The Minutes of the May 13, 1974 Regular Monthly Meeting and the
May 30, 1974 Special Meeting, having been previously sent to the
Town Board members, were now placed before them for their approval.
Mr. Clausen indicated that he felt there was an omission in the
report offered by County Representative Armstrong. Mr. Clausen
recalled he had asked Mr. Armstrong if he would bring before his
committee on County Board the fact that the County should take
over the Landfill site, and he believed Mr. Armstrong's reply was
that he would either check with his committee or he himself or
someone else would try to bring it out on the floor of the County
Representatives. If this be, in fact, what was so stated he wished
it to be so noted in the record.
MR. CLAUSEN moved that the Minutes of the May 13, 1974 Regular
Monthly Meeting and the May 30, 1974 Special Meeting, as submitted
by the Town Clerk be and they are hereby approved.
Seconded by Mr. Jensen.

The Town Clerk informed the Board that she had received the resig-
nation of Louis Eck from the Board of Assessment Review due to
the fact he had moved to Atlanta, Georgia. (His term of office
would have expired September 30, 1974).
MR. JENSEN moved to accept Mr. Eck's resignation, and direct a
letter of thanks to him for his past services to the Town.
Seconded by Mr. Clausen.
Motion Unanimously Carried
MR. DIEHL moved that the vacancy on the Board of Assessment Review
not be -filled at this time.
Seconded by Mr. Clausen.
Motion Unanimously Carried
Mr. Diehl recommended that the Town Board hear from the Chairman
of the Board of Assessment Review, one of the members of this Board
and Mr. Logan to be advised of the qualifications necessary for a
member of this Board, and action on this vacancy be taken at a later
date for next years Board of Assessment Review (since this years
Board will be sitting in one week's time.).
Notice of Public Hearing and Notice of Application for Permit to
Discharge, was received from the New York State Department of
Environmental Conservation in the matter of KORD Company and
Dutchess 3 Realty Corp. (Hidden Hollow). The Hearing is set for
July 17, 1974 at the Town Hall, Wappinger, at 1:00 P.M.
d

MR. JENSEN moved that the Matter of Notice of Public Hearing for
Hidden Hollow be referred to Allan Rappleyea and Rudolph Lapar,
Attorney and Engineer to the Town and authorize them to represent
the Town in this matter.
Seconded by Mr. Clausen.
Motion Unanimously Carried
A letter was received from Mr. Ghassen Tarazi, 69 Balfour Drive
kir (Schoonmaker Development) accompanied by a copy of a letter he had
addressed to Schoonmaker Brothers Inc. It was his intention that
the Town Board should be made aware of their experience with this
developer in the hope that it would be of some help to the Town
Board. The letter to Schoonmaker referenced to problems with
their sewer lines. Mr. John Steinberg had responded to Mr. Tarazi's
letter, and forwarded a copy of the Town Board.
Mr. Diehl indicated that the final answer to Mr. Tarazi's problems
might be the last paragraph of Mr. Steinberg's answer. "You may
at your expense, excavate the line and make your determination. In
order to secure our agreement to reimburse you for such costs should
we agree that the line is improperly installed, it is mandatory that
a representative of our firm be there at the time that you commence
excavation".
"I appreciate the frustration which you must feel with some of the
problems that you have experienced, but equally I think when you
review the situation objectively, you will agree that the respon-
sibility for the problem belongs to the homeowner until such time
as we can reasonably determine that it belongs to our firm. As I
have stated, we are more than willing to reimburse you for your ex-
penses if we are responsible and equally you should be responsible
to meet your obligations as the homeowners". Mr. Diehl further
commented that the Town has operated in their own districts under the
rules and .regulations that in case of stoppage of lines that the
initiative is taken by the homeowner in excavating and finding out
where the problem is whether it's in his lines or not and at the same
time the Town's engineer inspects the lines and if it is established
whether it is a fault of the Town, the Town stands the responsibility.
Mr. Steinberg is basically saying the same thing.
MR. JENSEN moved that Mr. Tarazi and Mr. Steinberg's letters be
received and placed on file, and further, that the Engineer to
the Town receive copies of these letters, and possibly check, along
with the Highway Superintendent, in a month or so the progress of
what has taken place.
Seconded by Mr. Saland.

A letter was received from William J. Riley, Parade Chairman for
the Village of Wappingers Falls. He informed the Board that this
year, in conjunction with the Community Day Picnic in the Park, a
parade will be held, and was extending an invitation to the Town
Board to participate, and perhaps enter a fleet.
MR. CLAUSEN moved to acknowledge and thank Mr. Riley for the invi-
tation and indicate to him that the Board would not be entering a
fleet, but hopefully will participate.
Seconded by Mr. Saland.
Motion Unanimously Carried.
A letter was received from Mr. Walter Mueller, Lydia Drive, inform-
ing the Board of an intolerable road drainage situation •OD Peter
Drive. He is experiencing the residual water running onto and
collecting on his property from the outfall of a culvert on Peters
Drive which is in a direct line with his house.
Mr. Horton stated it was an old problem and has taken it up with
Mr. Lapar. It would be a legal decision as to whether it was the
Town's responsibility or not. According to Mr. Lapar's calcula-
tions it would be in the neighborhood of $44,000 to correct the
situation. Mr. Clausen recommended Mr. Mueller's letter be received
and advise him that the Town is studying his drainage problem. Mr.
189
x.
Mueller spoke before the Board enlarging on the information he had
previously written to the Board about.
Mr. Clausen commented that he thought the Town Board, and certainly
the Engineer, has been concerned about down stream drainage. He
thinks this partial list just points up again that the Town Board,
Engineer and Attorney to the Town and Highway Superintendent have
got to come up with a solution and get rid of the drainage that's
causing property damage and frustrations to the Townspeople. The
biggest priority are water, sewerage and storm drainage. Water and
sewer are being worked on but up to now we have no definite attack
on storm drainage. He asked again that the Town Board, with all the
resources of Mr. Lapar's office in getting an adequate study before
the Board to act upon for downstream drainage.
Mr. Diehl agreed with Mr. Clausen, but felt the Board has given
that direction to both the Engineer and Attorney and thinks the
Town is working in that direction. It's a question of costs to
the homeowner in the Town at present, there isn't that much commer-
cial, to recoup that money, and the burden would fall on the home-
owner. Mr. Jensen added that $25,000 was allocated by the Town last
year for a downstream study, and also made application to certain
Federal and State agencies for funding of a study, and believes Mr.
Lapar is presently working on this ktudy. Mr. Clausen as he under-
stood the proposal was to find -out all of the drainage problems in
the Town, where is the water going, how does it have to be treated
to get into the streams to be carried away in a proper fashion.
Mr. Horton felt that something that should be looked into was not
draining all the water away, some of the swamps in the development
area should be made into lakes for holding basins, if all the
water is piped. away the water table will fall. That's an area to
look into, where holding basins should be kept. There was some
further discussions along these lines.
A letter was received from the Planning Board regarding some
apparent misunderstanding on the preliminary site plan approval
for Valley View Farms. Mr. Diehl commented that there was already
an executive meeting scheduled with the Planning Board and Dave
Portman from Frederick P. Clark Associates with regard to this
matter on June 20th.
The following letter was received:

RE: Parallel Road - Widmer Road and All Angels Hill Road.
Gentlemen:
The Planning Board of the Town of Wappinger presently has
before them the proposed Cranberry Hills subdivision, Forest
Farms subdivision and Wild Brook Acres subdivision which are
located on Widmer Road and Myers Corners Road.
The Board is aware that there are problems with traffic
congestion along the heavily travelled Widmer Road. It is the
intent of the Master Plan, adopted by the Planning Board, to
alleviate this problem by having collector roads going from
Widmer Road through to All Angels Hill Road. In view of this,
the Planning Board would now like to request that the Highway
Superintendent and the Engineer to the Town prepare a map
indicating more definitively, in rough calculations, where
this parallel road should be located.
The Planning Board would appreciate this information so
we may provide some guidance to applicants proposing to develop
land in this area.
Thank you for your cooperation.
Very truly yours,
s/ Robert A. Steinhaus, Chr.
T/W Planning Board
MR. JENSEN moved that Mr. Lapar be directed to investigate the
lands that are in question and what would be the feasibility of
the road the Planning Board is speaking of, so it can be discussed
from an engineering point, at the meeting with the Planning Board.
Seconded by Mr. Clausen.

A letter was received from Allan Hall, President of the Angel Brook
Civic Association, regarding the fire hydrants in Angel Brook. He
understands they are not approved by the appropriate State Agency,
thereby, feels homeowners are paying a higher insurance premium
than they should.
Mr. Jensen stated that the answer to Mr. Hall's question was that
the hydrants in Angel Brook were merely flushing hydrants. Mr. Diehl
noted that he had contacted Mr. Steinberg, who would investigate
and give the Board any information he comes up with as to the possib-
ility of using the hydrants for fires.
A letter was received from Allan Hall, President of the Angel Brook
Civic Association requesting the status of the Town's acceptance
of the roads in Angel Brook.
Mr.. Diehl noted that the roads are being maintained by the Highway
Department, although complete and official acceptance has not taken
place at this time. Mr. Rappleyea concurred, adding that the Town
had agreed to go in and complete the building of those roads in
return for the payment of $35,000, so that, in effect the Town is
maintaining them after they have been built by the Town. The roads
have been received and filed, there is, however, one outstanding
problem which is not legally resolved, there is an outstanding
lien against the property, which must be cleared up before he recom-
mends the bond be returned to the developer. But for all intents
and purposes they are Town roads.
Mr. D'iehl directed both letters from Mr. Hall be received and
placed on file.

Re: Redesign of Storm Drainage Facilities
in the Spook Hill Estates Subdivision
Gentlemen:
192.
Gentlemen:
My office has examined the above facilities and recommends the
following:
1. All roads must be fully piped to handle runoff from fllting
drains and roof leaders, as required by note "6D" on the filed
map. We have enclosed a map showing the proposed improvements.
2. After discussion with Mr. William P. Horton, Superintendent of
Highways, it was decided that any and all homes in the sub
division must have their lowest opening at least 2 feet above
the final road grade (as required by note "6B"). We are
particularly concerned that the 30" outfall will be submerged
during storm periods, as the swamp on the east side of Spook
Hill Road north of the outfall often floods.
In addition, a bond of $15,000 should be posted to assure the
subdivision's participation in the Downstream Drainage Program.
We feel the above figure is adequate until such time as our report
is completed and a determination by the Town Board as to who, if
anyone, will pay for said downstream drainage and to what extent.
Very truly yours,
s/ Rudolph E. Lapar P.D.
MR. CLAUSEN moved Mr. Lapar's report be received and placed on

Gentlemen:
As I understand, the original resolution for "Ye Olde Apple
Orchard." was each of three -developers was to pay $24,0.00.00: for -
100 hook-ups to the sewer system.
I think your office should review the number of hook-ups
received by each developer; then the Town Board should make
make a determination as towhether an additional hook-up fee
should be charged.

Gentlemen:
At present the Town has adopted a new Master Plan, and
the new zoning ordinance and map are in the offing. Until the
new ordinance with_its map is enacted, however, we continue to
be governed by the old ordinance and its map.
There are portions of the zoning map and the new Master
Plan which differ considerably- from one another.. For example,
the areas along the Hudson River designated on the new plan to
be "low density" and "conservation" areas are now zoned "indus-
trial". There are numerous other conflicting areas. Presently,
there is an application pending before the Planning Board for
an Industrial Park in one such area.
It will be some time before the new ordinance and map are
enacted by the Town. In the interim, the Town should begin
moving in the direction of the new Master Plan. To do otherwise
is to risk development which would be incompatible with this new
plan. At our last executive meeting with the Town Board, we rec-
commended that some: protective measures be taken. In light of
current developments, it is urgent for the Board to act promptly.
The interim approach recommended by the Zoning Regulations
Advisory Council is®to take those areas on the present zoning map
which differ from the new plan and to rezone them to be in reason-
able compliance. Existing boundaries would be used as far as pos-
sible as would existing zoning designations.
We are submitting the zoning map with the recommended changes
for your consideration.
Respectfully submitted,
s/ Alexander Zak
s/ Warren Strohm
ZRAC Chairman
Mr. Clausen explained, with regard to the above letter, that four
Town Board members hadmet with ZRAC informally, at which time they
had forwarded suggestions.and several maps that the ZRAC Committee
had outlined with regard to implementing zoning changes for an
interim period until the new Master Plan can be implemented by a
new zoning ordinance. When the Town Board and Planning Board has
had an opportunity to look them -over, a meeting can be arranged
with ZRAC to exchange thoughts, opinions and suggestions.
The Town Clerk informed the Board that she had been served on May
31, 1974 with a notice of Petition and Petition by Sarah P. Taylor
vs. the Town of Wappinger, Thomas Logan, Assessor et al.
MR. CLAUSEN moved Allan E. Rappleyea, Attorney, be appointed to
answer and defend this action on behalf of the Town of Wappinger.
Seconded by Mr. Jensen.
Motion Unanimously Carried
A petition was received from Mr. M. Specter P.E.L.S. representing
H.L. Associates requesting a PUD, districting for property on
Maloney Road (S.J.-Reynolds property).
MR. CLAUSEN moved that the Town Clerk send Mr. Specter a letter
indicating that the Town Board has been holding meetings and is
quite busy with Town government, and as soon as it sees an oppor-
tunity in the near future to meet with him again, the Board
would like to do so. But before another meeting, I feel that his
application does not warrant the recommendation at this timeto
the Planning Board.
Mr. Diehl directed a letter be forwarded to Mr. Specter indicating
that no action is being taken at this time and time and date will
be available some time in the future.

Re: Proposed Shopping Center
Myers Corner Rd. & W.S. Rt.9
Town of Wappinger, New York
Dear Rudy:
We have been studying the possible methods of providing
domestic water and fire protection services to the proposed
development. It appears that the most feasible would be to ex-
tend the Town water main that presently terminates at Myers Corner
Road from,$ "ipok Hill Road. Our previous discussions with you
indicated that adequate pressure and volume of water would be
available from this source, due to the height of the tank on
195.
Spook Hill.
Prior to our preparing detailed Working Drawings for such a
water main connection, we will need some assurance that adequate
service is available and that we would be permitted to extend this
system. Our requirements for the project would be 2,000 gallons
per minute with a residual pressure of 20 psi at the sprinkler
heads.
By copy of this letter, we are requesting the Town Board to
accept our application for such service and at the same time provide
us with a letter indicating we will be permitted to extend the
main up Myers Corners Road. This water main within the right-of-way
could then be dedicated to the Town of Wappinger. In addition, we
would like to have a flow test run on the nearest hydrant which
we could perform if it meets with your approval.
Since we are proceeding posthaste with the Working Drawings
for this project, we would appreciate an early answer to the items
noted above.
Very truly yours,
s/ Harry W. Nichols, Jr.
Mr. Diehl recommended that at this time the Board should instruct
Mr. Lapar to come forth at the next meeting with his recommendation
and decisions so that the Board can take some type of action on
this request. He believes the Board is familiar with this situation,
and have discussed and agreed in the past, the possibilities of
expanding the Wappingers Water Improvement Area to Route 9. Mr.
Lapar has indicated there will be an adequate supply of water to
take care of this shopping center and it would be an asset to the
people of the water district as well serve additional homes along
Myers Corners Road for the future, and bring water to other areas
of Route 9. Mr. Lapar indicated he had already communicated with
Mr. Nichols.
MR. CLAUSEN moved that a letter be written to the developers
indicating that the Town is favorable t_towardl their coming into
the Water Improvement provided they meet certain criteria set forth
by the Engineer.
Seconded by Mr. Jensen.
Motion Unanimously Carried
Under Committee Reports, Mr. Jensen stated that he had a conserva-
tion with the Building Inspector to try to clean up some of the
problems that were encountered in the Town Hall recently. And
unfortunately due to tight schedules,, it has not been possible to
meet with Mr. Clausen and Mr. Diehl to review the other sites that
have been reconimnded for other spaces for Justice Court. Hope-
fully in a week or two an inspection can be made. He also reported
on contracts for the next phase for the Town of Wappinger for the
1990 program, that they .should be forthcoming shortly.

The matter of the Recreation Commission's request of raising the fee
of the cash in lieu of land for recreational purposes in subdivi-
sions was placed before the Board for their consideration.
Mr. Jensen commented that, although it is a last resort to accept
cash instead of land for recreational purposes, the matter of raising
the present fee had been initially discussed at the last Board
meeting, resulting in a request to the Attorney to the Town to
review the possibility of raising this fee and at the same time
look -into the legality of .possibly prorating the fee so that the
fee could be according to the size of the lot rather than a flat
per lot fee. This would then work out to a graduated or escalat-
ing scale. Mr. Rappleyea did not have a report, but felt it would
certainly be legal to have it on a graduated basis, on a basis where
acreage would be the determining factor. It was his conclusion that
in reaching that determination, $100 could be rated at per 1 acre
lot, for 1 acre would certainly be reasonable, but the final
determination would be a legislative one, and up to the _Board to
reach a scale of rates. Mr. Jensen recommended that this be
discussed further at a work session of the Board.
The matter of redistricting the Town of Wappinger Election Districts
was placed before the Board. Mr. Anthony Cannistra and Mr. Donald
Reilly, co-chairman of the Redistricting Committee, recommended
adoption of 21 Election Districts.
MR. JENSEN moved to accept the recommendation of the Redistricting
Committee to expand the existing 14 Election Districts to 21 Dis-
tricts, and adopt the following Election Districts for the Town of
Wappinger, to become effective September 15, 1974, (after Primary

Town Board

Wappingers Falls, N.Y.
Re: Indian Ridge Proposed Storm
Sewer Project
Gentlemen:
As a result of an informal discussion between the Town Board
Supt. of Highways and the Attorney to the Town on May 30, 1974,
we have revised our storm sewer estimate.
The total cost to drain wet areas of the subdivision has been
estimated at approximately $350,000.00.
We have included a map for information showing the proposed
extent of the improvements.
It is understood by the Board that storm sewers are not de-
signed to handle sanitary waste water effluent. However, in
the installation of storm sewers, it is common to pick up
ground water and individual springs that are encountered, there-
by lowering the water table which usually allows the ground
more area for wastewater effluent absorption.
Very truly yours,
s/ Rudolph E. Lapar, P.E.
Mr. Diehl asked if Mr. Lapar had any further comments. Mr. Lapar
had none, but Mr. Versace commented on a partial list sans details,
similiar drainage problems the Board had received just prior to
the meeting. Indian Ridge was, however, the one that had been
under discussion for the last two meetings and the one the Board
had asked for a report on. Mr. Versace then moved that the Board
request the attorney to draw up a resolution for a bond issue to
correct the problem at Indian Ridge Project, and the nine items
should be deferred until the Board can have time to study them.
Mr. Clausen said he would second the motion if the Highway Super-
intendent and the Engineer to the Town have no objections as to why
the storm drainage is not needed and necessary. This motion and
second was later withdrawn. There was a question from the floor,
then Mr. Jensen, for clarification of Mr. Versace's motion,
questioned if he understood the proposal was to pass a resolution
for a $350,000.00 Bond issue to correct Wappingers Park septic
and storm drainage problems. As he understands Mr. Lapar's letter
there is no guarantee that this ground water problem would be
solved completely, that storm drains do take on some ground water,
but would not necessarily do the complete job. He also asked if
he was correct in assuming that if it does pick up any of this
septic water in going down the storm drains that it would defin-
itely get down to its tributary, therefore, in effect polluting
211..E
the stream. Mr. Lapar answered that was correct. Mr. Versace
then asked Mr. Lapar if the water table was lowered would it
solve some of the problems that have occurred. Mr. Lapar said
that's possible. Don Reilly asked if a Bond issue of this size
generally calls for a referendum. Mr. Rappleyea explained the 3
types of referendum, and what would necessitate each, and that if
the proposition is not related to the Highway it would probably
be subject to referendum. He would not, however, commithimself
069 without first consulting the Bonding counsel in New York. He
would submit the proposal to them and have them pass on it in the
first instant. Mr. Reilly presumed that the Bond would be the
liability of the whole Town, not just Wappingers Park and this was
verified by Mr. Rappleyea. Mr. Diehl indicated he would support
Mr. Versace's motion with an amendment that a referendum be set
to get the ball rolling, and have some type of action in the fore-
seeable future. Mr. Versace had no objection, but,Mr. Clausen
I
commented that if the Attorney could not rule on it.tonight he
thought it a little ridiculous to set a date for a permissive ref-
erendum, providing one would be necessary. He didn't believe the
Board should put it up if they were not clear on whether it's
necessary, or not, and he didn't want to hold a referendum if it
wasn't necessary. Mr. Rappleyea again explained the 3 types of
referendum, the 3rd type of referendum allows the Board, of its
own volition could put it up for a vote.". Mr. Jensen felt a bond
of this magnitude should go to referendum, if the whole Town is
going to pay taxes on it they should vote on it, and since the indi-
cation is that it is not strictly a road drainage problem, most prob-
ably a referendum would be necessary. There was further discussion
as to whether or not to call for a referendum. Mr. Rappleyea again
indicated that he would call the Bonding counsel in New York for an
opinion and/or resolution. Mr. Diehl stated he would move the reso-
lution again to instruct Mr. Rappleyea to form a resolution in re-
gard to the figures as presented for Wappingers Park storm sewer
212.x.
project, subject to the conditions that exist, and with the rec-
ommendation and advice of the Town's Bonding counsel, to be acted
upon at the next Town Board meeting, Mr. Clausen said he and Mr.
Versace would accept that. Mr. Saland made a final comment on
this question of bonding, in that unlike Mid -Point Park where only
those people in the district would pay the bill, the Board would
be asking approximately 22,000 people in the Town of Wappinger
to foot the bill for several hundred people, this he believes is
why a referendum is in order. Mr. Diehl said that's the decision
we're saying that we will come to when the Bond counsels opinion
is received. Mr. Clausen's comment was that the Board doesn't
know if the Bond counsel will say a referendum is necessary or not.
MR. DIEHL moved that the Attorney to the Town be instructed to
formulate a resolution in regard to the Wappingers Park Storm Sewer
Project and present it to our Bonding counsel for their recommenda-
tion and advice.
Seconded by Mr. Clausen.
Motion Unanimously Carried
Mrs. Wells being recognized by the Chair stated that there defin-
itely was effluent on our property where we get our water from, and
it really needs drainage on that property where we get our water.
Mr. Horton indicated that drainage for the water plant property was
already scheduled in the present storm drainage project in this area.
Mrs. Wells asked them about the recreation area and was informed by
Mr. Diehl that it would be strictly just a cleared area on the
water plant property, no more than that. Mr. Maurer was looking
into costs for clearing the property, but there would be no dig-
ging, no adding to it, nothing except a cleared area. Mr. Wayne
Moreau asked if there was a master plan for a storm drainage
system in the Town. Mrs. Wells asked if the Town would do a
feasibility study of the Wappingers Park Water System. Mr. Jensen
answered that in order to do this properly the residents of
Wappingers Park should petition the Town Board. Mrs. Wells
asked if the Town could supply some "no dumping" signs to be
erected at the water plant.
MR. SALAND moved the meeting be adjourned, seconded by Mr. Jensen
and unanimously carried.
The meeting adjourned at 10:32 P.M.
