Dear Board Members:
The Court of Appeals has recently construed the provisions of
Town Law S281 in a manner which prevents a municipality from demanding
that as a condition of 281 approval a donation be made/to the munici-
pality of lands for park or other public purposes without compensation.
More disturbing is certain dicta contained in the language (dicta
meaning comments on issues directly involved) wherein the court observes
that there is nothing in the provisions of Town Law S277 and S278 which
permits a municipality to compel conveyance of land for street or park
purposes without compensation. Under such circumstances, it might
be appropriate for the ordinance committee together with the Highway
Superintendent to review the regulations we presently have governing
private roads to consider whether or not additional provisions might
be appropriate in terms of compelling maintenance or other obligations
if this eventuality should occur in the tow .
