2011-2002011-200 Resolution Adopting Local Law No. 6 of the Year 2011 Which Would Amend the Zoning Map Based Upon the New Town Comprehensive Plan for the Purpose of Rezoning a Property to the R-20/40 Zoning District At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on June 13, 2011. The meeting was called to order by Christopher Colsey, Supervisor, and upon roll being called, the following were present: PRESENT: Supervisor Councilmembers ABSENT: Christopher J. Colsey William H. Beale Vincent F. Bettina Ismay Czarniecki Joseph P. Paoloni The following Resolution was introduced by Councilman Beale and seconded by Councilwoman Czarniecki. WHEREAS, the Town Board of the Town of Wappinger has determined that the Zoning Map should be amended based upon the new Town Comprehensive Plan; and WHEREAS, the Town Board is considering the adoption of Local Law No. 6 of the Year 2011 that would amend the Zoning Map of Chapter 240, Zoning, of the Town Code for the purpose of rezoning a property to the R-20/40 zoning district; and WHEREAS, the Town Board prepared a Draft Generic Environmental Impact Statement (DGEIS), a Final Generic Environmental Impact Statement (FGEIS), a Supplemental Draft Generic Environmental Impact Statement (SDGEIS), and a Supplemental Final Generic Environmental Impact Statement (SFGEIS) regarding the new Comprehensive Plan and Associated Zoning Changes (the "Proposed Action"); and WHEREAS, the Town Board prepared and adopted a Findings Statement regarding the Proposed Action, thereby completing the State Environmental Quality Review Act (SEQRA) with respect to this matter; and WHEREAS, the proposed Local Law has been on the desks of the members of the Town Board for at least seven (7) days exclusive of Sunday prior to the adoption of this resolution. NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS: 1. The Town Board hereby adopts and incorporates the recitations and statements set forth above as if fully set forth and resolved herein. 2. The Town Board of the Town of Wappinger hereby adopts Local Law No. 6 of the Year 2011; except as specifically modified by the amendments contained therein, the Zoning Law, as originally adopted and amended from time to time thereafter is to remain in full force and effect. The foregoing was put to a vote which resulted as follows: CHRISTOPHER COLSEY, SUPERVISOR Voting: AYE WILLIAM H. BEALE, COUNCILMAN Voting: AYE VINCENT F.
