At a regular meeting of the Planning Board of the Town of
Wappinger, held at the Town Hall, 20 Middlebush Road, Wappingers
Falls NY on the 16th day of March 1993.
The meeting was called to order by Acting Chail~an Parsons, and upon
roll being called the following were:

The following resolution was offered for adoption by Mr. DiNonno, who
moved this adoption, seconded by Mr. Musto to wit:
t~REAS, in accordance with the Town of Wappinger Zoning Law as last revised,
ART-TEX PETROLEUM Inc.
has submitted to the Planning Board an application for the approval of a site
plan titled:
New Canopy Site Plan & Snack Shop - Gas City,
located on Sheet 6259-02, parcel 524833, of the town tax maps;
and the applicant has represented to this board that they are the
lawful owner of said lot; and
WHEREAS, an application fee of Two Hundred Fifty & No Dollars
($250.00), covering an 0.9 acre site and a proposed floor area
of 1,682 square feet has been received by this board; and

determined that the proposed action is a matter of Local Concern. and
WHEREAS. the requirements of the Town of Wappinger Zoning Law and this Board's
regulations have been met except as noted below. and
WHEREAS. the Planning Board recognizes that this application pertains to an
existing developed site. containing existing site features

NOW THEREFORE BE IT RESOLVED,
that the application of
ART-TEX Petroleum Inc.
for the approval of a site plan titled
NEW CANOPY SITE PLAN AND PROPOSED SNACK SHOP
prepared by Robert P. Coane, RA
dated November 16, 1992 and last revised February 24, 1993
be approved subject to the conditions listed below, and that the chairman of
this Board be and hereby is authorized to endorse this Board's approval of said
plan upon compliance by the applicant with the terms herein:
This approval is contingent upon the applicant modifying the appropriate site
plans sheets to show:

BE IT FURTHER RESOLVED that unless a bUilding permit has been issued within 360
days of the date of this resolution, this approval will be null and void. AND
BE IT FURTHER RESOLVED that this approval is contingent upon:
A) Submission of fees as per town requirements in the form of separate checks
made payable to the Town of Wappinger:

B) Erosion control bond and inspection fee as required by the Engineer to the
Town
C) 1. Approval of the Dutchess County Dept. of Health on water
supply and sewage disposal shall be obtained prior to endorsement
of the site plan
2. Approval of New York State Department of Transportation
shall be obtained for entrance and exit prior to endorsement of
the site plan.
3. Downstream drainage fee of $ .15 a square foot for newly
constructed roofed areas and areas covered with impervious
material shall be paid prior to the issuance of a certificate of
occupancy.

4. A drainage plan shall be approved by the Engineer to the Town
prior to endorsement of the site plan.
5. A copy of the building plans shall be supplied to the Fire
Prevention Bureau for their review prior to the issuance of a
building permit.
6. The Fire Prevention Bureau shall inspect the premises prior
to the issuance of a Certificate of Occupancy.
7. Any signs to be located on the premises and/or building shall
comply with the requirements of the Town of Wappinger Zoning Law
8. Adequate screening shall be required for the refuse enclosure
as determined by the Planning Board.
9. Site lighting shall be submitted and reviewed by the Zoning
Administrator prior to final approval to insure that there will
be no glare onto roadways and/or adjacent residential areas.
10. Landscaping shall be required as determined by the Planning
Board.
11. A certified, "as-built" plan shall be submitted and approved
by the Planning Board prior to the issuance of a Certificate of
Occupancy.
