1991-05-20 PLANNING BOARD TOWN OF WAPPINGER, NEW YORK RESOLUTION APPROVING SITE PLAN B & H TIRE RESOLUTION NUMBER 230 DATE: May 20, 1991 At a Regular Meeting of the Planning Board of the Town of Wappinger, held at the Town Hall, 20 Middlebush Road, Wappinger Falls, N.Y. on the 20 day of May, 1991 The meeting was called to order by Chairman Keller, and upon roll being called the following were: PRESENT: Mr. Mills Mr. Perillo Mr. Simonetty Mr. Musto Mr. Parsons Mr. Keller ABSENT: Mr. Hawksley The following resolution was offered for adoption by: Mr. Mills who moved this adoption, seconded by: Mr. Parsons to wit: WHEREAS, in accordance with the Town of Wappinger Zoning Ordinance as last revised, BOBBY H. KORTRIGHT has submitted to the Planning Board an application for the approval of a site plan titled; SITE PLAN FOR BOBBY KORTRIGHT, located on Sheet 6056-02 parcel 713935, of the town tax maps; and the applicant has represented to this Board that he is the lawful owner of said lot; and WHEREAS, an application fee of one hundrE~d and fifty dollars ($150.00) covering an 3.1 acre site and a proposed floor area of 4500 square feet has been received by this Board; and WHEREAS, pursuant to SEQRA: 1) The action has been identified as a UNLISTE[ action by the Zoning Board of Appeals, acting as lead agency and, 2) A Negative Declaration has been adopted on July 24, 1990 on the basis of a short form EAF; and WHEREAS, the applicant has submitted, as part of his application, the follo~ing additional maps and documents; NONE and, Planning Board Resolution # 230 Page 2 WHEREAS, the Planning Board has referred this application to the following Boards and lor Agencies, and has received and considered the following reports of such Boards and lor Agencies; Architectural Review Board Conservation Advisory Board Fire Prevention Bureau: Town Engineer: Planning Consultant Highway superintendent Zoning Administrator Dutchess County Planning Board Dutchess County Department of Planning 9/19/88 Dutchess County Department of Public works n/a Dutchess County Environmental Management Council nla NYS Department of Transportation 12/5/88, 12/31/89 Dutchess County Health Department 4127/90, 9/13/90 nla n/a 6/29/89, 9/22/88 10/24/88 n/a 10/25/88 6126190 WHEREAS, the requirements of the Town of Wappinger Zoning Law and this Board's regulations have been met except as noted below, and WHEREAS, A public hearing was held at the Town Hall, 20 Middlebush Road, Wappinger Falls, N.Y. on August 20, 1990, and WHEREAS, The Planning Board, on August 20, 1990, did approve the applicaticn and directed that a written resolution be presented to the Board for passage, and WHEREAS, such approval required that the conditions of the Special Use perrrit be indicated on the site plan, NOW THEREFORE BE IT RESOLVED; that the application of BOBBY H. KORTRIGHT, for the approval of a site plan titled "Site plan for Bobby Kortright, prepared by Ernest Martin, PE & LS, dated 28 March 1989, and last revised 23 April 1990 be approved subject to the modifications and conditions listed below, and that the Chairman of the Board be and hereby authorized to endorse this Board's approval of said plan upon compliance by the applicant with such modifications and requirements as noted. Modify site plan to show: 1) The conditions of the Special Use Permit issued by the Zoning Board of Appeals, as set forth in appeal #1090, and 2) date of modification. BE IT FURTHER RESOLVED that unless a building permit has been issued within 360 days of the date of this resolution, this approval will be null and void, end PLANNING BOARD RESOLUTION # 230 PAGE 3 Addition requirements: A) Submission of fees as per town requirements in the form of separate checks made payable to the Town of Wappinger; Downstream Drainage Others B) Erosion control bond and inspection fee as required by the Town Engineer C) 1. Approval of the Dutchess County Department of Health on water supply and sewage disposal shall be obtained prior to endorsement of the site pan. 2. Approval of the New York State Department of Transportation shall be obtained for entrance and exit prior to endorsement of the site plan 3. Downstream drainage fee of $ .15 a square foot for newly constructed roofed areas and areas covered with impervious material shall be paill prior to the issuance of a certificate of Occupancy. 4. An erosion control plan shall be approved by the Engineer to the Towil prior to approval in accordance with the requirements of the Town of Wappinger Soil Erosion & Sediment Control Ordinance. 5. An application shall be made to the Zoning Administrator for a gradillg permit which shall meet the soil Erosion & Sediment Control Ordinanc,' requirements, including submission of a plan showing design and mate-ials. A month by month schedule shall be submitted to the Zoning Administrltor prior to final approval. 6. A drainage plan shall be approved by the Engineer to the Town prior :0 endorsement of the site plan. 7. A copy of the building plans shall be supplied to the Fire Preventioll Bureau for their review prior to the issuance of a building permit. 8. The Fire Prevention Bureau shall inspect the premises prior to the issuance of a Certificate of Occupancy. 9. Any signs to be located on the premises and/or building shall comply with the requirements of the Town of Wappinger Zoning Ordinance. 10. Adequate screening shall be required for the refuse enclosure as determined by the Planning Board. 11. site lighting shall be submitted and reviewed by the Zoning Administ -ator prior to final approval to insure that there will be no glare onto roadways and/or adjacent residential areas. 12. Landscaping shall be required as determined by the Planning Board. PLANNING BOARD RESOLUTION # 230 PAGE 4 13. A certified, " as-built" plan shall be submitted and approved by the Planning Board prior to the issuance of a Certificate of Occupancy. D) Upon completion of all requirements set forth in the action approving the site plan, 6 copies of the site plan shall be submitted for the Planning Board Chairmans signature.
