ADJOURNMENT 49 The Regular Monthly Meeting of the Town Board of the Town of Wappinger was held on February 11, 1974, at 8:00 P.M. at the Town Hall, Mill Street, Wappingers Falls, New York. Supervisor Diehl called the meeting to order at 8:26 P.M. Present: Louis Diehl, Supervisor Louis Clausen, Councilman Leif Jensen, Councilman Stephen Saland, Councilman Frank Versace, Councilman Elaine H. Snowden, Town Clerk Others Present: William Horton, Superintendent of Highways Allan Rappleyea, Attorney to the Town Rudolph Lapar, Engineer to the Town The minutes of the December 10, 1973 and January 14, 1974 Regular Monthly Meetings, December 21, 1973 Special and December 28, 1973 Auditing Meeting, having been previously sent to the Town Board members,: were now placed before the Board for their approval. MR. CLAUSEN moved the minutes of the December 10, 1973 and January 14, 1974 Regular Monthly Meetings, the December 21, 1973 Special Meeting, and the December 28, 1973 Auditing Meeting, as submitted by the Town Clerk be and they are hereby approved. Seconded by Mr. Jensen. Motion Unanimously Carried Reports for the month of January -were received from the Supervisor, Building Inspector and Town Justices, and also the annual report from the Grinnell Library. MR. CLAUSEN moved that the Januaryreports from the Supervisor, Building Inspector, Town Justices, and the annual report from the Grinnell Library be accepted and placed on file. Seconded by Mr. Saland. CLAUSEN moved the bills be paid, subject to audit. Seconded by Mr. Jensen. Motion Unanimously Carried Due to a capacity attendance in the Town Hall, Mr. Diehl, with full consent of the Board, deviated from the agenda by moving the first and third Resolutions up to the first order of business, since it was indicated the residents present were primarily con- cerned with these matters. The following resolution was introduced by COUNCILMAN CLAUSEN, who moved its adoption: WHEREAS, the Town of Wappinger Planning Board approved of the Valley View Farm Planned Unit Development on December 6, 1973, and WHEREAS, the Town of Wappinger conducted a public hearing with respect to said Planned Unit Development on January 16, 1974, NOW, THEREFORE, BE IT RESOLVED: 1. The Zoning map of the Town of Wappinger is hereby amended to provide that the following property is hereby classified as a Planned Unit Development: A. Town of Wappinger Tax Map, Map 84 - Lot 1.1 B. Town of Wappinger Tax Map, Map 84 - Lot 9 C. Town of Wappinger Tax Map, Map 76 .. Lot 10.1 2. The Valley View Farm Planned Unit Development as set forth on a map made by Richard G. Barger, P.E., dated November 1, 1973, and revised Febrary 8, 1974, and as filed with the Town Clerk is hereby approved by the Town Board of the Town of Wappinger subject to the following terms and conditions: A. Preliminary and final site plan approved by the Town of Wappinger Planning Board in accordance with the provisions of the Town of Wappinger Zoning Ordinance. B. Construction of a maximum of 550 dwelling units upon the entire tract, which construction shall take place in at least four stages; each successive stage of which shall be commenced only upon Resolu- tion of the Town of Wappinger Planning Board after approval of the preliminary and final site plan. The Town of Wappinger Planning Board shall consider the following criteria, in addition to any standards it may seek to establish before the commencement of each stage; (1) Whether or not the sewer and water facilities have been installed and are sufficient to serve the proposed stage to be constructed, and whether or not the construction and operation have had an adverse effect upon the surrounding properties. (2) Whether or not the recreation facilities have been completed in a manner sufficient to serve the resi- dents'of each stage. C. The construction of the said 550 dwelling units in stages shall be in the following ratios and each stage shall contain at least 100 dwelling units and no more than 150 dwelling units: 45% one bedroom dwelling units 45% two bedroom dwelling units 10% three bedroom dwelling units D. The ownership of the dwelling units shall be a condo- minium arrangement pursuant to the laws of the State of New York. E. All areas designated on tax map of Valley View Farm as Agricultural Conservation Area (11+ acres); Slope Conservation Area (41+ acres) or Open Space shall be owned by the Condominium unit. The Undeveloped Recrea- tion Area (100+ acres) and Slope Conservation Area shall be maintained in a forever wild state. The Agricultural Conservation Area may be leased for farming operations. F. The area on said map sown as "Lake" site shall be dredged and maintained in accordance with such recommendations as may be established by the Planning Board after con- sultation with the New York State Department of Environ- mental Conservation. G. The private road system shall not exceed 7500 feet in length and shall be constructed in accordance with Town of Wappinger road specifications. H. The Owners shall offer to dedicate to the Town of Wappin- ger for public purposes a parcel of land totaling approx- imately 20 acres, which said lands shall be set forth on the preliminary site plan and which said land shall be dedicated to the Town of Wappinger for public purposes at the tineof the granting of final site plan approval. The final site plan shall not be approved by the Planning Board until the quantity and location of such land shall have been approved by resolution of the Town Board. I. Prior to issuance of a building permit the entire parcel shall be held in single separate ownership by one entity. Seconded by: Councilman Versace Roll Call Vote: Councilman Councilman Councilman Councilman Clausen Aye Supervisor Diehl Aye Jensen Aye Saland Aye Versace Aye 51, •1 Resolution Unanimously Adopted t Mr. Clausen had a question on the dedication of recreation land, whereby Mr. Diehl, addressing Mr. Gordon, asked if, in fact, the area he intended to dedicate was that parcel which was located on River Road opposite the New York City Waterworks. Mr. Gordon answered yes. Mr. Clausen had another question regarding the number of bedrooms per dwelling unit, wishing to clarify the point that if an apartment was designated "one bedroom", the lay- out of the apartment would not be such that another room designated as perhaps a den could be utilized as a second bedroom. It was agreed that the concept would be one bedroom meaning a three room apartment, kitchen, living room, bath and bedroom. The following Ordinance was introduced by COUNCILMAN VERSACE who moved its adoption: BE IT ENACTED AND ORDAINED by the Town Board of the Town of Wappinger that the Town of Wappinger Zoning Ordinance adopted January 29, 1963, and amended from time to time, is further amended as follows: Section 1. Section 111 is hereby added to read as follows: "Section 111. The Town of Wappinger has had'prepared for its consideration a Town Development Plan, which said plan was prepared by Frederick P. Clark Associates under date of June, 1973, with addenda dated November 29, 1973, and December 31, 1973. To insure and promote the principles as set forth in said plan and the principles of this Article, and pending the considera- tion and adoptionof appropriate amendments to the Town of Wappinger Zoning Ordinance, the Town Board of the Town of Wappinger hereby declares a moratorium upon certain phases of building and land development within the corporate limits of the Town of Wappinger, exclusive of the Village of Wappingers Falls, for a period of 120 days from the effective date of this amendment; which said period shall automatically expire at 12 midnight on the 120th day. A. No building permit shall be issued for the constru tion of any building except for a single family dwelling upon a lot which is a lawful lot as defined by the terms of this ordinance. B. No sub -division plat or site plan shall be granted any form of approval by the Town of Wappinger Planning Board". Section 2. This amendment shall take effect immediately upon adoption, posting and publication as provided by Town Law. Seconded by: Councilman Clausen kw MR. VERSACE moved that a public hearing be set for March 18, 1974 at 8:00 P.M. EDST at the cafeteria of the Wappinger Junior High School, Remsen Avenue, Wappingers Falls, New York on a pro- posed ordinance establishing a moratorium on building, at which time all persons either in favor of or in opposition thereto, will be heard. Seconded by Mr. Clausen. Roll Call Vote: Councilman Clausen Aye Councilman Jensen Nay Councilman Saland Nay Councilman Versace Aye Supervisor Diehl Nay Motion to set a Public Hearing defeated. 5 3 Supervisor Diehl stated that the next order of business would be a return to the next item on the Agenda - 5A. Mr. Joseph Incoronato, having requested to speak before the Board on the subject of a building moratorium, first facetiously commented that the Board had stolen his thunder, but continued by mentioning that he had at a previous meeting submitted case notes on the topic of building moratoriums, and then proceeded to read a section (5.09) from the second edtion of Andersons' New York Zoning Law and Prac- tace which relates to interim or stop -gap zoning. This stimulated some discussion on the legality of such measures, whereas Mr. 1160 Rappleyea summed up the question by consenting that if there were to be a moratorium as was proposed„ he would have to defend any time subsequent litigation as they would appear. MR. CLAUSEN moved the rules be suspended to hear from Mr. Warren Strohm, seconded by Mr. Versace, and carried. Mr. Strohm believed the Zoning Regulations Advisory Committee should make some comment relative to a building moratorium. He commented that ZRAC had held a public meeting on the Town develop- ment plan last week, at which most of the people present felt a Zoning Ordinance to back up this plan should be expedited after its approval, and protection of the Town until such time as that ordinance could be developed, and a moratorium was the best way to do that. MR. CLAUSEN moved the rules be resumed, seconded by Mr. Saland and carried. The following letter was received: January 29, 1974 Town Supervisor and Town Board Town of Wappinger Town Hall, Mill Street Wappingers Falls, New York Re: Expansion of Sewage Treatment Plant of Mid Point Park Filtration Corp and area to be served by the same. Gentlemen: I represent Riverview Associates, a New York partnership which is presently under contract to purchase property on Route 376 in the Town of Wappinger, Dutchess County, New York, immediately_ adjacent to the subdivision known as "Mid Point Park". My client contemplates constructing a minimum of one hundred thirty resi- dential homes on the subject property, with the same to be serviced by central water and sewage facilities. It is contemplated that the sewage facilities will consist of an expansion of the existing facilities owned by Mid Point Park Filtration Corporation, which presently serves the Mid Point Park subdivision. It is my client's intention to expand the facilities of the existing plant so that the same can handle an additional capacity of 60,000 gallons per day. Since Mid Point Park Filtration Corp., is a transportation cor- poration under the laws of the State of New York, which has previously been approved by your Town Board, it will be necessary for my client to make application to both your Town and the Dutchess County Department of Health and New York State Department of Environmental Conservation for the approval of the expanded area and facilities. Since I also represent Mid Point Park Filtration Corp., I can assure you that it is in full agreement with the proposal for' the expansion by Riverview Associates. At the present time, my client's engineers are in the process of submitting the required plans and applications to the Dutchess County Department of Health and the New York State Department of Environmental Conservation for its expansion and as soon as we have the same and fully prepared we will also submit a copy of the same to your Town Board. In the meantime, since time is an important element under the terms of our existing contract for the purchase of the land and the approval for the expansion of the district, I would appreciate it if you would kindly advise us whether you feel an informational type meeting would be of any benefit to the Town Board or, in lieu thereof, if you have any questions or require any additional information or data which we will be more than pleased to submit to you upon request. Thank you for your considerations in this matter. Very truly yours, s/ John M. Reed Mr. Diehl commenting on Mr. Reed's request, believed, from past experience, that this sewer plant is questional' e. Mr. Clausen, noting that Gary Schmitt was present, suggested the Board allow him to speak since he had experienced problems with sewerage from this plant. Mr. Schmitt stated he had .had a problem with sewerage entering his house since 1970, and no one has really done anything about it. The last episode being the weekend before Christmas. He has written to everyone he could think of about it. Mr. Trautmanis, a Vice President of the Tri Pacific Corp. had said they would try to repair some of the damage that was done and assure him that it wouldn't happen again. He's not sure that all the remedies have been taken care of. One was supposed to be corrected by overflow system - put in a wet well, an overflow pipe that is supposed to dump directly into the stream with a chlorina- tor on it. Another was put in a new screen to catch rocks which bind the pumps up, also, install audio and visual alarms in that would go off_if a problem occurred. He hasn't heard of any of these things being taken care of except the chlorinator (which he saw installed). (He also submitted a letter he had written to Mr. Trautmanis itemizing damages caused by the back up of sewerage and reiterating his plea to correct the problems). He strongly urged the Town not consider the purchase of the plant until it can function in the capacity that it is supposed to. It can't at this time even support what it is supposed to - how can it support an additional 135 homes. He also mentioned that whenever there is a heavy rain, there is a high infiltration of surface water into the sewer plant, which overflows the tanks, and the plant does not operate and he usually gets it back in his basement again. He also believes there are breaks in the pipes allowing rocks to flow into the pumps, and he stated that he knows that the system wasn't completely TV's before the Town took the roads over. Storm drains were also found that connected into the sewer lines also. Mr. Saland said that presently there are two requests to consider the expansion of the Mid -Point Sewer Plant syptem, and as an aside, the Town is not projecting purchasing that sewer system, the purchase of the water system only will'be before the Board for consideration, but insofar as the expansion of this system (sewer) he would like to propose that no consideration be given any expan- sion until some of these problems are resolved, and he called the Board's attention to the letter of January 2, 1974 from Camo Pollu- tion Control, where Mr. Caccio, President, brings this particular problem to the attention of Mr. Trautmanis, and suggests that before any consideration be given to any action with regard to that plant, that Mr. Cacciq's letter be adhered to. MR. SALAND moved that no consideration be given any expansion of the Mid -Point Park Sewer System until some of the problems are resolved; and further, notify the Dutchess County Department of Health of the situation, that sewer plant problems still exist, that Camo Pollution has indeed brought this particular problem to the attention of Mr. Trautmanis, and that before any considera- tion by the Town Board will be given to any action, with reference to the Mid -Point Park Plant, Mr. Caccio's letter be adhered to. It is the further desire of the Town Board to arrange a meeting with Mr.JackHill of the Dutchess County Department of Health, Mr. Trautmanis and the Town Board for a sight inspection. Seconded by Mr. Clausen. Motion Unanimously Carried 57 A letter was received from Melvin A. Engelman, DDS in support of an ordinance requiring all newspapers to be separated and curbed for collection throughout the Town. MR. Motion Unanimously Carried Communications had been received regarding two meetings, the first, a meeting of the State Comptroller's Committee on the Real Property Tax Law and the other a training session on Natural Resource In- ventory sponsored by the Cooperative Extension. 65 Thomas Logan, Sole Assessor requested permission to attend the Real Property Tax Law Committee meeting at the Hotel Thayer on February 21, 1974, and the Conservation Advisory Council requested permission for four members to attend the training sessions of the Dutchess County Cooperative Extension Association on Feb. 19 Feb. 26, March 12, March 18 and March 26, 1974. MR. CLAUSEN moved that Mr. Logan and four members of the Conser- vation Advisory Council be granted permission to attend their respective meetings, and that their legitimate expenses be Town charges. Seconded by Mr. Saland. Motion Unanimously Carried Supervisor Diehl declared a recess at 9:54 P.M. Supervisor Diehl called the meeting back to order at 10:31 P.M. All Board members again present. Mr. Roger Evans, Dogwood Hill Road, being recognized by the Chair, submittedsa petition to the Board stating "We, the residents of Dogwood Hill Road, Wappingers Falls, New York are in agreement that the water in our area is becoming more of a problem. In- creasing difficulties in our wells are becoming more evident each day." "At this time we are asking the Town Board of Wappingers Falls for consideration in running the approved water district through our area at the earliest possible date". The petition contained 22 signatures, representing 15 families on this road. Mr. Evans elaborated on the petition, indicating ".5 families had already .had to.drill nem well8t4ith the last 3 achieving no,results and the water supply was excessively limited in some homes; eight families being very restricted and they are requesting a priority status (in relation to being serviced by the Central Wappinger Water Improvement). Mr. Diehl indicated there had been meetings in the d i 67 past when this and similar problems had been discussed. It was his feeling that the Board could reconsider and reevaluate the possibilities for this area. Mr. Jensen added that he believed this phase is not anticipated until 1975, but what will have to be done is sit down with the Engineer to see if it is feasible to speed up the construction of these lines. William Walker mentioned that the flow rate was continuously going down, and some people are already transporting water. He doens't feel that the individual flow rates will sustain unti 1975. Mr. Diehl indicated these residents would be notified of any decisions arrived at. Under committee reports, Mr. Saland, with reference to the pos- sibility of Historic Zoning, said he had conferred with John Bunting who has invited him to join with him to meet with some gentlemen from Cornell, and in addition, at the Association of Towns meeting Mr. Saland spoke with Mr. James Coons, Attorney to the State Office of Planning who agreed to provide him with certain additional information. Mr. Saland also stated he had requested the Supervisor to extend an invitation to Mr. Bunting to attend the March 4th executive session to discuss it further and get some of their imput. Mr. Jensen, reporting on the Fire Prevention Ordinance, indicated 111100 he and Mr. Versace had a meeting with the three Fire Chiefs, reviewing the comments made at the Public Hearing, a nd'made some kee additions and deletions to the ordinance.. At present the revisions are in the hands of the attorney. He also believes there were enough changes to warrant another Public Hearing. Mr. Rappleyea added that he would like to change the format of that and rather than an Ordinance, present it as a Local Law. 1 MR. JENSEN moved that a special meeting be held by the Town Board on February 20, 1974 at 6:45 P.M. for the purpose of intro- ducing a Local Law on Fire Prevention and Safety setting a Public Hearing on it, and any other business that may properly come before the Board. Seconded by Mr. Saland. Motion Unanimously Carried Mr. Clausen reported, as the delegate to the annual meeting of the Association of Towns, that the Association passed 7 resolu- tions recommending to theState Legislature. One, he believed, was of special interest to Wappinger which basically was that the Planning Board would have the right to acquisition land or money from new developers towards the building of new schools. The concept being that the new developers and new people coming into Town add to the burden of the school tax and that it would give the Planning Board the option to acquisition either land or money in lieu of land towards schools. Mr. Clausen indicated there had been opposition to this at the meeting, but he had stated he believed the resolution was optional, if a community didn't need it it wouldn't have to utilize it but to allow those communities who saw fit, should have the right to make that decision. He would like to have the Board recommend to the State Legislators the pas- sage of such a bill, but first, requested the Town Clerk to write the Association of Towns for a copy of the resolutions that were passed, to have the context of the resolutions in front of the Board when proposing support of it. There was no report from the lighting committee on the request for street lighting at the intersections of both Balfour and Scott at their intersections with Old Hopewell Road. c 69 The following resolution was offered by COUNCILMAN VERSACE who moved its adoption: WHEREAS, the members of the Town Board of the Town of Wappinger are seriously concerned with regard to the problem of those United States servicemen who are missing in action as a result of hostilities in Viet Nam and WHEREAS, it appears that the government of North Viet Nam has not provided the United States government with all the infor- mation that it might have available to it with regard to the fate of those men who are missing in action. Mr. Clausen indicated the Planning Board and Town Board have discussed 't 1 this matter on several different occassions, and are aware of the Town Board's sentiments on this subject. The Town Board did tell the Planning Board they were going to take this action tonight and they should be aware not to consider the granting of density bonuses. Mr. Lapar asked about the plans before the Planning Board at•.:present with preliminary approval, does this create a morator- ium for 60 days. Mr. Rappleyea said it did. MR. CLAUSEN moved that the Town Clerk would indicate by letter to the Planning Board the action taken on the 412.02 section and state that, a moratorium on density bonuses is in effect. Motion Unanimously Carried The following resolution was offered by COUNCILMAN CLAUSEN who moved its adoption: BE IT RESOLVED, by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: Section 1. Of the $3,963,320 serial.bonds authorized by - bond resolution dated August 14, 1972, for the construction of improvements in and for Wappinger Sewer Improvement No. 1 in said Town, there shall be issued and sold only $500,000 serial bonds, which shall mature $14,000 in each of the years. 1975 to 1980,.both inclusive, $16,000 in each of the years 1981 to 1986, both inclu- sive, $17,200 in each of the years 1987 to 1991, both inclusive, and $19,500 in each of the years 1992 to 2003, both inclusive, and shall be consolidated with other issues of bonds of said Town as hereinafter authorized. It is hereby determined that the period of probable usefulnessof the aforesaid specific object or purpose is forty years pursuant to subdivision 4 of paragraph a of Section 11.00 of the Local Finance Law, computed. from Decem- ber 27, 1972, the date of the first bond anticipation note issued therefor. It is hereby furtherdetermined that the sum of $13,320, from sources other than the proceeds of bonds or bond anticipation notes, will be used on or before December 27, 1974 to reduce the amount of bond anticipation notes now outstanding and issued tWO for the aforesaid specific object or purpose, and such payment shall constitute the first principal installment of such indebted- ness. Section 2. It is hereby determined that the period 7'2.` of probable usefulness of the aforesaid specific object or purpose if forty years pursuant to subdivision 1 of paragraph a of Section 11.00 of the Local Finance Law, computed from July 5, 1973, the date of the first bond anticipation note issued therefor. Section 3. Of the $475,000 serial bonds authorized by bond and capital note resolution dated November 13, 1972, for the construction of necessary works for a drainage system for the protection and maintenance of Town highways, there shall be issued and sold only $375,000 serial bonds, which shall mature $10,000 in each of the years 1975 to 1980, both inclusive, $12,000 in each of the years 1981 to 1986, bith inclusive, $13,800 in each.of the years 1987 to 1991, both inclusive, and $14,500 in each of the years 1992 to 2003, both inclusive, and shall be consolidated with other issues of bonds of said Town as hereinafter authorized. It is hereby determined that the period of probable usefulness of the aforesaid class of objects or pur- poses is thirty years pursuant to subdivision 3 of paragraph a of Section 11.00 of the Local Finance Law, computed frum August 28, 1973, the date of the first bond anticipation note issued therefor. Section 4. The serial bonds described in the preceding sections hereof, are hereby authorized to be consolidated for purposes of sale into one bond issue, aggregating $1,275,000. Such bonds shall each be designated substantially PUBLIC IMPROVE- MENT (SERIAL) BOND, 1974, shall be dated March 1, 1974, shall be of the denomination of $5,000 each, shall be numbered from 1 to 255, both inclusive, and shall mature in numerical order in the amount of $35,000 on March 1 in each of the years 1975 to 1980; both inclusive, $40,000 on March 1 in each of the years 1981 to 1986, both inclusive, $45,000 on March 1 in each of the -years 1987 to 1991, both inclusive, and $50,000 on March 1 in each of the years 1992 to 2003, both inclusive, with interest thereon payable September 1, 1975, and semi-annually thereafter on March 1 and'September 1. Such bonds shall bear interest at such rate as may be necessary to sell the same, which rate shall be deter- mined in the manner provided in Section 59.00 of the Local Finance Law. Such bonds shall be in bearer coupon form with the prj_vilege of conversion into bonds registered as to both principal and interest, and shall be payable as to both principal and interest in lawful money of the United States of American at Marine Midland Bank of Southeastern N.Y. N .A., Wappingers Falls., in Dutchess County, New York, or, at the option of the holder, at Marine Midland Bank New York in New York, New York, which by contract are the paying agents of the issuer. The aforesaid maturities constitute the aggregate of the individual maturities of each separate issue, which individual maturities are prescribed in the preceding sections hereof. Such bonds shall be signed in the name of said Town of Wappinger, Dutchess County, New York, by its Supervisor, and a facsimile of its corporate seal shall be imprinted thereon and attested by its Town Clerk, and the interest coupons shall bear the facsimile signature of said Super- visor. Section 5. All other matters, except as provided herein relating to such bonds, shall be determined by the Supervisor. Such bonds shall contain substantially the recital of validity clause provided for in Section 52.00 of the Local Finance Law and shall otherwise be in such form and contain such recitals, in addition to those required by Section 51.00 of the Local Finance Law, as the Supervisor shall determine. • L 373 Section 6. The faith and credit of said Town of Wappinger, Dutchess County, New York, are hereby irrevocably pledged to the payment of the principal of and interest on such bonds as the same respectively become due and payable. An annual appro- priation shall be made in each year sufficient to pay the prin- cipal of and interest on such bonds becoming due and payable in such year. Section 7. The powers and duties of advertising such bonds for sale, conducting the sale and awarding the bonds, are hereby delegated to the Supervisor, who shall advertise such bonds for sale, conduct the sale and award the bonds in such manner as he shall deem best for the interests of said Town provided, however, that in the exercise of these delegated powers, he shall comply fully with the provisions of the Local Finance Law and any order or rule of the State Comptroller applicable to the sale of municipal bonds. The receipt of the Supervisor shall be a full acquittance to the purchaser of such bonds, who shall not be obliged to see to the application of the purchase money. Section 8. We know of no reason why final payment should not be made. We call your attention to the fact that final inspection has not been made on the project and subsequently final Grant payment has not been requested. To the best of our knowledge, because of persisting infiltration and operational problems the pre- requisit six months operation conforming to permit requirements cannot be provided. Mr. Lapar reminded the Board that Mr. Davis was supposed to get letters from the adjoining property owners, and engineer's calcu- lations on cubic yardage that will be removed. MR. Motion Unanimously Carried The following resolution was introduced by COUNCILMAN VERSACE who moved: its adoption: Paragraph one of the resolution establishing a Conservation Advisory Council shall be amended to increase from seven to nine the .Members of such council. Seconded by Mr. Clausen. NO VOTE (Mr. Versace and Mr. Clausen withdrew this motion) Mr. Saland asked Mr. Versace if there was any particular purpose for increasing the number of members. Mr. Versace said that, in conversation with Mr. Cortellino, Mr. Cortellino stated that he doesn't have active membership, so Mr. Versace feels, by expand- ing the amount of people that maybe there can be a working com- mittee as far as conservation goes, and by expanding it maybe more interested people can be gotten into it and get it active. Mr. Saland asked if it wouldn't be just as wise, since these: members serve at the pleasure of the Board, to remove those who aren't interested, instead of expanding it. Mr. Jensen pointed out that at present there have only been 4 appointments of the seven allowable members. If there were seven people to fill all the positions, he could agree, but since there are still three vacancies to be filled, what would be accomplished by increasing the number of members. He would like first to talk to the Chair- man of the Committee first to see what the problem really is. Mr. Versace stated he would agree to a delay in this action, and withdrew the motion, and since there were only four members on the Board, with 3 openings he felt he would like to submit some names for these vacancies. 7 7 MR. Mr. Saland concurred with Mr. Jensen, and mentioned that these recommendations, by Mr. Versace's admission were not Mr. Cortellino's recommendations, merely that he would accept them, and would like to hear Mr. Cortellino's comments first. Mr. Jensen again made the comment that he would hope in the fu- ture that if any resolutions are going to come before the Board, as has been asked in -previous years, that at least the sitting. Board would have an opportunity to review them in depth before they are brought out on the floor. A resolution was introduced for acceptance of deeds for roads and recreation land in the proposed Spook Hill Estates. Mr. Horton had a question regarding the road specifications applicable to this subdivision, therefore, the matter was tabled. MR.
