Reference is made to your letter of February 8, 2010. You note that there were numerous
unanswered calls regarding what exactly was to be insured. I personally have no
recollection of ever receiving any messages, although it has been almost 9 years since
this project was initially approved. By letter dated September 18, 2001, I approved
various documents. A copy of my letter is enclosed. It is my understanding that items 2,
3,4 and 6 have all been recorded. The only item not recorded was the Bargain and Sale
Deed.
In the past, we have had one title policy insuring the fee to any roads as well as any
associated easements - drainage, sight, snow, etc. That is all that is required here.
The deed to the road has been placed on file with the Town Clerk pending the acceptance
of the road by the Town Board. By Resolution dated January 25, 2010, the road was
accepted. Since this subdivision was approved, the Town has changed its procedures with
respect to escrow accounts. In addition to the title and recording charges there are

reimbursements due the Town for legal and engineering fees in connection with this road
acceptance; approximately $700.00 due my firm and a similar amount due Morris
Associates. Morris has agreed to have its final bill submitted to the Town this week and I
will so advise Andlyn. In the meantime, there appears to have been a prior payment of
$402.00 towards the owner's policy which now costs $477.00. The recording fees are
approximately $315.00.
As soon as I receive the final checks from Andlyn, I will forward the deed to your office
for recording. I am sending a copy of this letter to Gerard J. Comatos, attorney for the
applicant as well as Andlyn for their information.
