The Reorganizational Meeting of the Town Board of the Town of
Wappinger was held on January 2, 1974 at 5:00 P.M. at the Town
Hall, Mill Street, Wappingers Falls, New York.
Supervisor Diehl called the meeting to order at 5:13 P.M.
Present:

Supervisor Diehl, before embarking on the agenda, welcomed Frank
Versace as the new Councilman on the Board.
Supervisor Diehl made known his appointment of Louis Clausen as
Deputy Supervisor.
Mrs. Snowden made known that Gladys Ruit and Ethel Relyea would
remain as her two Deputy Town Clerks.

OFFICERS AND EMPLOYEES OF THE TOWN
OF WAPPINGER
The _following resolution was offered by COUNCILMAN CLAUSEN
who moved its adoption:
RESOLVED, that the persons holding the following offices and
positions ofemployment in the Town of Wappinger he and they hereby
are required to furnish official undertakings and depository bond,
conditioned for the faithful performance of their duties and indemni-
fying the Town against any loss, in the sums set forth after the
respective offices and positions set forth below:
Receiver of Taxes $250,000.00
Supervisor 25,000.00
Town Justice 5,000.00
Supervisor's Bookkeeper 10,000.00
AND IT IS FURTHER RESOLVED, that the form and sufficiency of
surety of such undertakings shall meet with the approval of the
Town Board of this Town and shall comply with the provisions of
the Town Law of the STate of New York in general and with Section
25 thereof in particular, and it is further
RESOLVED, that such undertakings shall be filed in the
office of the Clerk of the County of Dutchess pursuant to the
provisions of the_Public.Officers Law and other related statutes
of the State of New York, and it is further
RESOLVED, that such bond or undertaking shall be executed by
a surety company authorized to transact business in the State of
New York, and the expense thereof shall be a Town charge, and it
is further
RESOLVED, that a blanket undertaking in the amount of
$10,000.00 be procurred from a corporate surety licensed to do
business in the State of New York indemnifying the Town of
Wappinger against losses arising from the failure of all other
Town employees to perform their duties or to account properly
for all monies for property received by virtue of their posi-
tions or employment.

The resolution for appointments of personnel to various Town
offices and positions of employment was placed before the Board.
It was the decision of the Board to take each office separately
(with the exception of the Supervisor's Bookkeeper and Confidential
Secretary, which were the Supervisor's appointments).
The following Resolution was offered by COUNCILMAN CLAUSEN who
moved its adoption:
RESOLVED, that Bruno Hermans be and he hereby is appointed
to serve as the Building Inspector for the Town of Wappinger for
the year 1974.

Upon introduction of the resolution for Building Inspector, Mr.
Saland asked for a resume of Mr. Hermans' qualifications. Mr.
Clausen stated that Mr. Hermans life time work had been as a
builder, - Mr. Diehl has a full resume, - has been superintendent
on many construction jobs, had authority over many men in the
building trade, and certainly understands, as far as Mr. Clausen
is concerned, all types of buildings, and feels he is well qualified.
Mr. Saland responded he meant no disrespect to Mr. Hermans, whom he
did not know, but indicated that he had not previously been apprised
of the qualifications of the gentleman, he feels these are very
sensitive positions, to be filled by qualified individuals. Mr.
Jensen echoed Mr. Saland and added that he felt by this time they
should have received a complete resume on the individuals who are
going to be selected tonight, and had not, so obviously it will be
very difficult to vote with any reasonable amount of confidence
without knowing all the facts.
The following resolution was offered by COUNCILMAN CLAUSEN who
moved its adoption:
RESOLVED, that Michael Turco be and he hereby is appointed
to serve as Assistant Building Inspector for the Town of Wappinger
for the year 1974.

The same questions came up about qualifications and Mr. Turco,
who was present and stated that he had had at least 20 years
experience in the area of construction business.
MR. JENSEN moved that Susan Pike be appointed as Zoning Administra-
tion for the Town of Wappinger.

The following resolution was offered by COUNCILMAN VERSACE who
moved its adoption:
RESOLVED, that Sylvia Anderson be and she hereby is appointed
to serve as the Zoning Administrator for the Town of Wappinger for
the year 1974.

Mr. Jensen again objected at the introduction of the resolution
for Zoning Administrator on the grounds of qualifications and the
lack of a resume being submitted of their qualifications - these
jobs take a certain amount of learning and he was quite amazed at
these selections.
Mr. Horton recommended the appointment of Kenneth Croshier as
Deputy Superintendent of Highways, said appointment confirmed by
the Board.
The following resolution was offered by COUNCILMAN JENSEN who
moved its adoption:
RESOLVED, that Virginia Ferris be and she hereby is appointed
as Town Historian for the Town of Wappinger for the year 1974.

Mr. Saland, upon presentation of the following resolution, wished
the point clarified that what was just voted on individually is,
in toto et pars continetur, of the resolution now before them, and
that this is simply confirmation that these are appointments at the
pleasure of the Board and established 26 pay periods to begin Jan-

AND IT IS FURTHER RESOLVED, that the salaries otherwise
fixed for the above designated offices and positions shall be
paid to the holders of such offices and positions with the
exception that no compensation shall be paid to the holder of
the Deputy Town Superintendent of Highways, payable every other
Friday, throughout the year 1974, with 26 pay periods during such
year, with the first payday to be January 4, 1974.

APPOINTING THE RECEIVER OF TAXES
AND ASSESSMENTS IN THE TOWN OF
WAPPINGER
The following resolution was offered by COUNCILMAN CLAUSEN
who moved its adoption:
RESOLVED, that Amelia Crosby be and she hereby is appointed
to the office of receiver of taxes and assessments in the Town
of Wappinger to serve in such capacity for a term ending on the
31st day of December 1975, and it is further
RESOLVED, that the receiver of taxes and assessments be paid
an annual salary of $8,500.00 payable every other Friday throughout
the year 1974, with 26 pay periods during such year, with the first
pay day to be January 4, 1974, and it is further
RESOLVED, that the receiver of taxes and assessments be and
she hereby is authorized to employ such clerical employees as
may be necessary for the performance of her duties and to compen-
sate such clerical employees at the maximum hourly rate of $2.75
per hour.

A resolution for the establishment of salaries for positions in
the Town was presented. Mr. Saland asked if any of the salaries
set forth in the resolution deviated from the figures discussed at
the budget meetings. Mr. Diehl answered yes, pointing out the
Assessor, Building Inspector, Deputy Building Inspector and Zoning
Administrator. Mr. Jensen questioned the reduction of the proposed
salary for the Assessor, reductions of the new appointees was

understandable, why the change from the original budget proposed
for the Assessor. Mr. Diehl stated, in his opinion, the position is
justified at $12,000.
The following resolution was offered by COUNCILMAN CLAUSEN who
moved its adoption:
RESOLVED, that the annual salary for the position of Assessor
of the Town of Wappinger be and the same hereby is fixed and
established at $12,.000 for the year 1974, and it is further
RESOLVED, that the salary of the person holding the position
of Assessor shall be paid every other Friday, with the first payday
to be January 4, 1974.

RESOLVED, that the annual salary for the position of Assistant
Building Inspector of the Town of Wappinger be and the same hereby
is fixed and established at $8,500 for the year 1974, and it is
FURTHER RESOLVED, that the salary of the person holding the
position of Assistant Building Inspector shall be paid every other
Friday with the first payday to be January 4, 1974.

Mr. Jensen asked what formula had been used to arrive at the
proposed salary for the Assistant Building Inspector, since this
was the amount agreed on at the budget meetings and was contrary
to what had just previously been stated about the reduction of
the Assessor's salary from what had been agreed on at the same
budget meetings. Mr. Saland indicated his prime objection was
that they had already taken one office and treated it in a certain
way - Mr. Logan is not to receive an increase - we now have three
offices in which we are placing people with absolutely no experience
in Town government in the positions to which they have been nominated,
we're paying them salaries very close to those who they are replac-
ing, people, all -of whom were experienced (with the exception of
the new position of Assistant Building Inspector). In effect,
we're asking the poeple of the Town to subsidize this inexperience
at virtually the same rate of pay of the competent, experienced
people that they replace. He finds this unconscionable and he
doesn't believe the Town should be a proving ground for somebody
to gain their experience. Mr. Diehl defended the appointments say-
ing the question of experience the future will bear out, speci-
fically speaking of the Assistant Building Inspector the salary as
compared to the Assessor is quite a distance away and the salary
of $8,500 is_a justified reasonable salary for that position.
The following resolution was offered by COUNCILMAN CLAUSEN who
moved its adoption:
RESOLVED, that the annual salary for the position of Zoning
Administrator for the Town of Wappinger be and the same hereby is
fixed and established at $9,000, and it is
FURTHER RESOLVED, that the salary of the person holding the
aforesaid position shall be paid every other Friday with the first
payday to be January 4, 1974.

of employees hired by the Town of Wappinger Highway Department
be and the same hereby is fixed and established at the following
minimum to maximum hourly rates:

$4.33 to $4.50 per hour

3.17 to 4.25 per hour

AND IT IS FURTHER RESOLVED, that all of such Highway Depart-
ment employees engaged on an hourly basis shall be paid every
other' Friday throughout the year 1974, with the first payday
to be on Friday, January 4, 1974.

hereby is fixed and established at a maximum hourly rate of $2.75
per hour, and it is further
RESOLVED, that all of such extra part time clerical employees
engaged on an hourly basis shall be paid every other Friday through-
out the -year 1974, with the first payday to be on Friday, January
4, 1974.

Dutchess County, New York, in the evening of the second Monday
of each month, or at such other place or places within the Town
of Wappinger as the Town Board shall from time to time designate.

eastern New York, the Dutchess Bank and Trust Company, and Empire
National Bank, each being a banking institution maintaining
banking room and offices in Dutchess County, New York, be and
they each hereby are severally designated as depositaries of
the monies of this town, and it is further

to give notice of such designation to each of said banking

The following resolution was offered by COUNCILMAN CLAUSEN who
moved its adoption:
RESOLVED, that the W&SD News, a newspaper regularly published
in the Town of Wappinger, Dutchess County, New York, and having
a general circulation in this Town, and being a newspaper entered
as second class mail matter, be and the same hereby is designated
as the official paper of this Town, and it is further
RESOLVED, that the Poughkeepsie Journal and the Evening News,
newspapers published in the County of Dutchess and having general
circulation therein, be and they hereby are designated as additional
newspapers for the publication of Town notices, subject to the
limitations of Section 64, Subdivision 11 of the Town Law of the
State of New York, and it is further
RESOLVED, that the Town Clerk be and she hereby is authorized
and directed to give notice of such designation to the publishers
of such newspapers.

the same hereby is fixed and established at the rate of $6,100 per
year, to be paid every other Friday throughout the year 1974, with

Town Justices of the•Town of Wappinger be and the same hereby
is fixed and established at the annual rate of $7,000, to be
paid every other Friday throughout the year 1974, with 26 pay
periods during the year, with the first payday to be January 4,
1974, and it is further
RESOLVED, that the said Secretary to the Town Justices of
the Town of Wappinger shall be required to furnish an official
undertaking, conditioned for the faithful performance of her

the Water and Sewer Districts for the Town of Wappinger be and the
same hereby is fixed and established at the rate of $10,700 per
year, to be paid every other Friday throughout the year 1974, with
26 pay periods during each year, with the first payday to be

Upon introduction of the resolution for Chief Operator of Sewer
and Water Districts, Mr. Jensen said, with regard to the name,
John Mailepors, again, no resume has been received of his qualifi-
cations with no knowledge, if in fact he has ever ran a water or
sewer plant. It would have been nice to have known if the gentle-
man has an operators license, or what training he has had in the
field towards a license. In the past year or so the Town has -
trained Mr. Waddle to perform at this particular job, and reports
from residents in these districts indicated he had done a good job.
Mr. Jensen couldn't see how, after spending Town moneyfor training,
schooling, etc., they could remove Mr. Waddle from the job and come
up with an unheard of name - to him - a person whom he believes has
only been a Town resident for a very short period of time - Mr.
Saland qualified his abstainance by stating, as an attorney, he
had represented Mr. Mailepors on -several occasions, bu•t he further
concurred with Mr. Jensen and voiced disapproval of appointing a
relatively unknown name when there already was a person who had.
qualified for an operator license, and whom the Board, in the past
unanimously appointed and at no time in the past did any member of
the Board display or ask for a vote of no confidence or ask that

he be removed. He also objected to the fact he had not received
a resume, and the fact that the new appointee was starting at a
salary higher than that which Mr. Waddle started at. Mr. Diehl
defended the appointment by stating that Mr. Mailepors had been
in the plumbing business for 15 years and at present being a
licensed plumber qualifies him greatly for this position. In the
past we have proposed and appointed people without licenses, it
certainly bears up to the fact that the.license itself does not
make a qualified operator. He feels this appointment is justified
and Mr. Mailepors' past experience in plumbing, and building of
sewer plants, etc., is a good qualification. Mr. Saland rebutted
by saying that at the time Mr. Waddle was appointed, every member
of the Board received a resume prior to the appointment, and
further, there was a deference to the opinion of the Town Engineer,
there was no arbitrary selection. Mr. Jensen pointed out that
this matter wouldn't be badgered about if he had the benefit of
meeting the people they were going to appoint and had a resume,
he was sure they could make an intelligent decision --then. He
felt probably Mr. Mailepors was a good plumber, but there was more
to operating a plant than checking pipes, and why go to more expense
to train another person to the job when we already have a bonifide
man to do the job. Questions were raised from the floor by Mr.
Mills, Mr. Cortellino and Mr. Reilly regarding the appointment of
a new sewer and water plant operator. Would the Town have to
continue with the services of an outside firm in order to operate
these plants, and at what additional cost to the Town, and, what
additional expense to train Mr. Mailepors.

WHEREAS, Subdivision 10 of Section 29 of the Town Law
requires that the Supervisor of each Town prepare and file with
the Town Clerk within 30 days after the expiration of each fiscal
year, an annual financial report accounting for all monies re-
ceived and disbursed by him, together with the certificates or
certificate of the bank or trust company where Town monies are
deposited, showing the amount of such monies on deposit with
said bank or trust company, and cause a certified copy of such
report to be published in the official newspaper,
WHEREAS, in lieu of preparing the report required by
Subdivision 10 of Section 29 of the Town Law, the Town Board
may determine, by resolution, that the Supervisor shall submit
to the Town Clerk within 60 days after the close of the fiscal
year, a copy of the report to the State Comptroller required by
Section 30 of the General Municipal Law and the Town Clerk shall
cause a summary of such report to be published within 10 days
after receipt thereof in a form approved by the State Comptroller
in the official newspaper.

Mr. Saland, commenting that the appointments having been made,
wished to read into the record the following editorial from the
Poughkeepsie Journal of Saturday, December 22, 1973:
QUESTIONABLE GAME
The game of politics may be responsible for removing three
experienced and qualified Wappinger twon employees from office
at the end of this year.
Supervisor Louis D. Diehl and his Democratic colleagues on
the town board have left it be known that zoning administrator
Susan Pike, building inspector John P. Holler and superintendent
of water and sewers Arthur W. Waddle will not be renamed when
the new board meets January 2nd.
The trouble, apparently, with Miss Pike, Holler and Waddle
is that they are Republicans, and Diehl will head a town board
with a Democratic majority starting next year.
The three facing ouster noted that Diehl gave them no
reason for the Democratic action, so they must assume it is
"strictly politics."
Miss Pike, at 26, already has had ground -floor experience
in Wappinger planning and zoning for nine years (the town zoning
ordinance dates back only 10 years), and has been zoning adminis-
trator, an important post, almost three years. Despite her youth,
she is considered by many people as extremely well qualified.
Holler and Waddle have not been with the town as long, the
former four years and the latter one year, but neither has been
the subject of criticism.
In his own defense and that of the Democratic majority, Diehl
contends that the board action is aimed at improving and coordinating
town government. He points out also that three Republican incumbents,
including town attorney Allan E. Rappleyea, a Poughkeepsie i'esident,
will be retained.
Time will tell whether the ouster of Miss Pike, Waddle and
Holler will have been in the town's interest.
I Mr. Saland adding the old addage "to the Victor belong the spoils
with the sentiments that what we have done, as shown in this edi-
torial, is replace three qualified and experienced people, all of
whom have been unanimously appointed in the past, and removed them
from their office. The reasons, calling a spade a spade, are purely
political, and we're making Town government a testing ground for
people whose qualifications, at best, are questionable. We've
taken the three in the most sensitive areas in which this, or
any town, provide services. Regulations of building and enforcing
building, administration and enforcing of our Zoning Ordinance and
bringing water and sewage to the water and sewer districts of the
Town and put them in the hands of people, who have experience, at
best, which is dubious. Actually, within this years budget, we
could have brought in and trained these people, if this was the
Democratic majority's desire, under the outgoing personnel. Trying
to mask the replacements as an attempt at efficiency or improving
and coordinating Town government is really but an empty deceit, and
an attempt at subterfuge. He felt he had stated his feelings, and
joined with that of Mr. Jensen. He certainly has no intention of
not cooperating with the new people, he wishes them the best, and
hopes that their training is speedy and that they can do justice
to their office, but feels with a totally clean conscience, that
at this particular point he has not partaken in a rather blatently
political action, one which he believes represents the Nader of
Politics in this Town, and we're now asking the people of Wappinger
to pay the price for the removal of competence. Mr. Diehl's-re-
sponse was that he believed the majority of the appointments were
Republicans, which takes politics out of the question, (which was
disputed by Mr. Saland) and Mr. Clausen indicated that, after 50
years of Republican dominance, the people went to the polls and
made their decision. He thought what Mr. Saland would like was
that although Democratics are elected, would be for the Democrats
to make the same appointments, make the same decisions and do the
same things the Republicans did for years. He thinks the Demo-
crats have to learn how to become the majority in this Town and
the Republican have to become the minority, at least for two years.
Give the Democrats a chance to prove their worth, don't be so
critical before they have a chance to do that, and if the Repub-
licans worked with us we might prove we did have some sense after all.
Supervisor Diehl entertained a motion for adjournment.
