RE: ADAMS FAlRACRE FARMS - RESOLUTION OF PRELIMINARY AND
FINAL SUBDIVISION PLAT APPROVALS FOR LOT MERGER
At a regular meeting of the Planning Board of the Town of Wappinger, Dutchess
County, New York, held ~own Hall, 20 Middlebush Road, Wappingers Falls, New

WHEREAS, the Town of Wappinger Planning Board received an application from
Adams Fairacre Farms, Inc. (the "Applicant") to combine four contiguous properties into
one :l:12.84-acre lot for the Adams Fairacre Farms project (the "Project" or "Proposed
Action"); and
WHEREAS, the subject properties are located on the east side of Route 9 north of
MacFarland Road and south of Old Hopewell Road and are known as NIF Mattison (Tax
Lot 6157-04-649374) :l: 3.54 acres; NIP Briscoe (Tax Lot 6157-04-614375) :1::0.27 acres;
NIF Owen (Tax Lot 6157-04-649335) ~ 8.78 acres; and a Town of Wappinger property
. identified as Parcel A on the subdivision plat, :I:: 0.23 acres (the "Site" or "Property"); and
WHEREAS, the NIF Owen property is located in the HD zoning district while the
remainder of the properties identified above are located in the HB zoning district; and
WHEREAS, the Applicant has submitted Preliminary and Final Subdivision Plat
applications, owner consent forms, and the following plan entitled "Drawing No. I of J,
Lot Line Realignment, Lands of Adams Fairacre Farms, Town of Wappinger, Dutchess
County, NY, " dated April 7, 2008, revised November 17, 2008 and prepared by Morris
Associates PS, LLC, Engineering Consultants, Land Surveyors; and

WHEREAS, the Planning Board is familiar with the Subject Property and its
surroundings, and has reviewed the Project in accordance with the standards for approval
contained in the Zoning Law and the Land Subdivision Regulations; and
WHEREAS, the Planning Board has determined that the lot merger will not result
in the creation of any new building lots within the Town of Wappinger; -and
WHEREAS, the Planning Board has determined that the Project is an Unlisted
Action in accordance with the State Environmental Quality Review Law; and
WHEREAS, pursuant to State Environmental Quality Review regulations, the
Planning Board has thoroughly analyzed the potential adverse environmental impacts of
the Project through the Expanded EAF and adopted a Negative Declaration on November
17,2008 on the grounds that the proposed action will not result in any significant adverse
environmental impacts and any minor potential adverse" impacts identified in the
Expanded EAF, its supplemental information, and the development plans will" be
eliminated, or minimized and mitigated by the design, details and maintenance of the
proposed development.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. The Planning Board hereby adopts and incorporates the recitations and statements
set forth above as if fully set forth and resolved herein.
2. The Planning Board hereby waives the requirement for a public hearing for the lot
merger in accordance with Section 217-12.H(2) of the Land Subdivision
Regulations.
3. The Planning Board hereby grants both Preliminary and Final Subdivision Plat
Approval for a lot merger to combine four contiguous properties into one :f:12.84-
acre lot as herein defined, subject to the following conditions and modifications
which must be satisfied prior to the signing of the Final Plat by the Chairman of the
Planning Board:

The Owner shall endorse a copy of this resolution and submit it to the
Planning Board for its files.
The Applicant shall prepare a final subdivision plat in accordance with"
Section A-5 of the Town of Wappinger Land Subdivision Regulations.

The Applicant shall submit a statement signed by the Town's Tax Collector
that all taxes due on the subject Property have been paid in full.
The Applicant shall submit the plat to the Dutchess County Department of
Health for its review, approval and signature and shall submit proof of such
approval to the satis.faction of the Town Conflict Engineer.
The plans shall be signed and sealed by a licensed survey~and engine~
all metes and bounds shall be finalized, and all required signature blocks
shall be endorsed to the satisfaction of the Town Conflict Engineer.
4. Conditional approval of the final plat shall expire one hundred eighty (180) days
from the date of this resolution unless all requirements have been certified as
completed or unless a written request for an extension of Final Subdivi~ion Plat
App~ovaI (not to exceed two (2) ninety (90) day periods) is granted.
5: In accordance with the Town's Schedule of Fees, the Applicant shall be responsible
for the payment of all application review fees incurred by the Planning Board in
review of this Project which are in excess of the application review fees paid by the
Applicant to-date. Such fees shall be paid within thirty (30) days of the notification
to the Applicant that such fees are due. lf such fees are not paid within this thirty
(30) day period and an extension therefor has not been granted by the Planning
Board, this resolution shall be rendered null and void. Refunds of any remaining
funds within the escrow account for the applications will not be made until six (6)
months after the filing of the subdivision plat.
6. The Planning Board Chairman shall endorse a copy of this resolution certifying its
correctness. The Owners and Applicant shall also sign a copy of this resolution
after it has been initially endorsed by the Chairman acknowledging receipt of a
copy of the resolution. When all of the conditions as set forth above have been
satisfit:d, and when the Applicant has funded the application review escrow
account established for the Project to its original amount, a mylar copy of the final
subdivision plat, revised as necessary, shall be submitted for endorsement by the
Planning Board Chaini1an, certifying that the plans comply with the terms of this
resolution, at which time, the Chairman shall also endorse this resolution in the
space provided below, certifying that the Applicant has complied with the above
conditions of approval and that the Final Plat is authorized for filing with the
Dutchess County Clerk, Division of Land Records.
After said filing, two (2) copies of the Final Plat certified by Dutchess County and
six (6) copies of the certified copies of the Final Plat shall be submitted to the
Planning Board. One (1) certified copy of the Final Plat shall be retained by the

Planning Board and the other certified copy shaUbe transmitted to the Town Clerk
along with a signed copy of this resolution.
Regarding the six (6) copies of the certified copies of the Final Platt one (1) copy
each will be provided to the Town Building Inspectoft Town Engineer, Town
Planner, Town Highway Superintendent, Town Zoning Enforc~ment Officer and
the Dutchess County 911 Addressing Offi~e.
The question of adoption of the foregoing resolution was duly put to a vote on roll
call, which resulted as follows: . .
