1 am in receipt of your letter dated August 3D, 2007 regarding the above, When this
subdivision was approved by the Planning Board, separate Offers of Dedication were
recorded in the County Clerk's Office, one for the recreation lands and the other for the
roads, easements, etc,
It is, and has been the practice of the Town of Wappinger not to accept any public lands,
easements, etc. tmtil the job is completely built out. This has been discussed with your
clients and/or their pre.decessors previously, If your clients wish to have the recreation
parcel dedicated sooner, I would request that you ask to be placed on the Town Board
agenda to have the matter discussed. Until such time as the deeds are accepted by the
Tovm, tax issues remain tbe responsibility of the deveJoperiproperty owner. Deeds for the
roads, recreation parcel and easements were all tendered at the time the subdivision map
was signed by the Planning Board Chairman,

Please be advised that my firm represents One of the principals of Blackwatch Development,
LLC, the Owner of the Blackwatch Farm subdivision off Robinson Road in the TOwTI of
Wappinger. Joel Hanig, whose office did the original subdivision of the property, has forwarded
to me a notice frou1 the Town ofWappingers Tax Office indicating to me that there are certain
taxes due on a parcel of land identified by the section, block Clnd jot number above.
It is my understanding that this is the property consisting oftlle wetlands along the creek that was
either already deeded or was to be deeded to the Town ofWappingcr as part oft:he subdivision
process. Tn any event, r do not want the tax issue to go On any further without resolution. Since I
do not have the original subdivision t11e, I cannot ascenain whether the Town was given the deed
andjusl not accepted at this point in time Or the deed still has to he drafted. In either event, if

A couple of weeks ago Loretta Brunella called indicating that she received a complaint
from Robert Oswald about a tax bil! he received for the recreation lands to be dedicated
along the creek. It was my tmderstanding that this recreation land was not to be accepted
until aU work in the subdivision was completed.
The recreation lands were included in the Offer of Dedication to the Town and to date I
am not aware of any requests formally being made by the applicant's attorney to have
this property accepted by the Town.
Should we accept this property now to avoid further tax liability or should we await until
completion of the subdivision?
Please advise.
