NEW BUSINESS 10. ADJOURNMENT to, v 2S4 The Regular Monthly Meeting of the Town Board of the Town of Wappinger was held on October 9, 1973, at the Town Hall, Mill Street, Wappingers Falls, New York. Present: Louis Diehl, Supervisor Louis Clausen, Councilman Harry Holt, Councilman Leif Jensen, Councilman Stephen Saland, Councilman Elaine H. Snowden, Town Clerk Others Present: William Horton, Superintendent of Highways Rudolph Lapar, Engineer to the Town Jon Adams, Attorney (for Allan Rappleyea) Supervisor Diehl called the meeting to order at 8:14 P.M. The minutes of the August 13, 1973 and September 10,:1973 Regular Monthly Meetings and the September 20, 1973 Special Meeting having been previously sent to the Town Board members, were now placed before them for their approval. MR. JENSEN moved the minutes of the August 13, 1973,.September 10, 1973 Regular Monthly Meeting, and the September 20, 1973 Special Meeting, as submitted by the Town Clerk be and they are hereby approved. Seconded by Mr. Clausen. Motion Unanimously Carried Reports for the month of September were received from the Supervisor, Building Inspector and Town Justices. MR. CLAUSEN moved that the Supervisor, Building Inspector and Town Justices' reports for the month of September be accepted and placed on file. Seconded by Mr. Holt. Motion Unanimously Carried 235 The Tentative Budget, filed with the Town Clerk by the Supervisor on October 1, 1973, was now presented to the Town Board by the Town Clerk. (Copies had been previously mailed to each Board member). Bills presented for payment were as follows: General Fund $133,873.64 OKWD $175.39 FLTWD $228.19 Highway Fund $29,793.19 OKSD 372.05 FLTSD $240.05 RFSD $1,414.09 MR. CLAUSEN moved the bills be paid, subject to audit. Seconded by Mr. Holt. Motion Unanimously Carried A letter was received from Joseph R. Brunet, Cider Mill Loop requestingtheiToWn to put up MPH or "Children at Play" signs at the:intersedtion of Cider Mill Loop and Peel Lane to caution drivers to goy s lower.! because.: of `,children. Mr. Horton indicated:tha.t he had had to replace the speed limit signs - these were erected October 3rd on Cider Mill Loop. These, to his;;.knowledge, are -still4 up but street, speed and curve signs in the Tye Lane, Edgehill section were lost over the weekend due to vandalism, overa;$i,000,worth and in response to Mr. Clausen's question, he advised the Board that it was illegal to erect "Childres at Play" signs. Mr. Clausen suggested the Town Clerk send a letter to Mr. Brunet indicating that the Highway Superintendent has reinstalled the speed limit signs and that it is illegal to put up "Children at Play" signs. Mr. Jensen added that the Sheriff's Office should be contacted requesting as much extra patrol of this area as possible. Mr. Clausen commented that perhaps the residents themselves could be alerted td watch for vandalism. Mr. Diehl observed that it was getting .toward that time of year, and a letter had been re- ceived from Mr. Waddle regarding recent severe vandalism at the Fleetwood Sewer Plant. Mr. Clausen suggested that a letter be sent to the Edgehill Civic Association indicating the problem the Town and Highway Superintendent have, cost wise and safety wise and ask the people if they couldn't be a little more watchful as to who it might be. He thinks it's a community problem and everyone should help. Mr. Diehl reiterated Mr. Jensen's suggestion regarding re- questing extra patrolling by the Sheriff's Department to try to prevent the loss of these signs. An Order was received from New York State Public Service Commis- sion denying the Town's Petition for reconsideration regarding Harry Raker, Inc. water rates. MR. HOLT moved the Order be received and placed on file. Seconded by Mr. Clausen. Motion Unanimously Carried A letter was received from the Planning Board regarding a request directed to them from the New Hackensack Fire District. The Commissioners were requesting to go on record with recommendations to the Town of Wappinger Planning Board regarding multiple dwelling units, such as, they would like to have available, on premises, a responsible person having full amthority concerning the property for emergency situations. Mr. Diehl stated that it would appear to him that this should be done under any normal .circumstances, one would think there would always be someone there, but apparently not. He believed this should be turned over to the Attorney to the Town and have him draft a resolution of instruction or whatever, so there would be someone of authority on premises with full knowledge of necessary information at all times. Mr. Saland recommended the letter from the Commissioners of the New Hackensack Fire District be turned over to the Attorney to the Town and ask for his study and recommendation, as he could take it all in context, and report back to the Board as to its feasibility. Mr. Holt asked that notification be sent to the chairmen of the three fire districts apprising them of this action. 237 A vacancy has occurred in Election District 12 with the death of Election Inspector (R) Emma Gildersleeve. Ruth Speedling was recommended to fill this vacancy by the Republican Committeemen of this district. MR. HOLT moved that Ruth Speedling be appointed as an Election Inspector (R) to fill the vacancy on the Election Board of District 12, which has occurred due to the death of Emma Gildersleeve. Seconded by Mr. Saland. Motion Unanimously Carried Notice was received on September 26, 1973,. from the Village of Wappingers Falls, pursuant to Section 7-7-6 of the Village law, of a Public Hearing to be held on October 9, 1973 on a proposed amend- ment to the Village Zoning Ordinance (portion of the Vincent Williams property for new and additional R -MI district). MR. DIEHL moved this notice of Public Hearing from the Village of Wappingers Falls be received and placed on file. Seconded by Mr. Clausen. Motion Unanimously Carried The following letter was received: September 20, 1973 Town Board Town of Wappinger Mill Street Wappingers Falls, N.Y. Re: Wappinger Sewer Improvement #1, Contract #1 and Central Wappinger Water Improvement, Contract #1 Dear Board Members: This is to inform you that we have already doubled our estimated rock quantities included in the above contracts. Be- cause of the method of construction, nearly all of the rock excava- tion has been charged to Wappinger Sewer Improvement #1, Contract, #1. We therefore feel that we should apportion the cost more equitably against Central Wappinger Water Improvement, Contract #1, as they are deriving benefits from Wappinger Sewer Improvment #1 rock excavation. It is estimated that the overage on Wappinger Sewer Improvement #1, Contract #1, could reach $100,000. We request permission to advertise for boring bids on the rest of the Wappinger Sewer Improvement #1 and the Central Wappinger Water Improvement projects. Thank you. s/ Rudolph E. Lapar, P.E. MR. CLAUSEN moved to defer action, and forward this information, in the form of a directive, to the Attorney to the Town to instruct the Board as to how they should proceed in this matter. Seconded by Mr. Holt. Motion Unanimously Carried The following letter was received: September 24, 1973 Town Board Town of Wappinger Mill Street Wappingers Falls, New York Re: Enforcement of Section 444 of the Town of Wappinger Zoning Ordinance and Section 33.2 of the Subdivision. Regulations. Gentlemen: With regard to enforcement of the above-mentioned sections, the Planning Board refers site plans and subdivision plans to the Engineer to the Town for his review and geport. In a number of cases the Planning Board has received reports, some of which have been verbal, on drainage on site plans and subdivisions. The Planning Board is now requesting that there be written documentation on all reviews made by the Engineer to the Town. Through these reports the Planning Board feels that enforcement of these sections may be implemented. The Planning Board would like to take this opportunity to suggest that your Board take steps to have a master plan on drainage in the Town prepared. Mr. Diehl commented that he belijed they were asking two things, first, instructions in writing from the Engineer, which he believes should be done, certainly, it clarifies the point and there is no question of what the recommendations of the Engineer would be to any particular cases, In regard to a master plan on drainage, he believes the Board has informally instructed the Engineer to the Town to contact the Federal and State Governments with regard to aid in a study which will comprise of a master drainage plan for the entire Town. 23* MR. DIEHL moved that the Engineer to the Town, Rudolph E. Lapar, be directed to make application to the State and Federal Governments for aide in a study for a comprehensive master drainage plan which he has been instructed to prepare for the Town; and further, ghat the Engineer to the Town be instructed to proceed with his opinions and recommendations to the Town of Wappinger Planning Board in writing. Seconded by Mr. Clausen. Motion Unanimously Carried The Town Clerk was instructed to direct a letter to the Planning Board letting them know of the Town Board's direction with regard to a master drainage plan. Mr. Lapar, upon being asked by the Supervisor as to what steps he had taken with regard to the question of state aide for a master drainage plan, explained that he is filing with the State under Section 701 of the Federal Law. (Acceptance or rejection of this will take 3 months). He is also filing under the A95 proceedure. Mr. Clausen reiterated that Mr. Lapar was given direction to pre- pare, as he sees fit, the staging of the comprehensive drainage plan for the Town. Mr. Lapar questioned whether the Board had allocated any funds, since 30 maybe 40 miles of streams are being talked about to be surveyed. Mr. Clausen stated to Mr. Lapar that this of course is going to need a letter back to the Board from him, all the Board has done now is formally to direct him to outline a plan of the drainage within the Town, and they were looking for, now, direction outlines, and if he needs money requests, to come back to the Board. If Mr. Lapar--can prepare some reports before the next regularly scheduled Town Board meeting, the Board would be willing to consider a special meeting on this subject. The following letter was received: 240 September 26, 1973 Town Clerk Town of Wappinger Mill Street Wappingers Falls, N.Y. Re: Watch Hill Section 6 Dear Mrs. Snowden: We have completed the installation of the pavement base coat of the roads in Watch Hill Section 6 Subdivision, and we would like the Town to accept dedication bf the roads so that we may be able to obtain building permits. We have submitted the Engineer's Certification to Mr. Lapar, the Town Engineer. We have also submitted the proposed street plans to the Town Engineer and the Planning Board, and we have submitted "as built" drawings to the Town Engineer. The Deeds to the raids and to the recreation area were submitted to the Planning Board prior to the Public Hearing. A certified check in the amount of $20,000.00, which amount was determined by Mr. Lapar, was de- livered to your office on September 26, 1973. This amount includes the performance security, and the maintenance security. A Lia- bility Insurance Policy was also delivered to your office on the 26th. Very truly yours, Arkawy Construction Co. s/ Seymour M. Arkawy,Pres. Mr. Horton recommended the roads in Section 6 Watch Hill Develop- ment be accepted, and Mr. Lapar also recommended approval. MR. CLAUSEN moved, upon the Highway Superintendent and Engineer to the Town's recommendation, the roads in Section 6 of Watch Hill, having met the road specifications, be accepted, and that the Building Inspector be authorized to issue Building Permits. Seconded by Mr. Holt. Motion Unanimously Carried A Petition was received from resident owners on Pleasant Lane and ,i Cameli Drive, though, not objecting in principle to the current water drainage project for their streets, they feel the planned system is not being properly implemented to prevent damage to their properties. A subsequent Petition was received indicating they would like the drainage project continued to completion. Although some of them had previously signed the original petition, it was not their intention to jeopardize the installation of this 241 needed drainage system, and they, therefore, requested their names be eliminated from the previous petition. Mr. Lapar said he believed this situation had been taken care of. The drainage work would be continued. Legal advice received was that the problem of cleaning out the stream having been resolved, the person has been informed that if he has any objections to cleaning the stream that runs through his property to advise`Mr. Lapar. This person has given his okay to Mr. Lapar. Mr. Horton, Highway Superintendent requested permission to adver- tize for bids for a Sander for one of the new trucks. MR. JENSEN moved that permission be granted the Highway Superin- tendent to advertize for bids for a Sander. Seconded by Mr. Clausen. Motion Unanimously Carried The following letter was received: October 1, 1973 Town Board Town of Wappinger Wappingers Falls, N.Y. Gentlemen: It is gratifying to read, both in the newspapers and in the minutes of your meetings, that you are very actively pursuing issues of vital importance to our town. I am very pleased to read of your interest in providing safe bicycle -pedestrian facilities along our town roads. Eventually we must come to this. By doing it now we may save some lives. We certainly would improve mobility of our youngsters, preserve the shoulders of our roads, possibly get us started in reducing school bussing needs, and give us all a change to preserve our health with wholesome exercise. Along the same lines I would like to know if anything concrete has been done to insure the inclusion of bike -pedestrian paths with all new developments, whether commercial or residential, as 'we have discussed in earlier communications. It seems to me that the very poor practice, of 'accepting money in lieu of recreational land from developers, could be terminated and paths provided instead. This practice should be terminated anyway. Ican see the time when we will be attempting to buy back this land for rights of way, and I am -sure it will cost us cons44erably more than we. are getting now. At this time I would request that you give serious thought to setting aside funds to be used for transportation of senior citizens. Revenue-sharing funds are permitted for this purpose. Mrs.`Lou Glass, Dutchess County Department of the Aging, and I would be glad to discuss this topic with you. 2 42 I am .a little perplexed over the intent of Councilman Holt's pro- posal concerning licensing of Public Meeting places. It has a very sinister ring to it and is certainly repressive. Are you requesting any input to the new master plan for zoning? I have heard nothing about this until reading about it in the September 26th issue of the Poughkeepsie Journal. If it is due to bepresentedon October 10th, when are you planning to review it with local residents? Or do you plan on doing this after October 10th? Yours truly, s/ Daniel J. CLAUSEN moved Dr. Hannigan's letter be received, and further that Dr. Hannigan be notified that the Board is concerned about the problem of the lack of this type of facility and will give it our attention and study in the future. Seconded by Mr. Holt. Motion Unanimously Carried The following letter was received: 54 Edgehill Drive Wappingers Falls N.Y. Oct. 1, 1973 Dear Town Councilmen: Mr. Louis D. Diehl Mr. Louis C. Clausen Mr. Harry F. Holt A resident of the Edgehill Manor area has acquired and-is.main- taining goats on his 3/4 acre lot of land. In addition, he has erected a (shed) and fencing to contain the goats. .Mr. :Rappleyea-has '-=innformed me, via telephone; that the above action is not in violation of any town ordinance. The deeds for the Edgehill Manor development are restricted by an Indenture between Eugen Schuele and. James Thomann dated July 11, 1961 (county records Liber 1061 Pages 157 through 160). Paragraph five (5) ofthat indenture states "No chicken, cows, horses or other.animals of any kind other than household pets shall be kept upon the premises." Paragraph .one (1)- estates that, other than the house .and.. garage and a: "utility, building :for then°_storage. of. : tools and garden.. equipment", no structure shall be erected on the premises. It is -requested that the town Council draft and adopt a town ordinance -which will restrict the residents of premises on one (1) acre or smaller lots to the restrictions of the above refer- enced Indenture. The:courtesy of a reply with respect to any intended action and plan would be _greatly appreciated. Thank you, s/ Ernest V. Parziale Mr. Diehl commented that informally the Board met with Mr. Rapple- yea and asked him to investigate this area and come back to this Board with more information and at the same time prepare an ord- inance in rd-inance,in this, regard for study by the Board. The Town Clerk was requested to so inform Mr. Parziale of the Board's action taken previous to his letter. A letter had been received from the Planning Board requesting an executive meeting with the Town Board to discuss a proposed Planned Unit Development for the Reynolds Property located on Route 376. The Board agreed on the date of November 14, 1973 at 7:30 P.M. for an executive meeting with the Planning Board. The Town Clerk was instructed to so notify the Planning Board. The following letter was received: October 9, 1973 Town Board Town of Wappinger Town Hall, Mill Street Wappingers Falls, New York Gentlemen: There have been numerous acts of vandalism at the Fleetwood Sewer and Water Plants and in the recreation area at this location. The door to the sewer plant has been broken into three (3) times in the past 5 days and miscellaneous :small tools and=equip- ment.have been stolen and/or damaged. We:have had electrical cords 'cut in two, roofs ripped from both water and sewer plants, all kinds of debris thrown into.:the tanks at the sewage plants. 3 would like to recommend that the whole area be: fenced with a 10 foot chain link fence, if this is not at all possible, gates should be installed to prohibit vehicle traffic into the area and street light type fixtures should be installed over the build- ings to light the area, also the roof's of both buildings should be repaired before winter and we experience water leaking onto the electrical controls in the buildings. Yours truly, s/ Arthur Waddle 241 Mr. Holt recalled previous estimates for fencing which had been quite high, and at that time the residents felt it was a large expense. Mr. Diehl stated, he had seen the damage, and believed the situation was urgent. MR. DIEHL moved to instruct Mr. Waddle to take bids on gates for both the water plant and sewer plant, instructing him also to take bids on repairing the roofs on both buildings, and also to make arrangements with Central Hudson for installing light fixtures at all the existing water and sewer plants. Seconded by Mr. Holt. Motion Unanimously Carried Mr. Jensen added that, obviously, the residents in Fleetwood have been alerted through their Civic Association on numerous occasions, and looking back, this has happened quite often, so, possibly a letter can be sent to the civic association, that once again, that it's going to cost them more money for their operation. Under reports of committees, Mr. Clausen said he and Mr. Jensen would like to report that the- 'inside and outside of the Town Hall building has been painted and it is refreshing to see an old build- ing with a new look. Also, informal bids were requested and re- ceived for essential re -wiring of the Town Hall building and one bid was accepted to do this needed rewiring. He further mentioned the problems again being experienced with the furnace for the Town Hall part of the Town building, and he had obtained a brochure from Mr. Waddle, on installation of an alarm system on the boiler that hooks up to the fire house which would indicate to them that some- thing was wrcng with the furnace. He and Mr. Jensen want to talk to the appropriate fire company, and with the Board's permission will come up with some kind of a recommendation. Mr. Holt commented on the paint job, and mentioned he had spolten with the painters. The painters had told him if they were to take the job over again they would want a couple of thousand more be- 4� cause of the hazards involved - loose capping in the front of the bt}ilding and a general that "it wasn't all there" so as soon as we can get into a new facility, the better he will like it. Mr. Clausen commented that, again, he had talked with the Board informally and asked Mr. Rappleyea to contact Mr. John Magdalany, who has shown some interest in the possibility of selling a piece of his land - a 2 acre parcel adjacent to the New Hackensack Fire House property. MR. CLAUSEN moved among other recommendations that may be forth- coming by the Board that Mr. Rappleyea get in touch with John Magdalany and try to draw up some type of an option or agreement and report back to the Board. Seconded by Mr. Holt. Motion Unanimously Carried Mr. Saland commented on the overcrowded quarters of the Justice Court. It's a little difficult to conduct business in a judicial manner in that particular building and if we don't see anything in the near future, he suggests the Board double its efforts to locate a new Justice Court. Mr. Diehl believed that Mr. Jensen was already looking in this direction. Mr. Saland made comment on the Landfill, saying that at the last meeting he had commented he hadn't received any of the reports from the Department of Health on the landfill site since then he has received reports of the 1st and 19th of September which indicate that the leachate is still pouring into the creek. It has indicated to him an air of resignation. In answer to his question (last meet- ing) Mr. Diehl had informed the Board that the additional drainage trenches had been provided and that this had remedied the situation. Mr. Diehl said to his knowledge yes, since that time he has a further report for the Board. As of the last meeting he too, had not had a report but a meeting on September 26th at which Vincent Kelley, representing Chazen, reported his engineering study to the Board of Governors of the Landfill. The Engineer, at that time, stated 246 that the flow of excess water at the landfill has been reduced from a six inch flow to a one inch flow. Kelley's recommendation to the Board at that meeting was to begin what was known as phase II which is not the "china wall" but a 800' retaining wall in the rear section of the landfill adjazent to the landfill site. The wall would be built of clay earth with a back up gravel and sand for filter purposes. The purpose of the wall was to concentrate the water from the surface of the landfill and from the airport in this one area where the leachate still appears and concentrate it into one holding area where they can control it and tests can be completed regularly in regard to the pollution problem. He had made a motion at that meeting that Mr. Kelley's plans be referred to the Dutchess County Department of Health for their study and recommendation, and, if recommended,_ they go forward with this step. At that time also a letter was directed to the Clerk to the Board of Representatives and the County Representatives that repre- sent the municipalities involved in the landfill project, advising them that no correction has been amde regarding the surface flow of water from the airport on the the landfill site. This is an area that has been serious and the Board of Governors has been advised as far back as perhaps two years that it would be corrected so that the'surface water from the airport would not go on the landfill. Mr. Saland asked if the engineers or Board of Governors had arrived at a life span for the landfill site. Mr. Diehl said it could be assumed that anywhere from a year to the most two years without expanding the site, the present site, as is, and regardless of the life span, the pollution problem must be corrected. Mr. Holt- asked if the engineer had an estimated figure of what the cost would be of the 800' wall. Mr. Diehl said there was a figure but couldn't recall it, seemed to think it was in the $40,000 mark. Mr. Saland asked if Mr. Diehl would know if Mr. Chazen's office received, aside from the proposed cost of this "china wall?, what moneys they have received to date for any services they've rendered 2. or have they received any money? Have they tendered a bill? - Mr. Diehl said they had tendered a bill but Mr. Kelley didn't know if they had been paid. Mr. Saland asked what the amount was, and Mr. Diehl said he believed around $50,000, for the drainage across the dump --Mr. Saland--and they want an additional $40,000? Mr. Diehl --the situation still exists and this is known as phase II, if phase II doesn't work, phase III must go into operation. Mr. Saland--then phase II will bring the figure to a total of $90,000. Mr. Diehl --if my figures are right, correct. Mr. Jensen reported that tomorrow at 9:00 A.M. (10-10-73) up in Albany, there would be an eligibility meeting on the Tri -Municipal sewer project, and some of the Town Officials, if they are on the Committees from the three town group will represent their own municipalities, along with Mr. Jack Hill from the Dutchess County Department of Health. He also made note that the work in Wildwood 2 & 2A on the roads is progressing. Mr. Clausen commented that he thinks this indicates the Town Board's final victory in that partic- ular area in that the efforts that this Town has put in in the last si»zyears, holding fast to the belief that the developer was_ under the provisions of the Highway stipulations to black top those roads. It has been through litigation and the very fact that blacktop is in the development now indicates the Town Board made the right decision. MR. HOLT moved that consideration of a proposed Ordinance for Licensing of Places of Public Assembly, which the Board had pre- viously received for study, be tabled for further study. Seconded by Mr. Saland. Motion Unanimously Carried A Public Hearing having been duly held on October 3, 1973 for the extension of the Orchard Homes Water Company, the matter was placed before the Town Board for their consideration. Mr. Clausen stated that the way he understands the reason for the Public Hearing was a two-pronged attack on whether Mr. Hankin was 248 infact going to be supplied with adequate facilities by the Town he would go one direction and if not he would be going another. It seems that they were in -the process of producing the facilities that Mr. Hankin is looking for and he would like some direction from the Attorney to the Town at this point, and Engineer, before we move on this, because it's probably to his way of thinking, academic at this point. He thinks possibly for _Mr. Hankin's benefit, and for the Town, that they move in one direction and he thinks they are just about there. MR. CLAUSEN moved to table action on the application for the ex- tension of the Orchard Homes Water Company until the Board can talk to the Engineer and Attorney to the Town further. Seconded by Mr. Saland. Motion Unanimously Carried Under New Business the Supervisor recognized Mr. John Bunting, Hughsonville, who presented the Board with a petition from the residents of the Hughsonville area. The petition stated 'ewe the undersigned feel the architecture in Hughsonville is unique. To have a unified collection of period styles is a wealth which should hot be squandered. Therefore,s wed petition that all com- mercial buildings o.f the_ future be_ in keeping with existing struc- tures". Mr. Bunting elaborated on the petition request indicating that there hasalways .been a spirit of cooperation and strong feel- ing of community among the residents of the Hughsonville Hamlet-. They have built up a strong feeling-odentity with the community. He believes the architecture within the community has helped the people retain that sense of community. He first suggested that the Board entertain the concept of .havitng..:the Attorney to the Town check =to see if some type, of moratorium could be placed on building within Hughsonville for a period of time so that the people in that area could have an informational meeting. to look at the pros and cons'of for example Historic Zoning or moving in the direction of something they have in Florence, Italy, appearance type zoning (in - which :all new buildings blend within :the: existing structures. He further suggested that an informational hearing be held by the Town Board with these residents to try to get some imput on what type of further ordinance could be drawn up to bring this about so that it's the type of thing that everyone feels they can live with, in- Stead Of simply adopting' "oxiet"ing historical ordinances such as they have in the Gsrfield area in Poughkeepsie and in the F.i:shkill area. .it did not appear:that his intentions were to stop growth, only that it should conform to the existing community. In conclu- sion he pointed out that with the Town and County centennials approaching it was something which should be considered, that this is the wealth that we should begin to think about now, and to act, r• and protect, in the ways that it can remain an ongoing, living community. MR. CLAUSEN moved that the petition presented by John Bunting be received and placed on file. - Seconded by Mr. Holt. Motion Unanimously Carried MR. SALAND moved to request the Attorney to the Town report to the Board by the next regularly scheduled meeting on the feasibility of either Historic Zoning of Appearance Zoning. Seconded by Mr. Clausen. Motion Unanimously Carried Mr.. Holt, along these same lines, commented that one of the Planning advisors had brought a layout on which hehad one portion of land designated NH defined as New Hamlet. There may be a possibility of creating a zoned area called "Hamlet", and he would ask the, Attorney -to also checkinto that,.;; and the referrals to the Planning advisors, to see if this can be. achieved. This could act the same. as a moratorium. -, Mr. Diehl, in regard to the same topic, asked Mr. Adams if he would check with Mr. Rappleyea about the possibility of a. resolu- tion for the Town Board to instruct the Planning Board to keep, c an area such as this in the character of the buildings as, they are. Mr. Clausen, upon seeing Warren Martin in the audience, remarked, (hoping it be the right place and not disrespectful) conveyed his feelings as to the tragedy Mr. Martin has gone through with his 252 home (extensive fire damage for the second time). He knows Mr. Martin has or will be going before the Zoning Board of Appeals for a variance, and he asked whether anything that if the Town could do to help Mr. Martin, he certainly would support that variance, and told him that anything in the future that he may have whereby the Town could be of assistance, to please ask them. Mr. Martin thanked him, and added that the Zoning Board had granted a special use permit to him tonight. MR. SALAND moved the meeting be adjourned, seconded by Mr. Holt and unanimously carried.
