The Regular Monthly Meeting of the Town Board of the Town of
Wappinger was held on February 12, 1973 at the Town Hall, Mill
Street, Wappingers Falls, New York.
Supervisor Diehl called the meeting to order at 8:09 P.M.

With regard to the minutes of the December 28, 1972 Special Meeting,
Mr. Saland indicated that a correction should be made with regard
to his statement on the first page of these minutes (first -.paragraph,
six lines from bottom of page) i.e. the words "suspended in" should
read "expended, and" --
The minutes of the December 11, 1972 Regular Monthly Meeting, Decem-
ber 28, 1972 Special, January 2, 1973 Reorganizational Meeting,
January 8, 1973 Regular Monthly Meeting and January 12, 1973 Special
Meeting, having been previously sent to the Town Board members, were
now placed before them for their approval.
MR. JENSEN moved the minutes of the December 11, 1972, January 2,
1973, January 8, 1973, and January 12, 1973, as submitted by the
Town Clerk, be and they are hereby approved; and the minutes of the
meeting of December 28, 1973, with the change of the words "suspended
in" to "expanded, and" as corrected by Mr. Saland, be and they are
hereby approved.

Annual report.
MR. CLAUSEN moved the monthly reports of the Supervisor, Building
Inspector, and the Town Justices, and the Grinnell Library Annual
Report be accepted and placed on file.
Seconded by Mr. Jensen.

Mr. Diehl announced that, with the consent of the Board, several
people from Montclair Apartments would be given the floor, before
the next order on the Agenda, to discuss dog problems in their
apartment complex.
Mr. Jerry Egan was recognized. He described an incident that
occurred Saturday (February 10th) involving two young boys being
attached and bitten by two dogs on the grounds of the complex. His
question was what authority does the Dog Warden have. He stated
that both dog wardens seem reluctant to come up to Montclair, he
theorized the reason for this was that since the road going into
the apartments was private, and not subject to he jurisdiction of
the Town. They feel, however, that dog wardens should come up,
like police or firemen, and respond to a very pressing need up
there.
Mr. Diehl said, to his knowledge, both dog wardens had been going
up and picking up unlicensed dogs, it is his understanding that if
the dogs are licensed and on the private property of Montclair, it
is an internal problem of the apartments. Mr. R3ppleyea agreed with
Mr. Diehl that that, essentially, is the position the Town has taken.
It is essentially the obligation of the dog wardens to pick up
unlicensed dogs, not to police the grounds of the apartment complex
to see that strays did not come on the property or that tenants did
not harbor dogs, this is not their responsibility. Mr. Egan stated
that any tenant who has a dog in the apartments does so with the
knowledge of management, but the dog must be on a leash - they do
have a leash law. Mr. Rappleyea commented that Montclair's leash
law is not the obligation of the Town to enforce. Mr. Egan argued
that the dog warden had been called this Saturday because of these
two vicious._ dogs on the property (owned by tenants in one of the
apartments). Mr. Rappleyea stated that if the dogs are vicious ,
this becomes a different interpretation. The Town is not equipped
to respond as the police are, and if, in fact, these dogs were
vicious this is a police problem. Paul Usinger, husband of,the
resident manager spoke up saying the dog wardens have, for five
years, refused to come up to Montclair under any circumstances until
this past week. Mr. Rappleyea disputed that statement, stating the
wardens had discussed these problems many times, and it could be
looked up in the records and they would show where they have picked
up dogs in the past at Montclair.
Mrs. Kenneth Koontz whose son was one of those bitten, couldn't
understand why, if there were two big dogs loose, they couldn't be
picked up, the owners were away and the warden was told this. Mr.
Koontz asked, if under the circumstances, prior to the incident, as
far as trying to get the dogs picked up, should Montclair have just
tried to do it themselves, or should they have gone to the Sheriff
rather than the dog warden. Mr. Rappleyea stated that essentially
the landlord has to enforce the obligations of the lease, and it's
a common obligation to protect other tenants, and if there were a
vicious dog, he was sure the Sheriff would send a Deputy to investi-
gate. Basically under the Agriculture and Markets Law, the dog
wardens are to pick up unlicensed dogs, unfortunately some people
think it's a much broader concept than it is.

requesting permission to advertize for bids for two trucks and one

MR. CLAUSEN moved that the Highway Superintendent be granted per-
mission to bid for two trucks and one loader, and further the
Attorney be directed to set up the Resolution for bonding, not to
exceed $55,000.
Seconded by Mr. Jensen.

Recommendation was received from the Dutchess County Department of
Planning regarding the proposed amendment to the "Mobil Home" defini-
tion in the Town of Wappinger Zoning Ordinance.
MR. JENSEN moved the recommendation be received and placed on file.

Two letters were received from the Town of Wappinger Planning Board.
The firs -t advised the Town Board that James Mills had been appointed
as Vice -Chairman of the Planning Board, and the second was in refer-
ence to the proposed rezoning of Route 9, indicating they would first
like to avail themselves of the opportunity to consult with Mr. David
Portman of Frederick Clark Associates and also benefit from comments
raised at the Public Hearing before they make their recommendation.
Mr. Diehl directed that these letters be placed on file.
Notice was received that the adjourned hearing on the proposed
increase of water rates for Harry Raker (Tall Trees) was scheduled
for February 15, 1973 at the Dutchess County Clerks Office.
Mr. Diehl directed that this notice be placed on file.
Notice was received from the New York State Department of Environ-
mental Conservation indicating a Public Hearing would be scheduled
for February 13, 1973 at 11:00 A.M., Town Hall if there were any
objections filed.
Mr. Diehl directed that this notice be placed on file.
Mr. Louis Eck had requested to speak before the Board on the
proposed zoning amendment (Section 412.02) with regard to the sewer
and water districts. Mr. Eck, upon taking the floor,. first approach-
ed the subject of Planning Board approval of Martin Leskow's subdi-
vision. His claim was that the Planning Board approved an illegal
or non -conforming subdivision, when, by using an additional area
of 43,000 square feet the lots could have been made to conform.
He pointed out that the Dutchess County Department of Planning had
submitted a map showing how the lots could meet the legal require-
ments, and this had been ignored. Why hadn't they accepted the
recommendation of the County Planning Board? He doesn't believe the
Town should accept Leskow Circle for a Town road. If they do, Leskow
will have an approval of an illegal subdivision. He tied this in
with his objection to the proposed amendment to Section 412.02 -
that the Town is trying to upgrade the areas with 40,000 square
feet with water and sewer and here the Planning Board gives approval
for 5,000 square feet lots without water and sewer. With reference
to the repeal of Section 412.02, he criticized the recommendation
from the Zoning Regulation 'Advisory Committee by asking where they
were when the Planning Board held the hearing on Leskow's subdivi-
sion of 8,000 square feet lots. He charged hypocrisy; and, on the
Cedar Hill -Pine Ridge Civic Association's petition for the repeal,
he pointed out that in that area there were approximately 170 homes
with approximately 42,000 feet of Town roads in this area which
equals approximately 235 feet per house against approximately
85% of the homes in the Town which have approximately ,50 feet
per home. Almost five times as much in the Cedar Hill -Pine Ridge
area as any other place in Town, and the other people are paying
the highway bill for them. He also pointed out that the deeds for
Cedar Hill area state one house per acre, so they're well protected
yet they're coming down here and telling the Board what to do with
the rest of the Town. He also claimed that some of the people who
signed that petition did so thinking they could stop the subdivision
going in below them (old Pul3sley property "Hidden Hollow"). He
read from a news item by Joseph Incoronato, recommendation from
Warren Strohm, and the Town Planning Board, all mentioning undesir-
able crowding and the Planning Board referring to central water and
sewer now available. He doesn't buy overcrowding on ½ acre lots, and
who gave the Planning Board the impression the water and sewer belongs
to the Town, it belongs to the people In the districts to be paid by
them, and it would be more expensive to these people with acre lots
instead of allowing ½ acre lots. With reference to the property
owners in the Wappinger Sewer Improvement, if the Board repeals
412.02, this Board would be reneging on what they told the public
in their public hearing. The public was told that the density would
be built up and the water customers were going to be in on these
lines, and the less it's going to cost the people. The thought
should be how to help the property owner, do the right thing for
the people, this won't be accomplished with low density. Leave the
section the way it is and leave it to the discretion of the Planning
Board. Don't pass this amendment just because of a couple of pressure
groups. Mr. Diehl assured Mr. Eck that at least he, Mr. Clausen and
Mr. Holt were scrutiniztmg - this proposed amendment, checking it
further before acting one way or another.
A letter was received from Warren Strohm, Chairman of the Zoning
Regulations Advisory Committee, indicating that this Committee
supported the proposed rezoning of Route 9 as an effective temporary

action, and further stating that it was felt that action should be
taken to expedite the development of an acceptable Town plan for
the utilization of such property.
Mr. Diehl directed that this letter be placed on file.
A letter was received from the Zoning Regulations Advisory Committee
submitting, for the Town Board's approval, statements defining their
mission.
Mr. Diehl directed that this be placed on file.
The term of office of Charles Cortellino, as a member of the Zoning
Board of Appeals, expired February 1, 1973 and the matter of this
vacancy due to the expiration of term was placed before the Board
for their consideration.
The following resolution was offered by SUPERVISOR DIEHL who
moved its adoption:
RESOLVED, that Charles A. Cortellino, be and he hereby is
appointed to fill the vacancy on the Zoning Board of Appeals of
the Town of Wappinger which has occurred by reason of the expira-
tion of the term of Charles Cortellino, and it is further
RESOLVED, that the said Charles Cortellino is hereby appoint-
ed to the said Town of Wappinger Zoning Board of Appeals for a
term which shall expire on the 1st day of February, 1978.

Notice of a Public Hearing to be held by the Board of Trustees
of the Village of Wappingers Falls on February 14, 1973, on a
proposed change in :the zoning classification .of property lying
within the Village on the easterly side of Route 9 presently zoned
PI. . Mr. Diehl stated that the Town Board has instructed the Chair-
man of the Planning Board to represent the Town Board at that
meeting, and to press the feelings of the Town Board and Planning
Board for a road to the rear of the proposed shopping center in
some way connecting New Hackensack Road with Myers Corners Road to
relieve traffic on Route 9.

A letter was received from Vincent C. Kelley, Engineer to the
Rockingham Sewer District, as follows:

Gentlemen:
Attached is Estimate No. 2 for the subject contract. You will
please note existing work order No. 1 in the amount of $1,634.35.
Immediately after the sand filters were put into operation,
excessive infiltration caused a sludge carry over onto the sand
beds which immediately plugged up causing the effluent to spill
over the filters washing out a section of bank. Since the plant,
by Health Department mandate at the time of approval, does not
have a filter by-pass, in order to preserve the beds from further
and possible extensive damage, the contractor was ordered to
reconnect the plant to the old outfall line, installing the two
valves so that flow could be directed either to the beds or to
the old outfall. The extra work order covers the cost of install-
ing the valves and reconnecting the old outfall pipe.
We believe it advisable to pay for this under this contract.
Approval of this work order and Estimate No. 2 is recommended.

Mr. Jensen further stated that he would like to ascertain, through
the Supervisor's Office, if the present rates would cover all the
anticipated expenditures, and discuss, in executive session the
memo received from Mr. Waddle, Acting Sewer Plant Superintendent

regarding future expenditures.
Mr. Diehl directed that this matter be held for next months' meeting.
Under reports of committees, Mr. Diehl referring to the Federal
Revenue Sharing monies received, and anticipated, representing

presumably between $450,000 and $500,000, his thoughts and purpose,
are that this money could be put to the greatest use in providing
a major sewer trunk line from Oakwood to the Village Sewer Plant,
if this is acceptable to the Village, and in effect a major col-
lector system for the Town wide sewer and eliminating the Oakwood
Sewer Plant which at best would only be a temporary plant. He
has spoken with Mr. Lapar and it apparently is financially feasible
to do this. Mr. Rappleyea has done some preliminary work to see
if the Town can use this Federal money for this purpose, and it
appears that it is very possible.
MR. DIEHL moved that Mr. Rappleyea and Mr. Lapar be requested to
ascertain some definite answer from the Federal Revenue whether
this money could be used, and, along with Mr.. Lapar's work that
he has now in progress, to go to the river in some fashion, that
the Board may be able to make a decision and go forward with a,
major trunk line to the creek or the river at some place.

Mr. Jensen commented that the Board is supposed to be getting a
report from the firms of Adler Brenner, Milton Chazen Associates
and Mr. Lapar. These three engineers were supposed to test the
feasibility of the three municipalities interconnecting with the
Village system. He doesn't believe the Board is in receipt of
this report as yet. He questioned whether Mr. Diehl's suggestion
was feasible, and Mr. Diehl's response was from what he had heard,
it was feasible, and was the right direction. Mr. Jensen said he
was just bringing it to the attention of the Board that they were
waiting for the Adler Brenner report, and further questioned the
receipt of State or Federal aid if the effluent was being discharged
in an estuary. Mr. Diehl concluded the discussion by stating that
his major interest was to find out if the Federal Revenue Sharing
money can be used for this major trunk line. Mr. Saland commented
that he found much merit in Mr. Diehl's recommendation, but would
not support it to the exclusion of any other possible uses. As a
Recommendation to be studied, he would support it.
A Public Hearing, having been duly held on January 23, 1973, the
repeal of Section 412.02 of the Town of Wappinger Zoning Ordinance,
the matter was placed before the Board for their consideration.
The Board did not desire to take action at this time.
Mr. Diehl directed the matter.be tabled..
The following Resolution was offered -by COUNCILMAN CLAUSEN who

WHEREAS the Town of Wappinger received an informal petition
from several residents residing in the development known as Tall
Trees in the Town of Wappinger,-Dutchess County, New York, and
WHEREAS said informal petition requested the Town of Wappinger
to investigate the possibility of acquiring thewater system serving
the development known as Tall Trees, and
WHEREAS the Town of Wappinger has had a number of conferences
with the owners of the Tall Trees Water System, now therefore be
it
RESOLVED that the Supervisor of the Town of Wappinger is
hereby authorized and directed to execute the attached agreement
on behalf of the Town of Wappinger, and be it further

1973 at 7:30 P.M., Eastern Daylight Time, to hold a public hear-
ing on the aforesaid proposed improvements -and the plan, report,
and map prepared and filed in connection therewith at which all
persons intetested in the subject thereof may be Aheard concern-
ing the same, and to take such action thereon as is required or
authorized by law.
Section 2. The Town Clerk is hereby authorized and directed
to give notice of such public hearing by publishing a copy of
this order once in the Wappingers and Southern Dutchess News, the
official newspaper, and by posting a copy hereof upon-tha bulletin
board of her office, such publication and posting to be made not
less than ten (10) nor more than twenty (20) days before the date
set herein for said public hearing.
Section 3. This ORDER shall take effect immediately.

WHEREAS the Public Officers Law, Page 2, Section 11 has been
amended to allow bonding of public officers under a blanket bond,
now therefore
BE IT RESOLVED that all officers under the present blanket
bond be covered by increasing the -present blanket bond to $15,000.
for all employees with excess indemnity for -the Supervisor and
Deputy Supervisor of $7,000 each and $235,000 for the Tax Collec-
tor, and be it further

the Town, and Allan E. Rappleyea, attorney-at-law, to proceed
with the engineering and financing of a storm sewer project, and
WHEREAS the Engineer to the Town, Rudolph E. Lapar, has
prepared plans for the commencement of said project, now therefore
BE IT RESOLVED that the contract for engineering services
as executed on June 26, 1969, between Louis D . Diehl Supervisor
of the Town of Wappinger, and Rudolph E. Lapar licensed profes-
sional engineer, be extended toinclude .the aforesaid project
in accordance with the attached memorandum and that the Super-
visor be and is hereby authorized to execute on behalf of the

authorized the preparation of plans and specifications by
Rudolph E. Lapar, Professional Engineer, in regard to Central
Wappinger Water Improvement Area, and now therefore
BE IT RESOLVED by the Town Board;:of the Town of Wappinger
that the Supervisor is hereby authorized and directed to execute
the attached agreement for engineering services.

Resolution Duly Adopted
The following Resolution was offered by COUNCILMAN HOLT who
moved its adoption:
WHEREAS, the Rockingham Sewer District has been imposing
sewer rents upon the uses of the sewer system, and
WHEREAS the sewerrents whichwere delinquent were added
to the State County and Town tax bills, and
WHEREAS FRANCIS A. ROSE was the owner of Lot No. 5.2.48
on Map 25, Block 1, in the Town of Wappinger and had added to
his 1971 State, County and Town tax bill the sum of $265.46 as
an unpaid sewer rent, and
WHEREAS said item was collected in error from said FRANCIS
A. ROSE,
NOW THEREFORE, BE IT RESOLVED that the Supervisor of the
Town of Wappinger is hereby authorized and directed to repay to
said FRANCIS A. ROSE the sum of Two Hundred Sixty-five and 46/100
($265.46) Dollars together with interest at the rate of six (6%)
percent per annum from the second .(2nd) day of February, 1971,
until the day of payment.

The matter of the proposed amendment of the "Mobil Homes" defini-
tion of the Town of Wappinger Zoning Ordinance was placed before
the Board for their consideration.
Mr. Diehl directed this matter be placed on next months agenda
in order to give Mr. Rappleyea a chance to formulate a report
on it.

The matter of the vacancy on the Town of Wappinger Planning Board
was placed before the Board for their consideration.
The following resolution was offered by COUNCILMAN HOLT who moved
its adoption:
RESOLVED, that Allen Cooke' -be and he hereby is appointed
to fill the vacancy on the Planning Board of the Town of Wappin-
ger which has occurredbyreason of the expiration of the term
of office of Robert Y. Heisler, and his subsequent refusal to
accept reappointment, and it is further
RESOLVED, that the said Allen Cooke is hereby appointed to
the said Town Planning Board for a term which shall expire on
the 4th day of January 1980.

Resolution Duly Adopted
The subject of the :drainage problem concerning the Wilson proper-
ty off Osborne Hill Road at 29 Kretch Circle was discussed by the
Board.
MR. DIEHL moved that the Resolution dated June 12th 1972 be
amended, to allow reimbursement of up to $6,000 to the Dutchess
County Department of Public Works for the installation of drain-
age across the Wilson Property.
Seconded ,by Mr. Holt.
Motion Unanimously Carried
Under unfinished business, Mr. Mills informed the Board that there
was a,meeting of Southern Dutchess 1990. on February 14th and
strongly urged the Town Board's attendance. It would be a work-
ing session on the base plans that Dave Portman and Edith Sil-
berstein have put together as to which way hopefully the Town is
going to go.
Robert Steinhaus, with reference to the intersection of Route 9
and Myers Corners Road asked if the Traffic Committee would look
into having the right turning lane extended back further on Myers
Corners Road to make a longer collector lane.

Mr. Cortellino was recognized by the Chair under new business.
He recalled that Atlas Water does not have a storage tank and
they may have a generator but it has never kicked in if there is
a power failure Wildwood has no water. He recommends that the
Town form a water district and approach it as they did the sewer
plant.
Mr. Rappleyea, answering at Mr. Diehl's request, stated that as
far as forming an improvement area, he supposed that a petition
would be a reflection of the expression of the intention of the
residents, whether it be formal or informal, would be helpful.
MR. HOLT moved the meeting be adjourned, seconded by Mr. Clausen
and unanimously carried.
