This was not required last time (2002). Insurance & other data was sufficient.
We believe that extrapolating a FMV based on correct square footage could be enough.
MLJ Consulting & Town acknowledge error; but have not been able to correct this problem to
date. We are asking that if we are found to be correct, that access parcel & Access.org databases
be corrected to prevent future problems.
If a formal assessment is required or needed as further evidence, I will spend the additional
money but will ask to have it reimbursed along with costs associated with generating, copying &
filing this RPTL 730.

Angry Residents Protest Town Revaluation

While many peopJ.e are seeing a change in the assessed values of their Tmvn of Poughkeepsie homes. To\\'l1
Board members Todd Tancredi (R-6th Ward) and Stephan Krakower (R-5th \V.ard) said Vlednesday that
protests from SpackenkiH residents~ .in particular, led them to believe the entire neighborhood may have heen
over-'assessed.
"I don't know that the numbers are correct yet," said Krakower.

Regrettably, the Town (.lfRye Hoard mismanaged the revaluation ()f our properties in the same way it. has mismanaged all Town atTain~ for over a
decade. The Town of Rye Board used the same practices it has become known for -" lack of transparency, followed by no bid contracts issued to

Quid pro quo? ,MJWCollsuJtiog made $10,500 in campaign contributions to the Town of Rye Board's political parties and also hired a
Councilman's son to work for them.
MJW Consulting specializes in CAMA based (Computer Assisted Mass Appraisal) statistical revaluations with mucb of the work being done in
Arizona. Thl~ choice ofthis firm detennined thatthc Town of Rye reval would he hased on statistical analysis rather than physical inspections of our
hOllles. However, as anyone who has ever worked witheornputermodeling knows "ifY(lu put galbage ill you will get garbage out." It seems to me
thatthish~ exactly what happened here in the Town ('}fRye.
When the Town of Rye first took up the issue of revaluation, they passed a resolution stating that they would implementa revaluation provided that

80% of the other towns and cities in Westchester did the same. For some reason that has never been made clear. thc Town of Rye abandolledthis

As a businessman, when ( nrst began to look more closely at the reval. the tirst question lasked was: where is the study? Where is the analysis that
states the problem and proposed solution '? ~111e Town of Rye never conducted any kind of in-depth study analyzing the costs. bencfit~. andprobablc
impact ()fthe extraordinarily complex and difficult revaluation process.
It did, however, convene a Revaluation Committee that met On six oocasions in 2001. When that committee was first convened, Supervisor
Morabito statcd that thc committee was set up to examine the advantages and disadvantages ora town wide revaluation with thegoaf of "'drafting a
working document to lake to the public", Unfortunately, that document describing the advantages and disadvantages was never produced.
At the last meeting of the Reval Committeeotl October 29, 20ot, Mr. Morabito infomlcd the commltteethatMJW had bt.'Cn hin..d and that he had
spoken with County officials and lCR1]led that there would lo+bc no countywide revaJuatkm".
When the Town Board leamed that the County would not move forward with reval, they should have abandoned the Roval projt.'Ct as per the
resolution they had passed. Again, for reasons never made clear, the Town decided to move forward witb the Revaluation, In fact, the Town
implemented the RevaI without ever having passed a resolution approving it. It is surprising that the State Ollicc of Real Property Services did not
insist on a.resolution being passed.
The process is further mired in secrecy because the Town Board never putout: a publicadvcrtiscment or request tor proposal (RFP)Jor contractors to
bid to provide the revaluation work. Fora process as complcxand ditlteult as this one, any government intent on achieving faimcss and equity

Sound familiar? I have encountered numerous people in the Town of Rye who expressed similar complaints. l11e best one was a Rye Brook resident
who said be was told he had b~)th a swimmiIlg pool and tennis court in the backyard when he bad neither.

Consulting was paid $ 31.000 for the work it did on 6,000 parcels ofland. The Town of Rye Board hired MIWConsulting to a NO BID contract of $

Worse, the MJW Consulting contract included a NO LOSE clause. Pat RineHo and William Villanova ran against the reval i02oo3. If they had
won they would not have moved forward with the roval proposed by Mr. Morabito. Hnwever. the contract signed by the Rye Town Board would
have had the taxpayers of the Town of Rye pay for the MJW contract even if Ms. RineHo and Mr. Villanova had won the election. From page 24 of
tile MIW Ccmsulting contract:
"If the tennination of this contract is the result of a political change in the current governmental structure of the Town of Ryc~ the contractor shall be
ptlid in full for the services contracted for."
What does this say about our Town democracy? Docs this mean that tbe 2003 election was a sham?

While the intellectual support fur phys~cal inspections is overwhelming, this requirement is easily understood. Would you buy a Immewithout

Clearly, the Rye Town Board does not take either its constituents or its responsibilities seriously. That is not new. Only this time, their callous
disregard tor even a modicum of propriety has impacted every home in our community in a direct and fundamental way.

by using a company (we believe It to be MJW ....) to do the revaluation and achieve equaUty & fairness.
The assessing unit used this data, which filled with errors: mad~ many assessment unequal & unfair.
it also made it difflcult to assess our fair market value by comptning to similar homes~ since there are so many errots.
The errors are In many areas Including land assessments. home value assessments and data on propenylaat sheets.
Attached are several examples, and many mofe can be provided if needed, to show that this effort yielded
very unequal and In some case excessive and in some cases lower than true market value.
In addition. to errors in both land and property asse~u~ment$. the revtewing body should be aware that our
assessment was SUbstantially raised above tneaverage a.52} Increase, even though a RP. 524 & subsequent RPTt., 130
adjudicated by J,H. Thomas Esq. (Sept 4. 2002 . hearing I ease" Supreme Court, County of Out chess, filing 3044-(2),
this fuU.revlew yielded a fair market value of $146.800& an assessment 0'$83,700 (equalization rate w8s57%).
Property values have not doubled In less than 4 years, (9J02 t() of thi, reassessment); no other doubling was found In dB

March 26, 2007 2,390 And I worked with MJW Chris Harkens &
Town Assessor Gwen to correct this error. Linda
of error called and said 1710 would be new
MJW double entered room number
MJW again told me that 2390 would Waited & continued to recall MJW &
May 2, 2007 2,390 be corrected, this time to 1718. I told Town, Finally called back by MJW &
them that that was close enough to told fix was being made
1724, so I was OK
Told MJW that SF was Told to wait updates were still being
May 14, 2007 1,388 too low in ReAssess.Org made & correction would be
completed ASAP bv 5/15
Told MJW that SF was back up (in Submitted RP-524 and confirmed that
May 19, 2007 2,084 Parcel Access) to 2084. MJW said too Town assessor had correct
late. I would have to deal with Town information in their data card, in my
Assessor - Told to submit RP-524 file. This showed original (pre 2000)
values and updates throum 2007
Between 5/19 & 8/1 databases were
August 8&9, 2007 2,222 again updated & synchronized Parcel Submitted RPTL -730 8/10
Access & ReAssess.org were now both
wronl! and at 2222 instead of 1724

I do not understand how my assessment was only reduced by 1.5% or 55,000 (from 5354,000 to
5349,(00); even though the town assessors card clearly shows that the house has not changed
since before 2000; and the total SF should still be 1724 and not 2222. This is a decrease of 22% in
SF. I would have thought the assessment reduction (excluding land) would have been more in
line with the reduction in house square footage, back to 1724.
I my opinion, I believe that the revaluation was forced fit into happening
There was plenty of data to show that MJW had done a poor job but since the town had to go to
100% assessment to gain certain benefits, I can understand that this was pushed through.
I do not understand why MJW could not fix the database for months and then tell me it's too
late and I have to deal with town assessor. I don't know why the reduction was only 1.5% when
the error was 22%.
I suspect, but have no proof, that the review board may have been overwhelmed; and rumor has
it that unless there was an "official external assessment" that RP 524 was rejected.
I tried to find out some facts by a FOIL, to see the minutes of the review; in order to determine
what the overall data was. I did not expect to see what my detail was but I did expect I could see
some general information & attendance.
This information, could have included the number of submissions and the overall results.
Example of the 1000 (or what ever the real number was) RP524 submitted: 50% were rejected
with no changes, 20% had decreases of 1 - 10%, 20% had a decrease of 11 - 20% and 10% were
decreased by over 20%.
I was told that there were no minutes submitted to Town clerk (see attached sheet that shows
requirements for minutes). I would like to know who was there to do reviews, was it all the
members, were there any substitutes, etc. This would give a good indication on how much time
they had (on overage) to due reasonable "due diligence" on each package.
I called Dutchess county clerk office and spoke to person who does training for the people doing
this review. I was given 5 names and have generated an a single sheet affidavit and am asking the
Town clerk to ask the people to rea and sign. This simple attests that the basic & assumed facts
were covered. (Added sheet to be read & sign attached)

ARRIVING AT FULL MARKET VALUE BASED ON RECENTLY SOLD PROPERTY
Property Selected = 2 Liss Road
I personally went to Town Assessor's Office & examined their Book of Sales
For 2006 (period I was told to use), I found 5 properties that sold
in my area { Mesier & Liss. These included:
2 Liss Road Sale Price $325K reassessed at $281K
26 & 47Liss Road Sale Price $ 00 according to book
18 No Mesier Sale price $ 279K
29 Mesier Sale price $ 266K
Many of these properties have apparent errors in their data
2 Liss road sold in Feb. 2006 for $325K, it was reassessed to $281K 14% reduction?
18 N Mesier Ave sold in May 2006 for 279K, it was reassessed at $392K 40% increase?
Our property was reassessed in 9/2002 a $146.8K (including land) and with out
any building improvements had its SF raised to 2222
We believe that if the current assessment was reduced as follows:
Land reduced from $67903 to $53000 based on a FMV of 100K/acres
This value is higher than the adjacent commercial property is currently assessed at
Home was reduced from 281K (349K-land) to 218K
based on same $/SF but changing erroneous 2222 SF to correct 1724 SF
The total would be $271 K - close to our estimate of $294.6K
The total would be $294.3K - if we 140/sf
I attempted to use the calculated $/sq foot for a sampling of home including
Kenneth Brown 11 Plaza Rd 3848 sf house (1960) assessed at 347K
Eugene Parlin 25 Martin Drive 2144sf house (1972) assessed at $376K
$821per slf
$1421per slf
These properties along with other properties identified in original RP524 have an avg. $140 slf
As a sanity check I looked at 22 Peter Dr. - A high end luxury house built & sold 2002
with 4443 sf . The 1 acre of land was assessed at only 68K & total of 758K?
this makes the cost $155 slf in line with the numbers I used for a 1955 house
I requested average data from Assessor, even if he gave me copy of database, I could
calculate average for all & have more & better evidence
The MJW data failed to take into account the fact that WF uses Chloramines
This may prove to be a questionable water quality issue (see sheet on Chloramines)
for all homes in Wappingers. Especially for Senor Citizens

Using chloramine to disinfect drinking water is becoming a common standard practice among drinking water utilities. A
number of utilities have made this switch from chlorine to chloramines.
Background information on chloramines
· Chloramines are produced by combining chlorine and ammonia. While obviously toxic at high levels, neither has proven
to pose health concerns to humans at the levels currently used for drinking water disinfection.
· Chloramines are weaker disinfectants than chlorine, but are more stable, thus extending disinfectant benefits throughout
a water utility's distribution system. They are not used as the primary disinfectant for your water. Chloramines are used
for maintaining a disinfectant residual in the distribution system so that disinfected drinking water is kept safe.
· Chloramines produce disinfection byproducts in the distribution system. Some disinfection byproducts, such as the
trihalomethanes (THMs) and haloacetic acids (HAAs), may have adverse health effects at high levels.
· These disinfection byproducts are closely regulated by EPA. EPA recently reduced the allowable Maximum Contaminant
Levels for total THMs to 80 ug/L and now limit HAAs to 60 ug/L. Chlorine and chloramines is also regulated by the EPA.

· Chloramines, like chlorine, are toxic to fish and amphibians at levels used for drinking water. Unlike chlorine,
chloramines do not rapidly dissipate on standing. Neither do they dissipate by boiling. Fish owners must neutralize or
remove chloramines from water used in aquariums or ponds. Treatment products are readily available at aquarium
supply stores.
· Chloramines react with certain types of rubber hoses and gaskets, such as those on washing machines and hot water
heaters. Black or greasy particles may appear as these materials degrade. Replacement materials are commonly available
at hardware and plumber supply stores..
· Chloramine cannot kill the pathogens in the water as well as chlorine. As a result, people with suppressed immune
systems must have their water boiled over TEN minutes BEFORE use to kill pathogens, or they risk becoming ill. Those
at risk include children under 6 months of age, the elderly, those on or who have had chemotherapy, people with HW or
AIDS, organ transplant patients, and others with a weakened immune system.
· Chloramine can cause and/or aggravate respiratory problems. Chloramine fumes can cause an individual to become
congested and cause sneezing, sinus congestion, coughing, choking, wheezing, shortness of breath, and asthma (see the
Hazardous Substances Fact Sheet for Chloramine, PDF, 98 KB), by the New Jersey Department of Health and Senior
Services). An increase in asthma due to exposure from chloramine was shown in a study from the Catholic University.
· Chloraminated vapor from showers, baths, hot tubs, dishwashers, and other household appliances contains volatilized
chemicals that can be inhaled and cause irritation to the respiratory tract. Chloramine damages mucous membranes. The
lung damage in those exposed to chloramine, in indoor pool air, is similar to that seen in regular smokers (see Health24
News article). Inhaled chloraminated vapor can enter the bloodstream directly through the lungs. It bypasses the
digestive tract where the SFPUC says it is broken down and excreted. The SFPUC says that, "if mono chloramine enters
the bloodstream directly, it combines with hemoglobin (red blood cells) so it can no longer carry oxygen"
· An individual can experience long term effects from repeated exposures to a chemical Oike chloramine) at levels not high
enough to make them immediately sick (see the Hazardous Substances Fact Sheet for Chloramine). The likelihood of
becoming sick from a chemical increases with exposure time and concentration.
· In a study by Zierler, et al (PDF, 821 KB), it was found that there was an increase in deaths from influenza and
pneumonia in the communities that used chloramine. (Communities in Massachusetts that used chlorine for disinfection
were compared to those that used chloramine). Chloramine exposure damages lung mucosa, making the lungs more
susceptible to allergens and infections. Chloramine is a less effective disinfectant and therefore people are exposed to
more pathogens.
· Chloramine tap water can cause severe skin reactions: rashing, dry skin, itching, flaking, welting, blistering, chapping,
burning sensation, 'cracking, scarring, bleeding and pigmentation. Chloramine can aggravate other skin conditions such
as eczema and psoriasis. Chloramine can cause bleeding lips, dry mouth and dry throat. Chloramine can cause burning,
red, and dry eyes.
· Skin exposure to ammonia "breaks down cell structural proteins, extracts water from the cells and initiates an
inflammatory response, which further damages the surrounding tissues."
· Chloramine damages digestive mucosa and can aggravate digestive disorders. It is suggested that monochloramlne is
responsible for gastric cancer. (Journal of Gastroenterology, 1997, "Enhancement by Monochloramine of the
Development of Gastric Cancers in Rats; a possible mechanism of Helicobacter, pylori-associated gastric carcinogenesis.
· Persons with liver or kidney disease and those with hereditary urea cycle disorders are at increased risk for ammonia
toxicity from the consumption of chloraminated water. Chloramine can diffuse through the reverse osmosis membrane
filters utilized by some hemo-dialysis machines, and patients undergoing kidney dialysis could be adversely affected. To
prevent this dialysis equipment MUST be adjusted to remove chloramine and the treated water MUST be monitored to
measure the final chloramine concentration. Dialysis facilities must review their dialysis treatment equipment to
determine its continued safe operation. Unot it may cause hemolytic anemia.
