Zng.'Amendment' 11 The Regular Monthly Meeting of the Town Board of the Town of Wappinger was on January 8, 1973, at the Town Hall, Mill Street, Wappingers Falls, New York. Present: Louis Diehl, Supervisor Louis Clausen, Councilman Harry Holt, Councilman Leif Jensen, Councilman Stephen Saland, Councilman Elaine H. Snowden, Town Clerk Others Present: William Horton, Superintendent of Highways Allan Rappleyea, Attorney to the Town Rudolph Lapar, Engineer to the Town Supervisor Diehl called the meeting to order at 8:07 P.M. Supervisor Diehl called for a minute of silent prayer in memory of former- President of the United States, Harry Truman. Monthly reports for the month of December were received from the Supervisor, Building Inspector and Town Justices; and also the annual report for 1972 was received from the Building Inspector and the second quarterly report (Oct 1972 thru Dec. 1972) was received from the Town Historian, Virginia Ferris, MR. CLAUSEN moved the December Monthly reports from the Supervisor, Building Inspector and Town Justices, along with the Historian's Report and the Building Inspector annual report for 1972 be accepted and placed on file. Seconded by Mr. Jensen, Motion Unanimously 'Carried Bills presented for payment were as follows: 1973 General Fund: $3,753.93 OKWD: $135.00 F1tWD: $170.66 1972 General Fund: 434.31 OKSD: 270.89 F1tSD: 205.32 Highway Fund: 3,034.66 RFSD: 887.30 MR. CLA1BEN moved the bills be paid, subject to audit. Seconded by Mr. Holt. Roll Call Vote: 4 Ayes Mr. Saland--Abstaih A request was received from Arthur Waddle, Acting Superintendent of the Water and Sewer Plants, to attend the school on Sewer Plant Operation in Syracuse, New York, January 29, 1973, thru February 9, 1973. MR. CLAUSEN moved that Mr. Waddle be granted permission to attend the Sewer Plant Operation School in Syracuse, and that his legiti- mate expenses be a Town charge. Seconded by Mr. Jensen. Motion Unanimously Carried A request was received from Thomas E. Logan, Town Assessor, to attend the New York State Assessor's Convention in ROchester, New York, January 14, 1973 thru January 17, 1973. MR. JENSEN moved that Mr. Logan be granted permission to attend the Assessor's Convention in Rochester, New York. Seconded by Mr. Clausen. Motion Unanimously Carried A letter was received from John M. Reed, regarding the claim of Richard G. Barger. Mr. Rappleyea stated he has discussed this with Mr. Reed, and will have something for the Board next meeting. Mr. Diehl directed this letter be turned over to the Attorney to the Town, and for him to report back at the next meeting. A letter was received from Hugh J. Maurer, Chairman of the Recreation Commission, regarding Rockingham Farms Section 1 and 11 recreation lands, requesting the Town Board advise the Recreation Commission wht action they should take regarding this matter. (No deeds for recreation land offered as yet to the Town). Mr. Rappleyea commented that he is in the process of getting all the Rockingham Roads and Recreation areas finalized. MR. CLAUSEN moved that the Town Clerk notify Mr. Maurer that Mr. Rappleyea is working on the subject and expects an early resolution on the matter. Seconded by Mr. Holt. Motion Unanimously Carried 18 A deed has been offered to the Town of Wappinger for recreation lands on Montfort Road by Donald McGrath. Mr. Rappleyea, in response to a question by Supervisor Diehl re- garding this deed, explained that the dedication of the six acres is in keeping with the land necessary for the entire tract, which is somewhere near 53 acres, so that even though when the Planning Board accepted only ten lots, the Planning Board worked out a plan with the developer whereby he would give all the land now and there- by not having to give additional land when he later develops the rest of the property. MR. CLAUSEN moved to concur in the Planning Board's action acceptance of this deed for recreation land presented by Donald McGrath, in lieu of all lands needed for the development of this particular property. Seconded by Mr. Holt. Motion Unanimously Carried The Planning Board's recommendation was received on the proposed kgpeal of Section 412.02 from the Town of Wappinger Zoning Ordin- ance. Their recommendation to repeal this section was based on the fact that Town Sewer and Water are now available and that the Board also felt clustering and the proposed Planned Unit Development Amendment would allow the developer flexability in developing the land in a manner somewhat similar to what was allowed by Section 412.02. A Petition was also received from residents living in the Pine Ridge - Cedar Hill area requesting the Town Board repeal Section 412.02 of the Town of Wappinger Zoning Ordinance. The petition was submitted by E. Jeffrey Berg, President of the Cedar Hill -Pine Ridge Civic Association. Mr. Claksen commented that the Town Board, in the past has seen fit 1411,111M 1 to repeal the Rmi15 density bonus, and it was the feeling of the Board at that.time'that since the Town is going to municipal Water and Sewer that the Town no longer has to give this bonus to developers for putting in central water and sewer, that if it was done for one cate- gory, it would seem to him logical to do it for all of them. The following Ordinance was introduced by COUNCILMAN CLAUSEN: Be it ordained by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: The Zoning Ordinance of the Town of Wappinger adopted January 29, 1963, and as amended from time to time is hereby further amended as follows: Section:1: Section 412.02 is hereby repealed. Section 2: This amendment shall take effect immediately except that the same shall not be applicable to subdivision plats which have received preliminary approval by the Town of Wappinger Planning Board as of the date of the introduction of this Ordinance. Seconded by: Councilman Jensen Mr. Clausen made note of the fact that, the Planning Board, in their recommendation on the repeal of Section 412.02 indicates that the proposed PUD amendment would allow flexibility in devel- opment similar to what is allowed now by this section. Mr. Saland mentioned that at one time Mr. Clausen had referred to where there was discussion of doing away with the first density, considered taking a comprehensive approach to cluster zoning. He felt at this time it might be appropriate to consider asking the to Attorney to the Town/draft a resolution under which the Board can consider a cluster zoning proposal, which might tie in very well with the removal of this density bonus situation. MR. CLAUSEN moved that a Public Hearing be held on January 23, 1973, at 8:00 P.M. at the Town Hall, Mill Street, Wappingers Falls, New York, on the Ordinance Amending the Zoning Ordinance of the Town of Wappinger, repealing Section 412.02 at which time all interested persons will be heard. Seconded by Mr. Jensen. Motion Unanimously Carried A letter was received from the Planning Board asking if any action 15 had been taken on the PUD proposal. Mr. Saland commented that there were certain questions after the Informational Hearing that have to be ironed out as to what the role of the Town Board would be with regard to any changes after the submission. No action was taken. The following letter was received from the Planning Board: January 4, 1973 Town Board Town of Wappinger Mill Street Wappingers Falls, New York Gentlemen: Regarding your letter dated December 13, 1972 concerning the ordinance amending the definition of "Mobile Home", the following action was taken by the Planning Board. A motion was made by Mr. Chrystie, to recommend that the ordinance amending the definition of "Mobile Home" not be_adopted, the motion was seconded by Mr. Keller. Roll Call Vote: Dr. Robert Y. Town of Wappinger Planning ,Board Mr. Rappleyea recommended that the Board postpone setting a public hearing on this matter -,amendment of the definition of "Mobile Home" until after the Association of Towns Meeting, since this topic is one that will be discussed at that time, and the Board can find out what the other Towns are doing. Mr. Diehl directed that the Planning Board be so notified of the Attorney's recommendation.• A letter was received from Joseph Incoronato requesting the Town Board to hold an informational hearing in the Town of Wappinger on the Solid Waste plan of Mr. Trautman. Mr. Diehl pointed out to Mr. Incoronato that there had been several recent meetings on this subject and Mr. Incoronato said that the - matter of proximity had precluded a lot of Wappinger residents from attending the Millbrook meeting. He believes that it would give the Wappinger residents a better chance to explore what is really being offered by the Trautman report. He thinks that since Robin- son Lane and the Green Fly Swamp have been mentioned as possible sites, the residents of these areas would like some salient answers to what is going on with the Trautman report. MR. CLAUSEN moved that Mr. William Bartles, County Executive, Mr. L'Archevesque, and Mr. William Trautman be requested to attend an Informational meeting on the Trautman report, on January 25, 1973, at the Wappinger Junior High School, or Ketcham High (whichever is available) at 7:30 P.M., subject to the availablility of all the principals. Seconded by Mr. Jensen. The following letter was received: Town Board Members Town of Wappinger Mill Street Wappingers Falls, N.Y. Subject: Fleetwood Water District Gentlemen: Motion Unanimously Carried Dec. 26, 1972 Last summer, Joseph Gutmann --former Town Superintendent of Water and Sewer Plants --and I reported substantial damage due to vandalism at the Fletwood water pump -house. At that time, The Board agreed that a protective chain-link fence should be erected aroind the pump house, and that necessary repairs to the wall and roof of the building would be undertaken. To date, neither the repairs nor the fence have been taken care of. Further deterioration of the Fleetwood water plant was reported at your regular ',December Town Board meeting by Bill Mihans, the water plant superintendent, who notified you that only one of the two pumps providing water for approximately 1,000 persons is operative. This means that district residents have been and continue to be without emergency backup should the existing water pump fail. At any rate, the second pump must be operative by next summer when water consumption is at its peak. It should also be noted that past flooding of the pumphouse has caused short- circuiting of pump motors, resulting in hundreds of dollars of repairs and suspension of water service. Therefore, priority should be given to raising the motors_so that spring floods will not damage the equipment and shut down service. We also support Mr. Mihans recommendation to replace and install valves and fixtures essential to proper plant operation. As spokesman for the Fleetwood/Hickory Hill residents, I ask your immediate attention to.the aforemantioned deficiencies so. that we can have reliable water service at reasonable cost. Attempts to avoid or defer --necessary plant repairs analoreventive maintenance can only result in magnified expenditures and incon- venience to Fleetwood customers.' Therefore, we.appeal,to the Town Board for immediate relief to long-standing problems affect- ing the water district: . Sincerely, s/ Joseph Incoronato, Fleetwood Manor Mr. Diehl took exception to several of the comments indicating that he had been at the plant Friday night. Both pumps are working, both have been raised, and a metal door has been installed. The fence has not been put up, but he questions whether one is needed now. Something, however, should be done about the ventila- tion since the windows at present are boarded up. Generally, there has been considerable work done around there. Mr. Incoro- nato commended the efforts of Mr. Mihans. Under Committee Reports, Mr. Diehl made known that the second Federal Revenue Sharing check for 1972 was received today. This was in the amount of $45,608,00; the first was $46,965.00. The Town will receive quarterly checks from now on, and hopefully in this amount. He further stated that he and Mr. Egan had attended a Seminar in Albany on Federal Revenue Sharing. It was notably stated at this Seminar that the Town should be well aware that this money is not a "windfall", it is taxpayers money, and to con- sider it as such. He said he would like to set an executive meeting with the Board to discuss various avenues where this money might be well spent to benefit all of the people of the Town. Some of the items he has in mind to explore are assisting in having Town wide sewer and water, recreation, to the Library, and in regard to repairs to the present Town Hall or a future Town Hall. It is anticipated that these funds, -will continue on to the year 1975, but there is no guarantee. Mr. Diehl also reported with regard to bookkeeping, or possible 1 84 assistance In,any of the Town work, as he understands it,,thePCOunty haS offered possible assistance with Town Bookkeeping, to what degree he isn't sure himself. They do have ultra modern computing machines and he is going to. investigate with the County to see what the possibility would be for them to prepare some type of monthly reports, or perhaps assist in payroll preparation. Mr. Jensen reported that he and Mr. Clausen are still working on the Building, or House, Committee situation. They have gotten some reports in, but not finalized them as yet, as there are some other avenues to look into. They hope to have something in by the next meeting. Mr. Clausen commented that he and Mr. Holt should have a recommenda- tion for the Comptroller position by next meeting. Mr. Jensen reported on the Zoning Regulations Advisory Committee that they appear to be quite active, that the participation is still strong. Mr. Saland stated that some time ago he had proposed the possibil- ity of installment payment of the State, County and Town and School Taxes. Having looked into the matter, and discussed it with some members of the County Board of Representatives, and by reading of the ruling of the New York State Department of Audit and Control, it's presently necessary to have a Local Law passed by the County Board of Representatives which would permit Towns to elect to adopt an installment payment program. Las year in April, a County Board Committee studied it and reported that at that time didn't believe it expedient to adopt such a Local Law permitting installment: payment of taxes. MR. SALAND moved to direct the Attorney to the Town to draft a resolution requesting the Dutchess County Board of Representatives to undertake another study for a Local Law for a tax installment payment program that would permit the individual Towns to elect an installment payment program, rather than adopting a mandatory install- ment paygtent program. Seconded by Mr. Jensen. Motion Unanimously Carried cei Mr. Rappleyea reported on several outstanding things that he has, that he wished to bring the Board up to date on. With regard to the roads in Wildwood II, he directed a letter to the Court and Calendar Clerk urging him to keep the case in the forefront on the Calendar. He appeared at the first opening day 10f Calendar Call in January and the case is -still in a preferred situation, and the Clerk and the Court promised that he would at least be entitled the courtesy of a conference with them this month. Secondly, on Widmer Road, he was unable to meet with Mr. Gellert and he has scheduled a meeting with him tomorrow. Third, he has received the road deeds for Edge Hill Manor Section I//, and has had Mr. Lapar review them. Mr. Lapar indicated they are in order and properly described. Mr. Horton has stated these roads are accept- able, provided a maintenance bond is established for Deer Run and Vorndran Drive. And lastly, he met with Miss Pike on Friday and prepared a proposed Ordinace for the rezoning of property on Route 9 which are presently not being used for commercial purposes or the subject of final site plan approval for commercial purposes. The following Ordinance was introduced by COUNCILMAN SALAND: Be it ordained by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: The Zoning Ordinance and Map of the Town of Wappinger adopted January 29, 1963, and as amended from time to time is hereby further amended as follows: Section 1: The following described lands located on Route 9 in the Town of Wappinger and as described on the tax maps of the Town of Wappinger and Zoning Map of the Town of Wappinger are hereby changed so that after the date of the adoption of this ordinance each of said parcels shall be zoned R-20 "one family residential" as more particularly described in Section 300 of the Zoning Ordinance of the Town of Wappinger. 1. SALAND moved that a IubIic Hearing be set on the Ordinance Amending the Zoning Ordinance of the Town of WapPinger, Dutchess County, New York, on the proposed rezoning to residential lands on Route 9, for February 13, 1973 at 7:30 P.M. at the Wappinger Junior High School, Remsen Avenue, Wappingers Falls, New York, 21 at which time all interested persons will be heard. Seconded by Mr. Jensen. Roll Call Vote: 3 Ayes Messrs. Diehl and Clausen --Nay The following Resolution was offered by COUNCILMAN JENSEN who moved its adoption: WHEREAS, the developer has offered the final deed for the roads named as follows: 1. Namoth Road 2. Hilltop Drive 3. Rock Road 4. Vorndran Drive 5. Deer Run 6. South Half of Magura Road and WHEREAS, the Highway Superintendent has examined said roads and found these roads to be in accord with Town Specifications, Now, Therefore, be it RESOLVED, that the Town of::Wappinger hereby accepts the above listed roads as public streets in the Town of Wappinger and hereby releases and discharges the principal and the surety on bonds pledged with the Town of Wappinger for the completion of said roads, and, be it further RESOLVED, that the developer post with the Town a maintenance bond to cover the cost of maintenance of: Deer Run Vorndran Drive The said maintenance shall be approved as to form by the Attorney for the Town; shall cover the cost of maintenance and repair of said roads for one yearr shall be in the amount of the sum of 10% of the original bond covering the roads Deer Run and Vorndran Drive. Seconded by Councilman Holt. Motion Unanimously Carried The matter of an appointment of a Chairman for the Town of Wappinger Planning Board was placed before the Board for their consideration. The declination by Dr. Robert Y. Heisler of his appointment to the Planning Board was received. Mr. Diehl stated that, in accepting_Dr. Heisler's declination of appointment, he compliments and thanks him _for .his service in the past. This now leaves a vacancy on the Planning Board as well as an appointed Chairman. 2$ MR. HOLT moved that Robert Steinhaus be appointed Chairman of the Town of Wappinger Planning Board. JENSEN moved the appointment to fill the vacancy on the Town of Wappinger Planning be tabled. Seconded by Mr. Holt. Motion Unanimously Carried The matter of the resignation of William Mihans as the Superintendent of Water and Sewer plants was placed before the Board. (Mr. Mihans resignation was effective as of December 18, 1972). MR. HOLT moved to appoint Arthur Waddle as Acting Superintendent of the Water and Sewer Plant Operation; accept the resignation of William Mihans as Superintendent of the Water and Sewer Plants; and establish the salary for Arthur Waddle at $9,500 per year retro- active to January 1, 1973. Seconded by Mr. Jensen. Motion Unanimously Carried Mr. Jensen indicated that a letter had been received from Mr. Waddle suggesting certain steps be taken at all of the municipal. Sewer and Water Plants in order to operate them on a minimum safety and efficiency basis. Mr. Jensen recommended that this letter be turned over to the Engineers to these various districts for their review and recommendations. A letter was received from Hugh J. Maurer, Chairman of the Recrea- tion Commission asking if the Town Board had given any consideration to their request regarding two Tennis Courts at Martz Field,and.if they had approved them would request the Board to direct the Attorney to prepare the necessary papers for bonding. 2 s Mr. Diehl commented that this was one of the areas in which he would like to discuss the use of the Federal Revenue Sharing money with the rest of the Town Board. Charles Cortellino, being recognized by the Chair, asked, since his application for a Peddlers License had been tabled, when would the Board like to discuss this application further. Mr. Clausen advised Mr. Cortellino that he thinks the Board, in this particular case, is not too sure of what the application really says, it's too general.. Most of the applications can be gauged as to what the service is. This seems to be dubious, and the reason the Board tabled it was to get back to Mr. Cortellino to ask him to resubmit one that is well understood by everyone. The Board certainly can- not act upon this request because they really doh't know what he is asking for. If he can come up with one that spells out what he is asking for possibly the Board can either deny it or accept it. Mr. Eck, being recognized by the Chair, approached the subject of one of the Board members being on a citizens zoning committee. He didn't think it was right, it has a disadvantage for the simple reason that when the committee meets and decides on something, the Board member then is already more or less biased, this way that Board member is on the spot at all times and he could more or less influence the Board when he brings these things up when he is sitting on the Board. Mr. Jensen said he was an active participant on this committee prior to becoming a Town Board member, subsequently he has discussed with this committee that he is not a voting member of that committee, and acts in an exo facto position, and will come down and pass things on to this particular committee when he deems it necessary, or feels there might be some information that has crossed his desk which might be helpful to them. In no way will this committee or any committee, be influential to set up things on this Board. Furthermore the proposed zoning ordinance amendment on the Section 412.02 was discussed by the Board before anything 24 was forthcoming from the Zoning -Regulations Advisory Committee.. MR.
