Contrail Assoc. of Wappinger RD 112 - Box 292 Hopewell Junction, NY 12533 RE: Angel Hill - 2 lots - Old Hopewell Road - Resolutions of Approval Dear Gentlemen: At the July 22nd, 1985 meeting of the Town of Wappinger Planning Board, a motion was made by Mr. Fanuele to grant preliminary and final approval and to waive the final public hearing. The resolutions of approval are as follows: TENTATIVE APPROVAL IS HEREBY GRANTED to Investors Maintenance Corp. for a subdivision entitled Angel Hill as show on map entitled, "2 Lot Subdivision and Lot Line Realignments, Angel Hill, Town of Wappinger, Dutchess County, New York", prepared by John E. Railing, P.E., L.S., and dated May 23rd, 1985 and revised 7/11/85 subject to the following conditions: Within six months of this tentative approval, the applicant is authorized to submit an application for approval of a subdivision plat in accordance with Article II, ~ 22, Article III, ~ 30, and Article IV of the Subdivision Regulations. In addition, the application must meet the requirements of the Town of Wappinger Zoning Ordinance. In addition, the following improvements, reservations, changes and requirements are pre-requisite to the approval of the plat. 1. Approval of the Dutchess County Department of Health shall be obtained on water supply and sewage disposal prior to final approval. 2. Curb cuts shall be obtained from the Dutchess County Dep. of Public Works prior to the issuance of building permits. 3. The following improvements shall be required: A. All storm water shall be conveyed by pipe to natural drainage courses. B. No open stream will be allowed unless permission in writing is obtained from the Town of Wappinger Highway Superintendent. 4. The Fire Prevention Bureau shall review the plan and submit any recommendations that they may have prior to final approval. The Fire Prevention Bureau shall also review the proposed street names to prevent similarities. 5. Downstream drainage fee of $200.00 per lot on the final plat shall be paid prior to the signing of the plat. 6. Lowest opening of all houses (windows, doors, garage doors, crawl space, etc.) shall be at least two feet above the finished road grade unless waived by the Town of Wappinger Highway Superintendent and/or the Engineer to the Town. All footing drains and roof leaders shall be piped into the storm drainage system if specified by the Town of Wappinger Building Inspector. 8. For each lot an application shall be made for a grading permit which shall meet the Soil Erosion & Sediment Control Ordinance requirements, including submission of a plan showing design and materials and at least a month by month schedule. 9. Five copies of the filed map shall be required for Planning Board distribution. Said copies shall be required from the County Clerk's Office. 10. All lot lines shall conform with the zone that the Subdivision is in. WHEREAS, an application for final approval of a subdivision plat entitled,"2 Lot Subdivision and Lot line Realignment, Angel Hill, Town of Wappinger, Dutchess Coutny, New York" was recieved by the Town of Wappinger Planning Board on July 22nd, 1985. WHEREAS, the requirements of the Subdivision Regulations of the Town of Wappinger have been met by said subdivision plat and application except as noted below, and WHEREAS, the conditions of the preliminary approval of said subdivision plat, granted by the Town of Wappinger Planning Board on July 22nd, 1985 have been met, except as noted below, NOW, THEREFORE, BE IT RESOLVED THAT the application of Investors Maintenance Corp. for approval of said subdivision plat, prepared by John E. Railing, P.E., L.S., and dated May 23rd, 1985 and revised 7/11/85 be approved subject to the following conditions, and that the Chairman be authorized to endorse approval of said conditions by the applicant, with conditional approval shall expire six months from the date of this resolution if the applicant has not complied with the conditions set forth. Upon completion of all requirements set forth in the action approving the SubdivisioT plat, the plat shall be properly signed by the appropriate officers of the Planning Board, and shall be filed by the applicant in the Office of the County Clerk in accordanct with the requirements of Section 278 of the Town Law. Any Subdivision Plat not so filed within sixty days of the date of Planning Board signature shall become null and void. Conditions of the final approval are the same as those stated in the resoltuion of preliminary approval. The vote was seconded by Mr. Parsons.
