The Regular Monthly Meeting of the Town Board of the Town of
Wappinger was held on October 15, 1974 at 8:00 P.M. at the Town
Hall, Mill Street, Wappingers Falls, New York.
Supervisor Diehl called the meeting to order at 8:23 P.M.

Mr. Jensen was absent due to the fact that his father had passed
away. The sympathy of the Board was extended to him and his
family.
The Minutes of the September 3, 1974, September 19, 1974 and
September 27, 1974 Special Meetings and the September 9, 1974
Regular Monthly Meeting, having been previously sent to the Town
Board members, were now placed before them for their approval.
MR. CLAUSEN moved the Minutes of the September 3, September 9,
September 27, 1974 Special Meetings and the September 9, 1974
Regular Monthly Meeting, as submitted by the Town Clerk be and
they are hereby approved.

The Town Clerk made note of the fact that the Tentative Budget
had been filed with her on October 1, 1974 by the Supervisor,
and so noted for the record that copies of the filed Tentative
Budget were mailed to each of the Councilmen on October 1, 1974.
No meeting of the Board had been called between this date and
prior to the 5th of October for the purpose of formally present-
ing the Tentative Budget to the Town Board, now therefore be it
considered as being presented.
A letter was received from Virginia Ferris, Town Historian, pro-
posing that signs noting the Centennial of Wappinger be placed
on the signs at the entrances to the Town. These signs could
replace the signs that were installed when the Senior Little
League won the Championship. Mr. Mills, a member of the Cen-
tennial Committee enlarged on Mrs. Ferris' letter. They hope
to be in before the Board next month with an appropriate logogram
for the Centennial. Mr. Diehl agreed that this would be a great
start.
Charles Cortellino, Chairman of the Town of Wappinger Conservation
Advisory Council, submitted a report on the Fishkill Creek Basin
Water Study - Initial Phase - of the Cooperative Program, which
summarizes a years work. He also indicated two resignations
from the Council had been received, Dr. Engelman and Mrs. Lynn
Bliss. The other matter was a request for funds. There were
still some funds left from the Ford grant, but they would be a
little short for completing further testing, not more than $150
(from each Town) would be needed.

MR. CLAUSEN moved that Mr. Cortellino's request for additional
funds, not to exceed $150.00 be granted.

The Town Clerk informed the Board that she had been served with
Tax Reviews on September 10, 1974, in the Matter of the Applica-
tion of Brack Construction Corp. vs. the Assessor and Board of
Assessment Review and on September 12, 1974 by Realty Leverage
and two from Land Properties Company.
MR. CLAUSEN moved that Allan E. Rappleyea, Attorney, be appointed
to answer and defend these Tax Reviews on behalf of the Town of
Wappinger.

Mr. and Mrs. Fred Tambolini had requested to speak before the
Boardjn reference to subdivision of their property into three lots.
Their application for subdivision had been formally submitted_ after
the first of July, hence they were caught in the Moratorium. Mr.
Tambolini explained that, although they had not paid their applica-
tion fee before July, they had been in contact with the Planning
Board starting in May but had been ignorant, at that time, of the
fact that a fee was required. There are three existing houses
on their property, and all they want to do is subdivide in order to

sell their property. The Planning Board held a Public Hearing on
their application in August, but, due to the Moratorium, the
Board cannot grant approval. They felt they were delayed because
all of the information wasn't given to them when they first applied.
There was some discussion between Mr. Rappleyea, the Tambolinis
and Mr. Steinhaus.
Mr. Diehl informed Mr. Tambolini that it was the feeling of the
Board that they would like Mr. Rappleyea to look into this matter
further and give the Board some advice due to the fact that there 111/
are already three buildings already on the property, due to the
fact that the Tambolinis may or may not have had bad information
and have him investigate these areas and see if there are any
reasons why the Board should not hold them up. Mr. Rappleyea
was asked to report back to the Board so that they may make some
kind of a decision on it.
Gregory McAdam, representing Dennis Truett, had requested to
speak before the Board regarding a drainage easement on Mr.
Truett's property. Both Mr. McAdam and Mr. Truett were present.
Mr. McAdam briefly described the location of the property in the
Dutchess Heights Development Section I. The map shows a drainage
easement, the problem is the extent of the easement, which has
created a very hazardous situation. Initially there was no sub-
stantial ditching and a very dangerous condition as a result of
some work undertaken by the Town. As he understands it, this
easement has been over -burdened by the addition of other sub-
divisions kvx*ImexiwiltaimmxolkntimexxxmlosaixAsAmmx to this drainage
system. The second half of the problem is some work the Town
undertook in the next subdivision which changed the flow of
water in this drainage easement, and also some work they under-
took on Mr. Truett's property itself by the installation of some
pipe. It is their feeling the Town has used more than it's
entitled to of the original drainage easement, therefore, creating

a hazardous situation and their responsibility to correct by
1, they would like some piping in that area, and at least as
some temporary measure, some fencing and grading in the open gap.
Mr. Horton explained that piping had been installed in the ease-
ment, and at one end where an original mistake was made in the
easement, was where the original stream was. He also said they
would have to put a wide drain in because people upstream dump
things into the stream, therefore any type grating would clog
it over. Upon questioning by Mr. Clausen, Mr. Truett stated he
had fenced off the front part of his property, it was the back
part of the property he was concerned with, there was a ditch
there when he purchased the property, but the situation has
grown worse. The question wasl._ultimately asked would a fence
along the easement line of Mr. Truett's property solve the prob-
lem. Mr. McAdam hedged on an answer to Mr. Clausen's direct ques-
tion but stated they would welcome any questions and appreciate
some response regarding some immediate efforts the Town could
undertake to grate that open section to protect the problem from
children getting into it, 2, any fencing the Town might want to
undertake, and, he really thinks Mr. Truett has a right to have
the situation remedied. This is not the easement that Mr. Truett
took title to, it's drastically different from the one which
the Town has. And they would only accept the fencing as a tem-
porary measure. It didn't seem likely the problem could be solved
this evening.
MR. DIEHL moved that this matter be referred to Mr. Horton, Mr.
Rappleyea, Mr. Lapar, and the Principals to meet and discuss
further.

A letter was received from Ernst Martin Jr. Engineer (with Mr.
Lapar's firm) seeking the Board's direction as to whom they
would recommend to supply LP Gas service to Oakwood Knolls
Sewer Treatment Plant.
MR. CLAUSEN moved that Mr. Martin be instructed to solicit bids
for the LP Gas service in the Oakwood Sewer Plant.

Gentlemen:
The Planning Board of the Town of Wappinger would like to
take this opportunity to request that your Board adopt a resolu-
tion to permit the Planning Board to allow cluster development
under Section 281 of the Town Law.
As you may recall on several occasions the Planning Board
has suggested that clustering could be better accomplished as
a separate entity under Section 281 of the Town Law rather than
under the provisions of the Planned Unit Development Ordinance.
The Planning Board would appreciate your serious considera-
tion of this proposal and urges action on your part in view of
the fact that the Board has before them the Cranberry Hills sub-
division, the Forest Farms subdivision, the Kelly Greens subdi-
vision, and the Wild Brook Acres subdivision which the Board
would like to see as cluster developments rather than grid
subdivisions.
Enclosed for your consideration are copies of a draft
resolution to allow clustering under Section 281 of the Town
Law as prepared by Mr.James Spratt, P.E., in April, 1972.

MR. CLAUSEN moved that, in view of the fact that the Board is
studying the new 1990 Plan and Report, and Cluster Zoning is
within that report, that the request be tabled until the Board

has a meeting and discuss it within the framework of the 1990
Plan, to do it otherwise may be doing it piecemeal and contrary
to what the Planners have recommended.

Dear Mrs. Snowden:
The Cedar Hill - Pine Ridge Civic Association would like to
erect signs at two or three main roads leading into this area.
These signs would be placed at the edge of the road, such that
they would assist delivery people, firemen, police, ambulance,
etc. to locate roads to residences. In an emergency situation,
it is felt that such signs would be very valuable.
The installation would be at no cost to the town and would be
similar to ones at Haggentown, Town of Poughkeepsie and Brett
View Acres, Town of Wappinger. The signs would be well constructed.
Mr. Barnes of the Wappingers School District of the Industrial
Arts Department has agreed to build them. I understand the
approximate size (in order that they be readable from a vehicle
driver's seat) would be approximately four feet high and eight
feet wide.
Would this be acceptable to the town and would this need planning
board approval. Exact locations have not been established, but
with your general approval, specific land owners would be con-
tacted, if necessary.
A map of the involved area is enclosed. Thank you for your

Mr. Rappleyea for his concurrance.

Re: Installation of Utilities Adjacent
To Spook Hill Estates
Gentlemen:
This letter is to put the Town Board on notice that the in-
stallation of various utilities adjacent to the Spook Hill
Estates Subdivision could possibly interferewdth the recently
installed sewer and water mains in the area.
This office has inspected a good percentage of these mains and

has found them to be in good working order. Therefore, this
office cannot accept the responsibility for any subsequent
damage done to these utilities. The Town should not hold the
Contractor, Lombardi & Son, Inc. responsible for any damage
that is done either.
We have written letters to the various companies doing work in
the area and have informed them of their responsibilities. We
have enclosed copies for your information.

Supervisor Diehl recognized County Representative G. Donald
Finnan and asked if he had anything he wished to inform the
Board of. Mr. Finnan commented he had come specifically to
speak to Mr. Rappleyea and Mr. Lapar on a few points regarding
the Tri -Municipal Sewer District as it relates to the County's
proposed purchase of the Bowdoin Farm. He then briefly summar-
ized the proceedings in this area up to present. A discussion
ensued on pursuing the Tri -Municipal project and specifically
achieving the original site on the Fresh Air Fund property for
the location of the sewer plant. The Board thanked Mr. Finnan
for his concern and expressed appreciation for his appearance
tonight.
A letter was received from :S. Barrett Hickman with regard to
the PUD Application of the Reynolds property, asking the Board
to consider making all referrals simultaneously for review so
as not to prevent additional delays.

it appears from the conceptual presentation to be a good use
of the land.
The Planning Board would appreciate being advised of any
action taken on this application.

Mr. Clausen indicated that what he was hoping was in a sense
what the Planning Board liked and didn't like about the Plan,
item by item. Mr. Steinhaus replied to this that he then would
have considered a more formal request for that "kind of" recom-
mendation. Mr. Clausen then commented that the Town Board would
have to do a lot more research, he doesn't believe they are at
the stage where the Town Board would want to submit it to the
Planning Board formally.
MR. CLAUSEN moved the Town Clerk send a letter to the Planning
Board thanking them for their comments and consideration.

Because of the unavailability of Gerald Mallow, principal
in the above matter, he was unable to attend the meeting
held by Supervisor Diehl, with Councilmen Jensen and Saland
present, on September 24, 1974. As a consequence, the members
of the Town Board;_in attendance very graciously permitted us
to submit the application of David Levine.
Mr. Mallow, however, desires to discuss the matter with you,
and I therefore respectfully request a meeting so that we may
have a preliminary discussion of the property insofar as it
can be applied for a P.U.D. development under the ordinance.
Your attention will be greatly appreciated.

Mr. Diehl noted that it would appear that there was enough
proposals now before the Board, and, they are waiting for a
new Ordinance and Zoning Map. It might be appropriate now not
to take on any more proposals, even in executive discussion.
Mr. Saland concurred in Mr. Diehl's suggestion and suggested Mr.
Aldrich be so informed that at present the Town Board doesn't
feel that, as a practical matter, the Board can do justice to
any proposal put before them at present.
A request was received from Virginia Ferris, Town Historian, to
attend the Hudson Valley Historian's Association meeting in
Kingston, New York, October 26th.
MR. CLAUSEN moved that Mrs. Ferris' request be granted, and her
legitimate expense be a Town Charge.

The following Resolution was offered by COUNCILMAN CLAUSEN who
moved its adoption:

WHEREAS, the Town of Wappinger previously had formed the
Wildwood Sewer District, and
WHEREAS, the L&A Filtration Corp. and the Town have entered
into an option agreement governing the purchase of the existing
facilities of said L&A Filtration Corp., now, therefore, be it
RESOLVED that the Supervisor is authorized and is directed
to proceed with said option agreement and purchase the facilities
of the L&A Filtration system on behalf of the Wildwood Sewer .
District for the sum of $350,000.00, and he is authorized to
make all appropriate adjustments for taxes and related matters.

A letter was received from Camo Pollution Control Inc., regard-
ing wiring and electrical control systems at the Wastewater
Treatment Facilities. "Patching" has been necessary to maintain
continuity of operation. Mr. Diehl indicated that the Board,
previous to tonight's meeting, has directed him to contact Camo
Pollution to ask them to forward to the Board the specific items
along with their costs so the Board can relate to the moneys
available at present.
A letter was received from Eugene V. Conte, Customer Relations
Manager for Central Hudson, indicating that there was an out-
standing bill of $88.70 for electrical service to a lift pump
on Baldwin Road. Opala Realty Corp. claims this pump was taken
over by the Town, therefore the Town's responsibility, and Mr.
Conte wished to be informed as to whether the Town will assume
responsibility for past and future bills.
Mr. Diehl indicated that he had checked with the Building Inspec-
tor who informed him that the lift pump was accepted on May 10,
1974. Mr. Diehl further stated that a letter was forwarded to
Mr. Conte, stating the date of acceptance, and bills after this
date would be the responsibility of the Town.
The matter of Election Inspectors was placed before the Board.
Resignations had been received from Edith Barbara (D), Lois Acker
(R), Carol McMahon (R), and Nancy Hayton (D), and several In-
spectors had refused the appointment: Maude Holler (R), Maureen
Porter (D), Evelyn Donnelly (D), Lois Golderisi (D) and Sarah
Berinato (D) and Herman Seligson (D). The Republican and Demo-
cratic Committee Chairmen, respectively, had recommended replace-
ments, and alternates.
MR. CLAUSEN moved that the following Election Inspectors be
appointed to fill the Vacancies created by either resignation or
refusal of appointment and also the following alternates be

A letter was received from Hugh J. Maurer, Chairman of the
Recreation Commission, submitting that Commission's recommenda-
tion of an appointment to the Director of Recreation (Part Time)
position that was vacated by the resignation of Thomas Rogers.
They recommended Miss Laura Helion.
MR. DIEHL moved to accept the recommendation of the Recreation
Commission, and appoint Laura Helion as Part Time Recreation
Director for the Town of Wappinger, for the remainder of 1974,
and further, that she be compensated with the balance of the
salary stipulated for Mr. Roger's position.

Mr. Versace commented that in the future he would request the
Board be supplied with a list of names of potential applicants
for this position that the Town Board might be able to interview.
A letter was received from Rudolph Lapar indicating he was in
receipt of one bid, from C&E Construction Co., Inc. to repair
the 10" Sewer Line in the Roek:irgham -. Farms Sewer District at
a cost of $324.00.
MR. SALAND moved that, based upon Mr. Lapar's recommendation,
the bid for the repair of the 10" sewer line in the Rockingham
Farms Sewer District be awarded to C&E Construction Co. Inc. @
$324.00.

A letter was received from Fred A. Felten regarding improper
placement of the lateral sewer line on his property (25 Central
Ave.) by K&A Excavating Contractors. Mr. Diehl commented that
he had forwarded correspondence to Mr. J. Paggi asking him to
advise the Board of his findings in the matter. Mr. Paggi has
not responded. (Mr. Felter's letter dated Oct. 9, 1974 was
only received Oct. 10, 1974 - short notice for a reply from Mr.
Paggi). It was recommended no action be taken until such time
as investigations are completed and a report submitted to the
Board.
Mr. Diehl approached the subject of fire hydrants for fire fight-
ing purposes in the area of Orchard Homes and Angelbrook.
MR. DIEHL moved that the Engineer to the Town be instructed to
undertake whatever engineering studies are necessary to be pre-
pared for the time when the Town has the water supply available
that the Town can move forward in regard to hydrants in the
Orchard Homes and Angelbrook Areas.

Mr. Diehl indicated that there had been a request from the
County that Towns endorse the State Authority in inspecting
bridges in the Town. The big question arises, the communication
does not state at what cost the Town might become indebted for
this inspection. Mr. Diehl further stated that, under this
condition, Mr. Horton has recommended not to endorse it until
more complete information is available.
MR. CLAUSEN moved that a letter be addressed to Mr. James Spratt,
Commissioner of Public Works for the County of Dutchess asking
to forward further details of the plan to Mr. Horton, Town of
Wappinger Superintendent of Highways for his recommendations
to the Town Board.

A letter was received from James Spratt, Commissioner of Public
Works, County of Dutchess, informing the Board that the speed
zone petition for Spook Hill had been denied. It was his recom-
mendation that the Board look into the use of an "area speed
zone" per Section 1622 (2) of the V&T Law.
Mr. Saland questioned whether the denial was due to the change
of Commissioners, or whether the section of V&T cited was a new
section. Mr. Rappleyea was unable to answer but indicated he
would research the section quoted and report back.

MR. CLAUSEN moved that Allan Rappleyea, Attorney to the Town
get in contact with Mr. Silver, the owner of the Sweet -Orr
Building and negotiate particulars for rental of part of his
building for Justice Court and further, refer it to Mr. Lapar
to follow up on change of construction of that part of the
building in question.

Mr. Rappleyea reported that the applications on both Tall
Trees and Mayim Water Systems were still before the Public
Service Commission.
Mr. Saland, reporting for the Landfill Committee, indicated
that he and Mr. Versace had briefly discussed the Ordinance and
found no great technical problems with it.

General Fund. This transfer will take care of the remaining
balance due for the Town of Wappinger share of the Tri -Municipal

RESOLUTION ADOPTING RULES AND REGULATIONS WITH
RELATION TO PUBLIC INSPECTION AND COPYING OF SUCH
TOWN RECORDS.AS ARE SUBJECT .TO PUBLIC INSPECTION
BY LAW
BE IT RESOLVED that the following rules and regulations
shall apply to the public inspection and copying of such Town
records as are subject to public inspection by law and shall

continue in effect until altered, changed, amended or super-
seded by further resolution of this Town Board, or by action of
the Committee on Public Access to Records established pursuant
to chapters 578, 579, 580 of the Laws of 1974;
A. PLACE OF INSPECTION. Such records shall be made avail-
able for inspection at the office of the Town officer or employee
charged with the custody and keeping thereof.
B. TIME OF INSPECTION. Such records shall be made avail-
able for public inspection on regular business days between the
hours of 10:00 A.M. and 12:00 noon and 2:00 P.M. and 4:00 P.M.,
if readily available. If not readily available, written request
specifically describing records to which access is desired shall
be filed with the Town officer or employee charged with the
custody and keeping thereof, who shall produce same within 48
hours of such request. Such written request shall be on the
form prescribed by the State Comptroller. If the Town officer
or employee charged with the custody and keeping of the record
elects or refuse access, he shall submit to requestor written
statement of his reason therefor within 48 hours of such request.
C. FEES. (1) Copies. The Town officer or employee
charged with the custody and keeping of the record shall upon
request make a copy or copies of any record subject to such
inspection upon a payment of a fee of $.25 per page.
If a copy or copies are desired thereof by the requestor,
the Town officer or employee charged with the custody and keeping
of the record shall make the same and mail or deliver the same
to the requestor within one week depending on the volume and
number of copies requested.
(2) Certification. Any Town officer or em-
ployee charged with the custody and keeping of any such record
shall upon request, certify a copy of a document or record
prepared pursuant to the provisions of the preceding subsection
upon payment of a fee of $.25.
D. To prevent an unwarranted invasion of personal privacy,
the committee on public access to records may promulgate guide-
lines for the deletion of identifying details for specified
records which are to be made available. In the absence of such
guidelines, an agency or municipality may delete identifying
details when it makes records available. An unwarranted in-
vasion of personal privacy includes, but shall not be limited to:
(1) Disclosure of such personal matters as may have been
reported in confidence to an agency or municipality and which
are not relevant or essential to the ordinary work of the agency
or municipality:
(2) Disclosure of employment, medical or credit histories
or personal references of applicants for employment, except such
records may be disclosed when the applicant has provided a written
release permitting such disclosure;
(3) Disclosure of items involving the medical or personal
records of a client or patient in a hospital or medical facility;

(4) The sale or release of lists of names and addresses
in the possession of any department if such lists would be used
for private commercial or fund-raising purposes;
(5) Disclosure of items of a personal nature when dis-
closure would result in economic or personal hardship to the
subject party and such records are not relevant or essential
to the ordinary work of the department.
E. Each department shall maintain and make available for
public inspection and copying, in conformity with such regula-
tions as may be -issued by the Committee on Public Access to
Records a current list, reasonable detailed, by subject matter
of any records which shall be produced, filed, or first kept
or promulgated after the effective date of this article. Such
list may also provide identifying information as to any records
in the possession of the department on or before the effective
date of this article.
F. In addition to such requirements as may be imposed by
this resolution or by Chapter 578 of the Laws of 1974, each
board, commission or other group of the Town having more than
one member shall maintain and make available for public inspec-
tion a record of the final votes of each member in every agency
proceeding in which he votes.

of the feasibility of incorporating the Oakwood Knolls Water
District into a new water area to include Kent -Sussex Company
and properties within that general area.

Mr. Clausen, under unfinished business, recalled a request made
by the Board in reference to both the County and State Highway
Departments to find out, if possible, who was responsible for
the paving of New Hackensack Road, coming on to Route 9. Since
there had been no written response to these requests, Mr. Clausen
asked that there be a follow-up letter directed at the additional
paving of New Hackensack at its intersection with Route 9, and
also the same situation as it pertains to Old Hopewell Road
with its intersection with Route 9.
With regard to the rezoning request from W. C. Dean, the matter
was again placed before the Board, since Mr. Dean had finally
submitted the requested maps and descriptions of both parcels
involved in the rezoning request, and both referrals had been
received from the Dutchess County Department of Planning and
the Town of Wappinger Planning Board.
Mr. Saland stated that he would like to find out first where
that particular proposal stands in light of the new zoning
proposal and projected zoning map. That determination should
be made first, therefore he recommended Mr. Dean's request be
deferred until the next Board meeting, if the information is
available by then.

Gentlemen:
On September 19, 1974 Video Pipe Grouting, Inc. TV'd the
storm drain line in Seneca Lane and Mohawk Drive in Wappinger
Park.
My inspector's report indicates that the storm drain was in
good condition and that the probable location of the leaching
into Mrs. Marino's back yard is through the existing catch
basins which were very poorly mortared and very poorly con-
structed.
It is suggested that possibly, at this point, more dye test-
ing be done in order to isolate the actual area to absolutely
determine whether the catch basin is the source of the sewage
in Mrs. Marino's back yard.
If it is determined that the source of the problem is the
catch basin, we will of course recommend that the Town have
it reconstructed.

Mr. Horton indicated that he can undertake the project of re-
building these catch basins.
Alan Hall, President of the Angel Brook Civic Association had
written to the Board in connection with fire hydrants in his
development. This matter had been acted upon earlier in the
evening. Mr. Lapar made a comment regarding this matter indi-
cating the Town does not own the water system as yet, but did
believe he could make an effective study that would be appliable
when the water was available and the system Town owned.
A request had been made by Schoonmaker Homes Inc. for the return
of a cash bond of $1,000. The following recommendation was
received:

Section I and Rockingham Farms Section II, since the ledger
shows the Town receiving two separate checks of $500.00 each
in accordance with the Highway Specifications.

The roads in Section I have been deeded to, and accepted
by the Town,and the one year maintenance period has been
satisfied. Therefore, I recommend the release of the $500.00
bond posted for Section I.

A letter was received from Warren Strohm, Chairman of the
Zoning Regulations Advisory Committee first expressing to the
Board appreciation for allowing two ZRAC members to participate
in the three day planning tour conducted by the County Coopera-
tive Extension Service, and further submitting additional recom-
mendations for the Zoning Ordinance revision.
MR. SALAND moved Mr. Strohm's letter be received and placed
on file.

to the membership list are Messrs. Haase, Moreau and Nussbickel.

Committee.

Under New Business Mr. Hawksley was recognized by the Chair.
He asked for help from the Town in assisting in four Saturday
collections of leaves for shredding in November and would be
in need of the use of a Highway truck to help pick them up.
Mr. Horton indicated all that would be available would be a
small truck, as he had already committed himself for the re-
cycling program in November. Mr. Horton and Mr. Hawksley would
get together to work out some arrangements.
Mr. Diehl called a 15 minute recess at 10:49 P.M. Supervisor
Diehl called the meeting back to order at 11:22 P.M. All Board
members again present, with the exception of Mr. Jensen.
MR. CLAUSEN moved that Mr. Gerzof and Mr. Dangler be so noti-
fied that any and all Certificates of Occupancy are cancelled
as of this date, and no additional Building Permits are to be
issued, and the matter to be referred to Mr. Rappleyea to write
the letter with those sentiments expressed.
