Supervisor Diehl called the meeting to order at 8:07 P.M. Present: Louis Diehl, Supervisor Louis Clausen, Councilman Harry Holt, Councilman Leif Jensen, Councilman Stephen Saland, Councilman Others Present: William Horton, Superintendent of Highways Allan Rappleyea, Attorney to the Town Rudolph Lapar, Engineer to the Town Supervisor Diehl, due to the large number of residents from the Rockingham development, directed that the first order of business would be hearing these residents. The following people spoke with regard to various problems they had sustained, due primarily to flooding conditions, and erosion of property from recent heavy rains. The complaints also reflected a wide spread belief that there was misrepresentatiorwon.the part of salesmen as to boundaries, easements, grading, and drainage etc. Mr. Monaco, 27 Doyle Drive ----Poor Drainage. Mrs. Russo, 14 Dwyer Lahe----never graded. Supervisor Diehl, throughout this session with the Rockingham residents, kept recommending they submit their complaints to the .Attorney General's office. At the completion of this discussion, Mr. Diehl -.instructed the Town Clerk to inform the Attorney to the 164 District, the Engineer to the District, the New York State Attorney General's Office. Mr. Steinberg, President of Schoonmaker Homes Inc., John Holler, Building Inspector and William Horton, Highway Superintendent, to be available next Tuesday (July 17, 1973) to meet at the Town Hall at 1:00 P.M. for a field inspection of the drainage problems in the Schoonmaker Development. Mr. Clausen asked that the following letter be read: July 9, 1973 Town Board Town of Wappinger Wappingers Falls, New York Gentlemen: As the result of some extremely heavy rains around June 30th and July 4th, we experienced some drainage problems in the Rock- ingham Community. On July 5th several calls were received con- cerning these drainage problems and Mr. Robert Field, our Sr. Vice President and Director of Operations, and the writer visited the site the afternoon of the same day. During the inspection a few of the homeowners advised us that they planned to appear before the Town Board. Based upon our inspection, some of the complaints by our homeowners are legitimate and some are not. All homeowners obviously are en- titled to an answer. In order to minimize confusion, it is suggested that indivi- duals write letters to the Company identifying their specific drainage problem with a copy to the Town Board. The Company will respond to each letter within two weeks with a duplicate copy to the Town Board referencing the initial letter. With your cognizance the Company can then move forward to the eventual resolution of these complaints. It will be helpful if correspondence will include addresses and business and home phones. Your cooperation in this matter is very much appreciated. Deputy Supervisor Clausen called for a five minute recess at 9:49 PM. Deputy Supervisor Clausen called the meeting back to order at 10:10PM. All Board members again present, except Supervisor Diehl who was still temporarily detained (he returned to the Chair shortly there- after) . The Minutes of the June 11, 1973 Regular Monthly Meeting, having been previously sent to the Town Board members, were now placed before them for their approval. MR. JENSEN moved the Minutes of the June 11, 1973 Regular Monthly Meeting, as submitted by the Town Clerk be and they are hereby approved. Seconded by Mr. Holt. Roll Call Vote: 4 Ayes 0 Nays Reports for the month of June were received. -.from .the Town Justices* Building Inspector and Supervisor, and the Town Historian's quarter- ly report. Mr. Holt commented that he had only received the Supervisor's re- port as of this date, and would prefer time to go over it. MR. HOLT moved the Town Justices, Building Inspector, and Town Historian's report be received and placed on file. Seconded by Mr. Saland. Roll -Call Vote: 4 Ayes 0 Nays The Audit of the Town Finances done by Frank C. Manning having only been received at last months meeting was again placed before the Board for their consideration. Mr. Saland commented, referencing a letter received from Mr. Manning, that there were certain things he would like to ask Mr. Manning con- cerning the audit, and_some things on the role of comptroller.. MR. SALAND moved that the Audit of the Town's Fiscal Affairs, done by Frank C. Manning be accepted and placed on file. Seconded by Mr. Holt. JENSEN moved the bills be paid, subject to audit. Seconded by Mr. Holt. Roll Call Vote: 4 Ayes 0 Nays Mrs. Rose Wells, Chairman of the Wappinger Park Homeowners Associa- tion was recognized by Deputy Supervisor Clausen. Mrs. Welts asked if there was any report from the Attorney to the Town regarding the possibility of leasing land from Hankin for recreation purposes. Mr. Clausen answered that the Board has been discussing this and it is their opinion that the possibility of purchasing the water plant with the land, be investigated and an estimate of cost be presented and if this would be acceptable to the residents of this development, they might want to buy it rather than lease it. It might be cheaper for these residents but at the present time there are no facts before the Board. By next month the Board should have a report on the feasibility of purchase. Mr. Diehl, in answer to the question from Mrs. Wells about leasing the property for a short time (1 to 5 years), stated that it would be unreasonable for the Town to spend thousands of dollars inproving a piece of property which could, ultimately, benefit the private owner on such short terms. It wouldn't be fair to all Town residents. Mr. Clausen asked that Mrs. Wells' request regarding this proposi- tion to lease land from Hankin for recreational purposes be refer- red to the Recreation Commission for their study and recommendations. (at this point Mr. Clausen turned the meeting back to Mr. Diehl). Mr. Diehl recognized Mr. Gromyko, Vorndran Drive, who brought up the problem he and several neighbors were having regarding water runoff from the hill behind them that isn't carried off by the storm drains in front of their properties. He had spoken several times to Mr. Horton about the problem, and asked if it would be possible 1 6" to have the Engineer to the Town develop a plan, or is there a plan, in order to alleviate this water problem, or perhaps do some- thing with the hill. He feels it could be a Town problem now that they've taken over the road. Mr. Horton, in answer to Mr. Diehl's question as to whether he had any recommendations that would feasi- bly correct the problem, stated that the water has to be stopped on the hill, the water still has to come through the back yards to get to Vorndran Drive. Mr. Rappleyea suggested the Board consider asking Mr. Lapar for a report on a recommendation to alleviate the problem. Mr. Diehl asked the Town Clerk to instruct the Engineer to the Town to investigate and formulate a possible plan to correct the problem on Vorndran Drive, and to report his findings at the August Town Board meeting. MR. CLAUSEN moved that the Engineer to the Town be authorized to make a study of the feasibility of forming a water district of the Wappinger Park Homes Development and report to the Board at their August meeting. Seconded by Mr. Holt. Motion Unanimously Carried Mr. Diehl recognized Charles Cortellino, who wished to make a report regarding the Town of Wappinger Conservation Advisory Coun- cil. He mentioned that presently he is the only remaining active member, and would like to forward, at this time the name of Melvin Zipes:as another member. Secondly, the Town had formed this Council prior to new laws, and he requested that the Board direct Mr. Rapple- yea draw up another resolution for the establishment of the Conser- vation Advisory Council to comply with the new State Law so that the Town would be eligible to apply for a grant from the Ford Founda- tion. The next function of the Council would be to draw up a map of clear areas in Wappinger for another portion to comply with State Law which he believes Mr. Rappleyea will bring up. RESOLUTION ESTABLISHING CONSERVATION ADVISORY COUNCIL AND APPOINTING MEMBERS THERETO. The following Resolution was introduced by COUNCILMAN HOLT who moved its adoption: The Town Board of the Town of Wappinger, pursuant to Article 12F of the General Municipal Law, Section 239X, hereby establishes for the Town of Wappinger a Conservation Advisory Council and confers upon said council all of the powers set forth in Section 239X of the General Municipal Law Subdivisions 1 and 2. Said Council shall consist of seven members. The following are hereby appointed as members of said council to serve at the pleasure of the Town Board for terms ending on July 1, 1975. 1. Charles Cortellino 2. Melvin Zipes 3. Lynn Bliss The Chairman of said council shall be Charles Cortellino. This resolution shall take effect immediately. Seconded by: Councilman Saland Roll Call Vote: 5 Ayes Let it be so noted that there are 4 vacancies yet to be filled on this council. Mr. Diehl brought before the Board the tabled matter of a proposed fee for Down Stream Drainage. Mr. Rappleyea commented that the .•• question posed at the last meeting was whether or not we had the right to impose a fee, on a lot basis, for every development in the Town, and whether or not the specifications as read or to be applied, that is, that each development should be examined, to be determined what, if any grounds for drainage is needed. He had then talked to the Board with respect to his general feeling that he questions the pre -possession of a blanket fee, without regard to merit, for every development, and that, while it is more burdensome on the Town to examine each development and make a recommendation for each develop- ment, he thinks that is, one the less, the Town's obligation under the existing specifications, unless the Board is going to change those, he believes that should be followed. This would be the re- sponsibility of the Planning Board and the Engineer to the Town, and perhaps ultimately, the Town Board after the report and recom- 1 '6 9' mendation by the Engineer. and Planning Board. Mr. Lapar commented that it was grossly unfair to the subdivider, since apartment complexes don't fall under the subdivision regula- tions and down stream drainage is not spoken to in, the siteplan regulations. Mr. Rappleyea commented that that could be resolved on any site plan, that can and should be a consideration in any site plan approval. MR. DIEHL moved that it be recommended that the Planning Board be given the power to assess a dollar value for down stream drainage through the recommendations of the Engineer and other appropriate officials concerned, and that assessment be charged to those that would cause problems in a down stream drainage in the Town of Wappinger and certainly that all site plan approvals be also inclu- ded in this. A short discussion followed, with the outcome that the Attorney to the Town was asked to draw up this resolution, and Mr. Diehl with- drew the above proposed motion. Two reports were received from Camo Pollution Control Inc. in connection with Oakwood Knolls Sewer District and Fleetwood Sewer District, and further, a letter recommending the Town hire addi- tional help for a more satisfactory maintenance program. Mr. Holt recommended that the Acting Superintendent of Sewer and Water be empowered to employ an additional operator at a figure of $7,000 per year with his option to recommend $8,000 per year be- ginning January 1, 1974, provided this individual qualifies. Mr. Clausen, at the suggestion of Mr. Jensen, recommended the Town Board meet with Camo and the Town operators, look over these reports, and discuss with them what they are asking for and what the Town can afford. MR. CLAUSEN moved to accept and Camo Pollution Control Inc. and Camo Pollution, Mr. Waddle, Mr. place on file the reports from schedule an executive meeting with Lapar, the Town Board and William L L Egan for Wednesday July 18, 1973 at 7:00 P.M. at the Town Hall. Seconded by Mr. Saland. Motion Unanimously Carried The fo1i wing letter was received: - June 14, 1973 Town Board Town of Wappinger Mill Street Wappingers Falls, N.Y. Re: Houses on Kent Road Tied Into One System Gentlemen: At the time of approval of the subdivision map of Section 2, the subdivider agreed that house laterals would be placed to lots #80 and #81 so that the owners of said houses could tie into the central system and no longer use the piping system of lot #79. DIEHL moved that the Attorney to the Town contact and notify the subdivider of the problem and instruct him of his obligation. Seconded by Mr. Clausen. Motion Unanimously Carried Mr. Rappieyea notified the Board that, in the matter of the application of Mobil Oil Corp. plaintiff vs. the Planning Board of the Town of Wappinger, et all, defendant, that Supreme Court Justice Gagliardi has dismissed- the proceeding for reason that the petitioner has failed tb exhaust hisadministrativeremedies. MR. DIEHL moved Mr. Rappleyea's letter be placed on file. Seconded by Mr. Saland. - Motion Unanimously Carried The'Operating Permit, Wastewater Treatment Facilities, Rockingham Farms Sewer District, was received from the New York State Depart- ment of Environmental Conservstion. MR. HOLT moved it be received and placed on file. 1.7.0 171 Seconded by Mr. Clausen. Motion Unanimously Carried The Town Clerk noted for the record that she had received on July 2, 1973, and placed on file, the Notice of Filing of the Application for Certificate of Confirmation by the U.S. Cablevision Corp. This application is open for inspection by any person. MR. CLAUSEN moved the application be received and placed on file.' Seconded by Mr. Saland. Motion Unanimously Carried A request was received from Douglas C. Cochran for a year's exten- sion of his permit to extract natural resources from property on Rt. 376. A recommendation was also received from Susan Pike, Zoning Administrator indicating that she had inspected this site recently, and can see no problems with extending this permit for another year. MR. CLAUSEN moved to accept the recommendation of Miss Pike and grant a one year extension of the permit of Douglas C. Cochran to extract natural resources from property on Rt. 376. Seconded ;by_ Mr:: Holt. Motion Unanimously Carried A letter was received from the Town Planning Board forwarding the recommendation that the Town of Wappinger accept a fee of $100.00 per approved lot on the final Subdivision Plat of Tall Trees, Section 4 in lieu of a land contribution (6 lots). MR. CLAUSEN moved that a fee of $100.00 per approved lot be accepted in lieu of a land contribution for Tall Trees, Section 4 for a total of $600.00 for 6 lots. Seconded by Mr. Holt. Motion Unanimously Carried A letter was received from the Town Planning Board regarding accept- ance of deeds for recreation and roads in the Watch Hill, Section 6 Subdivision. The Planning Board would appreciate being advised as to whether or not the deeds are acceptable. 172 Mr. Horton, when asked by the Board, recommended they be accepted. MR. CLAUSEN moved that the Deeds for Roads and Recreation Land in the Watch Hill Section 6 Subdivision offered by Seymour Arkway, subject to the Attorney to the Town's approval. Seconded.by Mr. Saland. The following letter was received: Town Board Town of Wappinger Mill Street Wappingers Falls, New York Attention: Supervisor Diehl Gentlemen: Motion. Unanimously_ Carried July 3, 1473 Re: Rockingham Sewer District I had been authorized some time ago to receive bids for T.V. Inspection of the 10" trunk from Pye Lane to the Plant. I have delayed this pending resolution of the easement problems. To my knowledge we do not have easement over the course of this 10" sewer. Several weeks ago I got in tough with John Vorndran asking him specifically if he would permit entry on his lands for this T.V. inspection. _. He: was non -committal. Obviously we cannot put out a contract until we have easement or at least consent of Mr.-Vorndran for this project. Please advise. Very truly yours, s/ Vincent C. Kelley, P.E. MR. Motion Unanimously Carried Under Committee Reports, Mr. Jensen reported that the Joint Sewer Committee are having meetings and various papers are being filed to see if the District can be formed. Mr. Clausen reported on the field trip dealing with PUD Cluster Zoning, which he felt, was very beneficial and he believes that .in the near; future, when the Board draws up something for the Town, some of the good ideas will be incorporated in it. MR. JENSEN moved that the Town Clerk write to Caroline Raymond of the Dutchess County Department of Planning and commend her on the splendid job she did in setting up the field trip, it was very well organized. Seconded.by Mr. Clausen. Motion. Unanimously Carried The following resolution was introduced by COUNCILMAN CLAUSEN, who moved its adoption WHEREAS Section 444 of the Town of Wappinger Zoning Ordinance requires that the Town Planning Board consider certain factors in reviewing site plans and WHEREAS one such factor is the consideration of the impact of drainage of storm water upon the subject property and upon other lands in the Town, NOW, THEREFORE BE IT RESOLVED that the Town Board of the Town of Wappinger hereby directs that the Planning Board of the Town of Wappinger and the Engineer to the Town require that all approved site plans make adequate provision for both on site storm water drainage and 174 down stream storm water drainage so that any such projects, when completed, shall not have an adverse effect upon the Town of Wappinger, and BE IT FURTHER RESOLVED that this Resolution shall take effect immediately. Seconded by: Councilman Saland Roll Call Vote: 5 Ayes 0 Nays MR. JENSEN moved that the Town Clerk be directed to send a letter to the Planning Board telling them to enforce Section 33.2 of the Town of Wappinger Land Subdivision Regulations as written. Seconded by Mr. Clausen. Motion Unanimously Carried The Town Board having directed the Engineer to the Town to submit a detailed drawing for an appropriate seal for the Town of Wappinger, such drawing was now presented to the Board by Rudolph Lapar for their consideration. MR. HOLT moved that the Seal, as submitted by Mr. Lapar, be adopted as the Official Seal for the Town of Wappinger Seconded by Mr. Diehl. Motion Unanimously Carried (The drawing submitted and adopted is attached hereto). There was further discussion on the down stream drainage between Mr. Lapar and Mr. Rappleyea and the Board. Mr. Rappleyea commented that he thought the answer was made at a previous meeting that the result of this may be in the more logical development of the Town, but he thinks another question is raised and that is that the. Town should seriously consider, as part of its planning program, that not only the Master Plan adopted around the Southern Dutchess 1990 program, but an entire storm drainage plan, be made available to the Town so that as a development comes in there will be a master plan 'for drainage which will be looked a t'and the Town can then, in effect say okay'we know there's going to be -drainage here by 1980. In addition, if the Town wants to, they can embark on a capital program six years at a time to plan over these six years a capital 1 75 budget just for storm drainage, and that's why you would have a master plan. Mr. Clausen thought what the Town absolutely needs is that it have a Town .wide drainage program. Mr. Rappleyea then recommended that the Town make an inquiry to the Dutchess County Department of Planning to render the Town some advice on how to go about adopting a master plan for storm drainage and inquire if there are any State or Federal funds available. to assist the Town. MR. HOLT moved to contact the Dutchess County Department, of Planning' to inquire if they can render the Town of Wappinger any advice on. how to proceed in adopting a master plan foristorm:drainage program. Seconded by Mr --Clausen. Motion Unanimously Carried A letter was received from Harry C. Calhoun, General Manager for US Cablevision, replying to:a request from the Board to investigate the feasibility of cable TV service to Mrs. Turner and Mrs. Pratt. He replied that, since there were only 13 or 14 homes per mile, it was not feasible at this time toservice this area. MR. SALAND moved that Mr. Calhoun's letter be_received and placed on file, and -that. -Mrs. Turner be so notified of Mr. Calhoun's reply. Seconded by Mr:_,Clausen. Re: Complaint of Residents in the Rockingham Farms Subdivision re Drainage Ditch Between Balfour Drive F,e Doyle Drive. Gentlemen: Due to a complaint voiced at the June 11, 1973 meeting by residents of the above captioned subdivision, Mr. William P. Horton,-, Superintendent.of Highways, who was accompanied by his deputy, Mr. Kenneth Croshier, and I examined the site on June 18, 1973. The developer could drainage ditch by either order to better maintain the ditch throughout the improve the flow characteristics of the riprapping the sides of the stream in the grade and prevent puddling, or pipe entire area.
