Under the tenns of an agreement between the Alpine Company of Poughkeepsie and the Town, dated
April 30, 1993, and in accordance with the Town zoning requirement, Alpine has the obligation to
maintain a 120 space reserve parking area for the benefit of the total shopping center approved square
footage of210,082 sq. ft. There are currently 172,082 sq. ft. of retail buildings in place and open and
1280 parking spaces built. There are no immediate plans for any further construction.
The current number of built parking spaces far exceeds the two anchor store standards and the utilization
rate which we have experienced for the past three years. It also exceeds the parking requirements of the
zoning law for the center as constructed.
The current bond guaranteeing the construction of the reserved parking area in the amount ofS180,000
expires August 16, 1993. Any construction of the reserved parking area does not appear to be necessary
at this time.
We would like to request of the Planning Board that the bond be returned and that we enter into a
modified agreement to reflect the actual experience over the past three years utilization. We would like
the opportunity to discuss a proposed modification to the agreement tied to the application for any future
building permits, including the existing 38,000 ft. vacant retail building, to ensure that the Town's parking
standards are met when additional space is constructed in conforming with the approval site plan.
We would appreciate being placed on the next available Planning Board agenda to further discuss these
issues.
