RE: Subdivision of lot 12, Blue Ridge, resolutions of approval
Dear Gentlemen:
At the March 26, 1984 meeting of the Town of Wappinger Planning
Board, a motion was made by Mr. Mills, to grant preliminary and final
approval and to waive the final public hearing. The resolutions of
approval are as follows
TENTATIVE APPROVAL IS HEREBY GRANTEDto ACR Properties, for subdivision
as shown on map entitled, "Resubdivision of Lot 12, Blue Ridge, Section
2 - F.M. #6443, Town of Wappinger, Dutchess County, New York", prepared
by Gary R. LaTour, L.S., and dated February 15, 1984 subject to the
following conditions:
Within six months of this tentative approval, the applicant is authorized
to submit an application for approval of a subdivision plat in accordance
with Article II, Section 22; Article III, Section 30; and Article IV of the
Subdivision Regulations. In addition, the application must meet the
requirements of the Town of Wappinger Zoning Ordinance. In addition, the
following improvements, reservations, changes, and requirements are pre-
requisite to the approval of the plat.
1. Approval of the Dutchess County Department of Health shall be
obtained on water supply and sewage disposal prior to final approval.
2. An erosion control plan shall be prepared and submitted to the
Conservation Advisory Council for review and then approval shall be obtain
ed from the Engineer to the Town prior to the signing of the plat.
3. Drainage flow patterns shall be indicated on the individual plot
plans. For any surface waters that enter upon properties of other persons
the applicant shall obtain a letter from the same permitting the discharge.
4. Inspection fees for the storm drainage lines shall be paid prior
to the signing of the plat.
5. Downstream drainage of $200.00 per newly created lot on the final
plat shall be paid prior to the signing of the plat.

6. Recreation fee of $500.00 per newly created lot on the final
plat shall be paid prior to the signing of the plat.
7. No structure is to be built where the lowest opening, (windows,
doors, garage doors, crawl spaces, etc.) are lower than two feet above the
road surface unless approved by the Highway Superintendent and/or the
Engineer to the Town.
8. All footings, drains and roof leaders, if required by the
Building Inspector, shall be piped into the storm drainage system.
9. There shall be two 2~" caliper decidous trees on each lot at a
height of four feet above the ground. The first branch should be at a
height of seven feet.
10. Five copies of the filed map shall be submitted for Planning
Board distribution. Said copies shall be obtained from the County
Clerk's office.
11. Compliance with the Engineer to the Town's comments numbers:
one, four and five, as stated in his letter of March 26, 1984, shall be
met prior to final approval.

WHEREAS, an application for final approval of a subdivision plat
entitled "Subdivision Plat of the Lands of ACR Properties, situate in the
Town of Wappinger, Dutchess County, New York" was received by the Town
of Wappinger Planning Board on March 26, 1984, and
WHEREAS, a final public hearing is waived by the Town of Wappinger
Planning Board, and
WHEREAS, the requirements of the Subdivision Regulations of the
Town of Wappinger have been met by said subdivision plat and application
except as noted below, and
WHEREAS, the conditions of the preliminary approval of said sub-
division plat, granted by the Town of Wappinger Planning Board on March
26, 1984, have been met, except as noted below.
NOW, THEREFORE, BE IT RESOLVED THAT the application of ACR Properties
for approval of said subdivision plat, prepared by Gary R. LaTour, L.S.
and dated February 15, 1984,be approved subject to the following conditions,
and that the Chairman be authorized to endorse approval on said sub-
division plat upon compliance with said conditions by the applicant, with
conditional approval shall expire six months from the date of this resolution
if the applicant has not complied with the conditions set forth.
Upon completion of all requirements set forth in the action approving
the Subdivision Plat, the Plat shall be properly signed by the appropiate
officers of the Planning Board, and shall be filed by the applicant in the
Office of the County Clerk in accordance with the requirements of Section
278 of the Town Law. Any Subdivision Plat not so filed within sixty days

of the date of Planning Board signature shall become null and void.
Conditions of the final approval are the same as those stated in the
resolution of preliminary approval.
