October 31, 2005, an application will be made to this Court at an IAS term thereof, to be
held at the Westchester County Courthouse, 111 Martin Luther King Jr. Boulevard,
White Plains, New York on the 16th day of December, 2005, at 9:30 A.M., or as soon
thereafter as counsel can be heard, for a judgment pursuant to CPLR Article 78 granting
Petitioner relief specifically determining that Respondents violated RPTL S 727 by
increasing the assessments of the subject property for the 2005 assessment year; directing
and compelling Respondents to correct the final assessment roll for the 2005 assessment
year by adjusting the assessments in accordance with the terms of the Consent Judgment

The Petitioner Redhead Properties, L.L.C., ("Redhead Properties"), by its
attorneys, Huff Wilkes, L.L.P., for its petition, respectfully states:
1. The subject property (the "Property") consists of a rental apartment
complex of numerous separate buildings containing dwelling units as well as
accompanying parcels of vacant land located in Dutchess County, New Yark, within the
Town of Wappinger and the Village of Wappingers Falls. The Property bears multiple
tax grid numbers and each lot is individually assessed. (A schedule of all parcels is
annexed hereto as Exhibit A.)
2. This application particularly concerns the Town of Wappinger ("Town")
Assessor's determination to reassess all 76 individual tax lots of the Property on the 2005
assessment roll in direct violation ofRPTL S 727. This occurred notwithstanding the fact

that a Consent Judgment was signed by the Court on March 16, 2004. (A copy of the
Consent Judgment is annexed hereto as Exhibit B).
3. Significantly, the March 16, 2004, Consent Judgment, was reached only
following the prior owner's motion for summary judgment asserting an earlier sweeping
assessment increase in all of the subject assessments that was similarly selective and
illegal.
4. Redhead Properties purchased the Property from the former owners,
Sherwood Development I, LLC and Sherwood Development II, LLC (collectively
"Sherwood Development") on March 14,2005. (A copy of the deeds are annexed hereto
as Exhibit C.)
5. The pnor owner of the subject property, Sherwood Development,
commenced tax certiorari proceedings for the 2002 and 2003 assessment years which
were settled pursuant to a Consent Judgment dated March 16, 2004. The Consent
Judgment resulted in the reduction of the aggregate assessments for the 2002 and 2003
assessment years from $3,055,100 to $1,680,000, which was to remain fixed, pursuant to
RPTL S727, for the 2004, 2005 and 2006 assessment rolls. (Exhibit B.)
6. The Consent Judgment stipulated by the parties specifically ordered:
"[T]hat the provisions of Section 727 of the Real Property Tax Law shall apply
to the assessments appearing in Exhibit A for at least the three assessment rolls
succeeding the 2003 assessment roll" (Exhibit B) (Emphasis added).
7. The 2004 assessments for the subject property were reduced in accordance
with the terms of the Consent Judgment. However, on May 6, 2005, the Assessor for the
Town of Wappinger mailed the Petitioner a "Notice of Change of Assessment" for each
of the subject lots indicating an increase in assessment. The effect of the notice was to

reset each assessment for each of the lots to the pre-Consent Judgment values. (A Copy
of each Notice of Change of Assessment is annexed hereto as Exhibit D.)
8. Although Petitioner timely filed an Article 7 in 2005 (annexed hereto as
Exhibit E), this application comes in the nature of Article 78 relief; a taxpayer may elect
to utilize either a CPLR Article 78 or a declaratory judgment to challenge an assessor's
jurisdiction or the legality of a tax. Matter of 22 Park Place Cooperative v. County of
Nassau, 102 A.D.2d 893, 476 N.Y.S.2d 935 (2d Dep't 1984) (See also, EMP of Cadillac
v. Assessor of the Village of Spring Valley, 15 A.DJd 336, 789 N.Y.S.2d 522 (2d Dep't
2005) (Article 78 is the proper method to compel respondent to comply with the terms of
a consent judgment).
9. The jurisdictional power of an assessor to levy a tax on a parcel may be
raised without regard to normal procedures. In Niagara Mohawk Power Corporation v.
City of Troy, 59 N.Y.2d 262,451 N.E.2d 207 (1983), the Court recognized that:
When the taxing authority exceeds its power, however, the
taxpayer may challenge its levy collaterally in a plenary
action. It need not meet statutory conditions precedent or
follow the procedures set forth in the Real Property Tax
Law because the assessment is void. (citations omitted).
The crux of this proceeding is a challenge to an action of a governmental body or officer
that is governed by CPLR Article 78, and the primary relief being sought is to vacate the
assessor's illegal action. Washington Commons v. City of Albany, 4 Misc.3d 1027(A),
2004 N.Y. Slip. Op. 51075 [So Ct. Albany Co. 2004, Cannizzaro, 1.].
10. This proceeding is timely commenced because four months did not elapse
since the filing of the Town of Wappinger's certified copy of the completed and verified

final 2005 assessment roll on July 1,2005. (A copy of the Assessment Roll dates for the
Town of Wappinger is annexed hereto as Exhibit F.)
11. As this Court has recently opined, RPTL 9 727 prohibits changes to real
property tax. assessments within three years of a Court ordered reassessment absent the
occurrence of certain specified exceptions. 2 Perlman Drive v. Village of Spring Valley,
9 Misc.3d 382, 2005 N.Y. Slip Op. 25284 [So Ct. Westchester Co. 2005, Dickerson, J.].
In contrast to the Perlman matter, there are no exceptions at issue to warrant any change
in assessment in the instant matter.
12. Petitioner is entitled to the relief sought because the 2005 assessments
were prohibited by a court order and RPTL 9727. Respondents must show that the
reassessment comes within an exception provided in RPTL ~727(2). Akey v. Town of
Plattsburgh, 300 A.D.2d 871, 872 (3d Dep't 2002).
13. Indeed, the only change that occurred at the subject property between the
stipulation of settlement and the illegal increase in assessments on the 2005 assessment
roll was a sale of the Property on March 14, 2005. Here, the assessor had no grounds to
circumvent RPTL 9727 and reassess the subject property. The assessor's actions were
unlawful, as well as arbitrary and capricious. Washington Commons V. City of Albany, 4
Misc.3d 1027(A) at 5.
14. Real Property Tax Law provides additional relief for a Petitioner when a
Court finds that an assessment of a property "was increased without adequate cause after
a final order.. .or stipulation between the parties determined the assessment thereof for a
previous year." The Court "shall award to the petitioner an additional allowance" of

$500 for the one year which a proceeding to review such assessment was brought. RPTL
S727 (See, McCrory v. Strogi, 101 A.D.2d 696, 696 (4th Dep't 1984)).
15. Here, Petitioner is the owner of 76 individually assessed tax lots located in
the Town of Wappinger. Each of the subject lots in question was illegally assessed.
CPLR ~ 601 and the Real Property Tax Law permits a plaintiff to join as many claims
under a single action against an adverse party. (See generally, Michael J Adrian
Corporation v. Sexton, 295 N.Y.S. 542, 544 (1st Dep't 1937) (Single action commenced
by same property owner to review assessments on 37 individually assessed tax lots. This
procedure conserves the time of the courts and of the litigants and avoids the multiplicity
of suits)). Here, Petitioner commenced this single action challenging the illegal
reassessment of each tax lot by the assessor. Pursuant to RPTL ~722(2), Petitioner is
entitled to the additional cost of $500.00 for each of the 76 tax lots illegally assessed.
The total amount of additional costs authorized is $38,000.
16. The circumstances here are particularly egregious considering that the
earlier Consent Judgment followed Petitioner's motion for summary judgment asserting a
massive illegal reassessment nearly identical to the instant actions of the assessor.
Clearly absent the punitive provisions of RPTL 9722(2), the Town may continue this
pattern of abuse and illegal action.
WHEREFORE, Petitioner prays for judgment as follows:
(a) Declaring that Respondents violated RPTL ~ 727 by increasing the
assessments of the subject property for the 2005 assessment ye.ar;

(b) Directing and compelling Respondents to correct the final assessment roll
for the 2005 assessment year by rolling back the assessments in
accordance with the terms of the Consent Judgment dated March 16,2004;
(c) Directing that refunds for the overpayment of any real property taxes
levied and paid pursuant to this illegal increase of assessment shall be
made together with statutory interest;
(d) An order directing the RPTL 9727 freeze to apply from the challenged
2005 proceeding and forward through the 2006, 2007 and 2008
assessment years.
(d) Directing the Respondents to pay costs pursuant to RPTL 9 722(2) for
each lot illegally assessed in the total amount of $38,000; and
(e) Granting such other and further relief as the Court may seem just and
proper, together with the legal fees, costs and disbursements of this motion

The above petitioners having heretofore served and filed the petitions and notices to
review the tax assessments fixed by the Town of Wappinger for the assessment years 2002 and
2003 upon certain real property located at Wenliss Terrace, et aI., Wappinger, New York, and
designated as the grid numbers shown as Exhibit A, annexed hereto, and appearing on the
Official Assessment Map of the Town of Wappinger, and
The issues of these proceedings having duly come on for trial at a Special Tax Certiorari
Term of this Court, and the petitioners having appeared by DAVID C. WILKES, ESQ., of HUFF
WILKES, L.L.P., and the respondents having appeared by EMANUEL F. SARIS, ESQ., of
VERGILIS, STENGER, ROBERTS & PERGAMENT, Special Counsel to the Town of
Wappinger, and the parties having made their settlement, it is

ORDERED, that the assessments made against petitioner's above referenced property be
and the same hereby are reduced, corrected and fixed for the assessment years 2002 and 2003 as
shown in Exhibit A, which represents in aggregate the reduction of the 2002 and 2003
assessments to the level of the 2001 roll, and so reduced, corrected, and confirmed, it is further
ORDERED, ADJUDGED AND DECREED, that the officer or officers having custody
of said assessment roll and any tax roll upon which the above-mentioned assessments and any
taxes levied have been entered, shall correct the said entries in conformity with this Order and
shall note upon the margin of said rolls opposite said entries, that the same have been corrected
by the authorization of this Order, and it is further
ORDERED, ADJUDGED AND DECREED, that the Commissioner of Finance of the
County of Dutchess, State of New York, be and is hereby directed and authorized to audit, allow
and pay to the Petitioner the amounts, if any, of State, Town, County, Judiciary, Fire District,
Sewer District, or any other applicable special district or otherwise ad valorem taxes paid by the
Petitioners as taxes and penalties and interest, if applicable, against the said assessment for the
above-referenced assessment years in excess of what the taxes and penalties and interest, if
applicable, should have been if the said assessment had been as determined by this Order, with
interest from the date of payment thereof as provided by law, and it is further
ORDERED, ADJUDGED AND DECREED, that there shall be audited, allowed and
paid to the Petitioner by the Wappinger Central School District, the amount, if any, paid by the
Petitioner as School District Taxes and penalties and interest, if applicable, against the
assessments for the above-referenced assessment years in excess of what the taxes and penalties
and interest, if applicable, would have been if the assessments made in the aforesaid years had
been as determined by this Order, with interest from the date of payment thereof as provided by
law, and it is further

ORDERED AND DIRECTED, that the Commissioner of Finance of Dutchess County
be served with a copy of this judgment with notice of entry, together with proof of payment of
State, Town, County, Judiciary, Sewer and any other Dutchess County taxes that may apply, and
it is further
ORDERED AND DIRECTED, that all tax refunds are to be paid with interest pursuant
to Section 726 of the Real Property Tax Law of the State of New York within fifteen (15) days
from the date of service of a copy of this judgment with notice of entry, and it is further
ORDERED, that the provisions of Section 727 of the Real Property Tax Law shall apply
to the assessments appearing in Exhibit A for at least the three assessment rolls succeeding the
2003 assessment roll, and it is further
ORDERED, that upon entry of this Order and Judgment on Consent, that certain
Decision and Order of this Court dated September 9, 2003, entered September 15,2003, granting
summary judgment on motion of Petitioners shall be vacated and of no effect, and any tax
refunds issued by any tax districts pursuant thereto shall be returned and tax refunds shall instead
be issued in accordance with this Order and Judgment.
ORDERED, ADJUDGED AND DECREED, that all tax refunds hereinabove directed
to be made are to be made by check or draft payable to the order of HUFF WILKES, LLP, 200
White Plains Road, Suite 510, Tarrytown, New York 10901, as attorneys for the petitioners, who
are to hold the proceeds as trust funds for appropriate distribution, and who are to remain subject
to the further jurisdiction of this Court in regard to their attorney's lien, pursuant to Judiciary
Law Section 475, and it is further,
ORDERED, that this Order hereby constitutes and represents full settlement of each of

Yark, to be held in and for the County of Westchester, at a special Tax Certiorari Part thereof,
111 Dr. Martin Luther King Jr. Boulevard, White Plains, New York, on August 22, 2005, for the
review under Article 7 of the Real Property Tax Law of the State of New York of the tax
assessments on certain real property described herein, to the end that all proceedings, decisions
and actions in the matter of the said assessments of said property may be reviewed, and for an
order reducing, vacating or correcting said assessments, and granting such other and further
relief as may be applied for and to the Court may seem just and proper.

TO THE SUPREME COURT OF THE STATE OF NEW YORK:
The petitioner alleges as follows:
1. Petitioner is a taxpayer in the municipality whose Board of Assessment Review is
a respondent herein, and is the owner or lessee of lands and premises hereinafter described and
situate in said municipality, or an aggrieved party within the meaning of Section 706 of the Real
Property Tax Law of the State of New York.
2. At all times herein mentioned, the Assessor of the said municipality was
authorized and required by law, for the purpose of taxation, to assess and value all the real estate
in said municipality on one common and general principle of valuation that shall apply alike to
all real estate assessed within said municipality, including improved and unimproved property,
and in the case of improved property, to value the land and buildings and improvements thereon
separately; at all times herein mentioned, the Board of Assessment Review was authorized and
required by law to review the assessments made and determined by said Assessor.
3. Respondents prepared and completed a tentative assessment roll for the said
municipality for the year 2005, and petitioner's lands and premises were described and assessed
on said assessment roll as set forth in Schedule "A" attached.
4. Within the time allowed by law for complaining and filing protests to said
assessment roll, petitioner, claiming to be aggrieved and believing itself to be unjustly, unfairly,
and unlawfully assessed, did complain and did file a due and timely protest against the
assessment set forth herein, which was received and accepted as sufficient, and did apply for a
correction and reduction of the same and presented to and filed with the said Assessor and Board
of Assessment Review a verified application to reduce the same. Petitioner complained therein
that none of the properties set forth in said assessment roll, including the property herein
described, had been assessed upon one common and general principle of valuation that shall
apply alike to all real estate assessed within said municipality, as required by law; that the
assessment complained of was unequal, excessive by reason of over-valuation, excessive,
unlawful and unjust in that it had been made at a higher proportionate value than the assessments
on other properties in said municipality on the same roll, which over-valuation, overassessment
and inequality have resulted in injury to the petitioner, and did specify as instances in which such
inequality existed, all other real estate in said municipality. Said statement of protest is hereby
incorporated in this petition by reference thereto with the same force and effect as though set
forth herein at length. In order to be equal and proportionate with the assessments of other real
property upon said assessment roll, petitioner asked that the said assessment should be reduced
as set forth in Schedule "A" attached.
5. The municipal Board of Assessment Review received and acted upon said protest
and application for reduction of assessment and refused and failed to correct or reduce said
assessment to said requested correct assessed valuations.
6. Thirty days have not elapsed since the final completion and filing of said
assessment roll and the first posting or publication of the notice thereof, as required by law. The
said lands and premises were assessed and described on the final assessment roll as set forth in
Schedule "A" attached.
7. The final assessment of said property is unequal, excessive by reason of over-
valuation, excessive, and unjust, and the property is in fact of an assessable value not to exceed
the values as listed in Schedule "A" attached, and the extent of such overassessment is as set
forth in Schedule "A" attached.
8. The said assessment of the within property is unequal, excessive by reason of
overvaluation, excessive, unlawful, and unjust upon the following grounds: (A) the said
assessment is unequal and unjust in that the said property is not assessed on one common and
general principle of valuation adopted by the Assessor in assessing generally the real estate
within said municipality; (B) by reason of such inequality, the said assessment has been made at
a higher proportionate valuation than the assessment of other real estate on said assessment roll,
and as instances in which such inequality exists, your petitioner specifies all other real estate in
said municipality on the said roll, and the assessments and valuations therein stated; (C) the said
assessment is unlawful in that it is excessive and the assessment has not been determined by the
application of the established ratio; (D) the extent of the overvaluation and overassessment
complained of and protested is as stated herein; (E) the said assessment and assessment roll is
illegal, not uniform, was not made for the purpose specified, and in the manner required by the
laws of the State of New York, the Constitution of the State of New York, and the Constitution
of the United States of America; (F) the assessment has been arbitrarily maintained by the
Assessor and the equalized value, or full value, placed thereon by the Assessor is not the true
value of the property; and (0) the assessment of the said property has been made at a higher
proportionate valuation than the assessment of other taxable real property of the same major
type, as determined by the New York State Board of Real Property Services, pursuant to Section
1200 of the Real Property Tax Law, and your petitioner specifies, as instances in which such
inequality exists, all other real estate of the same major type as the within property as assessed

upon said assessment roll and the assessments and valuations therein stated. The extent of such
inequality and overvaluation is as set forth in Schedule "A" attached.
9. In the event that the assessment at issue is or should be subject to a transition
assessment and/or exempt or partially exempt and has been incorrectly calculated, or not set
forth at all on the taxable assessment roll, the assessment should be reduced as it exceeds the
statutory formula and/or is unlawful, unequal, and excessive.
10. Petitioner is aggrieved and has been injured by the said unequal, unjust,
excessive, unlawful, and excessive by reason of over-valuation assessment, and will be required
to pay a greater amount and proportion of taxes than said petitioner would be required to pay if
the said assessment had been just and equal, and petitioner is or will be injured thereby.
11. No previous application has been made for the relief herein requested.
WHEREFORE, petitioner prays that the Court review all and singular the proceedings,
decisions, and actions of said Assessor and of the said Board of Assessment Review in the matter
of the tax assessments and assessed valuations of the real property described herein, and that the
said tax assessments and assessed valuations be modified, corrected, vacated, reduced, and be
properly equalized to assessed valuations of other real property on the same rolls in order to
secure equality of assessment, as the case may require, and that the respondents refund to
petitioner all excess taxes, and that the petitioner have such other and further relief as may be just
and proper; and that the petitioner be awarded the costs and disbursements of this proceeding,
together with reasonable expenses, including the fees of experts and attorneys.
