The Regular Monthly Meeting of the Town Board of the Town of
Wappinger was held on August 12, 1974, at -r8:00 P.M. at the Town
Hall, Mill Street, Wappingers Falls, New York.
Supervisor Diehl called the meeting to order at 8:16 P.M.

The minutes of the July 8, 1974 Regular Monthly Meeting and the
July 25, 1974 Special Meeting, having been previously sent to
the Town Board members, were now placed before them for their
approval.
MR. JENSEN moved the minutes of the July 8, 1974 Regular Monthly
meeting and the July 25, 1974 Special Meeting, as submitted by
the Town Clerk be and they are hereby approved.

The Town Clerk noted for the record that approval had been
received from the New York State Public Service Commission
for the transfer of the water system of Hilltop Water Works
Corp. to the Town of Wappinger.
Supervisor Diehl directed this Order from New York State Public
Service Commission be accepted and placed on file.
Several requests had been received for attendance at various
conferences and schools. The first considered was the request
from Bruno Hermans, Building Inspector to attend the New York
State Building Officials Annual Meeting at Fallsview, Ellenville,
New York on September llth thru 13th, 1974.
MR. CLAUSEN moved that Mr. Hermans be granted permission to
attend the New York State Building Officials Annual Meeting,
September llth thru September 13th, 1974 and that his legitimate
expenses be Town charges.

The second request was from $y1via Anderson, Zoning Administrator,
the members of the Planning Board, and Zoning Board of Appeals,
to attend the Planning Federation Convention at Grossinger's
Grossinger, New York on October 20 thru October 22, 1974.
MR. CLAUSEN moved that Mrs. Anderson, and those members of both
the Planning Board and Zoning Board of Appeals desiring to attend
the Planning Federation Convention at Grossingers October 20 thru
October 22, 1974 be granted permission to attend, and their legiti-
mate expenses be a Town charge.

The third request was from the Town Justices requesting permission
taisattend the Annual New York State Magistrate's Association
Conference at the Brown's Loch Sheldrake, New York on September
8th thru September llth, 1974.
MR. CLAUSEN moved that permission be granted the Town Justices
and staff to attend the New York State Magistrates' Association
Conference at the Browns on September 8th thru September llth,
1974, and their legitimate expenses be Town charges.

The last request was received from John Mailepors, Water and
Sewer Plant Operator, to attend the Syracuse University Environ-
mental School held by New York State, in order to obtain a #2 and
#3 Operator License. The first course is scheduled for September
23 to October 4, 1974 and the second course is scheduled for
November 11 to November 15, 1974.
MR. CLAUSEN moved that John Mailepors be granted permission to
attend the Environmental School at Syracuse University for both
sessions, September 23 to October 4 and November 11 to November
15, 1974, in order to obtain his #2 and #3 operators license and
that his legitimate expenses be Town charges.

Mr. Jensen qualified his Nay vote stating that he was not
entirely satisfied with the operation of the plants. He has, on
several occasions, requested from the Superintendant of Sewer and
Water, monthly reports and what have you, which haven't been
received, therefore, because of this and other reasons, he didn't
feel the man should be granted this opportunity.
A request had been received from Gregory McAdam, representing
Dennis Truett, to speak to the Board in reference to Mr. Truett's
drainage problem. Mr. McAdam was, however, unable to attend the
meeting and requested the matter be placed before the Town Board
at their September meeting.
Supervisor Diehl directed Mr. McAdam's request be honored and
directed the Town Clerk to place him on the agenda for the Septem-
ber Town Board meeting.
A letter was received from Mr. Herbert G. Elman regarding some
dissatisfaction he had with the installation of sewers as it
affected his property.
MR. SALAND moved Mr. Elmans' letter. be referred to Mr. Rappleyea
and Mr. Lapar.

A petition was received, signed by the residents of Spook Hill
Road, requesting the speed limit be lowered to 30MPH for safety
reasons.
MR. SALAND moved to request the New York State Department of
Transportation to consider a reduction to 30MPH speed limit
on Spook Hill Road and grant permission to the Town to so estab-
lish a lower speed limit on said road.

A Notice of Public Hearing was received from the Town of Fishkill
regarding a rezoning petition of Shinn Realty on August 19, 1974
and a letter was received from the Town of Wappinger Planning Board,
in reference to this particular referral, requesting that the Town

Board authorize Rudolph Lapar to represent the Town of Wappinger
at this hearing and express the Town of Wappinger's concern with
regard to drainage flow from this proposed DMUD.
MR. CLAUSEN moved that Rudolph Lapar, Engineer to the Town of
Wappinger be authorized to represent the Town of Wappinger at
the Town of Fishkill Public Hearing regarding the Shinn Realty
rezoning petition.

A letter was received from the Planning Board regarding the
Kelly Greens subdivision (Widmer Road). The Planning Board had
become aware of the fact that there was a Central Hudson Easement
on the proposed recreation land of this development, and the
Planning Board requested the Town Board to comment on What their
position would be with regard to accepting such an area with an
easement attached. It was also noted that a subsequent letter
had been received from Howard Kelly (the developer) indicating
they would forward an alternate proposal, that of deeding the
lots 16, 17 & 18 if it was so determined additional recreational
area be required. There followed a brief discussion between the
Board and Mr. Steinhaus with regard to this. It was the feeling
of the Town Board that the Town would not want to accept lands that
were encumbered by a Central Hudson Easement.
A second letter from the Planning Board regarding the availability
of water supply and sewage treatment facilities for the proposed
Cranberry Hills, Forest Farms, Kelly Greens and Wild Brook Acres
Subdivisions was received. The Planning Board would appreciate
being advised what the Town Board's position and requirements of
these proposed subdivisions are of obtaining a commitment on
these facilities for these areas. Another discussion ensued on
these four proposed developments with the Board and Mr. Steinhaus.
it was assumed that it would be several years before any of these

developments could enjoy the benefits of either the Central
Wappinger Water and Wappinger Sewer or Tri -Municipal. It was
agreed that Mr. Rappleyea would meet with the Planning Board at
7:00 P.M. on Monday (August 19th) to discuss further these develop-
ments and the question of sewer, water, etc.
Mr. Saland recommended that, since the Town Board is all of a
similar mutual opinion on both matters, the Town Clerk be directed
to draft a letter to the Planning Board embodying the consensus of
the Town Board on the question of the easement and inform them
that with regard to water and sewer for these four developments,
it's not available and this matter should be referred to Mr.
Rappleyea for his attention. Supervisor Diehl so directed the
Town Clerk.
A letter was received from Stanley Ries, Chairman of the Legisla-
tion Committee of the Dutchess County Chapter, of the American
Association of Retired Persons, Inc. which called attention to
legislation concerning the increase of income for property owners
over 65. Mr. Diehl recommended the Town Clerk place Mr. Ries'
letter on file since a resolution on this subject is to be con-
sidered later in the meeting.
Two letters were received from Attorney Russell and Aldrich
requesting a meeting with the Town Board in order to discuss a
PUD proposal for Angel Brook Development and David Levine.
MR. SALAND moved to table these requests from Mr. Aldrich until
next months meeting.

Supervisor Diehl recognized Mr. Donald Finnan, Town of Wappinger
County Representative, and asked if he would like to say a few
words. Mr. Finnan lightly commented that he was just being an
errand boy tonight, delivering the two last years of the printed
volumes of the Proceedings of the County Board of Representatives

to the Town. He further stated that he had left some material
with the Town Clerk regarding the Flood Plan Management and the
National Flood insurance Program, and commented that the Board
of Representatives was, this day, discussing the purchase, of the
old Bowdoin Farm for a County recreation site. The question
was raised that this site was being considered for the Tri -
Municipal Sewer Plant, what effect would it have if the County
purchased the property. Mr. Jensen did not see any conflict.
Mr. Finnan also commented that the Dutchess County Sewer Agency
is being revitalized and will meet with Clinton Bogart to go over
his latest study.
Mr. Al Zak, being recognized by the Chair, mentioned a letter
the Town Board had received from the Zoning Regulations Advisory
Committee. He felt it should have been placed on the Agenda
under communications. Mr. Diehl indicated the subject referenced
in this communication would be dealt with later in the meeting.
An application was received from Leonard O.Galarneau for a
Hawking and Peddling License. The application had been referred
to the Dutchess County Sheriff's Department, and returned indicating
no criminal record on file.
MR. CLAUSEN moved to approve the application and grant Leonard O.
Galarneau a license foTawking and Peddling in the Town of
Wappinger.
Seconded by Mr. Jensen.

Bids were solicited by the Recreation Commission for Football
Equipment, received and opened on July 18, 1974. Two Bids were
received: Letterii Sporting Goods @ $2,043.80 and Wolf's Cal
$2,208.20. The following recommendation was received from the

Dear Mr. Maurer,
With reference to the attached two bids for Wappingers Area
Pop Warner Football League equipment for the 1974 football
season, I would like to recommend acceptance of the Wolf bid
(Wilson Equipment).
Since football is a contact sport, quality and safety are our
prime concerns when purchasing equipment for the youngsters
involved in our program. Over the past 11 years, using different
manufacturers equipment, we have found Wilson to be far superior
for safety and durability.
Your assistance in our program is greatly appreciated. If there
are any questions regarding ourprogram or equipment, please feel
free to call on me at any time.

MR. CLAUSEN moved to accept the recommendation of the Recreation
Commission and award the bid for Football Equipment to Wolf's

Supervisor Diehl recognized County Representative John Armstrong.
Mr. Armstrong mentioned that the County Board of Representatives
passed a $40,000 resolution to study the site for Pyrolysis.
One of the proposed sites for the Landfill site will be inspected
tomorrow - namely the extra land near the airport that Mr.
Schueler wants .to take-over. Mr. Clausen posed the question of
the defeated proposal for an indepth study of the County jail,
was there anything the Board should know as to why the vote was
the way it was. Mr. Armstrong gave an explanation as he saw it,
it was just not possible to convince some of the other represen-
tatives to move forward with another study.
Under Committee Reports, Mr. Jensen reported that the final
printed copy of the 1990 program has been received by the Town.
The Office of Planning Services has also given the "go ahead"
and contracts signed for Frederick P. Clarke Associates to pre-
pare the final drafting of the Ordinance. Mr. Jensen also reported
on some of the problems being experienced with some of the Towns'
recreation sites, and that some of the problems have abated in the
last few weeks, but on this same vein, he mentioned a letter that
had been received from John Mailepors, Chief Operator, which
indicates once again the vandalism at the Fleetwood Plant, which
shows there is a growing vandalism problem not only with recrea-
tion areas but in the sewer and water plants. The thought of
contacting the Sheriff's Office to discuss the possibility of
that office hiring an additional man to patrol the Town of
Wappinger has been considered, at present the Sheriff's Office
allocates only one man for. the Town. Mr. Jensen believed the
cost of an additional Sheriff should be given some consideration

in the proposed budget for 1975, as this would give the Town
additional coverage and perhaps cut down on some of the vandal-
ism problems. Mr. Clausen commented that as he sees it, the
problem isn't to have another Deputy Sheriff in the area to give
surveillance and catch the kids - because when you go to the next
step Mr. Mailepors and the residents know who the children are,
but it seems the law prevents them or they are unwilling to go
the step further and do something about the children who are
breaking in. He also threw in the suggestion of obtaining a
watch dog such as is used by the Highway Department. Mr. Jensen
commented that he was not just concerned with the vandalism, the
Town has grown and there are other problems arising that would
necessitate and justify additional coverage. Mr. Saland commented
that one of the problems of vandalism was that at this point, with-
out an Ordinance the police are unable to make an arrest unless they
witness the acts, or unless those who have witnessed the act are
willing to lodge the complaint, which they apparently are unwilling
to do. Mr. Versace commented on the need for some electrical work
to be done at the Oakwood Water Plant, and reminded the Board that
money was requested by the Chief Operator to take care of this
necessary work. He also mentioned the recommendation from the
Supervisor regarding a position open in the Water and Sewer De-
partments. It was agreed that Mr. Versace and Mr. Jensen would
interview the applicants recommended by Mr. Diehl and place a name
before the Board for approval.
Upon presentation of an Ordinance which would direct the Planning
Board not to approve subdivision plats and site plans for a period
of 120 days, Mr. Diehl made the following introductory remarks
with regard to it: "In regard to the proposed Zoning Ordinance
tonight, and the scheduling of a Public Hearing on the proposed
future zoning for the Town of Wappinger, as recommended by Frederick
P. Clark Associates for the Town's 1990 program , based on the fact

that the Town of Wappinger Plariiing Board has adopted this plan
and that the proper Federal and State Departments have officially
signed the contract assuring continued funding so that a mapping
of Flood Zones in the Town of Wappinger is completed, to insure
the Town's ability of obtaining flood insurance and a complete
detailed report by Frederick Clark has been received by the Town
in this printed form, which has been spoken of tonight. Coor-
dination of the timing of these factors if essential to insure
the completion of this proposed zoning without opening the door
to possible legal actions and to cement the future direction of
the Town with all its departments and commissions. In conclusion,
it appears to be the appropriate time to coordinate the new master
plan with a new zoning ordinance for the best interests of the
Town and/or without the danger of instituting court actions against
the Town".
Mr. Jensen: "Mr. Diehl, I would move that this ordinance be
introduced to the Council and for its adoption" Mr. Clausen:
"Second".
The following Ordinance was introduced by COUNCILMAN JENSEN
AND COUNCILMAN VERSACE, who moved its adoption:
WHEREAS, the Town of Wappinger has participated for several
years in a long-range planning program, designated as "Dutchess
1990", with adjoining municipalities, and in cooperation with
the State of New York, and
WHEREAS, after several meetings and public informational
sessions, the Town of Wappinger Planning Board has adopted a
revised Master Plan, and
WHEREAS, the state and federal governments have been en-
couraging municipalities to adopt more stringent regulations
with regard to flood plains and building near streams, and
have required the adoption of said plans to enable home -owners
to purchase flood insurance, and the Engineer to the Town is in
the process of completing a proposal for such regulation, and
WHEREAS, Frederic P. Clark Associates have commenced the
redrafting of the Town's Zoning Ordinance and map, and it would
appear that such documents will be available for a public
hearing thereon, within 120 days, and
WHEREAS, the Town Board of the Town of Wappinger would like
to prevent a rush to the Planning Board by applicants prior
to the enactment of a new Zoning Ordinance, so that the aims
and purposes of the Town's Master Plan are not frustrated, now

BE it enacted and ordained by the Town Board of the Town
of Wappinger:
Section 1. The power granted to the Town of Wappinger
Planning Board by resolution of the Town Board of the Town of
Wappinger on January 7th, 1960, to approve subdivision plats
pursuant to Sections 276, 277, and 278 of the Town Law shall
not be exercised for a period of 120 days from the date of the
enactment of this Ordinance. During said period, the said
Planning Board shall not grant preliminary and/or final approval
to any applicant which has nol; not made an application to the said
Planning Board for subdivision approval prior to July 1st,
1974.
Section 2. The power granted to the Town of Wappinger
Planning Board by the Town of Wappinger Zoning Ordinance to
approve of site plans shall not be exercised by it for a period
of 120 days from the date of the adoption of this Ordinance,

Board with reference to subdivisions and site plans, at which
all interested persons will be heard either in favor of or in
opposition of said proposed Ordinance.

A Local Law amending Local Law No. 1 of 1967.
Be It Enacted by the Town Board of the Town of Wappinger,
Dutchess County, New York, as follows:
Section 1. Section 2 of Local Law #1 of 1967 is hereby
amended to read as follows:
Section 2. Real Property owned by one or more persons,
each of whom is sixty-five (65) years of age or over, or real
property owned by husband and wife, one of whom is sixty-five
(65) years of age or over, shall be exempt from town taxes to the
extent of Fifty (50%) Percentum of the assessed valuation thereof,
subject to the following conditions;
(a) The owner or all of the owners of such real property
must file an application annually in the assessors' office at least
ninety (90) days before the date for filing the final assessment
roll or such other time or date as may be hereafter fixed by law.
(b) The income of the owner or the combined income of
the owners of the property shall not and may not exceed the sum
of Six Thousand Five Hundred ($6,500.00) Dollars for the income
tax year immediately preceeding the date of making the application
for exemption. The income tax year shall mean the twelve months
period for which the owner or owners file a federal personal
income tax return, or if no such return is filed, the calendar
year. Where title is vested in either the husband or the wife,
their combined income may not exceed such income. Such income
shall include social security and retirement benefits, interest,
dividends, net rental income, salary or earnings and net income
from self-employment, but shall not include gifts or inheritances.

(c) The title to such real property shall have been
vested in the owner or all of such real property for at least
sixty (60) consecutive months prior to the date of making
application for exemption.
(d) The real property shall be used exclusively for
residential purposes.
(e) The real property shall be the legal residence of
and shall be occupied in whole or in.part by the owner or by all
of the owners of the same.
(f) .Applications for such exemption shall be made by the
owner, or all of the owners, of the property, upon forms pre-
scribed by the state board to be furnished by the assessing
authority, and applicants shall furnish such information and
shall execute the application in the manner prescribed in such
forms.
Section 2. This Local Law shall take effect immediately
upon adoption.

WHEREAS, certain areas of the Town of Wappinger, Dutchess
County, New York, are subject to periodic flooding from lakes
and ponds, causing serious damages to properties within these
areas; and
WHEREAS, relief is available in the form of Federally sub-
sidized flood insurance as authorized by the National Flood
Insurance Act of 1968; and
WHEREAS, it is the intent of this Town Board to require
the recognition and evaluation of flood hazards in all official
actions relating to land use in the flood plain areas having
special flood hazards; and
WHEREAS, this body has the legal authority to adopt land
use and control measures to reduce future nood losses pursuant
to Article 16 of the Town Law of the State of New York.
NOW, THEREFORE, BE IT RESOLVED, that this Town Board here-
by:
1. Assures the Federal Insurance Administration that it
will enact as necessary, and maintain in force for those areas
having flood hazards, adequate land use and control measures
with effective enforcement provisions aD nsistent with the Criteria
set forth in Section 1910 of the National Flood Insurance Pro-
gram Regulations; and
2. Vests Town Chief Building Inspector with the respon-
sibility, authority, and means to:
(a) Delineate or assist the Administrator, at his request,
in delineating the limits of the areas having special flood hazards
on available local maps of sufficient scale to identify the
location of building sites.
(b) Provide such information as the Administrator may
request concerning present uses and occupancy of the flood plain.
(c) Cooperate with Federal, State, and local agencies and
private firms which undertake to study, survey, map, and identify
flood plain area, and cooperate with neighboring communities
with respect to management of adjoining flood plain areas in
order to prevent aggravation of existing hazards.
(d) Submit on the anniversary date of the community's
initial eligibility an annual report to the Administrator on
the progress made during the past year within the community in
the development and implementation of flood plain management
measures.
3. Appoints Town Chief Building Inspector to maintain for
public inspection and to furnish upon request a record of
elevations (in relation to mean sea level) of the lowest floor
(including basement) of all new or substantially improved struc-
tures located in the special flood hazard areas. If the lowest
floor is below grade on one or more sides, the elevation of the
floor immediately above must also be recorded.
4. Agrees to take such other official action as may be
reasonably necessary to carry out the objectives of the program.

WHEREAS, the Town of Wappinger, Dutchess County, New
York has adopted and is enforcing the New York State Building
Code and the Town Zoning Ordinance, and
WHEREAS, Section 8 of the Town Ordinance for administering
and enforcing the State Building Construction Code of the
aforesaid prohibits any person, firm or corporation from
erecting, constructing, enlarging, altering, repairing, im-
proving, moving or demolishing any building or structure with-
out first obtaining a separate building permit for each building
or structure from the Chief Building Inspector, and
WHEREAS, the Chief Building Inspector must examine all

plans and specifications for the proposed construction when
application is made to him for a building permit.
NOW, THEREFORE, BE IT RESOLVED by the Town Board of the
Town of Wappinger as follows:
1. That the Chief Building Inspector shall review all
building permit applications for new construction or substantial
improvements to determine whether proposed building sites will
be reasonably safe from flooding. If a proposed building site
is in a location that has a flood hazard, any proposed new
construction or substantial improvement (including prefabricated
and mobile homes) must (i) be designed (or modified) and
anchored to prevent flotation, collapse, or lateral movement
of the structure, (ii) use construction materials and utility
equipment that are resistant to flood damage, and (iii) use
construction methods and practices that will minimize flood
damage; and
2. That the Chief Building Inspector shall review sub-
division proposals and other proposed new developments to assure
that (i) all such proposals are consistent with the need to
minimize flood damage, (ii) all public utilities and facilities,
such as sewer, gas, electrical, and water systems are located, _
elevated, and constructed to minimize or eliminate flood damage,
and (iii) adequate drainage is provided so as to reduce ex-
posure to flood hazards; and
3. That the Chief Building Inspector shall require new
or replacement water supply systems to be designed to minimize
or eliminate infiltration of flood waters into the systems and
discharges from the systems into flood waters, and require
onsite waste disposal systems to be located so as to avoid
impairment of them or contamination from them during flooding.

WAPPINGER, DUTCHESS COUNTY, NEW YORK, AT A
MAXIMUM ESTIMATED COST OF $420,000.00 AND
AUTHORIZING THE ISSUANCE OF $21,000.00 CAPITAL
NOTES AND $399,000.00 SERIAL BONDS OF SAID TOWN
TO PAY THE COST THEREOF.
BE IT RESOLVED, by the Town Board of the Town of Wappinger,
Dutchess County, New York, as follows:
Section 1. The construction of a surface drainage sewer
system in the Town of Wappinger, Dutchess County, New York,
consistingof necessaryfacilities fo `improvement of storm
ctrainage On roads and to provide adequate drainage to lands

in the area is hereby authorized at a maximum estimated cost
of $420,000.00.
Section 2. The plan for the financing of the aforesaid
class of objects or purposes is as follows:
a) By the issuance of $21,000.00 capital notes of said
Town, hereby authorized to be issued pursuant to the Local Finance
Law. Such capital notes shall be sold at private sale and all
further powers in connection with the details and the sale
thereof are hereby delegated to the Supervisor in accordance
with the Local Finance Law. Pursuant to Section 107.00 of the
Local Finance Law, the proceeds from the sale of such capital
notes will be provideqprior to the issuance of the bond herein
authorized or bond anticipation notes. Saidital 21 000.00 capital
p
notes shall constitute the downpayment required by Section 107.00
of the Local Finance Law; and
b) By the issuance of $399,000.00 serial bonds of said
Town, hereby authorized to be issued pursuant to the Local Finance
Law.
Section 3. It is hereby determined that the period of
probable usefulness of the aforesaid Class of Objects or purposes
is forty years, pursuant to subdivision 4 of paragraph a of
Section 11.00 of the Local Finance Law. It is hereby further
determined that the maximum maturity of the serial bonds herein
authorized will exceed five years.
Section 4. The faith and credit of said Town of Wappinger,
Dutchess County, New York, are hereby irrevocably pledged to
the payment of the principal of and interest on such obligations
as the same respectively become due and payable. An annual
appropriation shall be made in each year sufficient to pay the
principal of and interest on such obligations becoming due and
payable in such year. There shall annually be levied on all
the taxable real property in said Town a tax sufficient to pay
the principal of and interest on such obligations as the same
become due and payable.
Section 5. Subject to the provisions of the Local Finance
Law, the power to authorize the issuance of and to sell bond
anticipation notes in anticipation of the issuance and sale of
the serial bonds herein authorized, including renewals of such
notes, is hereby delegated to the Supervisor, the chief fiscal
officer. Such notes shall be of such terms, form and contents,
and shall be sold in such manner, as may be prescribed by said
Supervisor, consistent with the provisions of the Local Finance
Law.
Section 6. The validity of such bonds, bond anticipation
notes and capital notes may be contested .only if:
1) Such obligations are authorized for an object or
purpose for which said Town is not authorized to expend money,
or
2) The provisions of law which should be complied with at
the date of publication of this resolution are not substantially
complied with,
and an action, suit or proceeding contesting such validity is
commenced within twenty days after the date of publication, or

3) Such obligations are authorized in violation of the
provisions of the Constitution.
Section 7. TJpon this resolution taking effect, the same shall
be published in full in the Wappinger and Southern Dutchess News
(W&SD News), the official newspaper, together with a notice of
the Town Clerk in substantially the form provided in Section
81.00 of the Local Finance Law.
Section 8. This resolution is adopted subject to permissive
referendum.

AN ORDINANCE REGULATING USE OF
PARK LANDS IN THE TOWN OF WAPPINGER
Be It Enacted by the Town Board of the Town of Wappinger,
Dutchess County, New York:
Section 1. This ordinance shall apply to all park lands
within the Town of Wappinger, exclusive of those within the
corporate limits of the Village of Wappingers Falls.
Section 2. It shall be unlawful for any person to
operate a motor vehicle, motorcycle, motorbike or snowmobile
within any park ir the Tbwn Of Wappinger, except on roadways
br ih parking areas designated for the use of motor vehicles,
motorbikes, motorcycles or" snowmobiles, within.such park lands.
Section 3. It shall be unlawful for any person to
operate a motor vehicle, motorcycle, motorbike or snowmobile
within any area of a park unless the operator is duly licensed
by the State of his residence and unless said vehicle is
licensed by the State of the owner's residence.
Section 4. It shall be unlawful for any person to use,
enter upon or occupy any park within the Town of Wappinger,
except during the hours established for its use by the Town of
Wappinger Recreation Commission.
Section 4.1. The Town Board of the Town of Wappinger
hereby delegates to the said Town of Wappinger Recreation
Commission the duty of establishing the hours for the use
of each of the parks or portions thereof, within the Town of
Wappinger. All such hours shall be clearly posted at the
usual and ordinary entrances to said parks. Said hours shall
be established by resolution of said Town Recreation Commission
which shall be filed with the Town Clerk within ten (10) days
after its adoption or amendment.
Section 5. Any person violating the provisions of this
Ordinance shall be guilty of a violation as defined by Section
10.00 (3) of the Penal Law and upon conviction thereof, shall
be punished in accordance with the provisions of Article 55 of
the Penal Law.
Section 6. This Ordinance shall take effect immediately
upon adoption, posting and publication, as provided by Town
Law.

Mr. Diehl, with reference to negotiations for the purchase of
the Wildwood Sewer System, indicated that the Town has met with
the Principals, and is waiting for the legal work to be completed
with regard to an option to confirm a price established approx-
imately three years ago of $350,000.00. That price is to hold firm
at this time. Mr. Diehl believed it would be appropriate, under the
agreement that was set, to set an informal informational meeting
with the residents of the Wildwood Sewer District, so they may
voice their opinions and reaffirm what they approved at referendum
a few years ago. The difference would be a question of cost in
operation and maintenance of the plant, but the initial cost is as
was established a few years ago. September 19, 1974, 8PM at the
Town Hall was set for an informal Informational meeting with the
Wildwood residents. It was further agreed that a notice in the
newspaper to inform these residents would be the best vehicle for
notifying them of the meeting.
MR. CLAUSEN moved that an informational meeting be held September
19, 1974, at 8PM at Town Hall for the purpose of discussing the
proposals for the purchase of the Wildwood Sewer System with the
residents of said district, and that notice of said meeting be
published in the newspaper.

for the Town of Wappinger, with an attachment of a copy of his
application for National Flood Insurance Program.

that the rate of compensation for the Election Inspectors be

subject to the determination of the Supervisor that funds are
available in the budget account designated for this expenditure.
