I stand corrected regarding the five-year limitation of the Waiver of Construction of Parking Spaces. The section I referred to was a proposed new section which has yet to be adopted by the Town Board and may very well never be adopted. with reference to my comments regarding the agreement being "superfluous" after five years, I think you have misinterpreted, The agreement would have to be in effect for as long as the Waiver of Construction Spaces was in effect and/or the zoning Law changed.
