DiNonno 'OCT. 2 3 1992 Hugo Musto John Perillo Chris Simonetty ZONING ADMINISTRATOR ABSENT : Michael Franzese The following resolution was offered for adoption by Mr. Parsons, who moved this adoption, seconded by Mr. DiNonno. to wit: WHEREAS. the Planning Board of the Town of Wappinger. by resolution number 239, adopted May 2, 1991. conditionally approved an application made by The ALPINE COMPANY OF POUGHKEEPSIE (hereinafter called "Alpine") for site plan approval for the construction of the ALPINE SHOPPING CENTER, consisting of 102,000 sq. ft. on a 60+ acres site (19-6157-02-707773 on the Town tax maps), and WHEREASt The Planning Board of the Town of Wappinger. by resolution dated July 30, 1992. conditionally approved an application made by the Alpine Company of Poughkeepsie for site plan approval for the construction of the ALPINE SHOPPING CENTER. consisting of 210,000 sq. ft. on an expanded site of 70+ acres (designated as 19-6157-02-707773 and part of 19-6157-02-766660 on the town tax maps l; and WHEREAS, in accordance with the Town of Wappinger Zoning Law as last revised, THE ALPINE COMPANY OF POUGHKEEPSIE, has submitted to the Planning Board a application for the approval of a revised site plan titled "ALPINE SHOPPING CENTER", for the construction of 210,000 sq. ft. on an expanded site of 85+ acres, located on Route 9 in the Town of Wappinger and designated as 19-6157-02-707773; 19-6157-02-687634 and part of 19-6157-02-766660 on the town tax maps; and WHEREAS, the applicant has represented to this ~oard that it is the lawful owner of said lot. or has a valid contract of sale for said properties; and 10 39\:i'd +I ELLL StoZ; to 16 9'2:to1 Z;6/E7.:I01 , ALPINE SHOPPING CE,NTER October 19, 1992 Page 2 WHEREAS said revised site plan maps included the following: Erosion Control Plan 8i te Lighting Plan Landscape Plan Signing/Striping Plan ~:~ :~~::~ ~~;~~;; lffi~@~~~~~ last revised 10/9/92 U last revised 9/28/92 last revised 10/9/92 OCT. 2 3 \992 last revised 10/9/92 last revised 10/9/92 ZONING ADMINISTRATOR last revised 10/6/92 last revised 10/2/92 Sheet 1 Sheet lA Sheet 2 Sheet 2A Sheet 3 WHEREAS a Public Hearing on the revised maps was held October 19, 1992. and the Board received reports from the Planning Consultant to the Town and the Engineer to the Town. and WHEREAS. the Dutchess County Department of Planning. having reviewed the proposed action within the framework of General Municipal Law (Article 12B, Sections 239-1 and 239-m) has submitted a report on October 13, 1992, which indicates they have no comments and that it is a matter of Local Concern NOW, THEREFORE, BE IT RESOLVED as follows: The application of THE ALPINE COMPANY OF POUGHKEEPSIE for the approval of a site plan titled ALPINE SHOPPING CENTER prepared by C. T. M1\LE ASSOCIATES PC (Gary Hoffman PE) dated Maya. 1992 and last revised October 9. 1992 including the previously listed plans. documents and spe~ifications. be approved subject to the conditions listed below: 1. Compliance with the requirements-of the letter from the Engineer to the Town dated October 19, 1992 2. Review and acceptance of the Lighting Plan by the Planner and Zoning Administrator 3. Granting of the required variance by the Zoning Board of Appeals (for parking spaces size) 4. Appropriate screening along the south and southeast borders of the expanded site 5. Acceptance by the Engineer to the Town of a reclamation plan for the area now proposed for no construction (southern portion of the !'Ivanoff Property") 6. Review and acceptance of the Landscape Plan by the Planner and Zoning Administrator. 7. Receipt by the Town of the appropriate letters of approvals from New York State Department of Environmental conservation and the New York State Department of ~ransportation. ., ALPINE SHOPPING CENTER October 19. 1992 Page 3 BE IT FURTHER RESOLVED THAT all other provisions of the Resolution of July 30. 1992, not contravened by the above listed conditions shall remain in full force and effect until changed by the Planning Board. and . BE IT FURTHER RESOLVED that no site preparation nor construction activity shall be authoriz~d on the "Klein Parcel" (19-6157-02-687634) until the site plan is endorsed by the Planning Board.
