The Regular Monthly Meeting of the Town Board of the Town of
Wappinger was held on May 14, 1973, at the Town Hall, Mill Street,
Wappingers Falls, New York.
Supervisor Diehl called the meeting to order at 8:15 P.M.

The minutes of the April 9, 1973 Regular Monthly meeting, and the
April 17, 1973 Special Meeting, having been previously sent to the
Town Board members, were now placed before them for their approval.
MR. CLAUSEN moved the minutes of the April 9, 1973 Regular Monthly
meeting, and thDAApril 17, 1973 Special Meeting, as submitted by
the Town Clerk be and they are hereby approved.

Mr. Leonard Tomazin, Dorothy Heights, having requested to speak
before the Board regarding a storm drainage problem involving his
property, addressed the Board stating that his problem centers
around piping -Mr. Horton put in a few years ago, which drains the
water from one side of the street to the other, which renders his
property useless. At the time Mr. Horton was installing the pipe,
he had understood Mr. Horton to say the Town was going to continue
the pipes across his property to continue the drainage, but appar-
ently that never happened. What he wants done is for the water to
drain along the road to drain between his property and his neigh-
bors,then he can use his adjoining lot. Mr. Horton, in answer to
Mr. Diehl's question as to what the Town's responsibilities are in
this case, indicated that, first of all, the pipe he put in replaced
the pipe that the Town put in in 1940. The original pipe rusted
out and they simply replaced it. Mr. Tomazin purchased his property
in 1965, with this pipe across the road. He thinks this is a
matter that should be turned over to the Attorney because it was
replacing a pipe that had rusted out, no pipe was added, and no
water was added from other areas to create the problem. Mr. Tomazin
contended that if Mr. Horton raised the pipe up two more feet the
water would run all the way to the end of his property. When the
pipe was originally put in it served its purpose, but since then
the property has been bought and developed and it doesn't do justice
to him. Mr. Horton reiterated that he would like the Attorney to
look into this problem, since there are a number of existing old
pipes in the Town with the same situation.
Mr. Diehl directed this matter be referred to Mr. Lapar and Mr.
Rappleyea to study the problem and come up with a recommendation
by next months' meeting.

Mrs. Alice Turner, Old Troy Road, having requested to speak before
the Board on the matter of getting Cablevision, stated that several
years ago she had written the Board indicating that her area was not
eligible for Cablevision. She had been contacted by Mr. Diehl, who
explained at the time why the Cablevision Company couldn't run a
line down Old Troy Road. It so happens now that the Telephone
Company"is installing new telephone cable in their area at present,
and she would like to know if it wouldn't be possible, at this time,
for the Cablevision to be installed at the same time.
Mr. Diehl instructed the Town Clerk to direct a letter to Harry
Calhoun, informing him of the desire of the 'Board to have this area
investigated and establish what potential customers are there and
to report back to the Town Board as to the possibility of Cablevision
service in this area.
A second letter was received from Supervisor Franklin G. Knapp
of the Town of LaGrange regarding the matter of a rezoning in said
Town of the Bray Property. Mr. Rappleyea advised the Board that
the Town of Wappinger did not have to reach an opinion one way
or another, in favor of, or against, the proposal, but probably the
Board should at least respond to it.
MR. DIEHL moved that the Town of Wappinger take no position either
for or against the subject rezoning of the Bray Property in the Town
of LaGrange, and further, that Franklin G. Knapp, Supervisor, Town
of LaGrange, be so informed.

Board what the impact would be on that (Fleetwood) District as
to service, cost, and as to rates, subsequent to such adoption.

Various Developments
Gentlemen:
On March 14, 1973, we met with Mr. Jack Hill, Acting Direc-
tor, and Mr. Ronald B. Friedman, Director of Engineering, of the
Dutchess County Health Department.
Among the various matters discussed was the allocation of
capacity in the Plant.
My recollection of the discussion on the above matter is
as follows:
1. Town of Wappinger to sent to D.C.H.D. a proposal
of how they will allocate spaces in the Oakwood
Knolls Sewage Treatment Plant.
2. Discussion on the above matter with Board members
and the D.C.H.D. It was decided that approximately
80 hookups are presently available until infiltra-
tion has been corrected and the Plant expanded.
3. The Town would allocate hookups until the 80 avail-
able were exhausted, or more were allowed by the
D.C.H.D. when infiltration had been eliminated.
4. Further, the Town Board agreed to Mr. Rappleyea's

recommendation that a builder has 2 weeks to start
a house and 3 months to complete it orthe building
permit is no longer valid and can be issued to
someone else.
If you find my recollection in order, I recommend that
you forward a letter to the Dutchess County Health Department
to that effect. If your recollection is different from mine,
please write the letter with the rules agreed upon by the
Board.
Should you have any questions, please do not hesitate to
call me.

Mr. Diehl commented that he believed the Board should take action
tonight with a motion notifying the Health Department, so arrange-
ments can be made for hookup.
The following motion, proposed by MR. DIEHL and seconded by Mr.
Clausen was withdrawn after discussion on the subject.
MR. DIEHL moved to accept Mr. Lapar's recommendation and the
Dutchess County Health Department be so notified, and Mr. Rappleyea
proceed with the formula necessary to set it up.
The discussion that precipitated the withdrawal of the motion
commenced with the question from Mrs. Frisina as to the rights of
existing home owners having prior rights to developments -as regards
to the 80 hookups. Eighty hookups could be exhausted, long before
the lines got to her, by several proposed developments, but she
was there first. Mr. Rappleyea explained the rationale of -the
proposed allocations, and indicated that quite likely she'would be
able to obtain a hookup. Mr. Eck dwelt on Orchard homes, and the
fact that these residents should get preference.
MR. HOLT moved to receive Mr. Lapar's letter and place it on file
for consideration.

After various discussions with Dutchess County Health Depart-
ment officials, I would like to recommend the hiring of Camo Pollu-
tion Control, Inc. of Wappingers Falls, N.Y. to provide supervision
of the operation and maintenance of the following:
1. Rockingham Farms Sewage Treatment Plant
2. Oakwood Knolls Sewage Treatment Plant
3. Oakwood Knolls Water Supply System
4. Fleetwood Sewage Treatment Plant
5. Fleetwood Water Supply System
6. Kent Road Pump 'Station

to the Town, it is feared that they do not have the personnel or
time to adequately perform the service we require.
The Camo firm has a good reputation and excellent references,
plus the fact that their business is located in the Town of Wappinger.
Mr. George B. Cacchio, President of Camo, recently received recogni-
tion as the best sewage treatment plant operator in New York State.
Mr. Art Waddle,is, in my opinion and in the opinion of others,
capable of becoming a competent sewage treatment plant operator.
However, without the training that a firm such as Camo can afford,
he may never reach that potential which could be of great benefit
to the Town.
I am enclosing a letter and agreementform, dated January. 8,
1973, which is still valid, and recommend that it be signed as
soon as possible. _

Mr. Clausen introduced a motion to accept Mr. Lapar's recommendation,
but, on that subject, Mr. Holt felt however, from looking over the
suggestion of employing Camo, all indications were that we would have
to raise additional funds from the sewer districts. Since it had
already been planned to -meet -with William Egan to find out what is
available by way of funding, he suggested a session with him to -
evaluate the funding, and, as soon thereafter as possible, resolve
this situation. Mr. Clausen commented -that Mr. Lapar's letter was
initiated by the meeting with the Dutchess County Health Department,
the Town Board and the Engineer to the Town, which was due to the
fact that the Town's operating proceedures are not optimum within
the Town, according to the County, it would seem to him that whether
the money is there or not it's going to have to come. It's some-
thing he doesn't think the Board can put off indicating whether we
have enough money to insure the standards of good control to operate
Oakwood Knolls or anywhere else for that matter. He thinks it's
incumbent upon the Board -to get the plants operating according to
the Dutches,s County Health Department Standards, and supply the
money, he doesn't think it's -something they can wait any longer
for, it's imperative that we get an organization in here that will
get our plants in good operational shape. He then reiterated his
motion to accept Rudolph Lapar's recommendation, then we'll see
how the finances are and set about to solve them. Mr. Diehl felt
this was the right direction too,.and.perhaps the Sewer Committee
could set up an immediate meeting.in.regard to the possibility of
having to raise therates, and_ with Mr. Rappleyea then could work
out a cost increase, if necessary. Mr. Jensen commented that the
only o)ncern he had was that he's seen these recommendations to up
grade these plants before, and it seems the past Boards have been
somewhat remiss in not moving ahead at that time. He has spoken to
Mr. M. Morris whowouldbe most happy to sit with the Board and go
into detail as to what is -required of these plants. = He has reviewed

the recommendations of Mr. Waddle and Mr. Lapar, and feels this_
company will come back with some of the same recommendations. He
would be very concerned about the rate schedule, and he would gor:
along with the motion as long as the Board is all in agreement that
when the rate schedules are posted with Mr. Egan that they be accepted.
Mr. Diehl said he felt the main text of the problem was a serious
operation:problem, that problem we can correct by bringing in
additional experienced help. All Mr. Jensen said he was ques-
tioning was)what we are going to get for the money. Mr. Holt
failed to see how the retention of Camp Pollution Control Inc.
is going to make the plants work better when we have already seen
recommendations for the improvement of the operation. The plants
are in mechanical difficulties, hiring Camo to come in and look
at it three times a week isn't going to help it. This is where.
he's reluctant to use district funds, which are in short supply,
rather than pitch in there and mechanically fix the problems. Mr.
Diehl asked Mr. Lapar if he would or would not recommend that the
Board do hire additional experienced help, can this additional
help correct some daily problems. Mr. Lapar_said, according to
his recommendation, that the Board should hire Camo, if for nothing
else but for the reason that the Board of Health said this is what
you ought to do, since they have had more experience that:. the.Town
has ever had. However, this is just the beginning of a lot of money
that's going to have to be spent.
MR. CLAUSEN moved that Rudolph E. Lapar be given the authority to
negotiate with Camo Pollution Control, Inc., subject to the Board's
approvalfinancially and come up -with recommendations that can be
brought before the Town Board at their earliest convenience for
consideration.

the Town Hall.

MR. CLAUSEN moved the U.S. Cablevision Corp. year end financial
statement be received. and placed on file.

in Dutchess County
Touring Arts Festival 1973
Gentlemen:_
Dutchess County is planning to have an.Arts Festival avail-
able on a touring basis this summer. The Arts Festival will be
jointly sponsored by Dutchess County, the New_York State Council
on the Arts, and the Hudson Valley Philharmonic. In`addition,
each participating town or city may act as a local sponsor and.
contribute a proportionate share for the Festival. The cost to
each participating town or city will be $625.00 for the 2 day
Festival, and $350.00 fortheone-day Festival. Enclosed is a
schedule of events that are available for a typical 2 -day Festival.
Ideally each local sponsoring town or city will be able to custom
design the Festival for their own particular area by selecting
from the many options available. Since the availability of the
Festival is limited to the weekends from June 1st to August 20th,
it is suggested that interest and reservations for the Festival
be submitted to this office as soon as possible. Limited funding
necessitates honoring applications as received.

for more information then turn it over to the Recreation Commission
to see what they would like to do with regard to participating.

A:`request for permission to conduct a "Waikathon" through the. Town
of Wappinger was received from the Fishkill Jaycees,
Mr. Diehl directed the Town Clerk to take the: appropriate steps to
notify the Fishkill Jaycees and the Sheriff that the Town of Wappin-
ger has no objections to the proposed Walkathon,-subject to the
approval of the Dutchess County Sheriff's office, and further that
appropriate emergency, units should be alerted as to the date and
time of the walk and its route, as a precautionary measure.
Mrs. Snowden informed the Board that the decision and approval of
the Water Supply application of Brinkerhoff_Water Company, Inc.
was received from the New York State Department of Environmental
Conservation on April 24, 1973.
MR. CLAUSEN moved to receive and place on file the Brinkerhoff --
Water Company approval.
Seconded by Mr. Holt.

A request was received from the Town Clerk for permission to
attend a Seminar on Vital Statistics in White Plains on May 16,
1973, with her Deputy, and, also a request was received from both
Town Justices, Mr.. Bulger and Mr. Francese, to attend the annual
training session for Town Justices at St. Lawrence University,
Canton, New_York, July 23 to July 27, 1973.
MR. HOLT moved that the Town Clerk, her Deputy, and both Town
Justices be granted permission to attend their:respective training
sessions, and that their legitimate expenses be a Town charge.

Gentlemen:
On April 27, 1973 at 11:00 A.M., bidsfor the above .contract
were opened and read by Allan E. Rappleyea, Attorney to the Town.
We have examined the bids and find that the bids of Dave
Alexander, Inc., the low bidder on the base bid and the two
alternates, are in order.
Since the total bids are in excess of the authorized Bond
Issue, it is my recommendation that the low bidder, Dave Alex-
ander, Inc., be awarded the contract for a total price of
$427,195.00.
After discussions with Mr. William P. Horton,.Superintendent
of Highways, it was decided to.eliminate the Widmer Road Project.
The following projects are included in the bid. The alter-
nates shown were chosen because they are the least expensive.

Applications were received from Benjamin C. Varian, Mary Ann
Schroder, Joan Baratta, William J. Grove, Sr. and Sean Kelly for
Hawking and Peddling Licenses. The applications were referred. to
the Dutchess County Sheriff's Department, and returned indicating no
criminal record on file, with the exception of Kelly which indicated
an arrest for loitering in 1969.
MR. CLAUSEN moved to approve the applications and grant Benjamin
C. Varian, Mary Ann Schroder, Joan Baratta, William J. Grove, Sr.
and Sean Kelly licenses for Hawking and Peddling in the Town of
Wappinger.
Seconded by Mr. Saland.

Mr. Diehl, acknowledging the presence of James Mills, County Repre-
sentative, asked him if he wished to make a brief report of any
points from the County Board meeting that might be of interest to
the Wappinger residents. Mr. Mills hit on a few of the highlights
of the meeting making note of a tax rebate that would be made to
Wappinger along with other municipalities, from Tax and Equaliza-
tion; Joseph Pollucci introduced a resolution_requesting New York
Environmental Conservation to establish an Environmental monitoring
station in Dutchess County, the purpose of which would be to set up
a station to check the sound level. A contract was signed with
Banner Flyte East, Ltd. at the Airport which is primarily to take
care of all of the private pilots who have to have service done on
their planes. He has a five year option. Ralph Mark, Chairman
of the Dutchess County Guidance Council for Drug Abuse, asked for
funds to try to coordinate the program for the County. The CSEA
Contract was signed. Mr. Petrovits had received Mr. Diehl's letter
regarding the Wilson drainage problem on Osborne Hill Road. He
isn't sure how he will solve it. He might end up ditching it all
the way to the Fleetwood drainage system. He concluded by touching
on a few other items of interest unrelated to Wappinger.

A petition was received from Theresa Arkell and Eleanor Croshier
requesting a speed limit of 30MPH be established on MacFarlane
Road. The petition was signed by 45 residents of the road._ Their
concern is due to the fact that two large apartment complexes are
being constructed with both entrance and exit being on MacFarlane.
It was also noted that Sloper-Willen Ambulance Service is also
stationed on this road.
MR. CLAUEN moved that the Town of Wq? pinger request the New York
State Department of Transportation to consider the establishment
of a 30 MPH speed limit for MacFarlane Road and further, request
that the New York State Department of Transportation review the
Town of Wappinger request for a Town wide speed limit of 35MPH,
exclusive of State and County Roads lying within the boundaries
of said Town.
Seconded by Mr. Holt.

A request for soil mining permit was requested by Jack Davis to
remove excess fill from his property located:on-Route 9 and Middle -
bush Road, (a topography map showing original and intended grade
was submitted with application).
MR. DIEHL moved. that Mr. Davis' request be referred to Miss Pike,
Zoning Administrator, and Rudolph Lapar, Engineer to the Town,
for their review and recommendation.
Seconded by Mr. Jensen.

I have applied, for:water and_ sewerage from.thecAtlas Waterco."
and the L&A Filtration Corp. to service my property at 141 New
Hackensack Road, Wappingers Falls. They informed me that the

water I can have but the sewerage is up to the Town Board.
At this time I am contemplating the building of fifteen (15) new
homes on my property. Therefore, I am in much need of this sewer-
age as my property is only 50-75 feet from this particular sewer
system._ I think it would be a benefit to the Town to either .
install a system, as I understand the Town is in the process of
trying to take it over; or give me the permission to install one
myself. Without this sewer my property is practically useless.
I hope to hear from you on this matter in the very near future.

Mr. Jensen commented on the complimentaryletter received from
Joseph Incoronato, President of the Wappinger Conservation Associa-
tion thanking William Horton for making Town trucks.available for
the Boy Scout recycling operations.
The following resolution was introduced by COUNCILMAN JENSEN
who moved its adoption:
WHEREAS, the Towns of Wappinger and Poughkeepsie and the
Village of Wappingers Falls share a mutual sewage disposal problem;
and
,WHEREAS,_ it appears to be in the best interest of all parties
to investigate various alternatives in an effort to effect an
equitable solution; and
WHEREAS, the Federal and State Environmental Protection and
Environmental Conservation agencies require regional sewage
treatment plants to serve large communities; and
WHEREAS, provided an application is approved, combined
Federal and State Aid can approximate 87.5% requiring only a
minimal local share; and
WHEREAS, the three aforementioned municipalities have always
enjoyed exceptionally good relations; and
WHEREAS, each municipality is desirous of improving and
implementing sewage facilities for its constituency,
NOW, THEREFORE, BE IT RESOLVED, that the Town of Wappinger
update the New York State Comprehensive Sewage Report, known as
the Clinton -Bogart Report which would permit the aforementioned
towns and village to construct a joint sewer project consisting of

trunk sewers, interceptor sewers, and a sewage treatment plant
to serve the areas generally tributary to the Wappingers Creek
and to the Hudson River,
AND BE IT FURTHER RESOLVED, that the Town Board of the Town
of Wappinger shall be a committee of the whole to meet with the
other municipalities to formulate a proposal to engage consult-
ants for the purpose of updating said report.

Mr. Jensen, in reference to the request from the Fire Districts
concerning a Fire Code, stated that the Fire Committee had gotten
together with Fire Chiefs of the three districts. Mr. Holler was
selected to chair the meeting. At the present time the suggestion
has come up for review by the Town Board of the possibility of
setting up a Fire Prevention Bureau as the first step, this bureau
would'be made up of members of the Fire Chiefs of each Fire Company
with Mr. Holler still maintaining the chairmanship as he is the
only one who can enforce it at the present time and from that point
on the Fire PrevTention Bureau with the nucleous of these three
gentlemen with Mr. Holler could come up with a set of rules and
regulations for the bureau, listing numbers of inspectors that
might be required for each,one of the districts, and from that
point propose a Fire Code for the Town of Wappinger.
MR. JENSEN moved that a Fire Prevention Bureau, consisting of
three Fire Chiefs, from the three Fire Districts in the Town of
Wappinger, with John Holler, Building Inspector as the Chairman,
be set up for the ultimate goal of establishing a Fire Code in the
Town of Wappinger.

Mr. Clausen briefly stated that he and Mr. Jensen were still invest-
igating possibilities for a new Town Hall site. They had met with
the Chamber of Commerce regarding the Sweet Orr Building and were
to meet with them again. Hopefully they would have some recommenda-
tion of next months meeting.
Phe following resolution was offered by SUPERVISOR DIEHL who moved
its adoption:
WHEREAS, in that there is a growing need for Youths Programs
in all municipalities of the State of New York and,
WHEREAS, the increase of juvenile crime across the United
States has been drastic in the past six years, and
WHEREAS, also, that the amount of money allotted by the State
to our County of Dutchess, and all other counties, has not increased
since 1967, yet the cost of institutionalizing a youth for juvenile
crimes is set between $11,000.00 and $19,000.00 per year,
NOW, THEREFORE' BE `IT
RESOLVED, that we therefore urge that our Legislators act
favorably on the bill (Senate #4797, Assembly #5138) to increase
the amount of aid offered for youth programs in the State from
$.75 to $1.50 per youth, and be it further
RESOLVED, that the Town of Wappinger request that these bills
be removed±from Committee and voted on as soon as possible.

A Public Hearing having been duly held on the proposed Planned
Unit Development Zoning Amendment, the matter was placed before
the Board for their consideration. As a matter of record, the
Town Clerk further informed the Board that the recommendation
from the Dutchess County Department of Planning was received
May 14, 1973, with regard to PUD, recommending disapproval, subject
to some qualifications, recommending a mutual discussion of the
proposed amendment. Mr. Diehl stated that he believes the Board
has decided there is further study to do on the proposed amendment
and more information needed.
MR. DIEHL moved the proposed amendment be tabled for further study,
and placed on the agenda for the next regular Board meeting.
Seconded by Mr. Holt.

Bill Bibasotti asked when further study on the PUD would be
completed.
Louis Eck asked if cluster zoning could be included in the re-
drafting of PUD or if it could be considered separately.
Mr. Bradford asked if the Board was writing this ordinance or
considering rewording the old ordinance.
A communication had been received from the New York State Depart-
ment of Agriculture and Markets asking if the Town would consider
of
passing a resolution of support,/the new proposed New xork State
Dog Law, Article 7 of the Agriculture and Markets Law. Mr. Diehl
commented that he had spoken to Mr. Wells, one of the Dog Wardens,
regarding the proposed new law, who indicated he felt this law
should be passed. Mr. Clausen commented that the Board was meeting
again next week and could possibly consider some action at that
time.

and flow of privately owned lakes and dams.

MR. DIEHL moved that Mr. Bishop be notified of this notice from
New York State Department of Conservation, as it appeam,, the
responsibility is that of the people owning the Lake and that the
Town does.:not have jurisdiction, and further, a letter be sent to
the Lake Oniad Homeowners Association letting them know the action
the Board has taken.

Mr. Diehl stated that his office had received word from the Federal
Revenue Sharing Treasury Department that the Town's part of the Fed-
eral Revenue for the first six months of 1973 will be $53,477.00.
They request that the Town notify them of what is proposed

pated to do with the, money. This is only a proposal and does not
pledge the Town -to spend it.
MR. DIEHL moved that the Town Clerk so notify them that the pro-
posal has been made that $5,000 be used for environmental protection
control in junk cars and demolitions, $25,000 be used in Recreation
for tennis courts, $23,477 be used in starting swimming facilities
fora total of $53,477.

WHEREAS, the sum of $53,477 has been allocated to the Town
of Wappinger from the Federal Revenue Sharing during the first
six months of the fiscal year of 1973, of which $48,477 has not
otherwise been committed or appropriated,

RESOLVED, that $25,000 of said Federal Revenue Sharing be
and hereby is transferred to Account #A7140.4 Playgrounds and
Recreation Centersspecifically for tennis courts and that the
amount appropriated for such purpose be and hereby is $25,000.

During discussion, prior to voting, Mr. Saland indicated that he
had no intention of voting on the proposal without having further
time to look into it, as he had no prior knowledge of the proposal.
Mr. A. Zak asked in what area the proposed tennis courts would be
located. Mr. Saland again commented that to date there has been
no comprehensive study by this Board of how to use the Federal
Revenue Sharing monies that have been received to date. He feels
that a comprehensive place should be developed. Mr. Diehl said
that possibly some of this money could be used for a new Town Hall
in the near future, it's well spent for Recreation, we've got to
expand our Recreation into areas such as swimming and tennis courts -
we're running at capacity with baseball, we've got to get into the
other areas, to provide some recreationforthose who are not in
baseball, aslo. Mr. Eck was against Tennis Courts, Mrs. Eileen
Zipes.asked that Bicycle Paths be considered. Mr. Saland added
that this matter of Federal Revenue Sharing has only been approached
three, or four times, he wasn't against Recreation but he thinks
it needs a.lot more study before the Board starts spending that
money, the Board will have to establish what the priorities are.
Mr. Jensen, qualifying his nay vote, stated.he agreed with Mr.
Saland.

Under new business Mr. Jensen suggested that the Board, at one of
their future executive sessions, sit down and set down their
priorities where these funds should go so that the Board can
address them in a little different vane.
Eileen Zipes, DeGarmo Hills Road, asked what the status was of the
water.
Mr. Horton brought up the problem of the Landfill on Saturdays
when people go to use it without tickets, and are informed they
must purchase tickets first. It appears they don't bother to
take the time to get the tickets, they dump their rubbish along
the road. Mr. Diehl reported that the Town Clerk in LaGrange was
open Saturday mornings, and has been handling it quite well, the
City of Poughkeepsie is in the process of putting tickets at the
desk at the Police Department. When Mr. Horton asked about tickets
at the Landfill site, Mr. Diehl replied that the Board of Governors
had ruled that no cash would be received at the Landfill site and
invited Mr. Horton to the next Board of Governor's meeting if he
wished to pursue the problem.
Mr. Saland, having a few comments for consideration of the Planning
Board addressed himself to Mr. Steinhaus. He had been wondering
about the feasibility of either an ordinance or an amendment to
the subdivision regulations whereby a developer would if taking
the winter months and the early spring season, when it becomes
difficult to work outside, would be required, in order to get a
C.O. to have all of his exterior work completed, i.e., lawns
finished graded, seeded, shrubbery required,-prior'to the issuance
of the C.O.-during these four months or so when weather makes it
difficult to complete that work, perhaps the Town can sanction an
escrow of some kind, this does occur in other Townships he's been
told, and it might prevent a lot of people from getting a "run-
around". He'd like the Planning Board to discuss it and,get their
comments on it. Mr.' Steinhaus responded that'comments such as that
he thinks involves a joint effort with the Planning Board and the

Town Board. He would like to see a better raport established between
the two Boards although they seem to be heading in that direction.
It would probably involve a few sessions with the two Boards,
Building Inspector, and Zoning Administrator, but he would go
along with the comment.
Mr. Eck asked Mr. Diehl if anything had been done to close off
the temporary entrance to the White Gates Apartment Complex on
Hopewell Road. Mr. Diehl said he had reported it to Mr. Holler
and Miss Pike the next day to investigate the use of the entrance
on Old Hopewell Road in regard to violations of any type and they
were to contact the owner of these apartments. Mr. Diehl asked
Mrs. Snowden if she would notify Miss Pike and Mr. Holler again of
the situation of the entrance and exit now being used from the
apartment complex on Old Hopewell Road, and to investigate into
whether a violation or hazard exists and to take the proper action.
Mr. Eck, referring to previous action regarding authorization of
expenditures for repairs to the Rockingham Farms Sewer Plant a
number of months ago, asked why the problems still exist.
Supervisor Diehl called for a recess at 10:23 P.M.
Supervisor Diehl called the meeting back to order at 10:58 P.M.
All Board members again present.
A resolution concerning the roads in Section 111 of Ye Olde
Apple Orchard was read by the Attorney to the Town. There was.
discussion between Mr. Gerzof and Mr. Rappleyea after the first
reading which centered around an additional amount of cash bond to
be accepted by the Town for the remainder of roads in Section Ill,
so that the developers would not have to make further application
to the Town Board upon completion of those portions of roads when
approved by the Highway Superintendent.
An agreement was reached modifying the resolution as was first
read. Mr. Gerzof made note of deletion of Lots #106 and #107 -
have been deleted because there is a possibility there will not
be access to these lots because of the installation of a lift

station and that in the event that appropriate access is provided
for Lots #106 and #107, they shall not be deleted, but included
in the program outlined. tonight. It was agreed to leave it to
Mr. Horton's discretion to determine access on *106 and #107 as
part of the permit lots.
The following Resolution was offered by COUNCILMAN CLAUSEN who
moved its adoption:
WHEREAS, the Town of Wappinger Planning Board first approval
of a plat known as Section 3 Ye Olde Apple Orchard, said approval
having been given July 17, 1972, and
WHEREAS, Opalo Realty Inc. and Julius Gerzof, the developer
of said parcel as shown on said map have tendered.to the Town of
Wappinger a cash bond in the sum of $50,000 covering the com-
pletion of the roads and improvements as required by the road
specifications as applied to said plat including the maintenance
of said roads once the improvements have been formerly approved
and the roads formerly accepted by the Town of Wappinger:
NOW, THEREFORE, BE IT
RESOLVED, that the Town of Wappinger accept the tender of
the $50,000 from said developers to guarantee the completion
and maintenance of the portion of said plat hereinafter described
and in accordance with town specifications as provided by the
approval,of the Town Planning. Board and be it further
RESOLVED, that the Building InT ector_is authorized to issue
building permits after the compliance with the following conditions:
1. Delivery of deeds for two portions of roads set forth
in subdivision plat attached hereto outlined in red and designa-
ted as the roads and impromments and easements in front of lots
67, 162 thru 170 inclusive, 171 thru 176"inalu"sive, 143'thru
161 inclusive, 103 thru 112 inclusive, and 82 thru 86 inclusive
which are portions accepted by this resolution excluding such
roads in front of lots 106 and 107 as shall be determined by the
Highway Superintendent, together with title certificates approved
by the Attorney to the Town.
2. Approval of Dutchess County Department of Health for
sewage for each such Building Permit as the same may be applied
for.
3. Completion of the facilities within one year from the
date of this resolution subject to such extensions as the Town
Board may agree to.
and it is further
RESOLVED, that said fund be deposited in an escrow fund
provided, however, that the Supervisor is authorized to deposit
the same in an interest bearing account with the earnings thereon
to be returned to the depositor upon the satisfactory completion
and maintenance of the roads and facilities, provided said de-
positor shall release the Town of Wappinger from all claims for

any loss of said fund for any reason whatsoever, and be it further
RESOLVED, that upon written approval of the Highway Superin-
tendent Of the preliminary installation of facilities necessary
to get building permits under Town specifications the Town Building
Inspector shall issue building permits along the remaining roads
as shown on said plat upon the following conditions:
1. Depositing with the Town a cash deposit to be retained
under the same conditions, said deposit to -be in the sum of
$60,000.
2. Tender and acceptance of deeds and certifications of
title and it is further
RESOLVED that upon final acceptance of all of said roads in
said plat the maintenance cash bond in the sum of $40,000 shall
be retained for one year as provided in the Town specifications
and any balance less offsets shall be returned.
