Among my top priorities as the State.Comptroller is to maintain a strong partnership between
my office and the local governments of New York State. One of the main objectives of this
partnership is to assist local governments in improving their fmancial condition and strength-
ening their financial management systems.

EXECUTIVE SUMMARY
Our examination disclosed fi,ndings which should be reviewed by the Town
Board for appropriate action. Good management practices require that town
officials take prompt action concerning our recommendations. We believe
prompt action by town officials will help improve the town's fmancial condition,
protect the town's resources from possible loss or improper use, and ensure its
compliance with appropriate statutory requirements. For the ready reference of
the reader, the recommendations are summarized in the following section.
However, this is not,meant to serve as a substitute for reviewing the Findings
and Recommendations section of the report, which begins on page 7. Please
note that of the three findings in the report, two findings are similar to those
contained in our prior Report of Examination issued November 12, 1991.
The Town Board should prepare a plan of action that addresses our recom-
mendations and forward the plan to our office within ninety days. For guidance
in preparing the plan of action, you may refer to applicable sections contained
in the publication issued by the Office of the State Comptroller entitled Financial
Mana~ement Guide for Local Governments.

SUMMARY OF RECOMMENDATIONS
. Financial Condition .
The following reconunendation relates to the town's financial condition. Failure to properly
implement the reconunendation could unnecessarily burden future taxpayers who may not have
benefited from the services currently provided.
The Town Board should exercise care in estimating the amount of fund balance available
for appropriation in the succeedjng year's budget and ensure that such information is recorded
on the town's financial statements.
. Internal Control and Compliance.
An effective system of internal control is necessary so that the Town Board can have
reasonable assurance that resources are safeguarded and that transactions are executed in
accordance with management's authorization, are in accordance with statutory requirements
and are properly recorded.
Failure to establish proper controls could expose the town's resources to loss or improper
use. The following recommendations help ensure that the town's resources are not at risk and
that transactions are properly authorized and are in compliance with statutory requirements.
The Town Board should take steps to ensure that all unneeded cash is temporarily invested.
The Town Board should take action to ensure that competitive bidding provisions are
followed to help assure the prudent and economic use of public moneys and to facilitate the
acquisition of goods and services of desired quality at the lowest cost.

AUTHORITY AND SCOPE LETTER
TO THE SUPERVISOR AND MEMBERS
OF THE TOWN BOARD
OF THE TOWN OF WAPPINGER,
DUTCHESS COUNTY, NEW YORK:
Pursuant to the State Constitution, Article V, ~ 1 and further authority vested in the State
Comptroller by Article 3 of the General Municipal Law, we have examined the financial affairs
of the Town of Wappinger for the fiscal year ended December 31, 1993.
Our responsibilities are to review the financial condition and fiscal operations of the town
in order to identify areas needing improvement and to inform local officials and the public of
our findings and recommendations. Consistent with these responsibilities, the objectives of this
examination were to identify conditions indicating possible fiscal stress and to test for noncom-
pliance with certain finance related statutory and regulatory provisions as well as guidance of
the Office of the State Comptroller. It was not our objective to, and we do not, express an Audit
Opinion on the financial statements of the town or provide assurance as to either its internal
control structure or the extent of its compliance with statutory and regulatory requirements as
well as guidance of the State Comptroller.
The management of the town is responsible for its financial affairs' and for safeguarding its
resources. This responsibility includes establishing and maintaining an internal control structure
to provide reasonable, but not absolute, assurance that resources are safeguarded against loss
from unauthorized use or disposition; that transactions are executed in accordance with man-
agement's authorization and are properly recorded; that appropriate financial reports are
prepared; that applicable laws, rules and regulations are observed; and that appropriate correc-
tive action is taken in response to audit findings. Nevertheless errors, irregularities, or instances
of noncompliance may occur and not be detected because of inherent limitations in any internal
. control structure. The town engaged independent public accountants who issued reports dated
May 13, 1994 on the town's general purpose financial statements for the year ended Decem-
ber 31, 1993, its internal control structure and its compliance with certain laws, rules and
regulations.
In determining the scope of our examination, we considered the town's financial condition,
its internal controls, applicable statutory provisions, guidance of the Office of the State
Comptroller and other relevant information. We obtained an overview of the fiscal operations
of the town through inquiry, analytical procedures, observations and the inspection of records

and reports. As a result of this planning process, we limited our examination to the following
areas:

Retirement Reporting
Interfund Activity
Reserves
Capital Projects
We conducted our examination in accordance with Generally Accepted Government Audit-
ing Standards (Government Auditing Standards, issued by the Comptroller General of the United
States). For the areas selected, we gained an understanding of the town's internal control
structure. Based upon this understanding, we assessed risks and designed and performed such
tests which we considered necessary to satisfy our audit objectives. We believe that our
examination provides a reasonable basis for our report.
The results of our examination procedures disclosed certain findings and recommendations
which are presented in this Report of Examination. These findings and recommendations have
been discussed with local officials and their comments have been considered in preparing this
report.
The Town Board has the responsibility to initiate corrective action. Pursuant to Section 35
of the General Municipal Law, the Town Board should prepare a plan of action that addresses
the recommendations in this report. We encourage the Town Board to prepare a corrective
action plan which would be available for public review in the town clerk's office and the Office
of the State Comptroller.

Finding
The Town Board has appropriated unexpended fund balances in excess of amounts actually
available. Additionally, the appropriation of these fund balances was not reflected on the town's
1993 annual financial report.
The 1994 town budget contained the appropriation of unexpended fund balances in excess
of actual balances as follows:

The appropriation of fund balance in excess of actual may result in insufficient moneys being
available to meet budgetary appropriations. The appropriation of fund balance should be
included on the town's financial statements to accurately reflect the financial position of the
fund.
A similar finding appeared in our prior Report of Examination.
Recommendation
The Town Board should exercise care in estimating the amount of fund balance
available for appropriation in the succeeding year's budget and ensure that such infor-
mationis recorded on the town's financial statements.

Finding
Certain moneys on deposit were maintained in a non-interesting bearing checking account.
During February and March 1993 moneys from property taxes on deposit in the receiver of
taxes' non-interest bearing checking account ranged from $156,575 to $3,911,189. In today's
economy, when costs are rising and revenues are in short supply, the need to derive additional

revenue from investing idle cash is of ever greater importance. The timely investment of public
moneys is an important and integral part of a public officer's duties.
Recommendation
The Town Board should take steps to ensure that all unneeded cash is temporarily
invested. One option would be to convert the receiver of taxes current non-interest bearing
checking account to an interest bearing account such as a N.O.W. account.

Finding
No record was found to indicate that bids had been requested by public advertisement for
water system improvements costing $23,000.
With certain exceptions, which appear not to be applicable in the above instance, all public
works contracts involving an expenditure of more than $20,000, shall be awarded to the lowest
responsible bidder after public advertisement for sealed bids (General Municipal Law, ~103).
A similar finding appeared in our prior Report of Examination.
Recommendation
The Town Board should take action to ensure that competitive bidding provisions are
followed to help assure the prudent and economic use of public moneys. and to facilitate
the acquisition of goods and services of desired quality at the lowest cost.

EXAMINATION
1) APPROPRIATION OF ESTIMATED SURPLUS
This finding has been corrected by reflecting the
appropriated fund balances on the annual financial report
for 1994 and taking better care estimating a surplus fund
balance.
2) INTERNAL CONTROL AND COMPLIANCE
The Town Board has directed the Receiver of Taxes to
open a Money Market Account for Tax deposits as of January
1995.
3) COMPETITIVE BIDDING
NO RECORD FOUND TO INDICATE PUBLIC ADVERTISEMENT FOR
BIDS FOR WATER SYSTEM IMPROVEMENTS COSTING $23,000
The Town Boa rd does have a set po 1 icy fo r compet it i ve
bidding. This pol icy is carefully followed. However, in
t he above i nst ance it was a prudent and economi c use of
public moneys to waive the pOlicy.
Camo Pollution Control, Inc. is under contract with
the Town to service Town Water & Sewer Districts. This
company was to do work on Well #5 Central Wappinger Water
District a general maintenance. There was also a Dutchess
County Health Department mandate to do work on this well
site. The Town Board, on JUly 26, 1993, determined not to
go out to bid for this because Camo Pollution Control was
already going to do work on this well. The Town Board did
not think it prudent to involve another company. (See
attached documents).
