of Seventeen Thousand ($17,357.63) Dollars is paid in full. Two: In the event that the inspection services of the Town are greater in any month than the said sum of Two Thousand ($2,000.00) Dollars, the developer shall pay to the Town the proportionate value of such additional services, provided, how- ever, that in no event shall monthly payments be less than said sum of Two Thousand ($2,000.00) Dollars.
