1993-10-28 . m?~~~~W~fD) 'y ;ijOf 2 9 ~q?> DRAFT: 10-28-93 RESOLUTION ZONING ADMINISTRATOR TOWN OF WAPPINGER PLANNING BOARD RE: AIRPORT BUSINESS CENTER II SUBDIVISION - RESOLUTION OF PRELIMINARY AND FINAL SUBDIVISION PLAT APPROVAL At a regular meeting of the Planning Board of the Town of Wappinger, Dutchess County, New York, held at Tow!) Hall, 20 Middlebush Road, Wappingers Falls, New York on the 1st day of November 1993, at 7:30 P.M. The meeting was called to order by Chairman Donald Keller, and upon roll being called, the following were: PRESENT: Chairman Donald Keller Vice Chairman William Parsons Boardmembers Phil Dinonno Michael P. Franzese Hugo Musto John Perillo Chris Simonetty ABSENT: The following resolution was moved by MICHAEL FRANZESE and seconded by PHILIP DINONNO WHEREAS, the Town of Wappinger Planning Board received an application from Frank Buyakowski of Satellite Investments for preliminary and final subdivision plat approval to divide a 149.1- acre parcel of land to create three new lots of 10 acres, 23.5 acres and 114.6 acres; and ~ WHEREAS, the Applicant submitted a Short Environmental Assessment Fpr.m and the following plan prepared by Gray, Railing and Heinsman: 1. "Airport Business Center - Section II", dated 8/26/93, last revised 9/14/93; and WHEREAS, the subject property is .known as Tax Lot 19-6259-02- - 623462 on the Town Tax Assessment Map and is located at the end of Airport Drive in the Town of Wappinger, Dutchess County, New York and is zoned COP - Conservation Office Park; and WHEREAS, the proposed subdivision would not involve the construction of any public improvements, but will result in the dedication of a 100 foot wide right-of-way to the Town of Wappinger for future road extension purposes, which road right-of-way would permit the extension of Airport Drive to proposed County Route 11; and WHEREAS, the subject parcel of land was created from a pr-evious sUbdivision which involved the dedication of land to the Town of Wappinger for recreation purposes, which dedication satisfied the recreation requirements for the subject parcel of land; and WHEREAS, the Planning Board is familiar with the subject property and its surroundings, and has reviewed the project in accordance with the standards for approval contained in the Zoning Law and the Land Subdivision Regulations; and WHEREAS, in accordance with Article 8 of the Environmental Conservation Law, Part 617 NYCRR, and Local Law No. 6 of 1992 of 2 'the ..Town of Wappinger, the Planning Board determined that the subject action was an Unlisted aqtion; and WHEREAS, pursuant to SEQRA regulations, the Planning Board determined that the proposed action would not result in a significant adverse impact upon the environment and adopted a negative declaration on September 20, 1993 on the grounds that the - creation of the proposed" lots would not require any physical improvement to the property and that any proposed development of the lots would be subject to site development plan approval and a site specific environmental assessment pursuant to SEQRA at that time; and WHEREAS, a duly advertised public hearing was held on _ OCTOBER' 21,1993 at the Wappinger Town Hall, 20 Middlebush Road, Wappinge:t's Falls, New York at which time all those wishing to be heard ~era given the opportunity to be heard and the public hearing was closed on that date; and WHEREAS, the final plat will be substantively unchanged fr.om the preliminary plat, the Planning Board waived the requirement for a public hearing on the final plat; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. The Planning Board hereby adopts and incorporates the recitations and statements set forth above as if fully set forth and resolved herein; and 2. The Planning Board hereby grants preliminary and final subdivision plat approval subject to the following conditions and modifications: 3 '"A. .. The Applicant shall prepare a final subdivision plat in accordance with Section A-S of the Town o.f Wappinger Land Subdivision Regulations for review and signature by' the Dutchess County Health Department. Conditional approval of the final plat shall expire one hundred eighty (180) days from the date of this resolution unless all requirements have been . certified as completed or unless a written request for an extension of final subdivision approval (not to exceed two (2) ninety (90) day periods) is granted. B. The Applicant shall revise all plans to indicate the tax lot numbers for the subj ect lots as assigned by the Town Tax Assessor. C. The Applicant shall prepare a schematic building, water and sewer system on the proposed lots. Such schematic lot development plan shall indicate the building area consisting of the minimum yard setbacks and buffer requirements. D.' The final plat shall be revised to identify the zoning district boundaries, the zoning bulk standards and individual lot calculations indicating conformance with same. E. The final plat shall be revised to identify the acreage of the parcel of land to be transferred to the adjacent residential lot located in the R-40 District identified as "Now or Formerly Reynolds and Emsley". The total acreage of said lot after the land transfer shall be specified. A signature block shall be added for the owner of the adjacent residential lot to which approximately one acre of land is to be transferred. 4 , ยท 3. In accordance with the Town's Schedule of Fees, the Applicant shall be responsible for the payment of any application review fees incurred by the Planning Board in review of "this Project which are in excess of the application review fees paid by the Applicant to-date. Such fees shall be paid within thirty (30) days of the notification to the Applicant that such fees are due. If such fees are not paid within this thirty (30) day p~riod and an extension therefor has not been granted by the Planning Board, this resolution shall be rendered null and void.
