Re: Conservation Subdivisions
Dear Members of the Planning Board:
I have reviewed your memorandum of November 7th, 1980
inviting comments on deeding land to the town in a manner
analogous to recreation lands in those instances where con-
servation subdivisions are considered.
From a legal perspective, I would note that once the
property were deeded to the town, the town would be obliged
to make this land available to all residents of the town.
I question whether developers or perspective homeowners would
wish to invite that situation.
The conveyance would also diminish the area of taxable
land within the town.
These are only observations as questions of policy would
have to be addressed by the Town Board.
